1. If the utility approval & verification form has signatures from each of the uulity companies, and no comments are made directly
on the form, or no action is taken within 2 weeks of the Utinfy's receipt of the form without explaination the Town will presume
that there are no problems and the development can proceed'
2. If a utility company has concerns with the proposed construction, the uUlity representative shall note directly on the utility
verification form that there is a problem which needs to be resolved. The issue should then be detailed in an attached letter to the
Town of Vail. However, please keep in mind that it is the responsibility of the utility company and the applicant to resolve
identified problems.
3. These verificatjons do not relieve the contactor of the responsibility to obtain a Public Way Permit from the Department of
public Works at the Town of Vail. Utiliw locations must b€ obtained before diooino in any public right-of-way or easement
within the Town of Vail. A buildinq permit is not a Publac Way permit and must be obtained seDarately.

The Town of Vail Staff has reviewed the design review application for the proposed landscaping
project at 1797 Alpine Drive. The following is a summary of the Planning and Public Works
Department's comments from this preliminary review:
1. Submit written approval from all utility companies'
2. Submit written approval from the owner of Lot 44 for all plantings on their property.
3. Show the limits of disturbance fencing on the landscape plan'
4. Submit a construction staging plan.
5. Submit cut sheets for the proposed fire pit.
6. A Revocable Right-of-Way Permit is required for all existing and proposed improvements
within the Alpine Drive right-of-way.
7. A Public Way Permit is required prior to any construction.

Dear Mike:
At your request, on August 19, 2005, we visited the construction site on Lot 40. Vail
village west Filing No. 1, 1797 Alpine Drive, Town of Vail, Eagle county, colorado. The
purpose ofour site visit was to observe the soils exposed in the foundation excavation and
compare them with the findings and recommendations of the Soil and Foundation lnvestigation
Report, under the same project number, dated January 4,2005.
The excavation consisted ofone large bench at the bottom and three smaller benches
stepping up into the lot. The excavation cuts, varied from about 4 feet on the north side to about
8 feet on the south side. The foundation excavation was below Alpine Drive. The soil exposed in
the foundation excavation, was consistent with the findings and recommendations of the above-
named soil's report. It consisted of brown, silty-gravelly sand with cobbles. The soil exposed in
thefoundation excavation is suitablefor the recommended bearing capacity of 1500 psf.
We recommend compliance with the recommendations of the above-named soil report
during the remainder of the construction, specifically with the sections on drainase. qrading and
irrieation.

SCOPE OX'STTJDY
This report presents the results ofa subsurface Soil and Foundation lnvestigation for a
proposed residence to be constructed on Lot 40, vail village west, Filing l, at 1797 Alpine
Drive, Town of Vail, Eagle County, Colorado. The purpose of the subsr.rface soil and foundation
investigation was to detennine the engineering characteristics ofthe foundation soil and to
provide recommendations for the foundation design, grading, and drainage. Geologic hazard
studies are outside of our scope of services.
SITE DESCRIPTION
Lot 40 is ar1797 Alpine Drive in the Town of Vail, Eagle County, Colorado. The lot is
on t}e north side of the road, which is the downhill side. It has steep topography. Vegetation on
the lot consisted of pines and aspens. Drainage is to the north and northwest. Lot 4l (north) had a

residence and lots 39 (easQ & 44 (west) were vacant. Lot 40 is vacant.
PROPOSED CONSTRUCTION
We understand that the proposed residence will consist of two stories, wood fiame
construction with a walkout basement, on a concrete foundation. We anticipate loads to be light,
typical of residential construction.
If the finalized plans differ sigrrificantly from the above understanding, they should notifr
us to reevaluate the recommendations of this report.
F'IELD IIWESTIGATION
The field investigation conducted on November 8,2004, consisted of excavating, logging
and sampling one test pit. Excavation of the test pit was done with a Scat-Trak 2345, mini
trackhoe. The test pit location is shown on Drawing No. l. We show the soil profile of the test
pit on the Subsurface Exploration Log, Figure No. 1. Soil samples for laboratory soil analysis
and observation were taken at selected intervals.
STJBSTJRFACE SOIL AND GROTJIIDWATER CONDITION
The soil profile encountered in the test pit was as follows: Test Pit No. I had two feet of
topsoil over tlree feet of light brown, silty, gravelly sand with cobbles. Ground water was not
encountered in the test pit.
We sampled the soil in the test pit at random intervals. The soil samples were tested in
our laboratory for grain size distribution and natural moisture content.

I'OIJNDATION RECOMMENDATIONS
The proposed residence should be supported with conventional type spread footings,
designed for a maximum allowable soil bearing pressure of 1500 psf. The footings should be
constructed on the undisturbed silty, gravelly sand with cobbles. Ground water was not
encountered in the test pit at the time of our site visit. We recommend minimum width of 16
inches for the continuous footings and2 feetfor the isolated footing pads. Continuous
foundation walls should be reinforced top and bottom to span an unsupported length ofat least
l0 feet.
We recommend a minimum of 48 inches of backfill cover for frost protection of the
footing subsoils. The foundation excovation should be observed by the undersigned engineer to
verify that the soil conditions encountered during construction are as anticipated in this report.
The foundation excavation should be free from excavation spoils, frost, organics and standing
water. We recommend proof-rolling of the foundation excavation. Soft spots detected during
the proof-rolling, should be removed by overexcavation. Any overexcavation within the
proposed foundation, should be backfilled, in 8 inches loose level lifu and compacted to 100%
of the maximum dry density and within 2 percent of the optimum moisture content as
determined in a laboratory from a Standard Proctor test (ASTM D-698). A structural fill, placed
under footings should be tested by the engineer or her representatives on regular basis.
SLAB CONSTRUCTION
The natural on-site soils, exclusive oftopsoil and organics, are suitable to support lightly
loaded slab-on-grade construction. The subgrade for the slab-on-grade construction should be
proofcompacted to detect and remove soft spots. They should backfill overexcavated soft spots
and other underslab fill with the on-site soil, free from topsoil and organics, or other suitable
material, compacted to a minimum of 95 percent of the maximum standard proctor density
(ASTM D-698). Suitable material should be free from topsoil, organics and rock fragments

greater than 3 inches.
The concrete slab should be constructed over a 4-inch layer ofclean gravel consisting of-
3/4 inch gravel with at least 50% retained on the No. 4 sieve and less than 3 percent passing the
No. 200 sieve.
They should reinforce the concrete slab-on-grade and score controljoints according to the
American Concrete Institute requirements and per the recommendations of the designer to reduce
damage due to sbrinkage. The concrete slab should be separated from the foundation walls and
columns with expansion joints to allow for independent movement without causing damage.
RETAININGWALLS
Foundation walls retaining earth and retaining stuctures that are laterally supported
should be designed to resist an equivalent fluid density of60 pcffor an "at-rest" condition.
Laterally unrestrained structures, retaining the on-site earth, should be designed to resist an
equivalent fluid density of40 pcf for the "active" case.
The above design recommendations assume drained backfill conditions and a horizontal
backfill surface. Surcharge loading due to adjacent structures, weight oftemporary stored
constnrction materials and equipment, inclined backfill and hydrostatic pressure due to
undrained backfill should be incorporated in the desiga. They should bry to prevent the buildup
ofhydrostatic pressure behind the retaining wall.
UI{DERDRAIN SYSTEM
To reduce the risk of surface water infiltrating the fourdation subsoil, we recommend
installation of a foundation perimeter drain (see Figure No. 2). The foundation perimeter drain
should consist of a 4-inch diameter, perforated pipe, sloped to a suitable gavity outlet, or to a
sump pump location, at" a ll4 inch per foot for flexible or at a l/8 of an inch for rigid pipe. The
drain pipe should be covered with a minimum of 6 inches of -3l4-inch free-draining granular

material' Geotextile (Mimfi l40N or equivalent) should be used to cover the free-draining gravel
to prevent siltation and clogging ofthe drain. The backfill above the drain should be granular
material to within 2 feet of the ground surface to prevent a buildup of hydrostatic pressure.
SITE GRADING AND DRAINAGE
The following recommendations are general. Exterior backfill should be compacted at or
near the optimum moisture content to at least 95Yo of themaximum standard proctor density
under pavement, sidewalk and patio areas and to at least 90% of the maximum standard proctor
density under landscaped areas. They should use mechanical methods ofcompaction. Do not
puddle the foundation excavation.
The site surrounding the building structure should slope away from the building in all
directions. A minimum of 12 inches in the first l0 feet is recommended in unpaved areas, and
three inches in the first 10 feet in paved areas. The top ofthe granular foundation backfill
should be covered with a minimum of I foot of relatively impervious fill to reduce the potential
of surface water infiltrating the foundation subsoils.
Surface water naturally draining toward the proposed building site should be diverted
around and away from it by means of drainage swales or other approved methods. The roof
drains and downspouts should extend and discharge beyond the limits of the backfill.
LAWNIRRIGATION
It is not recommended to introduce excess water to the foundation soils by installing
sprinkler systems next to the building. The installation of the sprinkler heads should insure that
the spray from the heads will not fall within l0 feet of foundation walls, porches or patio slabs.
Lawn irrigation must be controlled.

This report has been prepared according to locally accepted Professional Geotechnical
Engineering standards for similar methods of testing and soil conditions at this time. There is no
other warranty either expressed or implied.
The findings and recommendations of this report are based on field exploration,
laboratory testing of samples obtained at the specific locations shown on the Location Sketch,
Drawing No.l and on assumptions stated in the report. Soil conditions at other locations may
vary, which may not become evident until the foundation excavation is completed. If soil or
water conditions seem different from those described in this report we should be contacted
immediately to reevaluate the recommendations of this report.
This report has been prepared for the exclusive use of Mr. Mike Dantas, Dantas Builders
for the specific application to the proposed residence on Lot 40, Vail Village West, Filing l,
Town of Vail, Eagle County, Colorado.

FOR PREVENTING NON.ETERGENCY FIRE AI-ARMS
ln order to prevent a no*emergency response from the Vail Fire Department
Suppression crews to the construction location you may be working on we
ask that you perform the following tasks:
Determine what kind of fire alarm system exists within the structure you
are working in with the owner or the manager of the property involved or
by contracting the Vail Fire Department.
Determine with the owner or manager of the property, which alarm
company services the system for them.
Become familiar with the difierent components that are associated with
the fire alarm system and how they operate before the DEMO begins.
Never paint a smoke detector, thermal detector, or any other component
of the fire alarm system, and never paint a sprinkler head.
For small projects bag detector within the area you will be working in
before you start, and remove the bags after work is done for the day.
For larger projects, please contact the Vail Fire Department so that we
can work with you in determining what needs to be done to alter or "Zone
Out" specific areas of the alarm system for the structure.
Please contact the Town of Vail Fire Marshal, Mike McGee at 479-2135 or the
Town of Vail Fire Prevention Officer, Mike Vaughn at 479-2462.

Amendment to the 1999 N.E.C. Town of Vail Ordinance 10-1-6.
o Overhead services are not allowed in the Town of Vail.
s Underground services have to be in conduit (PVC) from the transformer to the electric meter, main disconnect

switch and to the first electrical distribution circuit breaker panel.
The main disconnect switch shall be located next to the meter on the exterior wall of the structure easilv
accessible.
All underground conduits are required to be inspected before back-filling the trench.
In multi-family dwelling units, no electrical wiring or feeder cables shall pass from one unit to another. Common
walls and spaces are accepted.
NM Cable (Romex) is not allowed in commercial buildings or structures exceeding three (3) stories.
No use of aluminum wire smaller than size #8 will be permitted with the Town of Vail.
TOWN OF VAIL ELECTRICAL PERMIT GUIDELINES
All installations of exterior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
If this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30" above grade, you must also obtain a building permit.
If this permit is for installation of an exterior hot tub or spa on any existing deck or elevated platform,
a structural engineer must review the existing condition and verif,/ that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
If this is a remodel in a multi-family building with a homeowners association, a letter of permission
from the association is required.
o If this permit is for a commercial space, two (2) sets of stamped drawings are required.

I The Town of Vail has adopted the 2003 Intemational Mechanical Code and the 2OO3 International
Fuel Gas Code.
o All new construction within the Town of Vail is considered to be of unusually tight construction,
thus all combustion air is rcquired to be drawn from outside the structure for mechanical
equipmenl
Town of Vait Fireotace Ordinance
In September of 1991, the Vail Town Council adopted an ordinance which rcstuicts te consffuction and
use of open hearth fircplaces within municipal boundaries. Since that time the ordinance has
undergone numerous changes and rerisions, striving for compromise, yet effectiveness in addressing
the air quality issue. Therefore the following criteria has been adopted:
r Construction of open hearth wood burning fireplaces is no longer permitted within Town of Vail
municipal boundaries.
o Dwellino Units - Each new dwelling unit may aontain:
One (1) EPA Phase II certified solid fuel burning device and no morc t{ran turo (2) gas appliances
(B vent)
OR
Two (2) gas log fireplaces and no morc than hro (2) gas appliance fireplaces (B bent).
r Restricted Dwellina Units - Each new rcstricted dwelling unit may contain:
One (1) gas Iog fircplace and not more than one (1) gas appliance fireplace.
Accommodation Units - Each new accommodation unit may contain:
One (1) gas log fireplace or one (1) gas appliance fireplace.
If two or mone separate dwelling units or accommodation units arc combined to form one lalger
unit" the combined unit may retaan one woodburning fircplace (if one already exists) and no more
than 2 gas appliance fireplaces, or may @nvert up to two existing fireplaces to gas.
If during the course of a rcmodel an existing woodburning fireplace is altered or moved, the unit
must then comply with all provisions of the ordinance. That is, the fireplace must be convefted to
natural gas or replaced by an EPA Phase II certified unit.

A). Reduced copies of the proposed site plan and elevations are attached for reference
(attachment B) as is the written request from the applicant (attachment C) and the public
notice which preceded the request (attachment D).
BACKGROUND
On June 15, 2005, the Design Review Board unanimously approved a new single family
residence at 1797 Alpine Drive, which is a cunently vacant lot. The proposal included the
placement of a garage within the front setback. The applicant is requesting a variance to
locate Gross Residential Floor Area within the front setback on the lower level. The lot is
zoned Primary/Secondary Two-Family Residential, in which district a reduction in allowable
site coverage is placed upon any lot which has an average slope beneath
(30%). The existing lotsize

result in a stricter site coverage regulation and the desire to keep site disturbance at a
minimum by utililng living space within a building footprintthatwould remain equally-sized at

3. The effect of the requested variance on light and air, distribution of population,
transportation and traffic facilities, public facilities and utilities, and public safety.
4. Such other factors and criteria as the Commission deems applicable to the proposed
variance.
Desion Review Board:
Action: The DRB has no review authority on a variance, but must review any accompanying
DRB application.
Town Council:
Actions of the Design Review Board orthe Planning and Environmental Commission may be
appealed to the Town Council or by the Town Council. Town Council evaluates whether or

not the DRB or PEC ened with approvals or denials, and may uphold, uphold with
modifications, or overtum the Board's decision.
Staff:
The staff is responsible forensuring that all submittral requirements are provided and plans
conform to the technical requirements of the Zoning Regulations. The staff also advises the
applicant as to compliance with the design guidelines.
Staff provides a staff memo containing background on the property and provides a staff
evaluation of the project with respect to the required criteria and findings, and a
recommendation on approval, approval with conditions, or denial. Staff also facilitates the
review process.

and unnecessary physical hardships ihconsisfenf with the objectives of this title as would
result ftom strict or literal interpretation and enforcement, variances from ceftain regulations
may be granted. A practical diffrculty or unnecessary physical hardship may result from the
size, shape, or dimensions of a site or the location of existing strucfures thereon; from
topographic or physical conditions on fhe sife or in the immediate vicinity; or ftom other
physical limitations, street locations or conditions in the immediate vicinity. Cosf or
inconvenience to the applicant of strict or literal compliance with a
regulation shall not be a reason for granting a variance.

Within twenty (20) days of the ctosing of a pubtic hearing on a variance application, the
planning and environmental commission shall act on the application. The commission may

the commission may deny the application. A variance may be revocable, may be granted for
a limited time period, or may be granted subject to such other conditions as the commission
may prescribe.

Approval of the variance shall lapse and become void ff a building permit is not obtained and
construction not commenced and diligently pursued toward completion within two (2) years
from when the approval becomes final.

The purpose of this Chapter is to help protect the inhabitants of the Town from dangers
relating to development of flood plains, avalanche paths, sfeep s/opes and geologically
sensitrVe areas; to regulate fDe use of land areas which may be subject to flooding and
avalanche or which may be geologically sensitive; and fufther to regulate development on
sfeep s/opes; to protect the economic and property values of the Town, to protect the
aesthetic and recreational values and natural resources of the Town, which are sometimes
associated with flood plains, avalanche areas and areas of geological sensitivity arid slopes;
to minimize damage to public facilities and utilities and minimize the need for relief in cleanup
operations; to give notice to the public of certain areas within the Town where flood plains,

CRITERIAAND FINDINGS
A. Consideration of Factors Reoardino the Setback and Parkinq Location Variances:
1. The relationship of the requested variances to other existing or
potential uses and structures in the viclnlty.
This lot is located in a neighborhood of lots which sizes generally fall below
10,000 square feet. Additionally, many of the lots within the neighborhood
include areas of excessive slope (greaterthan 30%). Several lots within the
general vicinity of Lot 40 have been granted similar variances due to their
location on steep slopes. Recently, the Scolnick residence, located nearby
on a lot with excessive slopes at 2935 Basingdale recqived approval from the

ln instances when variances have not been applied for and/or granted, many
residences on lots such as this have been designed using 4pientype.f,

areas where piers would generally be utilized is a sensible altemative when
available site coverage is a concem. Should the proposed variance request
be approved, the house could be built olffiglftffg6ghligpatherthan using
a piLi system and thereby utilize a s!-aFffiih-ffiiitiready approvei
building footprint, which would othenrise be unusable.
The degree to which relief from the strlct and literal Interpretation and
enforcement of a specified regulatlon is necessary to achieve
compatiblllty and uniformity of treatment among sites in the vicinlty or
to attaln the obiectives of thls title without a grant of special privilege.
Because the garage would be constucted within the front setback regardless
of this variance request, the visual aspects of locating GRFA beneath the
garage are minimal, since the proposed square footage is mostly below
grade. By building part of the house below the garage, the site disturbance

elsewhere on the lot will be minimized, whether that site disturbance would
result from a more complex form of construction (as in a pier-type support
system) or from the actual relocation of 374 square feet of floor area
resulting in additional site coverage elsewhere. In sum, Staff believes that
the granting of this variance will not be a grant of special privilege. lt should
be noted that the applicant's proposal to locate GRFA within the front
setbacks includes no encroachment into the westem side setback near the
master bedroom.
3. The effect of the requested variance on light and alr, distribution of
population, transportation and traffic facilities, public facilities and
utilities, and public safety.
Theproposal will havelittle,ifany,effectontheseissues. Theproposal will,
however, allow the bulk and mass of the structure on site to remain
unchanged.
4. Such otherfactors and criteria as the commission deems applicable to
the proposed variance,
The Plannino and Environmental Commission shall make the followinq findinos
before orantino a variance:
1. That the granting of the variance will not constitute a grant of special
privilege inconsistent with the limitations on other properties
classified in the same district.
2. That the granting of the variance will not be detrimental to the public
health, safety or welfare, or materially injurious to properties or
improvements in the vicinity.
3. That the variance is warranted for one or more of the following
reasons:
a. The strict literal interpretation or enforcement of the specified
regulation would result in practical difficulg or unnecessary
physical hardship inconsistentwith the objectives of this title.
b. There are exceptions or extraordinary circumstances or
conditions applicable to the same site of the variance thatdo
not apply generally to other properties in the same zone.
c. The strict interpretation or enforcement of the specified
regulation would deprive the applicant of privileges enjoyed by
the owners of other properties in the same district.
STAFF RECOMMENDATION
The Community Development Department recommends approval of the request for a
variance from Section 12-6D6, Setbacks, Vail Town Code, pursuant to Chapter 12-17,
Variances, to allow for the construction of gross residential floor area within the front setback
located at 1797 Alpine Drive/Lot 40, Vail Village West 1s' Filing, and setting forth details in

regard thereto. This recommendation is based upon the review of the criteria in Section Vlll
of this memorandum and the evidence and testimony presented.
Should the Planning and Environmental Commission choose to approve this variance
request, the Community Development Department recommends the Commission pass the
following motlon:
"The Planning and Environmental Commissbn apprcves the applicant's request for a
variance, pursuant to Chapter 12- 17, Variances, Vail Town Code, from Section 12-
6D-6, Sefbackst, Vail Town Code, to allow for the construction of gross residential
floor area within the ftont setback located at 1797 Alpine Drive/Lot 40, Vail Village
West ls Filing, and sefting forth details in regard thereto.
Should the Planning and Environmental Commission choose to approve this variance
request, the Community Development Department recommends the Gommission makes
the following findings:

Thank you for attending the Design Review Board hearing of a final review of Lot 40 this past Wednesday. The
Board's comments can be summed up as follows:
D The roof line at the North elevation might be enhanced if it is made simpler. Please consider an
alternative that avoids the lowering of that roof form, in spite of the fact that its current location has been
dictated by the thirty three feet (33') height restriction. lt seems this problem was largely solved in lhe
course of yesterday's meeting between you, George, Dave, Mike and me.
) Please submit a model or rendered elevations that clearly communicate the shade, shadow, and
coloring of the residence, particularly the roof forms, which the Board felt should be more simplistic.
The type of submitted form or drawing is secondary to the concise communication of the roof forms, in
the Board's opinion.
Othenvise, the Board had no particular comments regarding the style of the home, the exterior materials or the

Thank you for submitting plans for a new residence at 1797 Alpine Drive. Currently, the application is
scheduled for final review by the Design Review Board on Wednesday, June 16 at 3pm. Before that date,
however, the following information must be submitted for review by Staff:
