developed the fol-lowing procedures to ensure that new constructionsites have adequately established proper drainage from buitdingsites along and adjacent to Town of Vail roads or streets.
The Town of Vail Public Works Department wiII be required toinspect and approve drainage adjacent to Town of Vail roads orstreets and the installation of temporary or permanent culverts ataccess points from the road or street on to the construction site.

misunderstanding concerning the wettands perrnit and the sign off
required by the Army corp of Engineers. According to shelly Mello,
we cannot issue a Building Permit until this is cleared up.
I am writing to request you to submit a full revised set (21
of drawings instead of revisions on I by 11 pages. I feel that the
extent of your revisions are such that a fu1l new set should be
submitted for revj-ew. I was prepared to review your drawings aS
submitted, however due to the holdup with the wetlands permit, I
would like a thorough new seL rather than go back and forth and cut
and paste with what was originally submitted and your recent
revisions.

There was no Citizen Participation, the first item on the agenda.
Next was a public hearing on the 1990-91 parking policies. Stan Berryman gave an
introduction to the hearing stating the Parking and Transportation Advisory
Committee had met several tlmes to discuss recommendations for these policies.
Arnold U1 levig then gave an in-depth presentation regarding the proposed policles
and the reasoning for the changes from the cunrent practices. He then held a
question and answer session with Council and the public. Trevor Bradway felt the
po1 icies were discriminatory against Village workers and those who,had paid into theparking fund for parking spaces in the Village Transportation Center. Josef Staufer
commented that making employees (who get off work at 2:00 a.m.) park in Ford Park
was unfair. There was some discussion regarding employees getting off at late
hours, and why coupons worked well before and some people hated to get rid of them.
Much discussion by the public and Council ensued regarding pros and cons. Rob
feVine made a motion to table the item and send it back to the Advisory Committee
for further review- Tom Steinberg seconded the motion. Jim G'i bson stated he wanted
to pass the program with the following conditions: lift restrictions on the Village
parking structure parking; parking free at Ford Park; and other modifications to be
lnade as the program went a1ong. He felt this was a step in the right direction.
f'layor Rose explained why he felt it should go back to the committee. A vote was
taken and the motion passed 5-2, with Lynn Fritzlen and Jim Gibson opposed. Ron
fhillips asked Council to specifically name the items they fe1 t the Advisory
Committee should review. Lynn Fri tzlen felt the added stress on employees becausepf the parking and housing situations was bad, and the plan could he'l p by providing
h pass speciflcally targeted to Village employees. Rob LeVine thought the Village
jlransportation Center could be shared by a first come, fjrst served basis by access
br price; include the coupons at a reasonable rate; and there be one pass with no
pestrictions for $750, that the person could come and go as he pleased. Mayor Rose
l^emarked since the aud'ience felt the blue parking passes would pronote more cars in
phe Village than the coupons, he felt a combined window sticker and coupon program
lvas good and wou'l d work. He added he did not think there should be any summer
pharges for the Village parking structure, and was not sure differential rates on
bverything in the Vil'l age structure was proper. .tim Gibson thought a blue pass
phould have "a nunber of times used" and not "number of days." Peggy Osterfoss
lcornmented the audience wanted to have the ability to do what they wanted and parking
where they wanted, and paying more was not an issue.

Merv Lapin made a motion to approve the Consent Agenda as presented. Tom Steinberg
seconded the motion. There was no discussion by Council or the publlc. A vote was

Next was 0rdinance No. 25, Series of 1990, second reading,.,an ordinance amending
Special Development District No. 23, the Vail National Bank Building, and settingforth the details in regard thereto, Mayor Rose read the full title of the
ordinance. Mike Mol'l ica stated the only change made since first reading was under
Section 4.E- A new paragraph had been added. Larry Eskwith then discussed Vail
Associates'wa'iver of right of reverter clause which Jim Gibson had questioned atthe first reading. Jay Peterson, representing the applicant, gave background
information regarding the parking situation, and did not feel the ordinance's new
paragraph 4.E. was fajr. After some discussion by Council and Jay, a motion to
approve the ordinance on second reading with the additional language was made by
Merv Lapin. A second came from Rob LeVine. A vote was taken and the motion passed
5-2, with Tom Steinberg and Lynn Fritzlen opposed.
Fifth on the agenda was Ordinance No. 22, Series of 1990, first reading, an
ordinance amending SDD No. 7, qommonly referred to as the Marrlott Mark Resort, and
the development plan in accordance with Chapter 18.40 of the Vail Munlcipa'l Code;
and setting forth details in regard thereto (714 West Lionshead Cjrcle, Lots 4,7,
C, D, Block 2, Vail-Lionshead 3rd Filing) (Applicant: M-K Corporation - Kaiser
Morcus and Marriott Corporation). The full tjtle was read by Mayor Rose. Jim
Gibson made a motion to table this item until.th€ September 4 evening meeting, peq
the applicant's request.' Rob LeVine seionded"the motion. Kristan Prltz explained
what rezoning the applicant was trying to change to and why. A vote was taken and
the motion passed unan'lmous'ly 7-0.
Next was Ordinance No. 27, Series of 1990, first reading, an ordinance amendlng
Chapter 18.04 of the Vail Municipal Code by the addition of Section 18.04.035 Brev{'i
Pub; ,and amending Section 18.28.030 of the Municjpal Code to add Brew Pub as a
permitted use in the Conmercial Service Center zone district; amending Chapter
18.28.040 of the Vail Municipal Code by the addition of Brew Pubs that sell beer
wholesale and Brew Pubs which se'l I fifteen percent of the manufactured beer or alefor off-site consumption as conditional uses to the Commercial Service Center zonedistrict; amending Chapter 18.28 of the Vail Municipal Code to provide certainrestrictjons in the operation of a Brew Pub; and setting forth details in regardthereto. The full title was read by Mayor Rose. Andy Knudtsen gave brief
background information on the request. He stated three changes to the Code which
had to happen regarding this request for a brew pub: l) it had to be defined; 2)
Council had to make a brew pub a use by right; and 3) they had to state specific

items for conditional use. Aften some discussion, Andy then answered questions ofCouncil '. Merv Lapin then made a motion to approve the ordinance, whj ch Jim Gibsonseconded. Larry Eskwlth suggested comblning the two conditional uses shown in theordinance into only one. Merv then amended his motion to approve the ordinance andto combine both conditional uses into one, and Jim amended his second. A vote wastaken and the motion passed unanimously 7-0.
Seventh on,the agenda was an appeal ,of,the PEC decision to approve requests for anexterior alteration and landsiape Variance in order to construct an addition to theLancelot Restaurant at the Bell Tower Building located at 201 Gore Creek Drive (partof Tract A, Block 58, vail village lst Fillng) (Applicant: Hermann Staufer,Lancelot Restaurant). Kristan Pritz gave background information on the exterioralteration request and explained why staff recommended approval with two conditions:
1. - The applicant must remove railings surrounding the patio fron November l to
May 1 of each year.
.2. The.appllcant must participate in a project involving the property owners
and the Town's Public Works Department in an effort to resolve drainagi problems
adjacent to the Bell Tower Building. These drainage problems are a resuit of theundirected drainage off of the building. Staff does not fee'l that the applicantshould be required to provide the solution individual 1y. However, staff feels it isfair to require him, as a property owner in the bu'ilding, to participate and pay forhis fair share as deemed by the bui'l ding association. Any drainage improvementi
necessitated by the deck enclosure shall be addressed by the applicant in the Design
Review Board submittal and building permit p1 ans.
Kristan then revlewed the landscape variance request and explained the reasoning forthe request. She stated the staff recommended approval of the variance, and
reviewed the Planning and Environmental commissionrs vote for appnova'l of 5-2.Kristan answered questions of Counci'l . Peggy Osterfoss felt these were good ideasfor the area. Tom Steinberg conmented there should be an agreement with the
applicant that he pay a parking fee, and if Council amends the ordinance and
increases stated fees sometime during the next year, he would be increased as wel1.
Peggy 0sterfoss made a motion to uphold the PEC's decision to approve an exterioraddition to the Be1 I Tower Building, findjng that the granting of this variance
wou'ld not constitute a grant of special privilege, and was substantiated by the VaiI
Village Master P'l an which encourages a wide variety of activities, events, andstreet life along pedestrian ways and plazas, and including the conditions requiredin the staff memorandum dated July 23, 1990. The motion was seconded by MervLapin. A vote was taken and the motion passed unanimously 7-0. Peggy Osterfoss
then made a motion to uphold the PEC's decision to approve a variance request to
reduce the landscaping to increase the Lancelot's deck. She stated the granting ofthis variance would not constitute a grant of special privilege, and was in
comp'l iance with the Vail Village Master Plan, and including the conditions that the
landscaping be added between the two buildings, and bench,/possible boulder,/Aspentree be added to the Gore Creek Promenade greenspace as mitigation for the reductionof the landscaped area. Tom Steinberg seconded the motion. A vote was taken and
the motion passed unanlmously 7-0.
Next was an appeal of DRB approval bf the proposed residence at 3010 Booth Creek
Drive (Lot 4, Block 3, Vail Village llth Filing) (Owner: George P. Caulkins,Jr.). Shelly Mello gave background information regarding the request. E1 iot Goss,
an architect representing the Caulkins, presented the Counci'l with drawings of thebuilding in question. Kristan and Shelly then answered questions of Council.
Werner Kaplan presented to Council for their reviev', photographs of residences in the
neighborhood, statlng reasons why he was opposed to the building of the new home
next door. Harry Frampton, a neighbor, requested Council overturn the DRB decision
because he felt the Swiss style chalet in a contemporary neighborhood was totallyout of place, plus the house needed a garage. August Gnassis and Byron Rose,
ne'i ghbors, supported Mr. Frampton's statements. Pepi Gramsharmer felt the house wasfine and should be approved, that everyone should have the right to build his/her
own hone. George Caulkins read aloud a letter he received from Rod Slifer in
support of the chalet style as far as neal estate price was concerned. After much
discussion by Council, staff, and the public, Merv Lapin mad

Ned Gwathmey, Chairman of the DRB, gave additionalinformation regarding the plans and DRB's reasoning for the decision made. JohntJittemyer also added background informatlon. Ned then answered quest'i ons ofcouncil. Lynn Fritzlen made a motlon to uphold the ORB decision, which peggy
Osterfoss seconded. A vote was taken and the motion passed 6-1, with Merv Lapin

Hiigle said TCI did not have separale financial statements for Vail, but such a local reprl could-be prepared, and Merv
requested such repod showing income and expenses be prepared and sent to Ron phillips. Merv lhen estimated lhe
total system revenue for the Vail area at approximately $4 million, 60"/" being f rom TOV alone. Merv commended TCI
on their conlributions to local organizations, but estimated less than 1% ol their revenues were going to local non-prolit
groups' and encouraged them lo do more. Merv also asked fi TCI was planning a'lileline'servici for the Vail area,
a service with a greatly reduced rate available for subscribers who only wanled to receive ABC, CBS, NBC, CNN,
ESPN, or whalever could be included. TCI said they were open to that, a'nd in tact, had recently negotiated a lranchise
in Slerling wilh such a service ofiering a twelve channel pad<age with just the off-air OroaOcasi signals at rate of
$10.75' Jim Gibson expressed concern with the cost of what TCI was delivering to subscribers. He asked to see a
simplified' direct cost breakdown of one home, detailing how a 93 produd cost eicalated lo over 922 per month. Mr.
Hiigle said that detail muld be provided. Peggy Osterloss summarized by indicating TOV's basic oncerns were
improved quality ol service and increased benefits to members ol the cornmunity, inctuOing cost benefits. She lell a
number of suggestions had been made by Council, and appreciated the fact TCI had attended to them, parliarlarly
the lifeline service and some modification of theh tiering system so thal it would be possible, pernaps at a subsidy tevet
on their part, to have more popular statbns in the basic expanded $23 service. She also appreciated lheir gooi faith
gesture of olfering to supply lhe specilb financial information for the Vail area. Further, she requesled i OeaibO
timeline for rebuilding the system, bul TCI said they wanted to discuss that as part of renqotiating the lranchise.
llem No. 4 was a presentation by Troul Unlimited. Bruce Keep a&ised lhe Eagle Valley Chapter of Trout Unlimited
had recenlly compleled a survey regarding Gore CreeKs stalure as an angling and recreation iesource. He iummed
up the suruey results which indicated Gote Creek was on lhe decline, anO deiaited the major reasons for lhe decline
emphasizing use of illegal lackle, lack of ac{ive palrollirE and regulation enforcemenl at the site, and pollution from
silver contamination. He noted Core Creek, running lrom lhe influx of Red Sandstone Creek to lhe oniluence of the
Eagle River, received Gold Medal designation in 1978, and he was oncsmed with the steady deaease ol lhe original
qualiticalions which earned lhe creek lhat status. He said Trout Unlimited felt cunent trends needed to be addressed,
and requesled TOVs assistance wilh implementation ol a long term public education, assessment, and maintenance
!ro9r9m, as well as Vail plice inrolvemenl in public relations and enforcement ol regulalions at Gore Creek. Peggy
Osterfoss saU she appreciated Mr. Keep's presentalion, and suggesied educational efiorts be spearheaded by Triut
Unlimited and encouraged self-policing by that group. She added Councilwould ask statf to meel with the gioup to
help find agencies more appropriate than Vail polics to assist with fishing violation enforcement. The Reireation
Districi was mentioned as one such agency.

to approve Consent Agenda items A and B, and he read those titles in full. Tom Steinberg seconded the motion. A
vote was laken and the motion passed unanimously, 6-0.
Discussion ol ilem C lollowed, Mayor Oslerfoss read lhe tille in full. Kristan Pritz delailed additional informdion from
the applicanl regarding localion of the lrash dumpster. lt was conlhmed the change in location was made lo decrease
the impast on Hanson Ranch Road. Discussion about encroachments and view corridor impacts followed. Merv Lapin
asked il any of the five statf recommendation on page 12 of the Community Development Department's March 23,
1992 memo had been unanswered. Kristan advised the issue ol the curb and gutter had not yet been finalized, bul
lhe applicanl had agreed to all of the recommendalions and all live were covered in the ordinance. Briel discussion
regarding lhe curb and gutler issue, paver edgers, and drainage specifics followed. Tom Steinberg asked il any
progless had been made on any agreemenl aboul the parking 'Esue. Applicant Paul Johnston said they had agreed
to enter into a developer's improvement agreement whereby they would escrow monies for anything not completed
by the time a Temporary Certificate ol Occupancy (T.C.O.) needed to be issued. Kristan added when the applicant
wanled a T.C.O,, the parking area and other site improvements would need to be finished otf the way it was on the
presenl approved plans or lhey would have lo provide a letter of credit. A linal Certilicde of Occupancy would nol be
issued on lhe projecl unlil the work was finished. Kristan detailed parking requirements in response to additional
queslions Merv had about P3 and Lol J. Jim Lamonl, representing lhe Easl Village Homeowners Associalion, said
he was slill concerned about the selbacks and, in his letter of April 21, 1 992 1o Town Council, requested lhe seclions
he indicated ol TOV's Streetscape Master Plan as il atfcted the Christiania and P3 sites be laken inlo consideration,

/ ltt fo 7 was an appeal of a Design Review Board (DRB) decision regarding exterior detailing of the George
/ }ulkins, Jr. tesidence at 3010 Booth Creek Drive, Lot 4, Block 3, Vail Village 1lth Filing. Werner and Gilda Kaptin/ were the appellants. Shelly Mello explained the chronology ol the pojed starling with initialJuly 11, 1990, DRB
approval ol this residence which specified the shutters/doors were to be a wash/stain treatment versus opaque. Therc
was no mention of lhe detailing being required to be solid in color. The DRB decision was appealed and on August
7' 1990, Council voted 4-3 to approve the residence with a number of conditions, including lhe shutters be done in a
solid olor. On April 1, 1992, the DRB unanimously approved a request by the owner to allow the exterbr
shutlers/doors to remain as lhey cunently exist with blue and white detailing. Theapplicant had, in facl, violated therr
approval and painted the details blue and white. The DRB found the scale of the building, the landscaping, and the
exteriorfinishes were compatible with the neighborhood, but adjacent property owners, Weiner and Gilda Kaplan were
appealing thal decision. Jim Morter of 2985 Booth Oeek Drive specilically recalled Council's August 7, .|990 approval
staling lhe shutters u/ere to be done in a solid color. Mr. Morter said his primary concern wiih this issue was the
process, and he lelt the owners should be required to abide by the original ruling made. Werner Kaplan'showed
Council recent photos ol the shutters and distributed a petition signed by Mr. Moiler, the tlyslom's, and the Liston's,
neighborhood residents opposed to the blue and white skiped shutters. Mr. Kaplan also reminded Council of their
August 7, 1990 vote to approve the residence wilh the mndition lhe shutters be done in a solid color, added no
evidence of hardship existed al the Caulkin's residence, and encouraged Council lo uphold lhe decision. Nancy
Nystrom of 3070 Booth Creek Drive said she had gone to added expense and lime building her home in order to abide
by all rules she was required lo lollow, and had a problem now observing anolher resident just doing what lhey wanted.
She lelt consideralion lor one's neighbors was a key, as well as following the process of regulation. George Caulkins,
spokesperson lor Geotge Caulkins, Jr., referred to the First Amendment ol the Constitution, and spoke about artistic
freedom. He indicaled lhe shutters and doors were now painled in tradilional Tyrolean slyle, and had been painted
that way to preserve the architectural integrity ol that style, He added he had offered to paint the shutters on the side
tacing the Kaplan residence solid, but Mr. Kaplan had refused lhat otfer. Mr. Kaplan explained he relused the ofier
because he lell the original ruling should be enforcsd. After additional discussion, Jim Gibson moved to overturn th€
Design Review Board's decision of April 1, 1992. Merv Lapin seconded the motion. Belore a vote was taken, Jim
Shearer noted hs appreciated Tyrolean architeclure, but lelt the rules needed lo be followed by all. Mark Nachtigal,
representing the applicant, said he told the conlractor to painl the shutters atter the DRB had approved the striping.
He added thal the painting had been the result ol misunderslanding and had not been a deliberate action against the
ruling. A vote was then taken, and the molion to overturn the DRB's decision passed, 4-2, Peggy Osterfoss and Tom
Steinberg opposed,
Item No. 8 was lhe reappointmenl of Mark Ristow to serve a live year term on ths Town ol Vail Housing Authority.

Dear Mr. Caulkins:
After reflecting on the Tuesday, April 21, 1992 Town Council meeting, I think it would be helpful to confirm
the Town's position on the exterior detiailing of the above residence. As dictated by the Council decision the
existing blue and white exterior detailing, including the door ard shutlers, will need to be changed to a solid
color. I would assume that they will either be solid blue or solid white. lf you choose either of these colors,
staff would probably be able to review and approve it. Should you choose to depart from the existing color
scheme, it will be necessary to have the Design Review Board consider the request. In either case, the
change to a solid colored finish ol the exterior details must be completed prior to the issuance of a final
Certificate of Occupancy for the residence.
As was discussed at the Town Council meeting, you may request a modified version of the exterior detailing
should you desire. I urge you to contact your neighbors prior to this request in order to avoid an appeal of a
DRB decision which may be made as a result of the request.
