HomeMy WebLinkAboutDRB120371 email from neighbor1Dear Rachel, Thanks for sending on the plans which we have spent a lot of time reviewing as they are complicated for a lay person to understand. We were unaware that this was a final review and felt we were unprepared to undertake this process on such a large project with only 3 days notice. We asked Craig Snowdon to help us read them and have also spoken to Kyle Webb about our concerns. 1. The proposed pool cantilever into the 30’ Mill Creek stream setback is inappropriate for 2 reasons. The TOV is interpreting the restriction as the same as an at grade patio or hot tub which it is not. The bottom of the pool is 5’ above grade with the top at over 10’ grade, so it is not so clearcut. Secondly, we know that the stream has been designated as polluted and the town is probably going to be reviewing its procedures and restrictions around the stream setback to make it more stringent. 2. The pool design with a glass panel floor will show light coming down in a very vibrant way which we would like mitigated through landscaping and Kyle felt this could be accomplished. 3. We would request some additional landscaping to mitigate the tallest face of the residence and also in front of the pool nearest our house and Kyle felt that was possible as well. The fir trees that look as if they are proposed on Tract E will probably interfere with our Gore Range view as they mature and we would like those moved back onto their property and he is going to check that out today when he visits the property. 4. Most of the plantings abut the property line and go into Tract E which Kyle indicated he has been talking to VR about. The tract E covenant is very important to the neighborhood and to the Town and we want to ensure that all the proper procedures have been followed which will not be an overnight discussion. While these issues should be able to be resolved it is important that the proper channels are used and for this reason we would like to ask that this not be a final review of the DRB and that we have time to have adherence to Tract E provisions.
