A request for a variance from Section 12-6D-9, Vail Town Code, to allow
for a residential addition in excess of allowable site coverage, located at
1 115 Hornsilver CircleiLot 8, Block 1, Vail Village 8tn Filing.
Applicant: Carol Collins, represenled by Arris West ArchitectsPlanner: BillGibson
I. BACKGROUND AND DESCRIPTION OF THE REQUEST
The applicant, Carol Collins, is requesting a variance to allow for a residential addition with site
coverage in excess (116 sf) of what is allowed by the Two-Family Primary/Secondary
Residential zoning regulations. The Two-Family PrimaryiSecondary Residential zoning
regulations allow a maximum site coverage ot 20% (1,787 sf) of the total site area (8,934 sf).
The applicant is proposing site coverage ot 21.77" (1,938 sf) of lolal site area. Site coverage
requirements for lots in the Two-Family PrimaryiSecondary Residential Zone District are
described in Section 12-6D-9, Vail Town Code. Proposed and existing plan reductions have
been attached for reference.
The applicant's representative has expressed lhe reasoning for the site coverage variance
request in a letter daled May 11, 2001; which has been attached for reference.
The applicant is proposing an addition to the northeast portion of the residence. Only 35 square
feet of site coverage is currently available on site and the applicant is proposing lo conslruct a
151 square fool addition, all of which constitutes sile coverage

II. STAFF RECOMMENDATION

The Community Development Department staff recommends that Planning and
Environmental Gommission deny the applicant's site coverage variance request subject
to the following findings:
1. That the granling of the site coverage variance will constitute a granl of
special privilege inconsistent with the limitations on other properties
classified in the Primary/Secondary Residenlial Zone District.
2. There are no exceptions or extraordinary circumslances or conditions
applicable to this site that do not apply generally to other properties in the
Primary/Secondary Residential Zone District.

does nol deprive the applicant of privileges enjoyed by the owners of
other properties in the Primary/Secondary Residential Zone District.
1II. REVIEWING BOARD ROLES. VARIANCE
Order ot Review: Generally, applications will be reviewed first by the PEC for impacts of
the proposed variance and then by the DRB for compliance of proposed buildings and
site planning.
Planning and Environmental Commissionl
ACTION: THE PEC lS RESPONSIBLE FOR FINAL APPROVAUDENIAL OF A
VARIANCE.
The PEC is responsible for evaluating a proposalfor:
1. The relationship of the requested variance to other existing or potential uses
and slructures in the vicinity.
2. The degree to which relief from lhe stricl or lileral interpretation and
enforcemenl of a specified regulation is necessary to achieve compatibilily and
uniformity of trealment among sites in the vicinily, or to attain the objectives of
this Tille without grant ol special privilege.
3. The effect of the requested variance on light and air, distribution of population,
transportation and traffic facilities, public facilities and ulilities, and public safety.
4. Such other factors and criteria as the Commission deems applicable to the
proposed variance.
Design Review Board;
ACTION: THE DRB HAS NO REVIEW AUTHORITY ON A VARIANCE, BUT MUST
REVIEW ANY ACCOMPANYING DRB APPLICATION.
The DRB is responsible for evalualing the DRB proposal for:
- Archilectural compatibility wilh other structures, the land and sunoundings- Fitting buildings into landscape- Configuration of building and grading of a site which respects the topography- Removal/Preservation of trees and nalive vegetation- Adequate provision for snow storage on-site- Acceptability of building malerials and colors- Acceptability of roof elements, eaves, overhangs, and other building forms- Provision of landscape and drainage- Provision of fencing, walls, and accessory slructures- Circulation and access to a site including parking, and site distances- Location and design of satellite dishes- Provision of outdoor lighting- The design of parks

Statf :
The staff is responsible for ensuring that all submittal requirements are provided and
plans conform to the technical requirements of the Zoning Regulations. The staff also
advises the applicant as to compliance with the design guidelines.
Staff provides a staff memo containing background on the property and provides a staff
evaluation of the projecl with respect to the required criteria and findings, and a
recommendation on approval, approval with conditions, or denial. Staff also lacilitates
the review process.
Town Council:
Actions of DRB or PEC maybe appealed to the Town Council or by the Town Council.
Town Council evaluates whether or not the PEC or DRB erred with approvals or denials
and can uphold, uphold with modifications, or overturn the board's decision.

Consideration of Factors Reoardino the Site Coveraoe Variance:
1. The relationship of the requested variance to other existing or
potential uses and structures in the vicinity.
Slaff does not believe the proposed addition, if constructed, will have a
negative effect on other existing or potential uses and structures in the
vicinity. The proposed addition is only 151sq. ft. in size and would be
located in the rear of the house belween two exisling decks. Existing
mature vegetation on the site will screen the proposed addition from
adjacent properties and public view.
o
2.The degree to which relief from the strict and literal interpretation
and enforcement of a specified regulation is necessary to achieve
compatibility and unilormity of treatment among sites in the vicinity
or to attain the objectives of this title without a grant of special
privilege.
Staff believes an approval of the requesled sile coverage variance would
result in a grant of special privilege. Site coverage variance requests for
neighboring properlies have been denied in the pasl.
This lol is 8,934 sq.ft. in total size and does nol conform to the 15,000
sq.fl. lot size requirement of lhe Two-Family Primary/Secondary
Residential Zone Dislrict. Since this neighborhood was suMivided in the
1960's under Eagle County jurisdiction, 68/. ot all lots in this area are
non-conforming with regard lo lot size. However, all structures built in this
neighborhood (since the adoption ol zoning regulations) are in
compliance wilh site coverage provisions. The two exceptions (Lots 1 &
3, Vail Village Filing 8) were constructed prior to the adoption of zoning
regulalions on non-conforming lots (lots less than 15,000 sf).
A site coverage variance request for Lot 3 was denied on 9/22197. ln
their denial ol this request, the PEC stated "the granting of a site
coverage variance at this location would conslitute a grant of special
privilege.' The following table summarizes site coverage allocations for
the applicant's lot and 24 other properties wilhin the adjacent
subdivisions.
Slaff does not believe thal lot size is a unique circumstance or
extraordinary condition that impacts the applicant's lot in such a manner
as to warrant a deviation from the site coverage requirements of Section
12-6D-9 of the Vail Town Code. Staff believes there are design
alternatives available to improve this property without exceeding the
maximum allowable site coverage.

Ms. Carol Collins is requesting a variance on site coverage for the addition of a 151 sq.ft.
proposed building addition (Guest Bath and Closet). The existing site coverage is 1,752
sq.ft. The allowed site coverage is 1,787 sq.ft. The remainilg allowed square footage is
35 sq.ft. She is therefore requesting 116 sq.ft. of additional site coverage. (1,752 + ZS -
1,787 allowed ; 17 52 + I 5 I = 1,903 required; 1,903 - 1,787 = I l6 requested).
According to town staffGRFA is not a factor in this request.
The reason for this request is due to the small size of the lot compared to other lots in the
general vicinity, the need to upgrade (modemize) the house, and to keep in line with
other property values in the neighborhood. The proposed addition would not add
appreciably to the existing mass of the building, the proposed addition being under an
existing (waterproofed) deck. The location ofthe proposed addition is also heavily
screened by large fir trees and is not readily visible from adjacent properties.
