Limited Warranty
Watkins Manufacturing Corporation ("Walkins") warrants
to the original consumer purchaser ("you') the following
about your new Tiger River@ porlable spa, when purchased
Jrom an authorized dealer/service provider ("deale/').
!l Year Surface/Stmctural Warrantv
Walkins warrants the dcrylic surface material of the Tiger River
portable spa to be free from delects in materials and
workmanship for seven years. Additionally, the acrylic
surface material is structurally warranted not to leak lor
a period ol seven years. The acrylic surface materials are
non-permeable and will not absorb odors, bacteria or pollutants.
l:TEl Year Component Warranty
Watkins warrants the electrical components, pumps, air valves,
levers, bezels and other Tiger River spa components against
defects in materials and workmanship lor five years. Some parts,
most of which can be changed oul without the use 0f tools, such
as filter cartridges, lilter lid, spa pillows and cover locks, are
not included in this warranty, but are warranled to be lree from
defects in materials and workmanship at the time ol delivery.
Spa covers and other spa accessories are specifically excluded
from this warranty, although they may be covered by other
warranties. Please check with your Tiger River dealer l0r details.
El Year No-Fault' Heater Warranty
Watkins unconditionally warrants the No-Fault heater to be free from
defects in materials and workmanship for five years. This warranty
delines unconditional as warranty coverage without exception
provided that the component has failed to operate properly within
the spa's system.
ln YearNoLeakWarranW
Watkins warrants the Tiger River spa against leaks caused by
defects in manufacturing and workmanship lor live years. This
warranty specilically covers leaks lrom the wall littings, iet
littlngs, internal plumbing, internal glue joints, drains, and all
bonded parts including the filter compartment and light lens.
EI Year SureWood' Cabinet Warranty
Watkins warrants the Surewood cabinet material to be lree
from defects in materials and workmanship for three years. This
warranty specifically covers the cabinet's struclural integrity
(exclusive of surface stain), including the SureWood and framing
material, and all bonded ioints. The Surewood cosmetic finish is
warranted to be free lrom delects in materials and workmanship
at the time ol initial delivery. Fading and r,veathering of the
surface will occur naturally over time, and are not defecls. To
restore the appearance ol the Surewood cabinet, refer to the spa
0wneis Manual lor proper care and maintenance instructions.
l.l Year LED Light Assembly Warranty
Watkins warrants the LED light assemblies, which consists of all
lights within the spa, including the main light and lighting 0f any
water feature, to be free from defecls in materials and workmanship
for one vear.
The lollowing applies to all ol the warranties listed above:
ExtentOfWarranff
This warranty extends orily t0 the original consumer purchaser
of the Tiger River spa when purchased and originally installed
within the boundaries 0f the United Stales. This warranty begins
on your delivery date of the spa. This warranty lerminates upon
any transfer of ownership, or if the spa is installed or relocated
outside the boundaries ol the United States by the original
consumer purchaser prior to the expiration of the warranty period.
Warranty Performance
To make a'claim under this warranty, contact your dealer. In
the event you are unable to obtain service from the dealer,
please contact Watkins Manufacturing Corporation, 1280 Park
Center Drive, Vista, California, 92081, Attn: Customer Service
Department (800) 5911001 or via e-mail, custserv@watkinsmfg.
com. You must give Watkins and/or your dealer written notice of
any warranty claim, along with a copy ol your original purchase
receipt indicating the date of the purchase, within ten (10) days
of the time you discover the claim. Walkins reserves the right
to inspect the malfunction or defect on location. Watkins or its
Authorized Service Agent will repair any defects covered by this
warranty. Except as described herein, you will not be charged
for parts, labor or the freight costs for parts necessary to repair
the spa for defects covered by this warranty. ln some cases,
the servicing dealer may charge you a reasonable repairperson
travel/service charge that is not covered by this warranty. Please
contact the dealer tor information regarding any such charges.
Limitations
Except as described above, this warranly does not cover defects or
damage due to normalwearand tear, improper installation, alteration
without Watkins' prior written consent, accident, acts of God,
misuse, abuse, commercial 0r industrial use, use ol an accessory
not approved by Watkins, failure to follow Watkins' Pre-Delivery
Instructions or 0wner's Manual, or repairs made 0r attempted
by anyone other than an authorized representative of Walkins.
Alteration includes, but is not limited to, any component or plumbing
change, or electrical conversion. Visit www.tigerriverspas.com or
contact your dealer lor a list of manutacturer approved accessories.

TO THE EXTENT PERMITTED BY LAW, WATKINS SHALL NOT BE
LIABLE FOR LOSS OF USE OF THE SPA OR OTHER INCIDENTAL
OR CONSEOUENTIAL COSTS, EXPENSES, OR DAMAGES,
INCLUDING BUT NOT LIMITED TO THE REMOVAL OF ANY DECK
OR CUSTOM FIXTURE OR ANY COST TO REMOVE OR REINSTALL

limilations may not apply to you. ANY IMPLIED WAERANTIES,

Effect.ive June 20, 1991 , the Town of Vail Building Department has
developed the following procedures to ensure that new constructionsites have adeguately established proper drainage from buildingsites along and adjacent to Town.of Vail roads or streets.
Tbe Towrl of Vail Public ltorks Department will be reguired toinspect and approve drainage adjacent to Town of Vail roads orstreets and tbe installation of temporary or permanent culverts at
access points fron the road or street on to tbe construction site.
Such approval must be obtained prior to any request for inspectionby the Town of vail Building Department for footings or temporaryelectrical or any other inspection. PLease call 479-2160 torequest an inspection from the Public Works Department. Atl-ow a
minimum of 24 hour notice.
Also, the Town of Vail Public lVorks Department will be approvingall final drainage and culvert installation with resulting roadpacching as necessary. Such approval must be obtained prior toFj.nal Certificate of Occupancy issuance.

III. IMPORTANT NOTICE REGARDING ALL SUBMISSIONS TO THE DRB:

DRB site visit. The applicant must ensure that staking
done during the winter is not buried by snow.
B. The review process for NEW BUILDINGS normally requirestwo separate meetings of the Design Review Board: aconceptual approval and a final approval. Applicants
should plan on presenting their development proposal ata minimum of two meetings before obtaining final
approval .
C. Applicants who fail to appear before the Design Review
Board on their scheduled meeting date and who have not
asked i-n advance that discussion on their item bepostponed, will have t.heir items removed from the DRBdocket until- such time as the item has been

D. The following items may, at the discretion of thezoning administrator, be approved by the Community

fact there was an existing structute on the proPertyr which was destroyed by
fire in January 1973.
(d) The property is situated in utility districts and served by

(e) The proposed townhouse project is totally compatible with the

(f) The proposed townhouse structure, in addltion, has received the

ARTICLE I
The followingr words when used in this Declaration (unl-ess
the conLext shall prohibit) shall have the following meanings:
1. I'Subject propert.yt' or "the property" shall mean thereal property described as follows:
Lot 8, Vail Vi-Ilage West, Filing No. 1,
County cf Eagle and State of Colorado,
according Lo the recorded plat thereof
and aII improvements thereon.
2. rrPlat" or "Map" shall mean the Final Plat of Aspen
Leaf Townhouses, an engiineering survey of the subject property
which DeclaranL has had prepared and proposes Lo record or filefor record with the Clerk and Recorder of Eagle County, Colorado.
Such Plat depicts the outside dj-mensions of the subjecb property
and divides the same into Lhree townhorrse lots and a tract occupied
by an encroachment of improvements on property adjacent to the
subject property; such Plat also depicts a parking easement across
the three townhouse lohs and. the location of all improvements thereon.
3. "Parking easement" shall mean such portion of the pro-
perty so designated on the p]at. Owners of units subject hereto
shall be entitled to use any of such parking easement for suchpurpose, for themselves, their families and guests.
4. ttlot", ttsitet', oE t'building sitet' shall mean anyof the three portions of the property d.esignated and numberedas a lot on the map. Each lot contains an individual residential
improvement, vacant land and a parking easement. Title to any
such lot shall be held in fee simpJ-e.
5. "Residence" shall mean the residenti-al improvements
constructed on each building site.
6. nunit" shall mean the lot, together with all the
improvements thereon and all appurtenant rights and obtigationsthereto, includ.ing those pursuant to this Declaration.
7. "Ownert' shall mean the record owner, whether oneor more persons or entities, of the fee simple title to a 1ot.
ARTICLE II
ArchitecturaL-Aesthetic Control
1. No exterior additions or alterations to any exterior
improvements or changes in fences, walls or other structuresr shall
be commenced, erected or maintained unLil and unless plans and
specifications showing the nature, kind, shape, heights, materials,floor plans, exterior color scheme and location of such structure
and the grading plan and finished grade elevaLions of the 1ot to be
built upon shall have been submitted to and approved by the owners.
No landscaping shall be done until a landscaping plan shall have
been submitted to and approved by the owners. Any owner shal-l have
the right to refuse to approve any such plans, specifications, grading
or landscaping which are not suitable or desirable in such owner's
opinj-on, for aesthetic or other reasons, and j-n so passing upon suchplans, specifications, grading and landscaping plansr dny owner sha1l
have the right to take into consideration the suitability of the
proposed Uuitaing or othel improvements and of the materials of
which it is to be built, to the portion of the property upon which
it is proposed to erect the same, the harmony thereof with the sur-
roundings, the topography of the land and the effect of the residence,
structure or other improvement as proposed on the adjacent or neigh-
boring property, and with the general residence plan of the property.
A11 subsequent ad.ditions to or changes or alterations in any residence,fence, wall or other structure, including exterior scheme and all
subsequent additions to or changes or alterations in any grading or
landscaping plans shal1 be subject to the prior approval of the o\dners.
2. Fencing, landscaping and other improvements erected or
placed by Declarant at his expense, shall thereafter be maintained as
the owners may determine
3. Except in the case of facilities erected pursuant to
consent of all owners, no exterior mounted radio. short wave ortelevision or other type of antenna shall be permitted except on an
interior roof, the elevation of which is lower than the surrounding
roof so that such antenna installation is not visible from any ot,her
unit or from the streets.
4. No tanks of any kind, either elevated or buried, shall
be erected, placed or permitted upon the property, except those ini-
tially installed by Declarant, if any, or pursuant to the consent ofthe owners.
5. No clotheslines or incinerators shall be permitted or
maintained on any unit without the consent of all owners.

6. AII storage piles, equipment, furniture, tools andother personal property shall be concealed from view from any otherunit and from the street.
7. No house trailer, tent, shack, detached. garage, barnor out building of any kind shall be permitted on the property
without consent of the owners.
B, Without prior approval of the owners, no house trailer,
camping trailer, boat trailer, hauling trailer, camper body, runninggear or boat or accessory thereto, shall be parked, stored or main-
tained on any lot or the streets adjoining the subject property.
9. Declarant, their successors and assigns, their employees,
representatives, agents and cont,ractors may maintain a business and
sales office, construction facilities, yards, trucks, equipment,
parkj-ng areas, model residences, di.splay facilities, advertising signs,
displays and other facilities reasonably necessary, appropriateor customarily used or acquired during the construction, development
and sales period.s.
10. Without consent of the owners, no signs of any kind
shall be displayed to the public view on any 1ot except one signof not more than 5 feet square advertisinq that unit for sale orrent.
ARTICLE III
Owner Consent
The approval or disapproval of any request or submission
as required by any provisions of this Declaration, sha11 be required
in writing, sha1l be delivered personally to all owners, or mailec
to any owner at such address as may appear in the records of the
Clerk and Recorder of Eagle County, Colorado. In the event no such
address appears, such notice shall be deemed effective if posted.

after the delivery, mailing or posting, of such request, or in any
event, if written demand to cease and desist the activity in question

ARTICLE IV
Common Expenses
No owner may bind any other owner or such owner's unit to
share in any expenses for services or materials furnished on or to
the property without the written consent of such owner to be charged'
except as provided herein or by law, Any owner who suffers loss or
damage by virtue of the action or default of another o'ivner in vio-
lation of the foregoing senLence sha1I have a right of action against
such owner for all damages of any sorL occasioned thereby together
with costs and attorneys fees.
ARTICLE V
Easements
1. Rectptocal Hasements, The Declarant hereby reserves

alteration, inspection and replacement of utility facilities, includ-

and. eguipment incidental thereto, as reasonably required on, over,
under and across that portion of any lot situate between any resi-
dence and the street adjacent thereto or the location of an ease-ment in which utiU-ty facilities may lie or be placed. Perpetualreciprocal easements for the continuance, construction and maintenanceof such utility lines shall exist both for the benefit of and. burdenon all of the owners, provided however that after the sale of a unitby Declarant, no disrupt.ion of the surface thereof or of any improve-

2. If any common utility }ine is destroyed or damaged, the

1. Petty WaI1 Easements. Mutual reciprocal easements are
hereby established, declared and granted for party walIs, if any,

the succeeding Seciions of this Article. Every deed, whether or not
expressly so stating, shall be deemed to convey and to be subject to

Every such description shall be good and sufficient for all purposes
to sell, convey, transfer, encumber or otherwise affect not onlythe designated lot or portion of the subject property, but all im-
provements thereon and all appurtenant rights, benefits and burdensthereto as created by the provisions of this Declaration, and each
such description shal-l be so oonstrued.
ARTICLE VTIT
Insurance
Each owner, whether or not such ownerr s lot is encumbered
by Deed of Trust or other lien, shaIl at his cost and expense main-
tain in force at all time a fire, hazard and personal liability
insurance policy with respect to the improvements on such owner'slot with an insurance company. the financial rating of which is
acceptable to the other owners. No insurance policy shal1 be accep-
table if it does not provide for ten day notice of canceLlation to
the owner and the other owners. The ninimum coverage limits of eachpolicy shall be such limits as the owners may establish by appraisal
from time to tj-me, but in no event sha1l such limit for any unit beIess than may be from time to time required in writing addressed tothe owners in question by the.mortgagee or mortgagees holding deedsof trust upon those units which are encumbered. Upon the requestof any owner, each owner'.shall furnish evj-dence of compliance with
the insurance requirements of bhis covenant.
ARTICLE IX

(a) Animal . Any dog or cat or any other domesticor wild animal or pet.
(b) Animal at Large. Any animal either (1) not
attached to a person by chain or leash, or (2) not at
"heel" beside a competent person, or (3) not obedient
to a person's command, or (4) not in a cage or similar
confinement.
(c) Violating Animals.
(f) Any animal at large on the subject property;
(2) Any animal except one dog and one cat per
lot on the subject property by virtue of such anj-mal 'sownership by the or^rners of any lot subject hereto, or
by virtue of the permissign of the oltners of any lot

2. Without the prior written consent of all owners, no
oliner shall have, permit or allow any guest, tenant or other person
lawful1y on the subject property to have, permit or allow any vio-
lating animal on the subject property.
3. The owners or any of them may, without comPensation to
the owner of any animal, undertake such actions as they deem advisable
to enforce the provisions of this Article, including taking possession
of and dJ-sposing of violating animals in such manner as may appear
reasonable frsm time to time.
ARTICLE XII
General Conditions Stipulations and Protective Covenants
The following general conditions, stipulations and protective
covenants are hereby imposed upon the property:
1. A11 lots sir:rff be subject to the restrictive covenantspreviously imposed upon the subdivision in which the property islocated.
2. Except for the business of the Declarant j-n connectionwith the d.evelopment of the property, no trade, business or activitysha1l be conducted, carried on or practiced on any 1ot or in anyresidence constructed thereon, and Lhe owner of any 1ot shall notsuffer or permit any residence erected thereon to be used or employed.for any purpose that vrill constitute a nuisance in law or that willdetract from the residential value of said unit or any other unit.
3. The covenants and restrictions of this Declaration shallrun with and bind the land, and sha1l inure to the beneflt of and beenforcable by the Declarant and the oviner of any lot subject to thisDeclaration, his respective legal representatives, heirs, successors
and assigns, for a term of twenty years from the date hereof, after
which time said covenants shaLl be automatically extended for successiveperiods of ten years unless terminated by the same vote of owners as
would be required for amnedment, hereinafter provided.
4. The covenants and restrict.ions of this Declaration
may be amended by instrument signed by all lot owners. Any amend-
ment must be properly recorded. No part of the Declaration may be
amended in such manner that it will adversely affect the existingright of any owner or mortgagee. For the purposes hereof, each lotsha1l be entitled to one vote so that if a 1ot has multiple owners,
such owners must provide arnong themselves for procedures to determinethej-r one vote. Similarly, an owner which is not a natural person
sha1I designate in writing a natural person to exercise such owner I svoting rights.

5. Any notice required to be sent to any owner und.er theprovisions of this Declaration sha]l be deerned. to have been properlysent when mailed, postpaid, to the last known address of the person
who appears as owner according to the records of the Clerk and Re-corde:: of Eagle County, at the tiine of such mailing. Any mortgagee
may, by notice in writing recorded in the records aforesaid,, providean ad.dress for notices which shall be similarly bind.ing on all parties.
6. Enforcement of these covenants, restrictions and otherprovisions shall be by Declarant or by an owner by any proceeding atlaw or in equity, either to restrain violation and/or recover damagesagainst any person or persons violating or attempting to violate anycovenant or restriction, and,/or against the land to enforce any Iiencreated hereby, The omission or failure of the Declarant or any ownerto enforce any covenant, or restriction set forth in this Decl-arationshall in no event be deemed a waiver of the right to do so thereafter.
7. ff any of the provisions of this Declaratj-on or anyparagraph, sentence, clause, phrase or word, or the applicationthereof in any circumstances be invalidated., such invalidation shall.not, unless by such invalid.ation, affect the validity of the remainderof Lhis Declaration.
B. Whenever used herein. unless the context shall other-wise provide, the singular number shatl include the plural, theplural the singular, the use of any gender shall include a1l genders
and the capitalization of words shall have no effect in their con-struction.
9. In the event of any dispute arising hereunder, thematter shall be hand.led by arbitration pursuant to the rules of the
American Arbitration Association. No 1egal action vrith respect toany such dispute shall be commenced or maintained until the procedures
thereunder have been exhausted..
