Request for a rear setback varjance, sjde setback variances, and astream setback variance in order to enlarge a deck on unit 44 of the
Texas Townhouses' 483 Gore.creek Drive. Applicants: H.T. & D coghill
DESCRIPTION OF VARIANCE REQUESTED
The applicants desire to construct a deck to the north of their townhouse locatedin the Texas Townhouses. The deck would be constructed on the north side ofthe building and would encroach into the requred 50 foot stream setback, therequired 20 foot rear setback and the required 20 foot side setbacks. In otherwords, the resultant setback distances witn tne deck construction would be:32 feet from the centerline of Gore creek, two feet from the rear property line,and 0 feet at each side setback. The lot is located within the HDMF zone-district.
CRITERIA AND FINDINGS

with the object'ives of this tjtle.
There are exceptions or extraordinary circumstances or condit'ions app'l icableto the site of the variance that do not apply generally to other properties
in the same zone.
The strict or literal interpretation and enforcement of the specified regulation
would deprive the applicant of privi'leges enjoyed by the owners of other propertiesin the same district.
STAFF RECOMMENDATIONS ;
The Department of Corrnunity Development recommends approval of the requested
variance. Since the lot is only 25 feet wide, the side setbacks of 20 feet
on each side overlap each other and therefore the side setback requirements
are unreasonable when applied to this lot. The fact that all other adjacent
properties encroach into the the rear setback and stream setback does create
somewhat of a hardship for the applicant and does deprive him of the same privi-
lege enjoyed by his neighbors. There is no negative impact upon adjacent property
owners nor on the creek.

It has corne to our attention that one or more of our
neighbors in the Texas Townhouses are contemplating expandingtheir units by going through the roof of their units to theSouth. As you may be aware, we have owned our unit since 1966.
Our unit, #3, was expanded in a similar fashion in L977. At thattime, we were not allowed to change the roof line on the south
side because it would change the overall appearance of thebuilding. After looking again at the whole building, I agreed
and our expansion was mad.e on the noith sid,e toward the strean.
This maintained the integrity of the building. It also provid.ed
a magnificent view of the stream!
Subsequent to our work, Unit 48 was allowed to er<pand into
the attic by putting in reverse dormers. This has changed the
appearance of the building and I have been concerned with that
approach ever since. Now we find out that the same unit is
contemplating building a full dormer to the South. This mostcertainly would change the appearance of the units and I formallyprotest. T have no objection to e:<pansion to the north as we
have done. In the case of unit 48, I would further suggest thatin order to expand to the north, they be required to close the
south facing windows and return the roof to its original
aPpearance.
Und.er no circumstances should any encroaehment on the firewall that exists between each unit be permitted. Not only would.fire insurance rates be affected. but the safety we each enjoy
would be severely impacted.
Please let me know if you have any questions. Had we
received proper notice of the meeting, we would have been glad to

8.Llen for NonpayoenE of Coooon Expense.A11 suns assessed by the
Assoclatlon but uripald for the share of common Expenses chargeable co any
unlt shall, when properly recorded, consttcute a rlen on euch unlt prlor to
all ocher llene and enctnbrances, excepc only: (a) tax and speelal a6sesa-
loent ll.ens on the unlt ln favor of any governEental authorlty and (b) arr
sums unpaid on a flrst nortgage of record, lncrudlng all unpald obllgacory
surs as nay be provlded by such encumbrance.
If any essesanent shall rernaln unpald after 60 days from the due
date thereof, the Board of lianagera or llanaglng Agent nay inpoee a penalty on
euch defaultlng Ouner equal to 52 of each euch assessment, whlch penally
shall be added to each sueceedlng aseessrnent.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Buildinq permit Apolication.
If yes was answered to any of the questions then a "Public way" permit is rcquired. you
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verifo (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November 1st and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to perform.
The Public Workt Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Depaftment will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permit".
NOTE: The above prooess is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal.

If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Depaftment review, and a review
by the Building Depaftment, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to

hereunder be punished as provided in Section 1-4-1 of this code.
o Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of

CODES 7-34.1 AND 7-3A-3: PARKING OBSTRUCTING TRAFFIC & IMPOUNDMENT AUTHORIZED
D No person shall park any vehicle upon a street or at any other place within this Municipality in such a
manner or under such conditions as to interfere with the free movement of vehicular traffic or proper
street or highway maintenance. (Ord. 2(1968) 5 1)
o Whenever any police officer finds a vehicle attended or unattended, standing upon any portion of a
street or upon any place within this Municipality in such a manner as to constitute a violation of any
section of this Article, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 42-4-1102, as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in
addition to a ten dollar ($10) impoundment charge. (Ord. 2(1968) g 3: Ord. 28(1981) S 1)
