model indicates an "Air-Tite" model with 4.2 "R" value

The proposed residence should be supported with
conventional type spread foofings, designed for an allowable soil
bearing pressure of2500 psf. They should consfuct the footings
on the undistwbed sandy gravel with cobbles. See Foundation
Recommendations.
SCOPE OF STI]DY
This report presents the results ofa subsurface Soil and Foundation Investigation for a
proposed residence to be consfucted on Lot 3, Vail Village West, Filing No. 1, Town of Vail,
Eagle County, Colorado. The purpose ofthe subsurface soil and foundation investigation was to
determine the engineering characteristics of the foundation soil and to provide recommendations
for the foundation desigr, grading, and drainage.
SITE DESCRIPTION
Lot 3 is on the east side of the road, at 1758 Alpine Drive, in the Town of Vail, Eagle
County, Colorado. The topography of the site is relatively flat. Drainage is to the north. Lot 3 is
vacant.

PROPOSED CONSTRUCTION
We have assumed that the proposed residence will consist of two stories, wood fiame
constuction, with a concrete foundation. We anticipate loads to be light, typical of residential
construction.
If the finalized plans differ significantly from the above understanding, they should notiff
us to reevaluate the recommendations of this report.
FIELD II{VESTIGATION
The field investigation conducted on March 31,2004, consisted of excavating, logging
and sampling one test pit. Excavation of the test pit was done with a Link-Belt hackhoe. The test
pit location is shown on Drawing No. 1. We show the soil profile of the test pit on tlre
Subsurface Exploration Log, Figure No l. Soil samples for laboratory soil analysis and
observafion were taken at selected intervals.
SUBSIJRFACE SOIL AND GROUNDWATER CONDITION
The soil profile encountered in the test pit was as follows: Test Pit No.l had 2 feet of
topsoil over 3 feet of light brown, silty sand with some roots over 4 feet of brown, sandy gravel
with cobbles. Ground water was not encountered in the test pit.
We sampled the soil in the test pit at random intervals. The soil samples were tested in
our laboratory for natural moisture content, and grain-size distribution. The test results are showh
on Figure No. 2.

FOTJNDATION RJCOMMEI\IDATIONS
The proposed residence should be supported with conventional type spread footings,
designed for a maximum allowable soil bearing pressure of 2500 psf. The footings should be
placed on the undisturbed sandy gravel with cobbles. We recommend minimum width of l6
inches for the continuous footings and 2 feet for the isolated footing pads. Continuous
foundation walls should be reinforced top and bottom to span an unsupported length ofat least
l0 feet.
We recommend a minimum of 48 inches of backfill cover for frost protection of the
footing subsoils. The foundation excqvation should be obsened by the undersigned engineer to
verifl thot the soil conditions encountered during construction are as anticipated in this report.
The foundation excavafion should be free from excavation spoils, frost, organics and standing
water. We recommend proof-rolling of the foundation excavation. Soft spots detected during
the proof-rolling, should be removed by overexcavation. Any overexcavation within the
proposed foundation, should be backfilled, in 8 inches loose level liffs and compacted to l00o/o
of the maximum dry density and within 2 percent of the optimum moisture content as
determined in a laboratory from a Standard Proctor test (ASTM D-698). A structural fill, placed
under footings should be tested by the engineer or her representatives on regular basis.
Voids left in the foundation excavation due to rock removal should be filled with lean
concrete.
SLAB CONSTRUCTION
The natural on-site soils, exclusive oftopsoil and organics, are suitable to support lightly
loaded slab-on-grade construction. The subgrade for the slab-on-grade construction should be
proofcompacted to detect and remove soft spots. They should backfill overexcavated soft spots
and other underslab fill with the on-site soil, free from topsoil and organics, or other suitable
material, compacted to a minimum of 95 percent of the maximum standard Proctor density

(ASTM D-698). Suitable material should be fiee from topsoil, organics and rock fragments
greater tllan 3 inches.
The concrete slab should be constucted over a 4-inch layer ofclean gravel consisting of-
3i4 inch gavel with at least 50% retained on the No. 4 sieve and less than 3 percent passing the
No.200 sieve.
They should reinforce the concrete slab-on-grade and score controljoints according to the
American Concrete Institute requirements and per the recommendations of ttre designer to reduce
damage due to shrinkage. The concrete slab should be separated from the foundation walls and
columns with expansion joints to allow for independent movement without causing damage.
RETAININGWALLS
Foundation walls retaining earth and retaining structures that are laterally supported
should be desigred to resist an equivalent fluid density of55 pcffor an "at-rest" condition.
Laterally unrestained structures, retaining the on-site earth, should be designed to resist an
equivalent fluid density of 35 pcf for the "active" case.
The above design recommendations assume drained backfill conditions and a horizontal
bacldll surface. Surcharge loading due to adjacent structures, weight of temporary stored
construction materials and equipment, inclined backfill and hydrostatic pressure due to
undrained backfill should be incorporated in the design. They should ty to prevent the buildup
of hydrostatic pressure behind the retaining wall.
TJNDERDRAIN SYSTEM
To reduce the risk of surface water infiltrating the foundation subsoil, we recommend
installation of a foundation perimeter drain (see Figure No. 3). The foundation perimeter drain
should consist ofa 4-inch diameter, perforated pipe, sloped to a suitable gravity outlet, or to a
sump pump location, at a l/4 inch per foot for flexible or at a 1/8 of an inch for rigid pipe. The

drain pipe should be covered with a minimum of 6 inches of -3l4-inch free-draining granular
material. Geotextile (Mirafi 140N or equivalent) should be used to cover the free-draining gravel
to prevent siltation and clogging ofthe drain. The bacldill above the drain should be granular
material to within 2 feet ofthe ground surface to prevent a buildup ofhydrostatic pressure.
SITE GRADING AI{D DRAINAGE
Grading plan was not available for our review. The following recommendations are
general. Exterior bacldill should be compacted at or near the optimum moisture content to at
least9l%o of the ma,rimum standard Proctor dansity under pavement, sidewalk and patio areas
and to at least 90% ofthe maximum standard Proctor density under landscaped areas. They
should use mechanical methods of compaction. Do not puddle the foundation excavation.
The site surrounding the building structure should slope away from the building in all
directions. A minimum of 12 inches in the first l0 feet is recommended in unpaved areas, and
three inches in the fust l0 feet in paved areas. The top ofthe granular foundation backfill
should be covered with a minimum of I foot of relatively impervious fill to reduce the potential
of surface water infiltrating the foundation subsoils.
Surface water naturally draining toward the proposed building site should be diverted
around and away from it by means of drainage swales or other approved methods. The roof
drains and downspouts should extend and discharge beyond the limits ofthe backfill.
LAWN IRRIGATION
It is not recommended to inhoduce excess water to tJre foundation soils by installing
sprinkler systems next to the building. The installation of the sprinkler heads should insure that
the spray from the heads will not fall within l0 feet of foundation walls, porches or patio slabs.
Lawn irrigation rnust be conholled.

This report has been prepared according to locally accepted Professional Geotechnical
Engineering standards for similar methods of testing and soil conditions at this time. There is no
other warranty either expressed or implied.
The findings and recommendations of this report are based on field exploration,
laboratory testing of samples obtained at the specific locations shown on the Location Sketch,
Drawing No.l and on assumptions stated in the report. Soil conditions at other locations may
vary, which may not become evident until the foundation excavation is completed. If soil or
water conditions seem different from those described in this report we should be contacted
immediately to reevaluate the recommendations of this report.
This report has been prepared for the exclusive use of Mr. Dave Hilb, Meadowbrook
Duplex, Inc., for the specific application to the proposed residence on Lot 3, Vail Village West,
Filing No. l, Town of Vail, Eagle County, Colorado.

WHEREAS, the a condition of approyal of the Temporary Certificate of
Occupancy for

judgement of the Town to make reasonable provisions for completion of certain improvements set
forth in the attached estimated bid(s) in accordance with the approved plans and specifications
filed in the office of the Community Development Department of the Town of Vail; and
WHEREAS, the Developer wishes to provide collateral to guarantee performance of this
Agreement, including completion of the all improvements referred to in this Agreement, by means
of the following:
The Developer agrees to establish a cash deposit account with the Town of Vail, as

NOW THEREFORE, in consideration of the following mutual covenants and agreements,
the Developer and the Town agree as follows:
1. The Developer agrees, at its sole cost and expense, to furnish all equipment and
materials necessary to perform and complete all improvements referred to in this Agreement. The
Developer agrees to complete all improvements referred to in this Agreement on or before the _

service districts, as their respective interest may appear, and shall not be deemed
complete until approved and accepted as completed by the Community
Development Department and Public Works Department of the Town of Vail.

2. To secure and guarantee performance of the obligations as set forth herein, the
Developer agrees to provide collateral as follows:
A cash deposit accounl with the Town of Vail, as escrow agent, in the amount of

Agreement, in the event there is a default under this Agreement by the Developer.
3. The Developer may at any time substitute the collateral originally set forth above
for another form of security or collaleral acceptable to the Town to guarantee the faithful
completion of those improvements referred to herein in this Agreement and the performance of
the terms of this Agreement. Such acceptance by the Town of alternative security or collateral
shall be at the Town's sole discretion.
4. The Town shall not, nor shall any officer or employee thereot be liable or
responsible for any accident, loss or damage happening or occuning to the work specified in this
Agreement prior to the completion and acceptance of the same, nor shall the Town, nor any
officer or employee thereof, be liable for any persons or property injured by reason of the nature
of said work, but all of said liabilities shall be and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) arise out of or are based upon
any performance by the Developer hereunder; and the Developer shall reimburse the Town for
any and all legal or other expenses reasonably incuned by the Town in connection with
investigating or defending any such loss, claim, damage, liability or action. This indemnity
provision shall be in addition to any other liability which the Developer my have.
5. lt is mutually agreed that the Developer may apply for and the Town may
authorize a partial release of the collateral deposited with the Town for each category of
improvement after the subject improvement is constructed in compliance with all plans and
specifications as referenced hereunder and accepted by the Town. Under no condition shall the
dollar amount of the collateral that is being held by the Town be reduced below the dollar amount
necessary to complete all uncompleted improvements referred to in this Agreement.
6. lf the Town determines, at its sole discretion, that any of the improvements
referred to in this Agreement are not constructed in compliance with the approved plans and
specifications filed in the office of the Community Development Department of the Town of Vail or
not accepted by the Town as complete on or before the date set forth in Paragraph 1 of this
Agreement, the Town may, but shall nol be required to, draw upon the security refened to in this
Agreement and complete the uncompleted improvements referred to in this Agreement. Pursuant
to Section 12-11-8, Vail Town Code, the Temporary Certificate of Occupancy refened to in this
Agreement may be revoked until all improvements referred to herein are completed by the
Developer or the Town in accordance with this Agreement.

lf the costs of completing the uncompleted improvements referred to in this Agreement
exceed the dollar amount of the deposit, the excess, together with interest at twelve percent
(12%) per annum, shall be a lien against the property and may be collected by civil suit or may be
certified to the treasurer of Eagle County to be collected in the same manner as delinquent ad
valorem taxes levied against such property. lf the Developer fails or refuses to complete the
improvements refened to in this Agreement, such failure or refusal shall be considered a violation
of Title 12 (Zoning Regulations), of the Vail Town Code, and the Developer shall be subject to
penalties pursuant to Section 12-3-10 (Violations: Penalties) and Chapter 1-4 (General Penalty),
of the Vail Town Code.
7. The Developer shall warranty the work and materials of all improvements refened
to in this Agreement located on Town property or within a Town right-of-way, pursuant to Chapter
8-3, of the Vail Town Code, for a period of two years after the Town's acceptance of said
improvements.
8. The parties hereto mutually agree that this Agreement may be amended from time
to time, provided that such amendments be in writing and executed by all parties hereto.

Dear Dave,
The Town of Vail Staffhas reviewed the Design Review application for a proposed Bemstein residence
located at 1758 Alpine Drive. The following is a summary of the comments from that review:
l. The Gross Residential Floor Area (GRFA) calculations must be revised to include all interior
walls that separate GRFA areas from crawlspaces, attics, and open to below areas as these
walls are not defined as exterior walls.
2. Crawlspace areas not.counted as GRFA must be labeled as ceiling height of five feet (5') or
less with an access of 12 square feet or less on the floor plans.
3. Attic areas not counted as GRFA must be labeled as ceiling height of five feet (5') or less on
the floor plans.
4. The landing on the main level may be included as garage credit only if the landing mea is
25o/o or more open to the garage area.
5. Stamped, engineered drawings from a licensed Professional Engineer will be required for all
retaining walls greater than four feet (4') in height with the building perrnit application.
6. A Revocable Right-of-Way Permit shall be required for all improvements within the Alpine
Drive ROW with the building pemoit application.
7. The Town of Vail will slurry seal Alpine Drive in the fall of 2004. All street cuts and repairs
shall be completed prior to this street improvement project. The Town of Vail will not allow
any sheet cuts for one year from the completion ofthe slurry seal project.

CODE $2-10: DEPOSITS ON PIJBLIC WAYS PROHIBITED
A. Unlanfirl deposits: Subject to subsection C thereof, it is unlawful for any person to litter,
track or deposig or cause to be linered, tracked or deposited, san4 gravel, rocks, mu{ dirt
snow, icg or any other debris or material upon any street, sidewalh alley or public place, or
any portion thereof.
B. Notice; Abatement: The Director of Public Works may notifo and require any person who
violates or c:uses another to violate the provision of subsection A hereof, or who has in the
Director's employment a person who violates or calses another to violate the same, top
remove such san{ gravel, rocks, mud, dirt, snow, ice or any other debris or material within
twenty four (24) hours after receip of said notice by the Director of Public Works. In the
event the person so notified does not comply with the notice within the period of time herein
specified" the Director of Public Works, or other authorized agent, may cause any such sand,
gravel, rocks, mud, dir! snow, ice, debris or any other material to be removed from any street
or alley at the o<pense ofthe notified.
C. Exceptions: The provisions of subsection A hereof shall not be applicable:
l. Within the immediate area of any construction" maintenance or repair project of any
stre€t or alley or of any water main, sewer main, electricity line, gas ling telephone line
or any appurtenance thereto;
2. Todepositsofsand,dirtormaterialsnecessaryfortheprotectionofthepublicsafety;and
3. To public areas designated for the dumping or depositing of said materials.
D. Summons; Penalty: As an altemative to the notice for removal provided in subsection B
above, any
person who violates or causes another to violate the same, rnay be issued a summons to
appear before the Municipal Court of the Town for said violations, and upon being found
guilty of a violuion hereunder be punished as provided in Section I 4- I of this code.
E. Notice; Penalty: It is unlawful for any person to hil or refirse to comply with the notice of
the
Director of Public Works as provided in subsection B hereof, and any such person shall, in
addition to payment of the expense of removal incurred by the Director of Public Works, as
provided in subsection B hereof, upon being found guilty ofa violation hereundeq be
punishable as provided in Section l4-l ofthis Code. (1997 Code: Ordinance 6 (19791

BUILDING PERITIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Deparfinent Approval, Engineer's (Public Works)
review and approval, a Planning Departrnent review of Health Departrnent review, and a revrew
by the Building Deparbnent, the estimated time for a total review may take as long as three (3)
weeks.
All commercial (large or small) anrt all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount of
time. However, if residential or smaller pro;ects impact the various above mentioned
deparbnents with regard to necessary review, these projects may also take the three (3) week
period.
Every attempt will be made by this department to expedite this permit as soon as possible'

the permit is not picked up by the expiration date, that I must still pay the Plan Check Fee and
