STATEMENT OF EXPLANATION
The proposal for a single garage structure with two 600 s.f. garages and storage
and recreation room space is virtually impossible to connect for the following
reasons:
Slope: the existing site slopes to the south southwest al a 22o/o grade
across the entire site and a 48o/o grade below the buildable area
adjacent to the cul-de-sac on Booth Falls Court.
Existing Structures: the 1970's vintage duplex is located in the southern
third of the lot with the entries into both units on southwest and southeast
walls of the double octagon shaped building
The entries to the existing units are 100 ft. more or less from the garage
door locations and 20 and 24 vertical feet below the proposed garage
floors.
The most northern adjacent portions of the existing duplex structures
to the proposed garage location are bedrooms affording no
interior route through the structure to the main living spaces.
The existing extremely steep topography and the awkward geometric
nature of the existing structure, the distances both horizontal and
vertical from garage to front door entries make a separation of the garages
from the existing units a necessity.

I has come to the Town's attentioil that lighting has been erected at the referonced duplex without approPriate

minor exterior aiterations (DR8050143 and DRB050391), ine town specifically stated that all non-conforming
ifghing mu"t be removed irom the structure as a condition of approval. lt appears that this hae occurred.
H-oweier, no approvals were given for the erecti<ln of any othei iighting on the house or fte site at either of those
times.
Therefore, it will be necessary b submit a lighting plan for revlew by the Town indicating the number and location
of lighting fixtures that you w6uld like to erdt on Obttr siOes of the structure and site. The Town Code requires
maiacoripatfUfe' materials be used upon all duplex shuctures within the Town. Please include cut sheets of all

Scope oFfoork Statement:
The deck is rotted and in need ofreplacement. I propose a deck addition as the current
deck does not meet my families needs. The design of the deck will basically be at the
proposed grade levels. This desigrr, for me, has less impact vizu{lY as it will not require
irand rails. you will notice that the proposed addition to the deck will encroach into the
building set back. I believe a variance should be granted for this area as my adjoining
o*n"rit this location is the Vail Mountain S*sol. Specifically the school's elevation in
closest proximity is the rear ofthe school at the g5rmnasiunq separated by their soccer
field paih which is +/- l0 feet below my proposed deck. Furthermore, there are no usable
windows on the schools elevations in close or distant proximity.The deck will also be
privatized by the existing and proposed landscape. In short I believe the deck is in an area
ihat is below surrounding grades and surrounded by landscape. Taking the emphasis of
the bulk ofthe deck.
the grade proposal, which is a joint effort with my duplex neighbor, is an effort to

views that have been taking away by the Vail Mountain School development. The new
grade gives me a usable and safe yard as well as giving me a highervantagc over the bulk

The proposed tree location is simply a continuance of a landscape theme that comes off
the d^uplex neighbors property. Thus creating a visual and physical separation and to
soften the rock wall.

. Please submit a site plan drawn at the same scale as the topographic survey, 1:'10 scale. Though the
enlarged versions are easy to read, all information regarding existing and proposed grades and the
location of the expanded deck must be located on a full sized site plan or survey.
. Please be aware that abovegrade decks are allswed to encroach into the setback no more than five feet
(5'). Above grade decks are defined as higher than five feet above grade. However, decks that exist
within five feet of grade are allowed to encroach into the setback by one half ( % ) the distance of the
setback. The setback that is under consideration is the rear setback, which is fifteen feet (15') in width
within the Two-Family Primary/Secondary zone district, within which this lot is located. Therefore, if the
proposed deck will be within five feet of grade, it may encroach no morc than 7.5 feet into the setback to
lhe southwest of the home. Please clarify this issue on the site plan.

clarified for me at our meeting today that the work was done by you as a part of your addition. Therefore, he has

Dear Mr. Canon,
Thank you for submitting an application for a re-paint of your duplex at the above address. As I
mentioned during our impromptu meeting onsite last Friday, the proposal has been scheduled for the
next Design Review Board public hearing on Wednesday, September 7n, at 3 p.m. Before the proposal
is heard by the Board,.it would be helpful for me to explain to the Board exactlywhere the installation of
shufters will be occuning. lt is not cunently clear to me which window configurations will be receiving
shutter treatments and which will not. This information would be best communicated through an
architectural rendering or elevation and should be submifted to our office on or before Friday,
September 2nd in order for this item to remain on the agenda for the 7h.
Additionally, please be aware that one condition of approval of this application will include the removal
of all non-conforming floodlights from the struclure. Floodlights and other lighting fixtures which are not
fully 'cut-off are not allowed within the Town of Vail pursuant to Title 14-10-F, Vail Town Code. lf you
are interested, I would be more than happy to send you a copy of the regulations that apply to this
request by the Town.
Thank you for your patience in the design review process. The proposed aesthetic changes will be a
wonderful addition to the duplex. Please don't hesitate to contact me with any question or concems. I
will plan on hearing from you before the 2no and seeing 1ou (or another representative of this proposal)

Thank you for submitting an application for changes to approved plans, which you submitted as a result of my
inability to grant a Certificate of Occupancy for your residence due to site disturbance which had not been
indicated at the time of the original proposal to constsuct addition GRFA at the entrpvay of your home. The
current site plan indicates the proposed restoration of the site, which I have approved, understanding that it
includes the following changes:
F Returning all disturbed grades to a 2:1 slope.> The re-sod of all disturbed grades.
> The addition of the following landscaping materials:

I have not included in this approval the addition of the three foot retaining wall indicated at the southem edge of
your property. Instead, this wall is being reviewed in conjunction with the site plan which was submitted by John
Canon as a part of DRB application #DRB05-0412.
Please call the Community Development Depaftment to rcquest another Ceftificate of Occupancy inspection (AO
inspection) once the aforcmentioned work has been completed. At that time, I will revisit the site and review its
compliance with the plan that I have just approved. As you know, the Planning Department will not issue
Temporary Certificates of Occupancy (TCO's) during the summer months due to the fact that landscaping is able
to be completed during times of warmer weather.

Pre-aoolication Meetino
A pre-application meeting with Town of Vail staff is encouraged. The pr,rrpose of a pre-application meeting is to
identify any critical issues pertaining to the applicant's proposal and to determine the appropriate development
review process for an application. In many cases, the pre-applicaUon meeting helps to expedite the
development review process as critical issues are identified and dealt with in the preliminary stages, A pre-
applicaUon meeting may be scheduled by contacting Joe Suther at970.479.2128 or jsuther@vailgov.com.
Time Resuirements
The Design Review Board meets on the lst and 3rd Wednesdays of each month. A complete application form
and all accompanying material must be accepted by the Community Development Department prior to
application deadlines. A schedule of DRB meetings and associated application deadlines may be found on the
World Wide Web at http://ci.vail.co.us/commdev/plannino/drb/meetinqs/default.htrn For a new residential
development, the application deadline is typically 3.5 weeks prior to a Design Review Board hearing.
Review Criteria
The proposal will be reviewed for compliance with the Design Guidelines as set forth in Tltle 72, (Toning
Regulations) and Title 14 (Development Standards) of the Town of Vail Municipal Code.
Reouirements for properties located in hazard arcas
If a property is located in or adjacent to a mapped hazard area (i.e. snow avalanche, rocKall, debris flow,
floodplain, wetland, poor soilq etc.), the Community Development Department may require a site-specific
geological investigation. If a site-specific Aeological investigation determines that the subject property is located
in a geologically sensitive area, the property owner(s) must sign an affidavit recognizing the hazard report prior
to the issuance of a building permit. Applicants are strongly encouraged to consult with Community
Development staff prior to submitting a DRB application to determine the relationship of the property to all
mapped hazards.
Required Plan Sheet Format
For all surveys, site plans, landscape plans and other site improvement plans, all of the following must be
snown,
1. Plan sheet size must be 24"x 36". For large projecG, larger plan size may be allowed,
2. Scale. The minimum scale is 1"=20', All plans must be at the same scale.
3. Graphic bar scale.4, North arrow.
5, Title bloch project name, project address and legal description.
6. Indication of plan preparer, address and phone number.7. Dates of original plan preparation and all revision dates,
8. Vicinity map or location map at a scale of 1"=1,000' or larger.
9. Sheet labels and numbers.
10. A border with a minimum left side margin of 1.5".
11. Names of all adjacent roadways.
12, Plan legend.
Desion Review Board Meeting Requirements
For new construction and addiuons, the applicant must stake and tape the project site to indicate property lines,
proposed buildings and building corners. All trees to be removed must be taped. The applicant must ensure
that staking done during the winter is not buried by snow. All site tapings and staking must be completed prior
to the day of the DRB meeting.
The applicant or their representative shall be present at the Design Review Board Hearing. Applicants who fail
to appear before the Design Review Board on their scheduled meeUng date and who have not asked in advance

II. PRE-APPLICATIQMEETING:
A pre-application meeting with a member of the planningstaff is strongly encouraged to deLerrnine if any additionalapplication information is needed. It is the applicanttsresponsibj-Ij-ty to make an appointnent with the staff todelermine if there are additional submittal requirements-

III. IMPORTANT NOTICE REGARDING ALL SUBMISSIONS TO THE DRB:
A. In addition to meeting submit.tal requirements, theapplicant must stake and tape the project site toindicaLe property lines, building lines and buildingcorners- All trees to be removed must be taped. A1lsite tapings and staking must be completed prior to the
DRB si-te visit. The applicant must ensure that stakingdone during the winter is not buried by snow.
B. The review process for NEW BUILDINGS normally requirestwo separate meetings of the Design Review Board: aconceptual approval and a final approval . Applicantsshould plan on presenting their development proposal ata minimum of two meetings before obtaining finaL
approval-.
C. Applicants who fail to appear before the Design Review
Board on their scheduled meeting date and who have not
asked in advance that discussion on their iten bepostponed, will have their items removed from the DRBdocket until such time as the item has been
republished.
D. The following items may, at the discretlon of thezoning administrator, be approved by the Community
Development Department staff (i.e. a formal hearingbefore the DRB may not be reguired):
a. Windows, skylights and similar exterior changeswhich do not alter the existing plane of thebuilding; and
b. Building addition proposals not. visible from anyother 1ot or public space. At the time such aproposal is submitted, applicants must includeletters from adjacent property owners and/or fromthe agent for or manager of any adjacent
condominium association stating the association
approves of the addltion,
E. If a property is located in a rnapped hazard area (i.e.
snow avalanche, rockfaIl, flood p1ain, debris flow,wetland, etc) r a hazard study must be submitted and the
owner must sign an affidavit recognizing the hazardreport prior to the issuance of a building pernit.
Applicants are encouraged to check with a Town Plannerprior to DRB application to determine Lhe relationshipof the property to all mapped hazards.
F. For all residential construction:
a.Clearly indicate on the floor plans the inside
face of the exterior structural- waLl-s of thebuildinq; andIndicate with a dashed line on the slte plan afour foot distance from the exterior face of thebuilding walls or supporting columns.
If DRB approves the application with conditions ormodifications, aLL conditions of approval must beresolved prior to Town issuance of a building permit.
