BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Depaftment Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeKs.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small p@ects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee

Amendment to the 1999 N.E.C. Town of Vail Ordinance 10-1-6.
Overhead services are not allowed in the Town of Vail.
Underground services have to be in conduit (PVC) from the transformer to the electric meter, main disconnect
switch and to the first electrical distribution circuit breaker panel.
The main disconnect switch shall be located next to the meter on the exterior wall of the structure easily
accessible.
All underground conduits are required to be inspected before back-fiiling the trench,
In multi-fami[ dwelling units, no electrical wiring or feeder cables shall pass from one unit to another. Common
walls and spaces are accepted.
NM Cable (Romex) is not allowed in commercial buildings or structures exceeding three (3) stories.
No use of aluminum wire smaller than size #8 will be permitted with the Town of Vail.
TOWN OF VAIL ELECTRICAL PERMIT GUIDEUNES
All installations of exterior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
if this permit is for installation of an exterior hot tub or spa on a new elevated platForm or deck over
30" above grade, you must also obtain a building permit.
If this permit is for installation of an exterior hot tub or spa on any existing deck or elevated platform,
a structural engineer must review the existing condition and verify that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
If this is a remodel in a multi-family building with a homeowners association, a letter of permission
from the association is required.
o If this permit is for a commercial space, two (2) sets of stamped drawings are required.

Observation of Exploratory Pits and Interior Pad Bearing Conditions. East
Duplex Unit, 31 10 Booth Creek Drive, Lot 9, Vail Village I 1"' Filing,
Vail. Colorado
Dear Mr. and Mrs. Techman:
As requested during the conference call on June 29,2004,a representative of Hepworth-
Pawlak Geotechnical, Inc. observed pits dug in the crawlspace adjacent the perimeter
foundation wall on July 6, 2004 and deepening ofthe interior pad bearing level on July l3
and 15, 2004, at the subject site. The findings of our observations and recommendations
for the footing bearing fr presented in this report. The services were perf,ormed as a
supplement to our agreement for professional services with you dated May 6,2004.
Perimeter Wqfl: Five hand dug pits between 9 to 14 inches deep were observed adjacent
the perimeter foundation wall. Four of the pits were located adjacent the east wall and the
fifth pit was located adjacent the south wall. The two pits located adjacent the northern
part of the east wall encountered imported crushed rock. The other tluee pits encourtered
natural, slightly silty sand and gravel soils. The footing bearing level is essentially the
same as the crawlspace level. The results of a gradation analysis performed on a sample
of the natural soils taken from the pit near the southeast corner are presented on Figure l,
attached. No free water was exposed in the pits. Probing of the bottom of the pits with a
steel rod encountered firm resistance within 3 inches.
The bearing conditions exposed in the hand dug pits are consistent with tirose assumed for
the building supporl. Continued settlement of the granular soils would not be expected.
lnterior Pad: The excavation for replacing tlie pad footing was initially observed ou
July 13. The excavation was about 22 inches deep and appeared to still be based in
organic soils. Probing with a steel rod indicated variable resistance between 6 to 30
inches below the cut depflr. On July 15, the excavation had been deepened to betweeri3
to 5 feet and exposed a large boulder located roughly below the center of the pad.
Groundwater level was encountered at a depth of about 4/z feet. Probing with a steel rod
adjacent the boulder indicated firm conditions within 6 inches ofcut grade except for the
north side that found firm soils at a depth of2 feet.

The bearing conditions observed on July 15 are variable but appear adequate to support
the new footing pad. The subexcavated area should be backfilled with concrete to design
footing bearing level. An allowable bearing pressrue of2500 psfappears acceptable for
the new footing pad design.

Katy press said the safeway policy is not to tow. lt won't be as convenient to access the liquor
store as it used to be. Hopefully they can use Mr. Gart's parking spaces'
Greg Amsden said fiere is a concern with parking for the liquor store and he would like Safeway
to address that.
Katy Press said we could look at a gate.
Henry pran said Safeway might take a look at the Lodge which has a voice-activated gate.
Galen Aasland agrees with a gate on the north side of the walk and to incorporate so.me
landscaping, so is not to seelhe gate. Snow storage should_ be the same as for Vail Commons.
He is concerned with the distance-between the road'and the first parking space. He would like to
see it bermed up to 3'for icy roads, or cars that are in the way of being hit.

Henry pratt agrees with John on the landscaping. He feels it is better to have 7or I more parking
spac6s and give up the landscaping islands. He qlso agrees wjth a berm. Henry asked if we are
gaining anytiing ,riitn tne amd and decel lanes? They just rnake people drive faster.
Dominic Mauriello said it's a CDOT requirement.
Greg Moffet approves of the gate to restrict access to the dock area and the liquor store. This
does not constitute any specilt privileges. The Code really rnissed on parking for. this kind ol
use. The hardship is t-ne'fact that thelite does not provide enough parking for this use. All the
required findings are met.
Dominic Mauriello pointed out that the memo has recornmended findings'
Henry Pratt made a motion for approval with three additional conditions; that a gate or traffic
barri6r be added to prohibit peop6 from parking in the truck loading area, and to guarantee that
the landscape islani be maihtained in a iive condition for 3 years, and that snow removal
performance be the same as other properties in the area.

Dominic Mauriello explained this appeal of an administrative decision. He gave an overview of
the background and explained what the definition of a demo/rebuild was. He also explained the
definition of a building. He stated that the definition was induded in the PEC packets. Dominic
said the applicant was granted 250 sq. ft. to each side of the duplex. Dominic conducted site
visits on July 22, 1996 and July 23, 1 996 with Building lnspector, Chuck Feldman. ln Ghuck's
estimation, 65% of the project was destroyed. Guy Cuccia, the superintendant on the project,
estimated lhat7|/o of the structure was demolished. A redtag was issued on July 24, 1996.
Tom Moorhead stated to the PEC that included in the packets are the Council transcriptions ot
the meetings where the Council considered revisions to the 250 ordinance, as well as an affidavit
from Jim Curnutte, the lormer planner for the project.

William pierce, the Architect, said that in 1995 the owners got togelher to^ renovate the property

GRFA. This was the amount-permitted t6 be actded to the existing home-plus 77 sq. ft. of.site
corerige. The existing squarb footage was approximately 3,700 or 3,800 sq. ft for both sides'
not including the garages.
Galen Aasland said the initial amount was 3,700 sq' ft.
Bill Pierce said the applicant used only 850 sq. ft. for the garages, so thgV could build more
garage space, They decided not to eipand ttie garages, -because the site co-\rerage space is too
iimirc1. We removdd about S% of the iloor areabf th-e house for additions. We submitted the
orbinlf drawingsin October, 1995 of the existing house, before the remodel, so that the extent of
woik would beilear. We highlighted in red an overlay of the areas that exist. The Tuchman
sheet A-204, dated 1 0/9/95 -sndws existing conditions with the addition over he living room. On
the 30th of october we submitted the Hughes, sheet A-204, dated 10/30/95' These all
referenced nhere the Tuchman roof is belng rernoved. Sheet A-7, deled 5nP2 on the original
shows there was never a question that this was not a substantial remodel. Sheet A-204
(Hughes) shows the roolline is a roof and a half above the existing roof.
At the 1Zl l/gb PEG meeting we received unanimous approval. Jim Curnutte summarized the
request and with one minor cnange and lelt comfortiable with he request, since it was a
strhghtfonvard application. Jim'Jaffidavit admiF that he met with us and went firough in detail
what we were doing with this house.
On January 22, 1996, the staff approved the DRB application after adding.one window. After
that approrial, the owners wantei to make it look better. They resubmitted drawings. On March
22, 1996, the DRB unanimously approved Sheet A-301 and Sheet A-303'
Diane Golden asked at this time if they went back to the PEC.
Bill Pierce said no, we did not alter the floor area, just the style. on May 1 5, 1996 we submiiled
the building permit application. Sheet S-4 shows all roofing members. There were 200 new
rooling me-nibers. trtbi one section showing has one roof remaining when the building permit was
issueJ. This was in the Town's hands for I months' $750,000 was the valuation and we had
given stafl countless opportunities to review these documents. One of the key issues here is the
6rdinance that says ttobr area cannot be removed. Statf says if you remove the roof or the walls'
it is taking the definition to its fullest definition. There is no definition of what removal of GRFA
is. The siifi memo refers to interpretation and intent. This is ok if it is done before issuing the,
builcling permit, not after. This reiers to the removal of the floor area, not the walls and roofs. ls
the TuChman/Hughes project the first to come through since the change?

spent time with my staff and the plans on the site and it would be inconceivable that Jim, with
his experience, w6uH say that he didn't see the roof needing to be removed.
Greg Moffet asked if I wanted to convert interior GRFA and wanted to replace the whole roof in
the process, could this be done?
Dominic Mauriello said not if it exposed more than 50% of GRFA'
George Ruther said on March 11, 1996 a homeowner did just that, but made it very clear that
they were going to remove the roof.
Rick Rosen said we came in on March 20th and this was not picked out by statf?
Dominic Mauriello said the scope of the subsequent DRB reviews was minor changes (such as
windows) to an approved plan and not a new review of the demo/rebuild issue.

applicant put a brand new wall in the same location.
Greg Moffet asked Tom Moorhead, since this is unlike anything^l've ever done since l've been on
the 6ommission, how do we choose to go to executive session?
Henry Pratt asked why we would need to go to executive session?
Tom Moorhead stated the commission has the ability to go to executive session for the purpose
of deliberation.
Greg Moffet asked what we were required to find as it relates to the interpretation of the slatute?
Tom Moorhead said the PEC, regarding all appeals, based directy on evidence, must find if the
standards or conditions lrom theZoning Title have or have not been met. The staft interpretation
of a demo/rebuild does not entite the applicant to any additional 250's. You are making a
determination on the evidence presented to sustain or overrule the staff intePretation.
Galen Aasland asked if a house was built and burned down by a fire, would the applicant be
allowed to build it as before?
Tom Moorhead sald hat this does not have anything to do with he appeal before the
commission. The situation has been clouded because it's underway. ls this application
appropriate in relation to the ordinance? We are talking about hypotheticals here.
George Ruther gave an example of this happening and the applicant not being granted the 250.
Gene Uselton said the contractor submitted the plans and did what he was required to do. Could
staff have recognized fr|at this was going to be a demo/rebuild and detected it?
Dominic Mauriello said no, nol from the plans that we had.

Debra Tuchman, owner of the east unit, stated that in order to qualify for the 250, we had to keep

Susan Connelly said there seems to be a distraction because of one's distaste of GRFA- The

Greg Moffet asked that if regardless of the PEC'S action, is this subject to a call-up or appeal by
Council?
Rick Rosen said it was his understanding they could not appeal to Council.
Diane Golden asked if they just built the additional 950 sq. ft. and not the 250, could they do it?
Dominic Mauriello explained that if you build a new house today, you are no longer eligible for the
250.
Rick Rosen said we are both clear on that position.
Tom Moorhead said the applicant is subject to an appeal or call'up to the Town Council.
John Schofield said there are several facts in dispute regarding the percent of demolition. The
definition is less than clear. He made a suggestion to the staff that the delinitions be published
and a separate demo/rebuild definition be formed down the road. I definitely think there is a
conflict between the staff interpretation and the code. I see nothing that addresses that'
Gene Uselton said my comments have nothing to do wifi GRFA. There is no uniform opinion
within the PEC memders as to the interpretation. How then could the applicant be expected to
comply?

Greg Amsden saitl we need to take a look at the code. That would mean that I can't put a new
rooion my house. We have to make GRFA proactive. This whole area needs to be defined.
Will therebe any negative impact to improve the property? There's a gray area here.
Galen Aasland said the Town has acted responsibly, with regard to questioning if this is
demo/rebuild. Where there's a 250, a demd plan should be required. As soon as it got to be fiis
much, a demolition plan should have been submitted. This does violate the spirit ot the 250'
however, the applicint was trying to make this work. The Tonrn's definition needs to make a
much clearer statement.
Diane Golden said the Town council has directed he staff and the PEC to be proactive. we're
here to help make Vail bener and build homes that people can stay in. The delinition is hazy,
unclear and needs clarification.
Henry pratt said the issue of the demo/rebuild has been clouded. There was a lotmore framing
removed belore the photos that were taken. For that reason, stal?s interpretation has been
violated, but I do notfeel the intent has been violated. In driving home, I noticed on a constiant
basis, even though the framing changed, the mass never changed. ldisagree with staff's
interpretation. lf floors were taken out, or walls put back in a dlfferent place, then I could see
stafl;s interpretation. During a walk-through, I saw stairs and conditions that I would not ha\re
rebuilt in the house, so the intent was not a teardown.
Greg Motfet said he does not see bad faith on the part of the staff, or the applicant. The
dilemma, in my mind, is that a demolition means lo bulldoze. lt is clear that there were gleat
pains being taken in this project to not have a demo. The code is not clear. We are required to
jump from definitions of structures to definitions of buildings in different sections of the code to
get one definition. lt is not obvious. We are looking at the code as an obiective document.
Applying staff's interpretiation would create a ftnancial hardship on the applicant. I don't think,
however, that staff is ac{ing out of line on this.
Henry Pratt made a motion to overturn the staft decision in favor of the applicant and also to
direct staff to modify the interpretation for everyone who uses it.
Tom Moorhead said to make one motion.
Henry Pratt withdrew the motion.
Henry Pratt made a motion to overturn stal?s ruling, based on the findings that the interpretation
is not clear and that the applicant acted on their own interpretation, which llind to be
reasonable.
The motion was seconded by Gene Uselton.
It passed unanimously by a vote of 7-0
Henry Pratt made a motion to direct, or ask staff to more dearly define what a demo/rebuild is
and have this definition not woft against what a 250 is intended for.
