Dear Tom:
I am owner of Lot 3, Block 2, U.U.llth Filing which is directly
west of Jom l4orters lot in the filing. I have reviewed the pre-
viously approved plans with Jim for the buildout of his resjdence
and have absolutely no problem with them as drawn.
Please understand that I am not giving my support to Jim just to
help a fellovr colleague. I am the most affected neighbor but see
no real effect on me. According to the filing p'lat and my improve-
ment survey the nearest point for the two residences would be .|13.3'
as designed and since setbacks are zoned to keep distances between
residences, I feel .l.I3.3' is very adequatel
The buffer of Tract B - Booth Creek gives you the opportunity togrant this request not based on hardship but on the pure basis
that this open space exists between the two lots, not to mentjon
the fact that as designed and approved it met the setback require-
ments in .l976.

Thank you for ca1 ling me in yesterday to discuss my vaniance request for
the addition to my home.
As we discussed, I honestly feel that the "practical difficulty" and "hard-
sh'ip" requirements apply, and certainly no special prjvilege wjll be grant-
ed if the variance is approved.
1. The home was situated on the sjte to save two large, sign'i ficant aspen
trees (see site plan), forcing the home to the west. This was beneficialto all, as a who'le grove of aspen trees has sprouted from the roots of these
two trees.
2. When the home AND THE PROP0SED ADDITION were designed (1976), the side
setback requirement was ten feet. There was no way 0r reason to pred'ict
that the rules would change AFTER the home was designed and built.
3. The town is benefitting from TH0USANDS of dollars of'landscaping im-
provements T0 THEIR Ol'lN PR0PERTY by me, as part of this development. Please
note that the landscape improvements occurjng NEXT WEEK will obscure the
proposed addition from every visible angle. Even without the landscape'improvements, N0 ONE is negatively impacted.
You mentioned that, except for recent comments by certajn planning commis-
sion members, your recommendation for such a variance request would Iikely
be favorable (or at least has, been in the past). I would appreciate a fav-
orable recommendation, if you feel ih your own mind that the request should
not be denied. Please speak your mind, as I'm sure those certain planning
corunission members will speak theirs. They'll have their chance to deny if
they want, but I'd have a decent shot going 'in.
Thank you for your consideration, Please stop by around Thursday the 23rd
or Friday the 24th to see the landscaping. Many of the willows along the
highway fence are recent transplants, and the five large spruce and other
improvements you'll see at the southwest portion of the sjte will be new.

The Morter/Rose Duplex was constructed in I976, when theside setback reguirement was only 10 feet. Since thattime, the side setback requirement was increased to 1.5feet.
It was always intended by the applicant to construct theaddition which is being pr:oposed. At the time that the
home and the addition were designed, the setback reguire-
ment was 10 feet.
The home was origi-nally placed on the site to maintain twosubstantial aspen trees (see attached site plan), thus pla-clng it in its proximity to the west property line.
Because the stream tract creates additional distance be-
tween the Morter site and t'.he Swetish/Friedman site, theproposed addition has no adverse inpact on the Swetish/
Friedman duplex, and if anything slightly helps the Framp-ton residence by screening a small portion of I-70.
The proposed variance grants no special privilege. It sim-pJ-y allows the applicant to use the site as originally in-tended, with no adverse affect on anyone, whj-le attemptingto save the only significant trees on the site. In addi-tion, the applicant's plans for landscaping will hetp re-store a beautiful creekside which was destroyed by the Townof Vail in 1977.
