This Commitment shall be effective only when the identity of the proposed Insured and the anrount of the policy
or policies committed for have been inserted in Schedule A hereof by the Company, either at the tinre of the issuance
of this Commitment or by subsequent endorsement.
This Commitment is preliminary to the issuance of such policy or poticies of title insurance and all liability and
obligations hereunder sball cease and terminate six months after the effective date hereof or rvh.en the policy or
. poli[ies committed for shall issue, whichever first occurs, provided that the failure to issue such policy or policies is
not the fault of the Company.
CONDITIONS AND STIPUIATIONS
I. The term "mortgage", when used herein, sball include deed of tmst, trust deed, or other security instrttltrent.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse clairn or
other matter alfe-ting the estate or interest or mortgage thereon covered by this Commitment other than those shorvn
in Schedule B hereof-, and shall fail to disclose such knowledge to the Company in writing, the Company shall be
relieved from liability for any loss or &mage resulting from any act of reliance hereon to the extent the Conrpany is
prejudiced by failure of the proposed Insured to so disclose such knowledge. If the proposed_ Insured_shall disclose
iucl knowledge to the Company, or if the Company otherwise acquires actual knowledge of any such defect, lien,
emcumbrance, adverse claim or other matter, theCompany at its option may amend Schudule B of this Commitment
accordingly, but such amendment sball not relieve tbe Company from liability previously incurred pursuant to
paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under tbis Commitment shall be only to the named proposed lnsured,and such
parties included under the dafinition of Insured in the form-of policy or qolicies committed for and only -for actual
ioss incurred in reliance hereon in undertaking in good faith (a) to comply with the requirements hereof or (b) to
eliminate exceptions shown in Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon
covered by thiJ Commitment. In no event sball such liability exceed the amount stated in Schodule A for the policy or
policies committed for and such Iiabfity is sublect to the insuriog provisions and the Conditions and Stipulations end
ihe Exclusions from Coverage of the form of policy or policies committed for in favor of the proposed Insured which
are hereby incorporated by reference and made a part of this Commitment except as expressly modified herein.
4. Any action or actions or rights of action that tbe proposed Insured may have or may bring against the
Company arising out of the status of the title to the estate or interest or the status of the mortgage thereon covered by
this Commitment must be based on and are subject to the provisions of this Commitment.
STANDARD EXCEPTIONS
Exceptions I through 5, of Schedule B-2 on the reverse side hereof, are as follows:
l. RighS or claims of parties in possession not sbown by the public records.
2. Easements, or claims of easements, not shown by the public records.
3. Discrepancies, conflicts in boundary lines, shortage in area, encroachments, and any facts which a correct
survey and inspection of the premises would disclose and which are not shown by the pubUc records.
4. Any lien, or right to a lien, for services, labor or materid theretofore or hereafter furnished, imposed by law
and not shown by the public .records.
5. Defects, liens, encumbrances, adverse claims or other matters, if any, created, first appearing in the public
records or attaching subsequent to the effective date hereof but prior to the date the proposed insured
acquires of record for value the estate or interest or mortgage thereon covered by this Commitment.

Mountain Bell is a public utility subject to regulation by the Colorado
Pub1ic Utilitles Corrnission and the FederaL Connrunications Corrnission.
Telephone facilities have been extended to this address. Extension of
our plant into this site depends upon numerous factors, such as our capltal
requirements and ability to raise capital. This wouLd also depend on the
availabiliEy of manpower and supplies, potential use of the facilities, and

The following lerms when used in this policy mern:
(a) "insured": the insured named in Schedul€ A, and, subject
to any rights or defens€s lhe Company may have had against the
named insuied, thos€ who succeed to the interest of such insured by
operation of law as dislinguished from purchase including, but notlimited to, heirs, distributees, devisees, survivors, personal
representalives, next of kin, or cotporate or fiduciary successors.

STIPULATIONS
2. Continuation ol Insuranca 8ft€r Conveyance of Title
The coverage of this policy shall conainue in force as of Date of
Policy in favor of an insuled so long as such ins,ured retains an estateor interest in lhe land, oa holds an indebledness secured by a
puachase money mortgage given by a purchaser fronl such insured,
or so long as such insured shall have liability by reason of covenants
of wartanty made by such insured in any transfer or conveyance oI
such estate or interesl; provided, however, this policy shall n()t
continue in fo.ce in favor of any purchaser from such insured of
either said estate or interest or the indebtedness secured by a
purchas€ money modgage given to such insu.ed.
3, Delense and Prosocution ot Actions - Notice ot Claim to be
given by an Insured Claim.nt
(a) The Compsny, at its own cosl and without undue delay,
shall provide for the defense of an insured in all litig!tion consisting
of actions or proceedings commenced againsl such insured, or a
defense interposed against an insured in an action to enforce a
contract for a s!le of the estate or interesl in said land, lo lhe extent
that such litigalion is founded upon an !lleged defect, lien'
cncumbrance, or other matter insured against by this policy.
(b) The insured shall notify the Company promptly in writing
(i) in case any aclion or proceeding is begun or defense is interposed
as s€t forth in (a) above, (ii) in case knowledge shlll come to an
insuied hereunder of any claim of title or interest which is advcrse
to the title to the eslate or inter€st, as insuied, and which mighl
cause loss or damage for which the Company may be liable by
virtu€ of this policy, or (iii) if title to the estate or intelest, as
insured, is rejected rs unmatkelable. lf such prompl notice shall

of the Company shall cease and terminate in regard to the malter or
matters fo. wbich such p.ompt notice is required: provided, how-
ever, that failure to notify sh8ll in no case prejudice the rights of
any such insured under this policy unless the Company shall be
prejudiced by such failure and then only to the extent of such
prejudice.
(c) The Company shall have the right al its own cost to
instilule and without undue delay prosecute sny action or
proceeding or to do any other act which iD its opinion may be
necessary or desirable to establish the title to the estate or interesl
as insured, a'nil the Company may lake any appropriale action under
the terms of lhis policy, whether or not it shall be liable thereunder,
irnd shall nol thereby concede liability or waive any provision of this
po licy.
(d) Wheneyer the Company shall have brought any aclion or
interposed a defense as required or permilted by the provisions of
this policy, the Company may pursue any such litiSation to final
determination by a court of competent jurisdiclion and expressly
rcserves the right, in ils sole discrelion, to appeal from any adyerse
judgment or order.
(e) In all cases where this policy permits or requires the
Company lo prosecule oa provide for the defense of any action or
proceeding, the insured hercunder shall secure to thc Company the
right to so prosecute or provide defe[se in such action or
proceeding, and all appeals lherein. and permit the Company lo use,
at its option, the name of such insured for such purpose. Whenevet
requested by the Company, such insured shall give the Company 8ll
reasonable aid in any such action or proceeding, iii effecting
settlement, securiog evidence, obtaining witnesses, or plosecuting or
defending such aclion or proceeding, and the Company shall
reimburse such insured for any expense so incurred.
4. Notice of Loss - Limiiation ot Action
ln addition to the notices required under paragraph 3(b) of these
condilions and Stipulations, a slatemenl in writing of any loss or
damage for \,r'hich it is claimed the Company is liable under this
policy shall be fu.nished to the Company within 90 days aftcr such
loss o! damage shall have been determined and no right of action
shall acque lo an insured claimanl unlil 30 days after such
statement shall have been furnished. Failure to furnish such
strtement of loss or damage shall terminate any liability of the
Company under lhis policy as to such loss or damage-
5. Options to Pay or Othorwir€ Ssttlo Claims
The Company shall h.ve lhe option to pry ot othcrwise settle
for or in the name of an insured claimanl any claim insured against
or to te.minate all liability and obligations of the Company
he.eunder by paying or tendedng payment of the amounl of
insurance under this policy togelher with sny costs, aitorneys'feeg
and expenses incurred up to the lin€ of such payment or tender of
payment, by the insured claimant and authorized by the Company.
6, Determination and Payrnenl ot Lost
(a) The liability of the Compary under this policy shall in no
case exceed the least of:
(i) the .ctual loss of the insured claimant; or
(ii) the amounl of insurance staled in Schedule A; or
(b)The Company will pay, in sdditior to any loss insured
against by this policy, all cosls imposed upon an insured in litigation
carried on by the Company for such insured, and all costs,
aItorneys' fees and expenses in litigation carried on by such insured
with the written autho.ization of the Company.
(c) When liabi.lity has been definitely fixed in accordance
with the condirions of this policy, the loss or damag€ shall be
payable within 30 days thereafler,
7. Limitation of Liability
No claim shall arise or be mainaainable under this policy (a) if
the Company, after having received notice of an alleged defect, lien
or encumbrance insured agaitrst hereunder, by liaigation o!
utherwise, removes such defect, lien or encumb.ance or establishes
the title, as insured, within a teasonable time after receipt of such
rrotice; (b) in ahe event of litigation until there has been a final
detcrmination by a court of competent jurisdiction, and dispositjon
ol all appeals therefrom, adverse to th€ title, as insured, as provided
in paragraph 3 hereof; or (c) for liability voluntarily assumed by an
insured in settling any claim or suit without prior writlen consent of
rhc Company.
8. Roduction ol Liability
All payments under this policy, except payments made for cosls,
attorneys' fees and- expenses, shall reduce the amount of the
insurance pro tanto. No payment shall be made without producing
this policy for endorsement of such payment unless the policy be
lost or desroyed, in which case proof of such loss or deslruction
shall be fu.nished to the satisfaction of the Company.
9. Lisbiliw Noncumulativo
It is expressly underslood that the amounl of insurance under
this policy shall be reduced by any amount the Company may pry
under any policy insuring either (s) a mortgage shown or referred to
in Schedule B hereof which is a lien on the estate or interest covered
by this policy, or (b) a mortgage hereafter executed by an insured
which is a chsrSe or lien on the estate or interest described or
refered to in Schedule A, and the amount so paid shall be deemed a
payment under this policy, The Company shall have the option to
apply to the payment of any such mortgages any amount that
otherwise would be payable hereunder to lhe insuted owner of the
eslate or inlerest covered by this policy and the amount so paid
shall be deemed a payment under this policy to said insured owner,

11, Sub.ogstion Upon Paymont or Sottlomsnt
Whenever lhe Company shall have s€ttled a claim under this
policy, all right of subrogstion shall vesl in the Company unaffected
by any act of lhc insured claimant. The Company shall be
subrogated to and be entitled to all lights rnd remedies which such
insured claimant would have had against any pe.son or property in
respect to such claim had this policy not been issued, and if
requested by the Company, such insured clEimant sh8ll transfer to
the Company rll rights and remedies against any pe6on or property
necessary in order to perfect such right of subrogation and shall
permit lhe Company to use the name of such insured claiman! in
any transaclion or liligation involving such riShts or remedies, If the
payment does nol cover the loss of such insured claimant, the
Company shsll be subrogaled to such righls and remedies in the
proporlion which said paymenl bears to the amount of said loss. If
loss should result f.om any acl of such insured claimant, such acl
sh|ll not void lhis policy, but the Company, in that evenl, shall be
required to pay only that part of any losses insured against
hereunder which shsll exceed the amount, if any, Iost lo the
Company by reason of the impairment of the right of subrogation.
12, Liability Limitod to this Policy
