1. TERMS: a. All C.O.D. orders are to be paid in full to the delivery driver with either a Cashiers Check or a personal check, preprinted with the Buyer's name and address, prior to unloading the order. Or
orders where vouchers are pre-approved, they must be presented to the driver prior to unloading the order.
b. This quoted price includes a 3% discount for payment made in cash, check, or other means not invoNing the use of a credit card. This discount is offered to all prospective buyers. Payment
by Credit Card will waive this discount.
c. No deductions may be taken from the invoice amount unless authorized by Sierca Pacific Windows prior to delivery. Sierra Pacific Windows will not be responsible for any back charges
resulting from additional materials or work pertormed by others (see Warranty for further information)
d. Past due balances are subject to 1.5% monthly finance charge.
e. Any check or other payment retumed to Sierra Pacific as the result of insufficient funds or canceled payment will result in a$50 processing fee added to the order total.
2. RIGHT TO LIEN: a. In the event the contract amount is not paid in full, Sierra Paciflc Windows reserves the right to place a lien or bond which may be asserted under any provision of the law, to secure paymenl
of the contract amount.
3. ATTORNEY FEES: a. If any legal action is required, Sierra Pac'fiic Windows is entitled to recover reasonable attorney fees, court costs and all other reasonable professional expert or consultant fees and costs
related to such legal action.
4. ESTIMATE OR BIDS: a. All pricing is good for 30 days unless specrfically noted to the contrary.
b. Sierra Pac�c Windows assumes no responsibility for erzors in take-offs or pricing.
5. ORDERS: a. Upon signing, Customer agrees to all terms and conditions of this contract.
b. Orders are subject to delay due to strikes, fire, floods, accidents, or any other cause beyond our control. Sierra Pacific Windows will not be responsible for loss or damage beyond its contro
c. Seller is not liable for prospecGve profits or special indirect, consequential or incidental damages, nor may the recovery of any kind against seller be greater in amount than the purchase pria
of the specific material sold and causing the alleged loss damage or injury.
6. CHANGE ORDERS: a. Orc1er changes will only be accepted within 3 days of signing the original order.
b. Special order items may only be changed or cancelled within 3 days from signing the original order.
c. Cancellations may only be made within 3 days ftom signing the original order.
d. Order changes are immediately binding. They do NOT allow an additional 3 days for modification or cancellation.
e. Sierra Pac�c Windows reserves the right to adjust prices for order changes made at the request of the buyer at any time following orlginal order acceptance.
f. My change to the order may result in a delayed delivery date.
7. TAILGATE DELIVERY: a. Sierra Paciflc Windows is not responsible for labor to unload. Buyer must provide sufficient labor at the job site when driver arrives.
b. Back orders will be noted on the paperwork and will deliver as soon as possible.
c. Any items missing or damaged must be noted on the driver's paperwork at the time of delivery or it will be assumed complete and in good condition.
d. Sierca Pac�c Windows is not responsible for goods picked up by buyer in his\her own vehicle.
8. SALES TAX: a. The Sales Tax rate in this quote is estimated at the time of the quote. Customer agrees to pay the actual Sales Tax in effect at the time of delivery of any portion of this order.

This Limited Warranty is effective for Sierra Pacific Products manufactured on or after April 1, 2006 and installed in the continental United States and
Canada, subject to the sta[ed conditions and limitations. Any previous warranties will contirme to apply to products manufac[ured by Sierta Pacific prior to this

Insulated Glass - 20 Year Limi[ed Wattanty
Sierra Pacific Windows (SP[), as manufacturer, wartanu the insulated glass supplied in its window and door products against failure of the air seal due to
defects in materials or workmanship for a period of twenty (20) yeazs from the date of manufacture. This wamanty does not include cracked or broken glass or
damage to the product resulting from accident, abusive handling, misuse, or shattering due to heat buildup. This warranty dces not include any insulated units
tLat exceed 50 square feet in overall size. Should there be a failure of the air seal within the first twenty (20) yeazs of the warranty period, SPI will deliver to
the place of product installation either a replacement of insulated glass or sash glazed with insulated glass or will refund the purchase price, at SPI's discretion.
Within a period of two (2) years from the date of manufacture, SPI will replace defective insulated glass at no chazge or will refund the purchase price, at SPPs
discretion. SPI shall not be responsible for repainting or refinishing involved in the replacement of glass.
After two (2} yeazs from the date of manufacture through the end of the warranty period, SPI will replace defective insulated glass or will refund the purchase
price, at SPCs discretion. SPI shall not be responsible for the cost and arrangement of installation, repainting, refinishing or similar activities involved in the
replacement of glass.
Wood Components, Hazdware, Weather-stripping and Screens - 10 Year Limited Waaanty
SPI warrants for a period of ten (] 0) years from the date of manufacture, that the wood components, hardwate, weather-stripping and screens which
accompany its products (the "Components") will be free from defects in workmanship or matenals which might unreasonably affect the product's normal
functioning. Within a period of two (2) yea� from the date of manufachtte, SPI will repair or replace any Components that are defective as to workmanship or
materials at no charge, or will refund the purchase price, at SPI's discretion. SPI shall not be responsible for re-painting, refinishing or similar activities
connected with the repair or replacement of any Component.
Afrer two (2) years from the date of manufactwe through the end of the wazranty period, SPI will repair or replace any Components that aze defective as to
workmanship or materials at no chazge, or will refund the purchase price, at SPI's discretion. SPI shall not be responsible for the cost and arrangement of
installation, repainting, refinishing or similaz activities involved in the repair or replacement of any Component.
This wamanty shall be null and void if the customer fails to properly finish, caze for and protect all wood items against mois[ure and excessive dryness and
ensure that a11 surfaces, interior and exterior, top and bottom, are thoroughly painted, vamished or sealed by accepted industry finishing standards. This
wamanty shall not apply to any weather-stripping, vinyls or plastics to which any paints, varnishes or stains have been applied.
Metal Clad Warranty - 10 Year Limited Warranty
SPI will provide a limited ten (10) year warranty on the coating on the metal cladding against cracking checking or peeling due to adhesion loss. In addition,
the coating is warranted for ten (10) years against chalking in excess of a number eight (8) rating based on ASTM D 4214-98 and against color change of more
than five (5) Delta E units in accordance with AS7'M D 2244-93. Within a period of two (2) yeazs from the date of manufacture, SPI will repair or replace the
defective metal cladding at no chazge, or will refund the purchase price, at SPI's discretion.
After two (2) yea� from the date of manufacture through the end of the warcanty period, SPI will repair or replace the defective metal cladding, or will refund
the purchase price, at SPPs discretion. SPI shall not be responsible for the cost and coordination of installation associated with the repair or replacement of the
defective metal cladding. On any replacement parts where new wood is a component, SPI shall not be responsible for repainting refinishing or similar
activities connected with such replacement. This warranty excludes minute fracturing that may occur in proper fabrication prceedures.
Warreuty Conditions, Exclusions and Limitations.
This warranty is limited to defects in workmanship and materials and expressly excludes damage or defects caused by or arising from:
o On-site damage occurring during construction due to vandalism, acts of nature or any other cause beyond SP['s control.
o Improper handling or installation by the builder or consumer and/or failure of the builder or consumer to fotlow manufacturer's instructions.
o Normal weaz and tear, and natural weathering of surfaces.
o Prolonged exposure to weather in the unfinished and/or primed state.
o Nahually occurring corrosion or tarnishing of hazdware finishes.
o Installation of the window or door in its opening in a manner which is not plumb, square and true and adequately shimmed on all sides.
o Improper installation not in conformance with Sierra Pacific installation instructions: operational problems and problems related to water and/or air
infiltration/leaking as a result of improper installation or flaws in building design or consWction.
o Strain which is a�plied to the unit by movement of the building or where provisions have not been made in accordance with sound industry practices for
adequate expansion or contrection of framing members.
o Producu subjected to conditions exceeding their design size and/or design pressure limitations.
o Doors with ADA compliant sills, special hazdwaze or no hazdware.
o Windows with special hazdware or no hardwaze.
o Variations in the color, grain and texture of wood products.
o Wood cellular structure failure for wood Componen[s and any Components that come in direct contact with soil. Note: supe�cial mold/mildew does not
indicate wood cellulaz structure failure.
o [mproper finishing and/or maintenance of wood Componenu.
o Warping in door panels unless it exceeds 1/4" in the plane of the panel itself for doors up to 3'-6" x 7'-0" and/or 3/8" for doors over 3'-6" x 7'-0". This
does not refer to the relation of the door panel to the frame or jamb in which it is hung. Action on any claim for warpage may be deferred for a period of
time up to 12 months at SPI's option [o pennit conditioning of the door to humidity and temperature ranges at the jobsite.
o Minor glass imperfections that do not affect normal vision or product performance per the guidelines established by ASTM C]036-01.
o Glass breakage, failure due to misuse or abuse, and damape caused by failure to properly finish and provide maintenance, by alteration or modification to
the window (e.g. customer applied tints or films, paint fimshes, secunty systems), or as a result of any cause beyond the conuol of Sierra Pacific
(e.g. vandalism, fire, flood, earthquake, o[her acu of nature).

o "Chalking" of the clad finish is not a defect unless it exceeds a numerical rating of eight (8) when measured in accordance with the standard procedures
�- specified in ASTM D 4214-98. Fading or changing in color of the "clad finish" is not a defect unless it exceeds five (5) E units (NBS), calculated in
�' accordance with AST'M D 2244-93, pazagraph 6.3. Color change shall be measured on an exposed "clad finish" that has been cleaned of surface soils and
chalk, and the corresponding values measured on the original or unexposed "clad finish." Fading or color changes may not be uniform if the surfaces aze
not equally exposed to the sun and elements. If the above ASTM standards change, the standards in effect at the time of purchase apply.

infiltration; deficiencies in building design, construction and maintenance; failure to install SPI products in accordance with SPI Installation Instructions; or
�� the use of SPI products in systems, such as barrier wall systems, unless proper management of moisture within the wall system is incotporated within the
design of the system. The determination of the suitability of all building components, including the use of SPI products, as well as the design and installation
