The cornnunity Developnent Department and Design Review Board nay grant anexception to allow the addi.tion of a second dwelling unit if the followingcriteria are met :
l. The second unit shall not exceed forty percent of the total GRFA allowed
on the lot; and
2, The comrnun ity Developnent Departnent shall find that the granting ofthe exception will not be detrimental to the public welfare or injuriousto other property in the area in which the subject property is siiuated; and
3. That no variances for setbacks, height, parking, site coverage or landscaping,
site development or gross residential floor area would be approved unlessthe granting of such a variance benefits the visual "ppearanle of thesite and surrounding area; and

III. RESTRICTIONS
Pursuant to 0rdinance 22, series of 1981 of the Town of vail , prior to issuanceof a_ building perrnit, an agreernent to the following conditions nust be signedby the property owner or owners on a form provided by the Departnent ofConnunity Devel opment :
1' That the secondary dwelling unit shatl not be soId, transferred or conveyedseparately frorn the prirnary unit for a period of not less than the lifeof rrent hlillian Ruder, a life in being, plus twenty-one (21) years fromthe date that the certificate of occupancy is issued. for said secondwlit, and
2, That the secondary dwelling unit shall not be leased or rented. for anyperiod of less than thirty (s0) consecutive days, and that if it shalibe rented, it shall be rented only to tenants who are full tine enployeesin the upper Eagle valley. The "upper Eagre Valley" sharl be deened '
to include the Gore Valley, Minturn, Red cliff, Gilnan, Eagle-vail, andAvon and their surrounding areas. A_ "full-tirne employee', is a perion
who works an average of thirty (30) hours per week, and
3. That the secondary dwelling unit shall not be divided into any forn oftineshares, interval ownership or fractiona.l fee, and
4. That a declaration of covenants and restrictions shall be filed of recordin the office of the Eagle, county -clerk and Recorder in a forn approvedby the Town Attorney for the benefit of the Town to insure that iierestrictions herein shall run with the land.
IV. TIME. REQUIREMENTS

If thls appllcatlon requires a sepalate revlew by any local' State or
Federal agency other than the Torn of Vail., the appllcatLon fee sha1l be
increased by $200.00. Exanples of such revJ.ew, may include' but ale note
ltmtted to: Colorado Department of Blghnay Access Permits' Army Corps of
Engineers {04, etc.
The appllcant shall be responsible for paylng any publishing fees whlch
are ih excess of 50t of, the appllcatlon fee. I'f, at the aPPllcant's
requestr any matter is postponed for hearlng, causing the natter to be
re-published, then, the entlre fee for such re-publication shall be paid
by the applicant.
ApplJ-catlons deenred by the Cormnunity Development DePartment to have

lrnpact on the contnunity may requJ.re review by consultants other than town
staff. Should a determinatlon be made by the town staff that an outside

Before the Town can issue a building permit for the Kimball residence, we will need Ms.
Kimball to deed restrict the'secondary unit. Because Lot 28 is less than 15,000 sq. ft., any
secondary unit on the site must be deed restricted for employee housing.
I have scheduled this request for the July 3, 1991 Design Review Board hearing. Please fill
out the attached form and submit it to the Community Development Department before June
26, 1991. I hope he delay in the building permit review is not a problem.

I have reviewed your Design Review Board application lor a Primary/Secondary development
at 1915 West Gore Creek Drive. During my review, ldeveloped a list of issues which must be
resolved before the DRB can review he project.
Please have your surveyors re-draw the 100 year floodplain on the survey, based on
updated FIRM data.
Have your surveyors add the 50 foot Gore Creek stream setback to the survey.
ldentity any wetlands on the site.
Re-drar fte roof plan so that the roof ridges, eaves, walls of the structure, and patios
are clearly indicated.
Verify tlrere are no retaining walls planned for the site.
Please prepare a color board for the DRB hearing.
Greg Hall is checking into the driveway slope. From a brief look at the driveway, it
appears that il has 81n% slope and annnot be approved by the DRB without Greg
Hall's approval.
