. Snow storage areas.. Proposed dumpster location and detail of dumpster enclosure.. Retaining walls with proposed elevations at top and bottom of walls. A detailed cross-section and
elevation drawings shall be provided on the plan or separate sheet. Stamped engineering
dmwings are required for walls between 4'and 6'feet in height.. Delineate areas to be phased and appropriate timing, if applicable
. Landscape Plan:. Scale of 1" = 20'or larger. Landscape plan must be drawn at the same scale as the site plan.. Location of existing trees, 4" diameter or larger. Indicate trees to remain, to be relocated
(including new location), and to be removed. Large stands of trees may be shown (as bubble) if
the strand is not being affected by the proposed improvements and grading.. Indicate all existing ground cover and shrubs.. Detailed legend, listing the type and size (caliper for deciduous trees, height for conifers, gallon
size for shrubs and height for foundation shrubs) of all the existing and proposed plant material
including ground cover.. Delineate critical root zones for existing trees in close proximity to site grading and construction.. Indicate the location of all proposed plantings.. The location and type of existing and proposed watering systems to be employed in caring for

The Following is a brief explanation as to the proposed changes to 2840 Aspen
Court. Basically, we would like to add some windows and doors to allow for
more light in the lower level as well as update the building. All of the changes will
be seemless and will match what is existing.
1. Add a new 5'0"x4'0' window on the north side of the entry to match the
existing windows on that side. An engineer will be engaged to design
and provide plans to header this window.2. Increase the stair landing window from 2'0x3'0 to 2'0x6'0. The esisting
header will be used and all trim will match existing color and material.3. Replace the lower level south bedroom window with french doors to
allow proper aooess to the back yard area while eliminating the existing
2'0" back door.4. Replace the front door with a more up to date door. The existing
header will be used and the door will be stained to match the existing
stained wood.
I have attached pictures to better explain the changes. Hopefully all this will be

This letter is sent in response to your inquiry as to how much expansion potential exists on your site.
According to our records your property is zoned Two-Family and the size of you lot is 18,295 square feet.
The allowable Gross Residential Floor Area (GRFA) for a lot of this size within the Two-Family zone
district is 6,928 square feet for the entire structure (both sides of the duplex).
From plans within our archives it appears that the existing duplex measures 4,620 square feet total for
both sides of the duplex. This number is only as accurate as our archived plans. Any additions done
since the initial construct would be added to the total existing GRFA.
fn concfusion it appears that there is approximately 2,307 square feet remaining for both sides of the
duplex. Within your zone district this remaining GRFA can be divided as the owners see fit. This would

DRB site visit. The applicant must ensure that staking
done during the wint,er is not buried by snow.
The revlerir process for NEW BUILDINGS normally requirestrdo separate meetings of the Design Review Board: aconceptual approval and a final approval . Applicantsshould plan on presenting their development proposal ata minimum of two meetings before obtaining final
approval .
Applicants who fail to appear before the Design Review
Board on their scheduled neeting date and who have notasked in advance that discussion on their item bepostponed, will have their items removed from the DRBdocket unt,il such time as the item has beenrepublished.
The following items may, at the discretion of thezoning administrator, be approved by the Community
Development Department staff (i.e. a formal hearingbefore the DRB may not be required):
a. Windows, skylights and sinilar exterior changeswhich do not alter the existing plane of thebuilding; and
b. Building addition proposals not visible fron anyother lot or public space. At the tine such aproposal is submitted, applicants must includeletters from adjacent property owners and/or frontbe agent for or manager of any adjacent
condominium association stating the associatlonapproves of the addition.
If a property is located in a mapped hazard area (i.e.
snow avalanche, rockfall, flood plain, debris flow,wetland, etc) r a hazard study must be subnitted and theowner must sign an affidavit recognizing the hazardreport prJ-or. to the issuance of a building permit.Applicants are encouraged to check with a Tor,rn plannerprior to DRB application to determine the relationshipof the property to afl napped hazards.

operation of a Bed and Breakfast business on L,ot 16, Vail

I. DESCRII{TION OF PROPOSED USE
In December of 1989' the Vail Toltn CouncLl passed Ordinance
No. 31, Series of 1989 to allow Bed and Breakfast operations
in the Town of vail with certain criteria. The definition of
a Bed and Breakfast given in that ordinance states that:
ItA Bed and Breakfast means a business which accommodates
guests in a dwelling unit in which the Bed and Breakfast
proprietor lives on the premises and is in residence
during the Bed and Breakfast use.rl
A Bed and Breakfast may short term rent separateLy up to 3
bedrooms or a maximun of 900 sguare feet of the dwelting unit,
whichever is the most restrictive.
Ms. Funk has applied for a conditional use permit to
allow her to use three bedrooms in her home for Bed and
Breakfast rental . Her property is one half of a duplex
in a Two Farnily Residential zone district. The bedrooms
and baths contain a total of approxinately 600 square
feet. Two guests could stay in each bedroom for a total
of 6 guests.
IT. CRITERTA AND FINDINGS
Upon review of Section 18.60' the Cornmunity Development
Department recornmends approval of the conditional use perrnit
based upon the following factors:
A. Consideration of Factors:
1. Relationship and imnact of the use on developnent
obiectives of the Town.
The Town Council encourages Bed and Breakfasts in
the Town of Vail as a favorable tlpe of lodging for
tourists.
2.The effect of the use on liqht and air,
distribution of population, transportationfacilities, utilities, schools, parks andrecreation facilities, and other public facilities
needs.
Two guests in each bedroom can be accornmodated atone time, and it is unlikely that there would be
more than three guest vehicles. There is a busstop not rnore than 2OO yards from the home. It isfelt that the inpact on the use of parks andrecreation facitities and on transportation
facilities would be rninirnal .
Effect upon traffic with particular reference tocongestion, automotive and pedestrian safetv and
convenience. traffic flow and control . access,
maneuverabilitv, and removal of snow frorn thestreet and parkinq areas.
It is likely there would be at most, three
additional vehicles driving to the Funk residence.
Staff feels that this would be an insignificant
impact upon traffic.
Effect upon the character of the area in which theproposed use is to be located, includinq the scale
and bulk of the proposed use in relation to
surroundinq uses.
The staff feels that the character of the area wiII
not be negatively irnpacted by the addition of a Bed
and Breakfast in this area. No exterior changes to
the residence are proposed to accomnodate the Bed
and Breakfast.
Bed and Breakfast operations rnay be allowed as a
conditional use in those zone districts as
specified in Title l-8 of the Vail Municipal Code
for Ordinance No. 32. Series of l-989. Bed and
Breakfast operations shal.l be subiect to the
followin€l recruirements :
a. off-street desiqnated parkincr shaIl be
recruired as follows:
one space for the owner,/proprietor plus one
space for the first bedroom rented plus I/2
space for each additional bedroorn rented.
The Funk property contains more than the

cars to park in front of the garage.
Enclosed trash facilities and reqular crarbaqe

Ms. Funk has covered garbage cans in the

additional parkinq is stronolv dl-scouraged.
There will be no removal of landscaping.
Each Bed and Breakfast shall be allowed oneresidential name plate sicrn as defined and
regulated bv the Town of Vail Sicrn Code.

The meeting was called to order at 2z50PM by Chairperson Diana
Donovan.
Worksession - PEC update on'road sandinq practices in the Town of
Vail.
The road sanding update was presented by Susan Scanlan,
Environmental Health Officer, and Pete Burnettr Acting Director
of Public works. As a part of the Presentation on the Town's
road sanding practices, Pete presented samples of the sanding
material used by Pub1ic Works. The Town uses volcanic cinders on
all of the Town roads with the exception of the streets in the
Village core. The core area is "sanded" with 3/8" granite chips.
Pete presented samples of the clean cinders prior to use and
samples of the cinders after the material is swept from the road
surface. Pete explained that to recycle the material they sweep
from the streets would probably noL be cost effective, as the
material wouLd have to be washed and screened to prevent the re-
application of fine, dirty naterial . The cinders are relatively
soft and tend to break down easilyr which creates a certain
amount of fine dust.
Pete further explained that while the granite chips used in the
core area are a cleaner sanding material and do not have the
tendency to break down, they are too heavy when foaded into the
Unimogs. A foad of the granite chips in the Unimog would exceed
the axle weight. for the vehicle. There would also be a greater
problern with broken and cracked windshields when hit with the
granite chips because of the hardness of the materiaf.
Pete presented a sample of the material used for sanding by the
Colorado Department of Highways. The material is a combination
of granite chips, sand and salt. He explained that there is no
measuring done by cDoH when these materials are applied to the
road surface. Tbey are simply applied indiscriminately during
periods of snowfalf or anticipated icing of the roads.
Pete said that it is his policy to sweep the roads when they are
dry between snow storms and when weather conditions permit. Pete
indicated that it takes roughly four days to clean up the sanding
material used at t.he 4-way intersection for one period of
snowfall. The Town sweeper cleans the residential streets in
Town and the South Frontage Road from the Blue Cow Chute to the
Lionshead bus turnaround.
When asked what was the cleanest sanding materiaL available,
Susan Scanlan related that the EPA is currently doing a study on
the durability and cl.eanliness of various sanding materials. The
study is expected to be completed within the next 8 weeks, and
the information will be relayed to the PEC. Susan also stated
that Steamboat Springs has submitted samples of their sanding
material for this study. This naterial is the same material used
by the Town of VaiI. It is expected that the EPA will developguidelines for acceptable sanding materials based on the results
of this study.
Jim Shearer wondered if there is a nachine which could both sweep
and vacuum. Pete answered that you can get them, but they are
very expensive.
Discussion followed concerning how much of the Town is sanded.
Pete said that many streets are sanded which may not normally
need sanding. He would like to be able to only do streets with a
certain slope and intersections with stop signs. He would like
some direction from the Town Council that Public works could
reduce their sanding j-n this manner. Pete hated to do more
graveting than necessary, because he said that gradually the
gravel will take over a yard. He does t.ell people that if they
rake their yards to the edge of the road, the Town will pick up
the gravel at the road edge.
Pete estirnated that they only sweep up about half the total
amount of sand or gravel that is put down.
Tom Steinberg felt that the biggest problem was the Highway
Department. He felt that if the Highway Department would spend
more money and listen to Pete, they would change their method of
sanding. Tom stated that the Highway Department supervisors neet
$rith the Board once a year, and suggested that perhaps Pete could
make a 15 rninuLe presentation. The person who makes the decision
is the one who writes the checks. Pete suggested it should be ajoint venture between the Highway Department and the Town.
Kathy Langenwalter asked if the Town could do the on and off
ranps. Pete replied that the Town is only budgeted to do 32
miles of Town because of the cost of the sweeper and salary to
pay the workers. Pete explained that continuing to sweep larger
areas of CDOH roads will l-ead to budget overruns and shortened
life expectancy of the sweeper. The CDOH policy with regard to

sweepi.ng is to sweep once in May and once in October to permit
road striping to occur.
Diana Donovan feft that the Cornmission did not have enough
information to make a recommendation, and Tom Steinberg indicated
that after more information etas obtained, the Commission would
receive that information.
One of the Commission members asked who sanded the Frontage Road.
Pete rep).ied that the state and the Town both did. This past
year, the Town had done more than in the past, because they kept
getting calls from the Police Department to sand the road.
Pete, s concern about using chemicals in cornbination with sanding
material was that it would affect the water quality. He was
concerned that the Highway Department was considering the use of
calcium magnesium. Pete was asked where he stored the sand which
had been swept up. He said they stockpi)-e it and give it to
people who need it for fill. The remai.nder is hauled to the
dump.
The Commission felt it was vj,tal to deaf with the Highway
Department as well as the Town of Vail roads, and asked for more
information. Pete and Susan agreed to come back with more
information at a later date.
At 3:26PM, the public hearing was caffed to order.
Fifinq, 2910 Aspen Court.
Applicant: Patricia D. Funk
Betsy Rosolack explained the request for the conditionaf use
permit. Betsy reviewed the criteria and findings and the
requirements for a bed and breakfast. She stated that staff
reCommended approval, because they felt all applicable review
criteria and findings had been satisfactorj.ly met.
Betsy then read a ]etter from Frank Winer opposing the bed and
breakfast. Pat Funk, the applicant, responded to each part of
t.he letter. In response to the paragraph about the bed and
breakfast being a cornmercial operation, Pat said this is a home
stay operation. She did not feel it was commercial- Mr- Wimer
stated he felt the Council was not highly focused when the bed
and breakfast proposal was considered. Pat's response was that
the Council was highly focused, the review was very extensj.ve and
lasLed many months,
Another part of the letter from Mr. wimer stated that he felt the
owner of the other haff of the duplex wouLd probably not want to

have a B&8. Betsy replied that the owner of the other half ofthe duplex had been notified, as had the other adjacent property
OLJnerS.
Pat Funk also mentioned that Mr. Wimer had been up last weekend,
and she was home, but he did not come over and talk with her
about this.
Diana Donovan nentioned that this was the first. bed and breakfast
anyone had opposed. She stated that since this was a conditional
use, any problems which night arise could be dealt with. There
could also be conditions in the approval .
Chuck pointed out that the level of a bed and breakfast is not
very different from a short term rental . Diana reminded him thatin a bed and breakfast the owner has to be in residence.
Shelly Mello mentioned that she had a lengthy conversaLion with
Mr. Wimer, and he felt strongly that the bed and breakfast was a
commercial use in a neighborhood, and would have an adverse
affect on the property values.
Connie Knight moved to approve the bed and breakfast per the
sLaff memo, and according to the findings under which conditional
uses were to be approved. Specifically, those conditions are:
1. That the proposed location of the use in accord $rith the
purposes of this Ordinance and the purposes of the districtin which the site is located-
2. That the proposed location of the use and the conditions
under which it would be operated or naintained would not be
detrimental to the public health, safety, or welfare, or
naterially injurious to properties or inprovements in thevicinity.

Chuck Crist seconded the motion, and the vote was 7-0 in favor.

Dear Mr. Blanch:
This letter is to constitute an agyeement between the Town of
Vail and yourself regarding the use of the tlrn burner stove in the 'lower
bedroom of the above-referenced unit. The conditions of this agreement
are as fo] 'lows:
1.) The lower bedroom is to be used so1 e1y by your
housekeeper. It is never to be rented separately
nor in any way used as a separate living unit.
Periodic insoections wi'l I be conducted to insure
compl 'iance.
2.) Ttre two burner stove is to be removed at the
expense of the owner at such tine as a violation
of this use agreement occurs, or when the propertyis sold. At the tine when such violation occurs
or when said property is so1d, a letter will be
sent from the Zoning Adninjstrator giving youthirty (30) days in which to remove the stove and
take out the 220-volt power leading to it. If
the work is not completed within the 30 days, the
Town of Vail will take the appropriate steps, at the
expense of the owner, to complete the work. If
legal action is required, the cost thereof wi'l 1
be paid by you.
3.) This agreement is to be recorded with the Eagle
County Clerk & Recorder's office as a Deed Restriction
on said property.
