Special End Fittings Are Easy To Install & Conceal
Assembf ies begin with the ThrEaded Termrna, fltting already fastened
to one end of the cable when lt comes from the factory. Attach the
terminal to an end post using a Flat Washer and a special Washer-Nut
and adJust tension in the llne by splnning and torquing the Washer-Nut.

The other end uses the new all stalnless Ctutc/(conne{'-ss* fitting.
The fittlng attaches to the cable by hand in the fleld without special

Joe Macy of Vai'l Associates thanked Peter for his efforts. Kit Cowperthwaite,representing the Golden Peak Neighborhood Association, stated that ihey werenot notified of the proposed changes and had no input at all. He read-fromsection 18.39.090 (d) which stated that if there are "changes of substance"the request must be referred to the Town council. He felt-that the changesrequested were substantial and that the neighborhood should be a'l lowed t6 havei1Put. He mentioned that Tract F2 was to have been conveyed to the Town, afterwhich is was to have been conveyed to the Texas Townhouse-Association.

Gordon Pierce stepped down because he was the architect for this proposat. TomBraun showed circulation and site plans, describing parking leve'l s, entrys andexits. Braun then showed a table'of statistics whibtr indicated theamount of GRFA requested, parking required, etc. He stated that there weref,nree marn factors: the sDD, the Guide plan and zoning. Braun then gave thebackground on SDD6 stating that it was estabtished'in frarch of tsi6 aid'inil-three phases of the SDD had been completed to date.

Patten continued the presentation and was pleased with the redesign of the
roadway. He felt that since the roadway did not go straight, motorists would
be more inclined to turn in either direction onto the South Frontage Road rather
than drive straight ahead onto Vail Road. He added, concerning the height of
Phase IVr, that this was a good effort to preserve the view in compliance with
the Urban Des'ign Guide Plan. Concerning parking, Patten stated that valet parking
would help with the 1l spaces that were short, and commended the applicant forproviding commercial on-site parking. Concerning density, he mentioned that
the staff felt that one important fact was that dens'ity was to the leve'l of
PA zoning and not above.
The impact on the gas station was that the access off of the frontage road was
narrower, and that Phase IV would be within 12 feet of the gas station. Patten
stated that the Fire Department had approved the site p1an.
The timing of the five conditions was discussed and it was suggested that the
board of directors of the Ski Museum and the developers must iome to agreement
on terms for the relocation of the museum into Phase IV prior to the iisuanceof a building permit.
Tim Garton of Garton Liquors had strong objections to the changes. He saidthe tenants weren't po1led and stated that Garton Liquors could no longer be
seen by pedestrians along Meadow Road and that Garton Liquors was dependentupon-vi.sibility and upon cars being ab'le to come to the front door. 'Jay Peterson
flRIied that Phase IV had always bien envisioned to be built someday. i{e admittedthat Garton Liquors was affectbd but for the Town of Vail, this was-a good solution.
Peterson pointed out that adding 175 hote'l rooms would be of benefit t6 GartonLiquors, but the applicant was also willing to work on relocation of Garton Liquor.
'Ross Davis,.representing the Amoco station, said that he had very strong feelings
concerning driving and fire safety. He added that the access had been i Sotntaccess with the Vail Village Inn. He pointed out that the increased density
was 40%,. Another comment was that people would park on the gas station premises.
Peterson responded that the access to the gas stit'ion was sti'll significintand that,the.applicant was not changing th- access or the grade, tfiat the Conocostation had been using vail village-Inn property for accesi until now.
Merv Lapin-asked whether or not the staff felt this project would have anyeffect on Crossroads parking. He added that the Crobsroads parking lot hindled
more cars than the park_ing structure because it was easier for people to parkat Crossroads, and he also noted that many people park in Crossi^oais when'they

AN.EI\'ERGENCY ORDINANCE SETTING FORTHpRovrsroNs FoR THE pRoTEcrroN or,iinINIIABITANTS OF TUE TOWN OF VArr, rNONrGEOLOGIC HAZARDS AND PROVIDING DETAILSIN REGARD THERETO.
WHEREAS, lecent devel0pments within the Town indicate that
it is essential that subd.ivisions and. construction in the Town
of Vail affected by geologj.c hazard be regulated. for the protection
of the health, safety and welfare of the inhabitants of the Town.

WHEREAS, the Town council and the Town staff are in the process
of studying the best possible way to handle geologic hazards within
the Town of Vai1, a.nd
WIIEREAS, because the building season is approaching it is
necessary to set forth a temporary means of dealing with the
problems created by geologic hazards until a permanent solution
can be found.
NoI[, TIIEREIORE, BE rT ORDATNED BY THE ToIfN couNcrl oI THE
TOilN OT'VAIL AS FOLLOWS:
Section 1. Purpose. The purpose of this.ordinance is to
protect the inhabitants of the Town from dangers rerated to
development in areas identified as georogic hazards and to
protect the economic and property values, the esthetic and
recreational values and the natural resources which are sometimes
associated with geologic hazard.s ancl to protect the public health,
safety a.nd welfare.
section 2' For the purpose of this ordinance geologic ttazard
means landslides, rockfalls, mud f1ows, debris f1ows, unstable or
potentially unstable slopes, ground subsidence and faulting,
expansive soi.l or rock or any manmade modifications to slope whieh
may be cause significant hazard to life or property.
Section 3. For the purposes of this ordinance, development
plan means the following whenever rel_evant:

A. preliminary plan for a major subdivislon or
B. A deveropment pran for a speciar development district or
C' The final plan for a minor subdivision, unless vraiveal for
good cause by the community Devel0pment Department.
section 4. The following speciar restrictions are imposed for
the development of geologic hazard areas:
A. In any area identifled as a geologic haza"rd. area by
either a master plan or map of the Town of vail, the subd.ivision
process of the Town of vail or any reliable study done by a geol0gist
or engineer' no devel0pment plan and no building permit for a new
structure shal1 issue except as otherwise provid.ed. herein unti-r site
specific investiga.tion has been cond.ucted. and reviewed. For the
purpose of this section, a site specific geologic investigation shal1
be deemed a detailed geologic investigation which is applicable to
each respective site. Al1 reports and stud.i-es required in this
section sha1l be prepared und.er the d.irection of and at the expense
of the owner/appllcant and submitted to the Department of cormruni.ty
Development. The community Development Department then shall have
the dlscretion to send any report or stud.y to the colorado Geologic
Survey for their review and recommendation.
B. The extent of the site speclfi-c geological_ investigation
required shall be determined by the geologist or engineer who is
responsible for the investigationl however, the investigation shall
be of sufficient thoroughness and. aaccuracy to a11ow a geotechnical
expert to certify whether the geotogic cond.itions are such that the
site can or cannot be devel0ped for the specific structure or use
proposed without corrective engineering and engineered construction
or whether corrective engineering and engineered constructi-on, can or
cannot be acsomplished to eliminate the d.anger to the public health,
safety or to property due to geologic inazard.. I[hen any geotechnical
study disturbs the surface of the area studied, construction on said
area is not to be instituted within three (s) months of sald study,
then the owner wilr revegetate the area and return it to the same
condition it was prj"or to the geotechnical investigation as much as
is reasonably possible.
B. Following the
investigation, a d.evelopment
issued as follows:

completion of the site specific geologic
plan may be approved or a build.j.ng permit
1. If the conclusi_on of the engineer or geologist
performing the investigation is that the site can be developed for the
specific structure or activity proposed without corrective engineeri-ng
and englneered construction, the development plan may be approved without
conditions relating to the mitigation of geologLc ]nazard and. the
bui.lding permit may be issued.
2. If the finding of the engineer or geologi-st performing
the geologic i-nvestiga.tion is that the site is subject to geologic hazard.
but that corrective engineering and engineered construction can be
accomplished to eliminate danger to the public health and safety or
to property due to such geologic b.azard. and such mitigation does not
increase hazard' to adjaeent property or structures, a.pproval of the
development plan for the i.ssuance of the build.ing permit shal1 be
conditional and contingent upon approval of plans for corrective
engineering and engineered construction as set forth in this ordinance.
3. rf the conclusion of the geologist or englneer d.uring
the geotechnical investigatlon is that the site cannot be developed for
the strueture or activity proposed due to the danger posed by geologicar
ba-zard, the development p1a"n or building permit sha11 be denied.
C. The following requirements sha.Il pertain to the
construction of any building or structure to be built j-n a.n identified
or designated geologic ha.zard a,rea which requires corrective engineered
construction to eliminate danger to the public health and safety or to
property due to geologic h,azard as set forth in paragraph B 2 above. The
certified site specifie reports and plans required by this paragraph shall
be prepared by each engineer and geologist as applicable to their area of
specialty.
1. Town
(as built) construction
indicate that:
approval of all reports, designs, and actual
plans shall be required. A1l reports shall

a. Adequate base data, including engineering,
geology, hydrology and soils englneering and related information have
been provi.ded;
b. Said base data is utilized in the design and.
planning of the proposed project;
c. Design a.nd construction proeedures derived.
from said base data are executed; and
d. Design and construction will red.uce danger
to the pubric health and safety or to property due to geologic ]nazatd..
2. The following certified site specific reports and
plans sha1l be prepared by the owner/applicant and submitted for approval
to the Town Engineer and Building Official or their authorized representa-
tive prior to the i.ssuance of a building permit:
a, An engineering geology report, including an
adequate descripti.on of the nature, distribution and strength of the
exi-sti-ng soils of the site, conclusi.ons regard.ing the effective soils
condition on the proposed project and recommend.ations as to design
criteria for corrective measures whenever necessary.
b, Other reports and recommendations as determined.
necessary by the engineer or geol0gist pertaining to hydrol0gy, s10pe,
rockfall or other factors to be filed as separate reports or incruded
in the reports required j_n Section Z (a) and (b).
c. P1ans and specifica,tions for the proposed
project and a report descrlbing how the recommend.ations presented in
the above noted report are incorporated into said plans and specifications
3. No certificate of occupancy shaI1 be issued untj.l the
followlng have been approved by the town engineer and buitding official
or their authorized representatives:
a, Professional inspection and certification that
the work was done in accordance with the plans and specifications set
forth above.
b. Preparation or review and certification of
revised recommendations and/or plans and/or specifications as required.
for original reports, plans and specifications in subsections l and 2.

c. Preparation and submission of final reports
and,/or plans to incrude the summary of the tests conducted. during
construction and certifica.tlon as to the adequacy of the site for the
intended use and that the work has been done in accordance with the
final approved plans and. specifications.
4' rf in the sourse of fulfilling their responsibility
under this chapter, the engi"neer or geol0gist find that the work is not
being done in accord.ance with the approved prans and specifications,
the descrepancy sha1l be reported immediatery, in. writing, to the
contraetor and to the building official of the Town- Becommend,ations
for corrective mea'sures, if necessary, shal1 also be submitted.
5. If the engineers or geotogists of record are
ehanged during the course of the work, the work shaI1 be stopped. until
the replacement has agreed to accept responsibility wi_thin the area
of their technicar competence with certification of work completed
under their inspection and supervision.
6. A11 geotogical reports prepared under this chapter
sha1l be signed by and prepared by or under the responsible direction
of professional geologists as defined by colorado Revised. statutes,
section 34-L-20t, as amended. such professional geol.gists shal1 be
experienced and competent in the geol0gic specialty requi.red to meet
the'objectives of this chapter. such professional geol0gist shal1 be
responsible for certification of arl georogic maps and reports prepared
by him under his responsible direction as specified in this sectiorr.
A11 engineering reports require4 by this section sha11 be done by a
regi-stered professional engineer as d.efined. by L2-25_102 cRS as
amended.
D. The fol10wing procedures sha1l be used in deciding
cases in which the boundary of a designated georo gj.c hazard area i.s
disputed or in ca.ses where because of 1ocal , d.etailed circumstances,
the designated hazard conditon d.oes not present a significant hazard
to public health, safety or to property at the specific location for
the partieular proposed land use.

In a1l such cases, the person contesting the designated
geol0gic hazard area boundary or the severity of conditions at a
speclfic l0cation within the d.esignated geol0gic hazard area, shall
be given a reasonabre opportunity to present its case to the Town
council and submit technical and geol0glc evidence to support hls
claim. The Town Council shal1 not a110w deviations from the boundary
lines as mapped or changes in the designation of a particurar piece of
property as a ]"azard area unless technical and geol0gic evid.enee
clearly and conclusively establishes that the mapped l0cation of the
1lne is incorrect or that the cond,ltions affecting the specific property
do not present a significant hazard to public health, safety or to
property a.t the specific l0catlon within the hazard area boundary for
the particular proposed land use.
Section 5. This ordinance shall be in effect
days from the date it becomes law uuless the Town
sixty (60) day period by a majority vote,
section 6- The Town council finds that due to the danger to
peopre and property within the Town because of geologic hazard, this
ordinance shal1 be passed as an emergency ordinance for the preserva-
tion of the publie property, health, welfare, peace, or safety and.
shall take effect immediately upon passage.
Section 7
If any part, section, subsection, sentenee, clause or phrase
of this ordinance is for any reason held to be invalid, such decision
shall not effect the validity of the remaining portions of this
ordinance; and the Town council hereby declares it wourd have passed
this ordinance, and' each part, section, subseetion, sentence, cl_ause
or phrase thereof, regardless of the fact that any one or more parts,
secti'ons, subsections, sentences, clauses or phrases be declared
invalid.
Section g
The Town council hereby finds, determines and declares that
this ordinance is necessary and proper for the hearth, safety and
welfare of the Town of Vail and the inhabitants thereof.

The repeal 0r the repeal and reenactment of any provision of
the vail Municipal code as provided in this ordinance sha1l not
affect any right which has accrued, any duty imposed, any vioration
that occurred prior to the effective d,ate hereof, any prosecution
commenced' nor any other action or proceeding as commenced. und.er or
by virtue of the provision repealed or repealed and reenacted. The
repear of any provision hereby sha11 not revive any provision or any
ordinance previ-ous1y repealed or superseded unless expressr-y stated
herein.

consideration, hereby commits to issue its policy or policies of title insurance, as identified in Schedule A, in favor of the
proposed Insured named in Schedule A, as owner or mortgagee of the estate or interest covered hereby in the land described or
iefeired to in Schedule A, upon payment of the premiums and charges therefor; all subject to the provisions of Schedules A and
B and to the Conditions and Stipulations hereof.
This Commitment shall be effective only when the identity of the proposed Insured and the amount of the policy or policies
committed for have been inserted in Schedule A hereof by the Company, either at the time of the issuance of this Commitment
or by subsequent endoresement.
This Commitment is preliminary to the issuance of such policy or policies of title insuance and all liability and obliga-
tions hereunder shall cease and terminate six months after the effective date hereof or when the policy or policies committed for
shall issue, whichever first occurs, provided that the failure to issue such policy or policies is not the fault ofthe Company.
CONDITIONS AND STIPULATIONS
t. The term "mortgage", when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter
affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof,
and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved from liability for any loss or
damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure of the proposed Insured
to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to the Company, or if the Company other-
wise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim or other matter, the Company at its option
may amend Schedule B of this Commitment accordingly, but such amendment shall not relieve the Company from liability
prwiously incurred pursuant to paragraph 3 of these Conditions and Stipulations.
3. l.iability of the Company under this Commitment shall be only to the named proposed Insured and such parties in-
cluded under the definition of Insured in the form of policy or policies committed for and only for actual loss incurred in re-
liance hereon in undertaking in good faith (a) to comply with the requirements hereof or (b) to eliminate exceptions shown in
Schedule B, or (c) to acquire or create the estate or interest or mortgage thsreon cowred by this Commitment, ln no event shall
such liability exceed the amount stated in SchEdule A for the policy or polic,ies committed for_and such liability is subject to the
insuring provisions and the Conditions and Stipulations and the exclusions from Coverage of the form of policy or policies com-
mitted-f6r in favor of the proposed Insured which are hereby incorporated by reference and made a part of this Commitment
except as expressly modified herein.
4. Any action or actions or rights of action that the proposed Insured may have or may bring against the Comprny arising
out of the status of the title to the estate or interest or the status of the mortgage thereon covered by this Commitment must be
based on and are subject to the provisions of this Commitment.
STANDARD EXCEPTIONS
In addition to the matters contained in the Conditions and Stipulations and Exclusions from Coverage above referred to,
this Commitment is also subject to the following:
1 . Rights or claims of parties in possession not shown by the public records.
2. Easements, or claims of easements, not shown by the public records.
3. Discrepancies, conflicts in boundary lines, shortage in area, encroachments, and any facts which a correct survey and
inspection of the premises would disclose and which are not shown by the public records.
4. Any lien, or right to a lien, for services, labor or material theretofore or hereafter furnished, imposed by law and not
shown by the public records.
5. Defects, liens, encumbrances, adverse claims or other matters, if any, created, first appearing in the public records or
attaching subsequent to the effective date hereof but prior to the date the proposed insured acquires of record for
