Thousands of people come to Vail each year to sightsee, recreate, shop and to enjoy everything the Vail Valley has to offer. The community and merchants rely upon our guest to generate revenue. Our summer/winter guests expect a pleasant experience wtrile in Vail. To insure that all of the proposed construction has as liftle negative impact on the community and on our guest as possible, the Town of Vail finds it imperative to create and implement the Vail Village and Lionshead Mllage Constuction Hours Handout. It would be inesponsible for the Town of Vail, the Construction Contractors and the Merchants, to not actively participate to minimize the impact of construction in the Vail and Lionshead Village areas. New for 2004-2006 will be the Vail Village Streetscape lmprovement Project. Work to include all utility related improvements, streetscape, drainage, snowmelt systems and landscaping. All Construction projects and/or remodels within the Vail Village Core Area should contact Scott Bluhm Town of Vaif Streetscape Coordinator at970477-3418 for further information. Givens The following givens are intended to provide the basic foundation by which construction will be completed in the Mllages: . The public's health, safety and welfare shall be honored at all times. o Adequate pedestrian, loading/delivery, vehicle, and emergency vehicle access and circulation shall be maintained. . Roadways and pedestrian walkways shall be kept clean and free of dirt and debris. r All construction deliveries, equipment, tools and materials entering the Vail Village and Pedestrian areas must go through Check Point Charlie. All Lionshead construction activity must go to the Vail Police Department for a parking permit. Do not use delivery zones for construction parking, refer to approved staging plan or make other anangements for parking. . The hours of Outside Construction Activity shall be as follows: - April 15-June 18&SeptemberT- November 19,7a.m. until 7 p.m., sevendaysaweek. June 18 thru September 10, work must end by 4:00 p.m. on Fridays. Upon review of the application, and the evidence and testimony presented at the hearing, the, Commission voted 6-0-0 to voting against the the variance request. In v. More -spedfically, the Commission found neither the presence of a 2O-foot wide utility easement along the rearof the property, the impacts of the S0-foot Gore Creek stream setback, northe size, configuration, or orientation of the lot was a physical hardship or practical difficulty that necessitated relief from the strict and literal enforcement of the front setback regulations. A copy of the staff memorandum to the Planning & Environmental Commission dated November 28, 2005 and a copy of the approved meeting minutes have been attached for reference (Attachment A). DESCRIPTION OF REQUEST AND BACKGROUND The applicant is requesting a setback variance in order to extend a deck from an existing residence into the twenty foot (20') front setback by a distance of eleven feet (11'). The proposed extension would result in a front setback of nine L eJ ![g)_]hereb total proposed area of deck encroachme he residence was constructed in 1999 under Town of Vail jurisdiction and consists of one dwelling unit with one attached Type I EHU. Other than remodels and regular maintenance, this home has not been altered from its original construction. lf approved, the applicant's proposal would provide an outdoor covered parking spa@, similar to a carport, for the tenant(s) of the EHU. This space would be in addition to the three covered parking spaces constructed atthe time thatthe house was built, one of which was designated as an Employee Housing parking space, per Section 12-13-4 (Requirements by Employee Housing Unit [EHU] type, Vail Town Code). The applicant's residence recently suffered damage due to a fire. The current proposal, therefore, is a portion of his efforts to reconstruct and repair the front of the residence. The existing lot is non-conforming in regard to minimum lot size within the Primary/Seoondary District, as the lot area totals just less than 13,000 square feet' The minimum lot size within the Primary/Secondary district is 14,000 square feet. This property is in conformance with the density requirements allowing one dwelling unit due to the fact that the Employee Housing Unit (EHU) is not included in the Town's density calculations according to the Town of Vail Zoning Regulations (Secfbn 12 -6D-8C, Vail Town Code). The relationship of the requested variance to other existing or potential uses and structures in the vicinity. 2. The degree to which relief from the strict or literal interpretation and enforcement of a specified regulation is necessary to achieve compatibility and uniformity of treatment among sites in the vicinity, or to attain the objectives of this Title without grant of special privilgge. 3. The effect of the requested variance on light and air, distribution of population, transportation and traffic facilities, public facilities and utilities, and public safety. 4. Such other factors and criteria as the Commission deems applicable to the proposed variance. Desion Review Board: Action: The DRB has no review authority on a variance, but must review any accompanying DRB application. This lot is located in a neighborhood with many smaller lots than the minimum lot size requirement within the Primary/Secondary district of 14,000 square feet. Additionally, several homes in the neighborhood were approved or constructed with variances allowing encroachments into the setbacks, as previously stated in Section ll of this memorandum. The variances were granted for reasons ranging from "awkwardly-shaped" lots to easement locations and small lot sizes. However, in spite of the frequency with which variances have been granted in this neighborhood, Staff believes that the requested setback variance has the potential to negatively impact other existing or potential uses and structures in the vicinityfufhis extension may have a negative impact on the otherexisting or potential uses and structures in the vicinity by limiting the amount of light and air available to such uses and structures, while creating a lesser quality experience for the passerby on West Gore Creek Drive. The degree to whlch relief from the strict and literal interpretation and enforcement of a specified regulation ls necessary to achleve compatibility and unlformity of treatment among sites In the vicinlty or to attaln the objectives of this title without a grant of special privllege. Staff believes the granting of this variance request may be a grant of special privilege in spite of the fact that other properties in the vicinity have been granted setback variances for similar situations. Though approximately twenty nine percent (29%) of the lot is unable to be developed due to existing site constraints, Staff believes that the cunent request could likely have been avoided t the time of construction. Additionally, the previous owner had already fulfilled the provision of an enclosed parking space for the EHU making the cunent 5 1. 2. request unable to be justifiable for that reason. The extended deck design cunently undergoing review does not require relief from the strict and literal' interpretation without a grant of special privilege. 3. The proposal may have a negative effect on the elements of this criterion. By increasing the amount of bulk and mass within the front setback, the applicant is affecting the amount of light and air avaihbb to the local and passing public. OB GYN physicians b. Proximity to WMC-emergency response: we moved to Vail from Edwards after our first winter because of response time from Edwards. Fire of July 13,2005: a. Additional means of egress: Wind was from lV. to E.; tenant had difficult escape down main stairwell due to location of fire. Had the fire not been detected when it was this would not have been a safe egress. The only other egress is a bedroom window which is a 15 foot drop to the driveway. b. Extension of deck would remove object such as grills from under the soffit and away from house,lessening the risk of fire to house. c. In order to rebuild the deck, the ceilings of two of the three garage bays need to be demolished. This is necessary in order to cantellever deck joists back into the garage to provide the support necessary to bring the deck back to its original design. The gar,age was not damaged by the fire nor the water used to extinguish the fire. It is our opinion that it makes no sense to loose use of our garage for an unknown period of time especially in this climate! We are OB GYN physicians whose cars need to be ready at all times. We can not afford to risk a delayed response in a true emergency. 1. 2. 3. You do not see fire trucks & ambulances parked outside overnight in this weather. 4. The PEC Variance: b. House is placed at the front 20 foot front setback due to the following constraints: 100 hundred year flood plain setback. Sewer utility setback rule. Lateral side yard setback of 15 feet & the Gore Creek. This makes approximately l/3 of the lot unavailable for development. Therein lies the hardship. Based on the successful variance application for the Bassett property granted October 2/ln,2OO5 by the PEC, we used the same logic and reasoning for our variance. Unfortunately, the PEC did not follow their precedent as they did for the Bassett property based on the above reasoning and denied our application. They wrongly concluded that we were seeking another covered parking area rather than improving the safety of our home. As part of our site plan, we were to plant three lO to 12 foot spruce trees and create a retaining wall so that the trees would be at street level. These improvements would soften any effects that the deck might have upon neighbors. We were very optimistic that our variance would pass and we completed the landscaping before winter closed in upon us. One PEC member stated that the deck would be an obstacle to the street. One simply has to travel down West Gore Creek Drive to see all of the man made obstacles that are closer to the street than our deck. To our di$nay, w€ l€arned that our house was already positionod at the 20 foot front selback and that a variance was needed to gncroach upon ths airspace ol the 20 foot setback rule. In order for the varianc€ to be approved hardship had to be d€monstrated. In our application wo argued that th€ hous6 was pushed to the 20 foot lront setback limit due the 100 year flood plain soiback rul€ and th€ 20 loot sotback ior lhe sow€r utility that also passes through our back yard. This creates a hardship du€ to the lsct thal nearly one lhird of th€ lot is unavailabl€ for developmsnt due to th€se constrainls. The reason sitod was that we already had enough parking. PEC failed to follow their preced€nt that they established during another m€€ting on October 24, 2005 in which thoy granted a varisnce to anothor prop€rty owner to the v{est ol our home bas€d on lhe same hardships created by the conslraints ol lhe Gor€ Creek, tho 100 yoar llood plain sstback rule, and the utility easemenl setback rul€. Our only r€@urse al this time is to appeal their decision at ths Town Council m€eting sat for Decembor 20th, 2005. Kate and intend to appeal the decision. The ability to escape from the aparbnent was hindered due to immediate proximity to the exterior combustible siding. The egress stairs run directly above the natural gas meters as well. Extension of the balcony on the south side of the structue (West Gore Creek Drive) would provide additional egress potential. We concur with the need to be readily able to respond. Emergency medical response is well recognized. Being familiar with the layoul it seems unteasonable the existing garage should have to be demolished to repair the balcony. We cannot speak to the depth ofthe proposed balcony, but the concept is valid. We are likewise aware of the variance granted to the other property in the immediate vicinity. Justice should be dispensed equitably. The 100 year flood plain is only the north side of the house. A modification or amendment to the flood plain would not solve the egress problem or mitigate the demolition of the garage. Setbacks firnction for several reasons, one being to prevent fire spread to adjacent structures. The south side ofthe house fronts West Gore Creek Drive and a variance to the 20 foot setback would not create any additional hazard, or diminish the existing degree of safety due to exposure to or from adjacent property. The proposed extension would result in a front setback of nine feet (9'). Therefore the total proposed area of deck encroachment into the front setback would be 276 square feet. The residence was constructed in 1999 under Town of Vail jurisdiction and consists of one dwelling unitwith one attached Type I EHU. Otherthan remodels and regular maintenance, this home has not been altered from its original construction. lf approved, the applicant's proposal would provide an outdoor covered parking space, similar to a carport, for the tenant(s) of the EHU. A.Consideration of Factors Reoardinq the Setback and Parkinq Location Variances: The relatlonship of the requested varlances to other existing or potential uses and structures in the vlclnlty. This lot is located in a neighborhood with many smaller lob than the minimum lot size requirement within the Primary/Secondary district of 1 4,000 square feet. Additionally, several homes in the neighborhood were approved orconstructed with variances allowing encroachments into the setbacks, as previously stated in Section ll of this memorandum. The variances were granted for reasons ranging from "awkwardly-shaped" lots to easement locations and emall lot sizes. However, in spite of the frequency with which variances have been granted in this neighborhood, Staff believes that the requested setback variance has the potential to negatively impact other existing or potential uses and structures in the vicinig byextending the builtenvironmentclosertothe fight- of-way. This extension may have a negative impact on the other existing or potential uses and structures in the vicinity by limiting the amount of light and air available to such uses and structures, while creating a lesser quality experience for the passerby on West Gore Creek Drive. The degrce to which rellef from the etrlct and literal Interpretation and enforcement of a speclfled regulatlon ls necessary to achieve compatlblllty and uniformlty of treatment among sites In the viclnlty or to attaln the objectives of thls title without a grant of special privilege. Staff believes the granting of this variance request may be a grant of special privilege in spite of the fact that other properties in the vicinity have been granted setback variances for similar situations. Though approximately twenty nine percent (29%) of the lot is unable to be deraeloped due to existing site constraints, Staff believes that the curent rcquest could likely have been avoided had the residence been located closerto the steam setback line at thetimeofconstruction. Additionally,thepreviousownerhadalreadyfulfilled the provision of an enclosed parking space for the EHU making the cunent 5 1. 2. o request unable to be justifiable for that reason. The extended deck design cunently undergoing review does not require relief from the strict and literal interpretation without a grant of special privilege. 3. The efiect of the requested variance on light and alr, dlstrlbutlon of populatlon, transportatlon and trafflc facilities, publlc facilitiee and utilities, and public safety. The proposal may have a negative effect on the elements of this criterion. By increasing the amount of bulk and mass within the front setback, the applicant is affecting the amount of light and air available to the local and passing public. Though the applicant has proposed to berm the land ftonting the residance bytwo (2)to three (3)feet and the addition of three (3)bn (10) to twelve (12)footevergreens, Staff does notfeelthatthe screening justifies the lessened quality of light and air that will result from the deck extension. 4. Such other factorc and criteria as the commlsslon deems appllcable to the proposed variance. B. The Plannino and Environmental Commission shall make the followino findinqs before orantino a variance: 1. That the granting of the variance will constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same district. 2. That the granting of the variance will be detimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. 3. That the variance is not wananted for one or more of the following reasons: a. The strict literal interpretation or enforcement of the specified regulation would not result in practical dfficulty or unnecessary physical hardship inconsistent with the objectives of this title. b. There are no exceptions or extraordinary circumstances or conditions applicable to the same site of the variance that do not apply generally to other properties in the same zone. c. The strict interpretation or enforcement of the specified rcgulation would not deprive the applicant of privileges enjoyed by the owners of other properties in the same district. VIII. STAFFRECOMMENDATION The Community Development Department recommends denlal of the request for a variance from Section 12€D€, Setbacks, Vail Town Code, pursuant to Chapter '12-17,Vanances, VailTown Code, to allow for a deck within the setback, located at 1835 West Gore Creek Drive/Lot 20, Vail Village West Filing 2. Based upon the review of the criteria in Section Vll of this memorandum and 6 the evidence and testimony presented as well as the findings listed below, straff recommends that, should the Planning and Environmental Commission choose to denythe application, the following findings be made a part of the motion: 1. That the strict interpretation or enforcement of the specified regulation will not result in practical difficulty or unnecessary physical hardship inconsistent witrt the objectives of the Zoning Regulations. 4. That the strict interpretation or enforcement of the specified regulation will not deprive the applicant of privileges enjoyed by the owners of other properties in the same district. However, should the Planning and Environmental Commission choose to approve the application, Staff suggests that the following conditions be made a part of the motion: 1. The applicant shall submit and receive Design Review Board approval of an application for a minor alteration for the proposed deck extension. 2. Prior to the issuance of a Final Certificate of Occupancy from the Community Development Department, the applicant shall provide thtee (3) twelve foot (12')' evergreen fees according to the site plan to provide adequate screening from the right-of-way. 3. Prior to the issuance of a Final Certificate of Occupancy from the Community Development Department, the applicant shall comply with the Public Works Department requirements for a rerocable rightof.way permit. Furthermore, based upon the review of the criteria in Section Vll of this memorandum and the evidence and testimony presented, stiaff recommends that, should the Planning and Environmential Commission choose lo approvewith conditions the application, the following findings be made a part of the motion: 1. Notice; Abatement: The Director of Public Works may notifr and require any person who violates or qluses another to violate the provision of subsection A hereoi or who has in the Director's employment a person who violates or causes another to violate the same, top remove such san4 gravel, rocks, mud" dirt, snow, ice or any other debris or material within twenty four (24) holrs after receip of said notice by the Director of Public Works. In the event the person so notified does not comply with the notice witlin the period of time herein specified, the Director of Public Works, or other authorized agent, mny cause any such sand" gravel, rocks, mud" dirt, snow, ice, debris or any other material to be removed from any street or alley atthe expense ofthe notified. C. Exceptions: The provisions of subsection A hereof shall not be applicable: l. Within the immediate area of any construction, maintenance or repair project of any street or alley or of any water main, sewer main. electricity line, gas line, telephone line or any appurtenance thereto; 2. To deposits of sand, dirt or materials necessary for the protection of the public safetyl and 3. To public areas designated for ttre dumping or depositing of said materials. D. Summons; Penalty: As an alternative to the notice for removal provided in subsection B above, any person who violates or causes another to violate the same, may be issued a summons to appear before the Municipal Court of the Town for said violations, and upon being found guihy ofa violation hereunder be punished as provided in Section l-4-l ofthis code. E. Notice; Penalty: It is unlawful for any person to fail or refirse to comply with the nqtice of the Director of Public Works as provided in subsection B hereoi and any zuch person shall, in addition to payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B hereof, upon bein! found guilty ofa violation hereunder, be punishable as provided in Section l-4-l ofthis Code. The windows on the east and west elevations "don't fit". Trimwork is needed on the north elevation. The stonework needs changing (i.e. not stopping on exterior corners, eliminate it on west side, etc..) The next DRB meetings are scheduled for March 3' and March l7s. The GRFA must be reduced to3,932 sf. The GRFA of the plans is calculated at 4,080 sf. The main east-west ridge line (elev. 7985') must be reduced to at or below 33'. It is exceeds this, briefly. The front deck may encroach only 5' into the setback. The 100 year floodplain needs to be delineated in accordance with the Public Works comments. No disturbance including sod or fences may occur within the 100 year floodplain. The plans need to indicate a limit of disturbance which will be fenced until grading is completed. Samples of colors and materials will need to be provided at the final DRB meeting.
