Thank you attending yesterday's Design Review Board regarding the re-roof applicalions that you had
submitted for the above addresses. As you know, both applications were approved with the following
condition:
1) The applicant shall use the thlcker ot the two avallable metal shingle rooflng systems at the
time of construction.
Per our conversation, only one shingle is currently produced by Plath, which is the shingle with the
thicker level of relief that the Design Review Board requested for these re-roof jobs. Thank you for
clarifying that with me during yesterday's meeting. Please don't hesitate to contact me with any further

T am the owner of the property located at lot 27, block I'
Potato Patch Subdivision, Vail, Colorado. I have been
terribly disturbed by the many violations and flagrant
disregard of property ownerrs rights by CDS Enterprises
in the construction of several projects in the Potato
Patch Subdivisi-on. I am attaching a copy of my letter to
the Design Review Board, which I wrote in protest to CDS
Enterprises/Dan Gagliardo calling attention to the numerous
violations caused by this firm.
It is my understanding that an appeal will be made to the
Town Council on August ISth by Western Management Company.
It is further my understanding that this reguest is for
approval of changes to the plans and specifications on a
duplex under construction on lot 4, block 1 by Western
Management Company and Paul Johnson and/or CDS Enterprises.
Many of the changes they are requesting approval on have
been made without the approval of the Design Review Board
and are in violation of the city code. T believe it is
unfair to the residents of the subdivision and I therefore
urge that their appeal be denied.
I do not personally know any of the parties involved and
have no personal feelings against them in this matter.
However, I do think Lhat it is important that al1 owners
and builders in any subd.ivision i-n the Town of Vail be
required to conform to the city codes and regulations-
oue to previous conrnitments, I am unable to appear in
Vail at the hearing and therefore request that my letter
serve as my official protest to the appeal of Western
Management Company/VataI Johnson and CDS Enterprises,/
Dan Garliardo.

In accordance with your request, we have completed a soils
investigation for a proposed residential structure at the
above referenced location" The investi-gation consisted of
tqro test borings. Ttre test ]rorings indicated one main group.
Soj-l Group No. 1: This material consbted of a coarse, silty
and clayey sand and gravel with many nested cobble and boulder
sized particles. These soils are generally of a glacial origin.
fhe fine matrix materials are slightly expansive, developing
swell pressures of about 3OC psf" At shallow foundation depth,
these soils were found to trave a maximum allowable bearing
capacity of 37CO psf" These soils were relatively free of

A shallow foundation system would probably be most suitable
for construction on this site. The foundations can be pro-
portioned on the basis of a maximum allowable bearing capacity
of 3700 psf" A minimum dead load pressure of 3OO psf should
be maintained at all times.
In order to make the structure somewhat more rigid and to spread
the loads more evenly around the building, it is recommended
that all stem walls of the building be designed as grade beams
capable of spanning at least l-2 feet, Horizontal reinforcement
should be placed continuously around the structure with no gaps

signs of being moderately unstable- The nature of the unstabi-Lity
is not the classic deep seated circular type failure, but ap;iears

encountered during excavation of the footing, this material
should be removed ard replaced with baekfill compacted Lo 95%
of maximum Proctor density, AS'IM D-598.

The native soi-ls may be used for this purpose" The more plastic
soils should be used as an impermeable cap to prevent the infil-
tration of surface water through backfilled areas and into the
foundation soils. Material should be placed in lifts noi to
exceed 5 inches compacted thickness and at a noisture content
approximately equal to the optimum Proctor moisture content,
plus or minus 2%. Backfitl should be compacted to the density
reguired by mechanical means" No water flooding techniques of
any type should be useC in the placement of backfill on this site"
It is extremely importart, due to the nature of data obtained
by the random sampling oi such a variable and nonhomogeneous
nraterial as soil, that we be informed of any changes in the sub-
surface conditj-ons observed during construction from those assumed
and outLined in the body of this rePort. Conslruction personnel
should be made familiar with the content of this report and
instructed to report an7 of. these differences immedi-ateIy when
encountered.
It is believed that all pertinent points concerning the subsur-
face soils on this site have been covered in this report. If
questions arise or further information is desireC, please feel
