Il'|PORTANT NOTICE REGARDING ALL SUBMISSIONS TO THE DRB:
1. In addition to meeting submittal requirements, the applicant must stake the site
to indicate property lines and building corners. Trees that will be removed
should also be marked. This work must be completed before the DRB visits the
s'i te.
2. The review process for NEW BUILDINGS will normal 1y involve two separate meetings
of the Design Review Board, so plan on at least two meetings for their approval .
3. People who fail lo appear before the Design Review Board at their scheduled
meeting and who have not asked for a postponement will be required to be
republ i shed.

5. You may be required to conduct Natural Hazard Studies on your property. You should

MATERIAL TO BE SUBMITTED
I . NEI,I CONSTRUCTION
A. Topographic map and site plan of site containing the following (2 copies):
1. Licensed surveyor's stamp.
?. Contour intervals of not more than 2' unless the parcel consists of 6 acres or
more, in which case, 5' contour intervals wil'l be accepted.
3. Existing trees or groups of trees having trunks with diameters of 4" or more
one foot above grade.
4. Rock outcroppings and other significant natural features (1arge boulders,
intermittent streams, etc. ).
5. Avalanche areas, 100 year flood plain and slopes 40% or more, if applicable.
6. Ties to ex'isting benchmark, either USGS landmark or sewer invert.
7. Locations of the following;
a. Proposed surface drainage on and off site showing size and type of
culverts, swales, etc.
b. Exact locations of all utilities to include existing sources and proposed
service lines from sources to the structure. Utilities to include:
cable TV sewer gasTelephone water electric
c. Property lines showing distances and bearings and a basis of bearing
d. Proposed driveways with percent s'lope and spot elevations
e. All easements
8. Existing and finished grades.
9. All existing and proposed improvements including structures, 'l andscaped areas,
service areas, storage areas, walks, driveways, off-street parking, loading
areas, retaining wa11s (with spot e1 evations), and other site improvements.
10. Elevations of top of roof ridges (wjth existing grade shown underneath) to
determine height of bu'i1ding.
B. A statement from each utility verifying location of service and availability. To
be submitted with site plan.
C. Preliminary title report to accompany a'l I submittals, to insure property ownership
and al l easements on property.
D. Landscape Plan (1" = 20' or 'l arger) - 2 copies
1. Show the location of 4" diameter or-iarger tre6s, other shrru6s,.and-riatjve plants thaare on the site and the location and design of proposed landscape area:s lvith
the varietjes and approximate sjzes of plant materials to be planted. i"
2. Complete landscape materials list.
3. Designate trees to be saved and those to be lost.
N0TE: As much of the above information as possible should occur on the site p1 an, so that
the inter-relatjon of the various components js clear. The landscape plan should be
separate. The existing topographic and vegetationai characteristics may be a separate
map. The applicant must stake the site to show lot lines and building corners. Trees
that will be lost during construction must be tagged. The work should be completed
before the DRB site visit.
E. Architectural Plans (1/p= 1' or larger) 2 copjes
1. Must include floor plans and all elevations as they will appear on completion.
Elevations must show both existing and finished grades.
Z. Exterior surfacing materials and colors shall be specified and submitted for
review on the materials list avai'l able from the Department of Conrnunj ty Develop-
ment. Color chips, siding samples etc., should be presented at the Design Review
Board meeting.
F. The Zoning Administrator and/or DRB may require the submission of additlonal plans,
draw'i ngs,-specifications, samples and other materjal (jncluding a model) if deemed
necessary to detennine whether a project will comply with design guidelines.
II. MINOR ALTERATIONS TO THE EXTERIOR OF BUILDINGS
Photos or sketches that clearly indjcate what is proposed and the 'location (site plan)
of proposal may be submitted in ljeu of the more formal requirements given above, as
long as they prov'ide all important specifications for the proposed includ'i ng colors and
materials to be used.
III. ADDITIONS - RESIDENTIAL OR COMMERCIAL

C. Site p1 an showing exist'ing and proposed construction - 2 copies topos

E. Photos of existing structure
F. Specifications for all materials and color samples on materials list available at
Department of Community Development
At the request of the Design Review Administrator you may also be required to submit:

attached utility location verification form.
H. Site improvement survey, stamped by registered professional surveyor.
I. Preliminary title report, verifying ownership of property and lists of easements.
IV. FINAL SITE PLAN
After a building permit has been issued, and when the project is underway, the following
wil'l be required before any building receives a framing inspect'ion from the Bu'i lding
Department: A certjfied improvement survey showing:
A. Buildjng locations with ties to property corners,'i.e. distances and angles.
B. Building dimensions to nearest tenth of foot.
C. All utility service lines as-builts showing size of lines, type of material used'
and exact locations. 2 copies
D. Dra'inage as-builts. 2 copies
E. Basjs of bearing to tie to section corner.
F. Al 1 property pins are to be either found or set and stated on map.
G. A] I easements
H. Building fl oor elevations and roof ridge elevations.

Dear Mr. Patterson:
Upon hearing of your officers concern for the design of the above ment ioned balcony,
I have spoken with the contractor on that job, as well as with Chuck Thomas. Today
I visited the project and have descri bed the situation to the structural engineer.
In as much as I, like you, am unable to view the connections of the framing members
behind the exter ior wall I have had to rely upon what the contractor has told me
about that condition. lt should be noted that Chuck Thomas retained us for design
services alone. Consequently, the tasks of monitoring or "observingrr construction
was not performed by this office. Our drawing called for double 2rr X l0rr joists
at l6rr on center spanning l6' between bearing walls and canti levering 9rto sup-
port the balcony. The contractor has used a single 2'r X l0rr joist to span the
l6t and has scabbed on two 2" X 10il members lapping the single joist 7! He tells
me that this lap was fully nailed the length of the lap, The contractor then
nailed a 2rrX l0rr member on to both sides of the joist the remaining 9r to
the wall. He also inserted a 2t'X 10" between the scabbed on members. This condi -
tion was descri bed to our structural engineer. Using a combined 9O# live and dead'load and a 40# load for the railing he analyzed the construct ion as safe.
Several things may be pointed out:
a. The balcony, perhaps without the completed hand rail, withstood the heavy
snows of last winter - without being shoveled lrm told.
b. The wood siding on the solid west wall of the balcony does afford some
added stiffening.
c. There is a snow guard on the sloped roof above the deck which should
el iminate massive snow sl ides.
d. Your predecessor, Itm told, did perform a framing inspection.
I regret that this situation has come about and would try to answer any further
question you may have, although Itm afraid lrve no other knowledge of the situation
than that stated above.

The appljcant has requested a setback of 15 feet from the west
property line in lieu of the required .|8.5 feet and to place the residence
23.5 feet from Booth Falls in lieu of the required 28.5 feet in order
to construct a two-family residence. C'losest existing structure is
Booth Falls located to the west of the proposed Thomas residence whichis located approximately l0 feet from its east property line.
The Department of Conrmunity Development has reviewed the criteria
and findings provided for in Section 18.62.060 of the Municipal Code and
our conc'l usions are as fol I o,,ts:
The relationship of the requested
variance to other existing or potential
uses and structures in the vicinity.
' The plans for the proposed structure would have little adverse
impact on existing or proposed structures in the area as the Booth Falls
wall adjacent to the proposed structure.has no windows.
The degree to which the re'lief from
the strict or literal interpretation and
enforcement of a specified regulationis necessary to achieve compatability
and uniformity of treatment among sites
in the vicinity or to attain the obiectives
of thjs ordinance without grant of spec'i a1
priv'i1ege.
One of the objectjves of the Zoning Ordinance is to protect the environ-
ment, discourage excessive cuts or fills and preserve existing large trees.
The proposed location of the residence is 'in keeping with this objective.
The applicant states that the structure has been designed and sighted to
minimize. the site disturbance and another location of this structure
(which has 3/4 the allowable area for the'l ot) wou'l d require extensive
site deve'lopment. Maximum exposure to the sun and view from the living
areas within the units requires the buildings greater length be parallel
with the short axis of the lot. Because of the 'lot's narrow dimensions
this length cannot be accormodated without an encroachment on the required
setback. Another objective has been to locate the garages out of public
view, thus, with this design, the building gains height (and added setback
requirements). The alternative would be garage doors facing the road and
driveways in place of existing trees and ground cover.

Design covenants within Booth Creek require a pitched roof which

finds that the granting of the variancewill not constitute grant of special
privilege inconsistent with the limitations
on other propert'ies classified in the same

That the granting of the variance will not
be detrimental to the public health,
safety , or wel fare , or materi a'l 'ly i ni uri ous
to properties or improvements 'in the vicinity.
That the variances warranted for the follolving r€asons:
a. The strict or literal interpretation
and enforcement of the specified
regulation would resu'lt in practical
difficulty or unnecessary physical
hardship inconsistent with the obiectives
of this tit'le.
b. There are exceptional or extraordinary
circumstances or conditions applicable
to the site of the variance that do not
apply generally to other properties in
the sare zone.
The applicant states that rnoving the house to meet the setback
requirements and separation between bu'i ld'i ngs would result in extensive
site development. We feel that it is important to preserve ex'i sting
trees and ground cover and minimize cuts required on steep sites.
The location of the existing Booth Falls building w'ithin l0 feet of its
property line creates a hardship for the applicant in providing the
required separation.
