General Information: This application is required for all proposals involving minor changes to buildings and site improve-
ments, such as roofing, painting, window additions, landscaping, fences, retaining walls, etc. Applicable Vail Town
Code sections can be found at www.vailqov.com under Vail Information — Town Code Online. All projects requiring de-
sign review must receive approval prior to submitting a building permit application. An application for Design Review
cannot be accepted until all required information is received by the Community Development Department, as outlined in

Sounds great, that gets us into a better position. I did submit the paperwork to David. Shall I drop by later? I know you
guys are busy, what works best? The windows will be painted, no issues there Warren. I have found a contact for a paint
which can adhere well to PVC. The ambient air temperature for application needs to be above 65f. It also as a plasticizer
that etches the vinyl for adhering and that too needs to be in a dry and warm condition. I'll have the work done before
any siding work or application is requested, no problem there Warren.

to my voicemail. It sounded like you are out of the office so I thought I would send an email as you might have a device

As you are aware there is a request by the Wallners to replace their windows with tan windows to match the existing
windows in their unit. The Wallners began the installation of their new windows prior to submitting an application to
the Town of Vail to do so which has resulted in tan windows already having been installed. The windows were installed
as the contractor believed they were a same for same replacement not needing a permit.
Upon doing a site visit I discovered that Unit B currently has white windows and doors (with the exception of the two tan
windows flanking the sliding door above the garage). This condition prompted me to research the Town's records to
determine how the duplex structure ended up with different colored windows and doors. I discovered in 2005
(DRB050191) that a staff inember approved the white windows and noted that there was a mismatch of window colors
in this structure. This staff inember at the time should have worked with you and the other half of the duplex to arrive
at a solution where all the windows and doors in the structure were the same color as the Town Code contains a
provision requiring architectural compatibility within a single structure (duplex). The Design Review Board has
consistently required duplex structure to have matching window colors in order to have a unified architectural
character.
This correspondence today is an effort to resolve a condition which should not have been permitted to occur (the Town
Staff accepts responsibility for this situation). I need to resolve this issue so that I can approve the Wallner's new
windows. I have spoken to Stephen (the Wallner's contractor) and he has confirmed there are methods and products by
which vinyl windows can be painted. This is one solution.
The tan windows on the Wallner's unit could be painted white is another solution.
I am seeking your input on other solutions. I do not know the lifespan of the white vinyl windows (surely more than 8
years), but if they were on your radar for replacement that might be an option as well.
I am looking to work with you and the Wallners to resolve this issue in a way wear there is minimal impact to either
owner, but results in matching colored windows and doors in the structure.

I am aware of the issues on the neighboring duplex to the west and working on that one as well. You are correct that
one half stuccoed their half and placed a bond for the other half which was stuccoed probably 5 years later. The same
planner who created the situation on this structure created the situation on the structure to the west.
I would rather attempt a painting solution of the vinyl if the other owners are amenable even if it may not last in
perpetuity. I just did a search in Google and there are obviously varying opinions, but many suggest that Sherwin
Williams Duration and Superpaint as a good solution. Apparently Sherwin Williams has a color pallet for vinyl as well as
Benjamin Moore. They reference vinyl siding, but windows shouldn't be too different are they? I also found that there
is a XIM Plastic and Vinyl Primer that helps paint adhere.

Not sure I follow your comment about siding replacement and removal of walls, but you can propose changes, but
those changes need to work in architectural harmony with the other half of your duplex.
If the vinyl windows are replaced soon we might be able to post a bond for that work like the stucco on the other
duplex.

I have spoken with a couple of window specialists and they do not recommend painting of vinyl windows. Apparently
there is no longevity in a paint solution that will last.
We do have a few issues here. The next duplex up has three different colour windows. Front door painted outside of
the original color scheme and the exterior was stucco'd. The east unit had stucco for nearly 13 years before the other
side followed suit.
When my owners apply for re-siding work next year, how do we justify replacing same for same when the neighbouring
duplex have done away with deck walls and have completely changed the look of a duplex which was inherently the
same as 1141A and B.
I'm a super amicable person Warren, and I truly appreciate the effort that the TOV have gone through in order to rectify
this small situation.
I have to sympathise with the owners though. They have remained positive about keeping there unit intact and as close
as possible from its 1978 conception. My owners would not want to install white windows because it detracts away from
the look and inherent quality of a unit they bought as an investment. They have wanted to change the exterior colour
for many years however, they deferred from doing this to creat harmony amongst other home owners of Casolar Dr. The
neighbouring duplex have almost lost all identity to the Wallners residence.
I'm not at the point of having to beg, but I'm getting close Warren! Lol..... I'm pretty sure that if 1141b have to replace
there windows in the future, they would oblige Jack and Janie Wallner and bring there unit back in line with its original
status. Could we get a exception in this circumstance? It would be very helpful...
