Dear Kyle,
The Town Staff has preliminarily reviewed the design review applications- for the proposed new
primary/secondary residences at 809 and 81 'l Potato Patch Drive. The Town Staff has determined that
inesJ ipplicationi are incomplete and can not be fully reviewed as submitted. The following inlormation
and revisions must be submitted to complete these applications:
1. Submit all utility company approvals.
2. Submit Title Reports (schedules A & B).
3. Submit landscape plans.
4. Submit site coverage and landscape area calculations.
5. Submit detail drawings for the proposed driveway bridge'
6. Submit cross-section drawings.
7. The site/grading plans must be revised as follows:
. the site/grading plans must be printed at the same scale as the lopographic survey
(1 "-10).o The entirely of the lots must be shown on the plans.
. Show all existing and proposed easemenls.. Show all natural and proposed grades.
o Show all existing and proposed roof ridge and eave elevations. For building height
calculation purp6ses, strow att natural and proposed grades underneath all root lines.
. As shown on sheets A1O4 (Lot 32) and A105 (Lot 31) the proposed buildings appear
to exceed the maximum allowable building height of 33 feet'
. Show all proposed driveway grades; including percent slope and spot elevations at

Dear Michael,
The Town Staff has preliminarily reviewed the revisions to the design review ap.plications for the proposed
new primary/secondary residen-ces at 809 and 81 1 Potato Patch Drive. The following is a summary of the
comments from that review:
1. Utility company approvals have not yet been submitted'
2. The Lot 3i residence exceeds the maximum allowable site coverage limit of 20% ol the lot
size (i.e.4,197 sq.ft.)
3. The floor plans have not been revised to show the dimensions of all roof eaves and
overhangs.
4. The building footprints shown on the site/landscape plans must be coordinated with the floor
plans.
5. Both residences still exceed the maximum allowabte building height limit of 33 ft. (measured
to natural or finished grade, whichever is more reskictive).
For oomp6 on Lot 31: ridge height 646.5 - natural grade 6L2.7 = 33.8 feet and ridge height
632.5 - natural grade 599.2 = 33'2 feet'
For example on lot 32: ridge height 633.0 - natural grade 596.8 = 36.2 feet, ridge height
643.0 - natural grade 609.2 = 33.8 feet, ridge height 639.0 - natuml grade 604.9 = 34.1
feet.
6. Lol 91 does not comply with the maximum allowable GRFA limits. Submit calculations
demonstrating that the secondary unit does not exceed 2'911 sq' ft' (40%).
7. The Lot 32 basement deduction calculations must be corrected to have a single percent
deduction for the enlire structure. Additionally, the sq.ft. for wall #1 are not labeled and walls
#1 1 and 12 must be clarified to be either 100% above or 100% below grade. Revised
calculations must be submitted verifying that the entire structure does not exceed 8,562 sq.ft.
and that the secondary unit does not exceed 3,424 sq'ft'

8. The retaining walls on Lot 31 must be revised to comply with the minimum 2 toot setback
requirement.
g. Submit a redlined elevation drawing and calculations verifying that the bay window on Lot 31
does not exceed 10% of the wall arca and therelore can encroach up to 3 feet into the
setback.
Since neither proposed residence complies with the zoning standards prescribed by the Vail Towl C9d9,
these applications will be conceptually reviewed by the Town of Vail Design Review Board at its April 18,
2007, public hearing. A final review of these residences will be scheduled after revised plans,
demonstrating compliance with the Town Code, have been submitted and re-reviewed.

- Provide an access agreement from lot 32 for lower unit of lot 31.
- Provide a designated lurn around for unit 31B. Cannot be required parking for other lot 32 units.
- Hammer head to be a min of 12'wide.
- Provide detail on unit 31A driveway. Bridge abutments not to be in ROW. lf no abutments then how
is driveway constructed?
- All snow slorage to be on property out of the ROW.
- Provide stamped PE drawings for all walls over 4'and any combination walls.
- Provide a staging plan.
- Provide a Public Way and Revokable ROW permit.

lwanted to ask...the easements, staging, retaining walls, and ROW are always requirements for Permit, not
DRB.
We usually don't invesl time and money into these items until the DRB Approves them first...because they may
change.
Do we need these by Monday?

We would like to retract the DRB application for Lots 3l and 32 for review this Wednesday, April 18.
We would like to take a little more time developing the design of the house on Lot 31. We feel
confident in the direction that house 32 is taking, and we feel we can accommodate all of the comments
in your April 13 fax.
One question that will remain with the new plans because we are not planning on changing the stacked
garage scheme for House 3l is that in the Public Works Dept. comments sent out last Thursday they
state there are no abutrnents allowed in the ROW. Will we have to request a variance for this? Can we
get a variance for this? If a bridge driveway is to accommodate the upper garage we would have to have
some type of abutnent in the ROW. Please let me know what you think about this item. All other
comments should be accommodated easily enough.

Dear Michael,
The Town Staff has again reviewed corrected plans for the proposed new primary/secondary residences
at 81 1 Potato Patch Drive. As submitted, the Lot 32 English Residence plans are still incomplete (site
and landscape plans not corrected, missing east elevation drawings, etc.). For your reference, anached
is a submittal checklist lor a new residence.
Additionally, the submitted plans have not been coordinated with each other (sile plans and landscape
plans not updated, new fioor plans do not match previously submitted GBFA and site coverage
calculations, etc.).
The corrected plans have not yet been corrected to comply with the Town's zoning regulations (vaultgg
spaces greatei tnan 16 leet in height and the party walls have not been included in the GRFA
calculations, the dinning room and gallery must be removed from the south setback area, vehicles can
not enter/exit the exterior parking spabes, etc.)
This application will not be scheduled for final review by the Dbsign Review Board until three sets of
revised,'complete, coordinated, and zoning code compliant plans have been submitted to the Town of
Vail for review.

Dear Michael,
The Town planning Stafl has preliminarily reviewed the revisions to the design review applications for.the
proposed new priirary/secondary residences at 809 and 81 1 Potato Patch Drive- The following is a
summary of the comments from that review:
1. Written utility company approvals musl be submitted.
2. Exterior material and color samples must be submifted prior to the Design Review Board
hearing.
3. The limits of disturbance fence must be adjusted lor both lots to enclose all landscape
plantings and retaining wall construction. Lot i1 has excessive slopes, as defined by Section
'12-21-74,Vail Town dode, and the total disturbed area shall not exceed 60% of the tolal lot
size (i.e. 12,592 sq.lt.).
4. For GRFA calculations, the percentage used for basement deductions must be rounded to

Patch. Wc have only induded the drawing sheets that have changed. Hopefully it is
okay to simply insert thrse new sheets. All of the "f' landscape dnwings nced replactd
in both ses. Ih only architecunl sheets that need rtplaced are the GRfA sheetr in
both setr and thr l0l fieet for housr 31. Phase let me know if you would prefer for
me to pick up the old drawing sels so that I can replace these sheets. We have also
induded the utility verifiation and approval sign-off shetr and one deYation rendering
of each house with an athched ilD devation with materid kepotes.
We havr addnsred all of your romments in your lttter daltd June l, as well as the
Public Works commrnts in your email from yrsterday. for the utility approvals wt have
only received rignatures from Xcel, Holy Crosr, and Qtrtst. We have included email

Yesterday aftemoon we received the ILC (improvement locatjon certiflcate) for 811 Potato Patch. Upon reviorv
of the ILC the building location and horizontal dimensions appear to comply with the approved plans; however,
the roof peak elorations do not match the approved plans and exceed the 33 foot building height limit in some
locations.
Please cmrdinate with your surueyor to determine the cause of these roof height discrepancies (surveying
enor, consfuction error, etc.). Once the cause of the discrepancy has been determined, please inform me of
your findings and what steps you will be taking to bring the new residence into compliance with the height
limits of the Zoning Regulations.
Please be aware that the Town of Vail Building Team will not be able to conduct a framing inspection for this
project until this issue has been resolved,

WHEREAS, the Developer is obligated to provide security or collateral sufficient in the
judgement of the Town to make reasonable provisions for completion of certain improvements set
forth in the attached estimated bid(s) in accordance with the approved plans and specifications
filed in the office of the Community Development Department of the Town of Vail; and
WHEREAS, the Developer wishes to provide collateral to guarantee performance of this
Agreement, including completion of the all improvements refened to in this Agreement, by means
of the following:
The Developer agrees to establish a cash deposit account with the Town of Vail, as
escrow agent, in the amount of $ QSaa - as collateral for the
completion of all improvements referred to in this Agreement, in the event there is a
default under this Agreement by the Developer.
NOW THEREFORE, in consideration of the following mutual covenants and agreements,
the Developer and the Town agree as follows:

2. To secure and guarantee performance of the obligations as set forth herein, the
Developer agrees to provide collateral as follows:

3. The Developer may at any time substitute the collateral originally set forth above
for another form of security or collateral acceptable to the Town to guarantee the faithful
completion of those improvements referred to herein in this Agreement and the performance of
the terms of this Agreement. Such acceptance by the Town of alternative security or collateral
shall be at the Town's sole discretion.
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occuning to the work specified in this
Agreement prior to the completion and acceptance of the same, nor shall the Town, nor any
officer or employee thereof, be liable for any persons or property injured by reason of the nature
of said work, but all of said liabilities shall be and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) arise out of or are based upon
any performance by the Developer hereunder; and the Developer shall reimburse the Town for
any and all legal or other expenses reasonably incurred by the Town in connection with
investigating or defending any such loss, claim, damage, liability or action. This indemnity
provision shall be in addition to any other liability which the Developer my have.
5. lt is mutually agreed that the Developer may apply for and the Town may
authorize a partial release of the collateral deposited with the Town for each category of
improvement after the subject improvement is constructed in compliance with all plans and
specifications as referenced hereunder and accepted by the Town. Under no condition shall the
dollar amount of lhe collateral that is being held by the Town be reduced below the dollar amount
necessary to complete all uncompleted improvements refened to in this Agreement.
6. lf the Town determines, at its sole discretion, that any of the improvements
referred to in this Agreement are not constructed in compliance with the approved plans and
specifications filed in the office of the Community Development Department of the Town of Vail or
not accepted by the Town as complete on or before the date set forth in Paragraph 1 of this
,Agreement, the Town may, but shall not be required to, draw upon the security refened to in this
Agreemenl and complete the uncompleted improvements refened to in this Agreement. Pursuant
to Section 12-11-8, Vail Town Code, the Temporary Certificate of Occupancy referred to in this
Agreement may be revoked until all improvements referred to herein are completed by the
Developer or the Town in accordance with this Agreement.

lf the costs of completing the uncompleted improvements referred to in this Agreement
exceed the dollar amount of the deposit, the excess, together with interest at twelve percent
(12o/o) per annum, shall be a lien against the property and may be collected by civil suit or may be
certified to the treasurer of Eagle County to be collected in the same manner as delinquent ad
valorem taxes levied against such property. lf the Developer fails or refuses to complete the
improvements refened to in this Agreement, such failure or refusal shall be considered a violation
of Titfe 12 (Zoning Regulations), of the Vail Town Code, and the Developer shall be subject to
penafties pursuant to Section 12-3-10 (Violations: Penalties) and Chapter 1-4 (General Penalty),
of the Vail Town Code.
7. The Developer shall warranty the work and materials of all improvements referred
to in this Agreement located on Town property or within a Town righfof-way, pursuant to Chapter
8-3, of the Vail Town Code, for a period of two years after the Town's acceptance of said
improvements.
8. The parties hereto mutually agree that this Agreement may be amended from time
to time, provided that such amendments be in writing and executed by all parties hereto.

You are free to submit a "Nerry Construction" Design Review application at any time, However, please be aware
that the DRB has the authority to table any "final review" agenda item to a future meeting if they feel additional
information, corrections, or changes are needed.
Whether you submit another Conceptual Review application or a New Construction application, yesterday the
DRB requested that:
- site plan options with a single access point for Lot 31 be submitted for review,
- grading and retain wall plans be finalized and submitted for further review,
- site plan options reducing the driveway slopes to <10Vo be submifred for review.

Just for clarification (I should have asked before I left), the way I saw it was that we are free to proceed
with our current site plan for final DRB review, but they would also like us to at least show them a site
plan altemative that will illustrate what Lynn asked. That is an option without a stacked garage for lot
31. That would mean as you said that we will need a24' luu.rde driveway and it will most certainly
make the driveway much longer, more circuitous, and probably steeper. I assume that their reaction
will be similar to the option that we showed with the two driveway access, not very favorable. We are
happy to show them this altemative however. One question is do we need to do another conceptual
DRB review with the site plan, plans, and elevations or are we free to go for final review?
On another note have you heard anything about the plans review for the building permit for the
Rosenbach Residence on Rockledge Rd?

Dear Mr. \Messner:
Thank you for your letter of July 25, 1995. In response to your request for an extension of the
Design Review goard (DRB) approval daied August 3, 1994, I am hereby granting you a one year
exteision. This extension is in accordance with Design Review Guidelines, Section 18.54.110'
which states that Community Development staff may extend the period of approval if there have
been no zoning revisions or amendments to the Guidelines that would alter the conditions under
which the approval was given.
It is our finding thet the Design Guidelines have not been significantly amended since your
apploval was granied. The previous approval, due to expire on August 3, 1995, will now

DRB site visit. The applicant must, ensure that staking
done during the winter is not buried by snow.
The review process for NEW BUILDINGS normally requires
two separate meetings of the Design Review Board: a
conceptual approval and a final approval . Applicants
should plan on presenting their developrnent Proposal at
a minimum of two meetings before obtaining final
approval.
Applicants who faiL to appear before the Design Review
Board on their scheduled meeting date and who have not
asked in advance t,hat discussion on their item be
posLponed, will have their items removed from t'he DRB
docket unti] such time as the item has been
republished.
The following iEems mayr aE the discretion of the
zoning administrat.or, be approved by the Community
Development Department staff (i.e. a formal hearing
before the DRB may not be required) :
a. Windows, skylights and similar ext.erior changes
which do not aLter the exisLlng plane of the
building; and
b. Buitding addit,ion proposals not visible from any
other loc or public space. At the t.ime such a
proposal is submitted' applicants must incLude
fetters from adjacenL property owners and./or from
the agent for or manager of any adjacent
condominium association stating the association
aPproves of the addition.
If a property is located in a mapped hazard area (i.e.
snow avalanche, rockfall, flood plai.n, debris flow,
wetland, etc) r a hazard study must be submit.ted and the
owner must sign an affidavit recognizing the hazard
report prior to the issuance of a building permit.
Applicants are encouraged to check with a Town Planner
prior to DRB application to determine the relationship
of the property to all mapped hazards.

On May 4, 1989 I had a meeting with Rick Pylman of the Town ofVaiI. At that meeting, he gave me approval for new location ofsolar panels. We also discussed the possible problem ofcompleting all site work this falt. He agreed with me thatfinish grading, landscaping, rock walls and possibly drivewaypaving night have to wait until good weather in the spring. Hepointed out that the Owners wouLd only get a temporarycertificate of occupancy until aII work on plans is completed.
You would be able to use the house with the temporarycertificate of occupancy, but work required to get a pernanentcertificate of occupancy would have to be cornpleted in six
months tine.

Subdivision in Vail , Colorado in view of ttre uldated residentiaL crcnstructi.onplanned. The rockfall hazard assessrent for this lot was previously
sr-mnari zed in a report dated OqEooe r 31 , 1988 unde r our Job tlc. 4 i29 89.
ProFpsed Con:truction: Ilased upon plans provided to us by Briner/Strain
Architects, construction of tire residence on the lot is planned for tne crestof the topographic ridge that lies on tlre northern one-third of the lot.

7 feet nray be required locally buE. in general tire cuts ard fills that, are
planned are in the range of 2 to 4 feet in height.
Based upon tie site plan providecl, tfe res idence will consist of a i.rest
wi ng ard an east wi ng connecEed by an enclosed hal lway area. the raest wi rgwill be approximatefy 40 feet by 35 feet in plan dinension ard wiII be 3stories in heignt. 'Ihe east wirq wiII have naxjmum plan dimension of
approxirnately 40 feet by 20 feet ard will be 2 stories in heignt. Access to
t-lre residence will be off the switchlcack on Potato Patcn Drive at the
northeast edqe of t}le lot.
Conclusions ard Recomnerdations :In our opinion, construction of the plarured
residence on lot 32 with tlre associated site gradirq does not change ourprevious assessnent of the potenLial- rockfall hazard on the site. As
discussed in our report of October 3l, because of tLe geolcAic and totrrcgraphicsettirg of the l-ot in a steep nnuntain environment, the 1ot shoul"d not be
cons ide red totally risk free with respecE to rockfall. fiowever. in our
opinionr tne potential for rockfall is very low ard mitigation does not appear
to be appropriate or warrantd considering the very Iow rockfall potential.

knowledge to the Company, or if the Ccmpany othemise acquires actual knowiedge 0f any such defect, lien, encumbrance, adverse claim or other manet the
Company at its option may amend Schedule B of this Commitment acccrdingly, but such amendment shall not reireve the Company from liabiliry previously
