cannot be accepted until all required information is received by the Community Development Department. The

This application is required for proposals involving minor exterior alterations and/or site improvements.
Proposals to add landscaping do not require DRB apprwal unless they involve the addition of patios,
water features, grading, or the addition of retaining walls.

flue sha11 be protected by a one-hour fire resistive
construction. IIBC L706. This involves lining the
inside of such chase wiLh 5/8" TLpe x slreetrock and
fire-taping joints.
Gas fireplace appliances are required to be
installed as per listing insLallation instructions -
with a rrBrr vent only. Combustion air must be
supplied from the ouLside for all new construction
in the Town of Vail.
Supply a mechanical drawing indicating design of
system, size (BTu and volume) of equipment, vent
locat.ion and termination, and combustion air to be
supplied prior to any installation.
Due to Colorado State Statutes, all sink fauceEEs
and shower heads are required to utilize flow
restricLion devices. A1so, the maximum water closet
ftush usage is limited to a maximum of 3.5 qallons
per flush.
This factory-built fireplace must be an approved
unit. Include the manufaclure's name, model number,

The design, construction, and installation of
elevators, dumbwaiters, escalators and their
hoistways shal1 be as per the requirements of UBC
Ch. 51. This includes fire-resistance of enclosure
& openings, hoistway ventilation, and vestibule
requirements.
Elevator shafts which extend through two or more
floors sha11 be enclosed in a shaft of one hr. fire
resisLive construction. Openings (doors) shal1 be
proLected by a self-closing assembly with a one hr.

Gentlemen,
As requested, we visited the subject site in April of 1993 to observe
site Conditions and. to excavate a test pit at the base of the slope.
We also visited the site during the summer of 1993, when there was no
snoId. The purpose of our visitJ were to observe site conditions, eval-
uate geol6gii conditions, and to recomrnend design and construction
critefia for the proposed resid.ence from a geologic and geotechnical
point-of-view.
The site is located on a steep slope above Gore Creek Drive as indi-
cated on Fig. 1. There are slopes ol SOZ to 72>" in the proposed build-
ing site. The site has a sparse pine cover and good cover of grasses.
a iesidence is proposed in the nbrthern portion of the lot. A resi-
dential structuie with concrete and woodfrarne construction is propos-
ed. The residences will be served by public water and sewer services.
The adjacent lots, Lot 43 to the east and Lots 45-46 to the ltest have
be dev6loped. Building records were checked at the Town of Vail and
there is no records of geologic or geotechnical investigations foteither of the lots. Construction at f,-ot ag is a relatively sma1l sin-
gle farnily structure. The apartments at Lots 45-46 are similar to the
proposed construction at Lot 44.
A summary Geologic Hazards fnvestiqation & Subdivision Evaluation by
Li-ncoln 6".ro.e in fg8z identi-fied Lbt 44 as rrmetastablerr slopes, with
a srtall area at the southwest corner of the property identified as,
metastable and unstable slopes consisting nainly of mapped landslides'
The area is underlain by colluvial and landslide deposits fron the
high slopes to the south. With the downcutting of Gore Creek, the rnod-
erite to steep slopes have been created. In the Highland Park, High-
land Meadows, and Vail Village West subdivision, there have been slope
stability problens. The problerns are closely related to surface and
ground water flow.
Subsurface conditions were investigated by excavating a test pit at
the southern edge of the property at inaicated on Fig. 1. Subsurface
conditions cons-isted of i feet of loose sand and clay topsoil under-
lain by clayey sand and gravel to the maximum depth explored of I
feet. - No freL water was observed in the test pit. No springs or

evidence of ground water were observed at the site. There was no
evidence of slope instability at Lot 44.
Using the topographic data presented on Fig. 1 and the results of the
exploratory test pits; a slope stability analysis was perforrned using
PCSTABLs, the Purdue University/Federal Highway Adrninistration slope
stability computer software. Using a Uodified Janbu analysis with the
a single colluvial deposit a series of Factors of Safety were deter-
mined. Tlre materials parameters of cohesion ranging. fron o to 500
pounds per square foot (PSF) and coefficients of friction of 30 to 35
degreeJwere used in the analysis. The analyzed cross-section is indi-
cated on Fig. L. This section is the steepest section within the pro-
posed constluction area. The naxinum section which was analyzed is
presented on Fig. 2, which includes: A. the existing ground surface
ind B. the section for the proposed temporary excavation. Ground water
was assumed at 3 elevations;- A. 7944' the lower slab elevation, B.
7934, l-0 feet below the lower slab elevation, and C- 7924' 20 feet
below the lower slab elevation. A surnrnary of the analysis is present-
ed as TABLE I and detaited analysis is presented in APPENDIX A.

The analysis indicates Factors of Safety (FS) of 0.95 to 1.30 for the
existing-slope. Based on the conditionbf tne slope at the site, with
no evid6nce 6t slope instabilityr w€ believe the correct soil parane-
ters are a ninirnurn- cohesion of ZOO PSF and a Friction An91e of 30 de-
grees. When the proposed excavated slope was analyzed with a cohesion
5f zOO and Frictibn -angte of 30, the FS was I.I7. There was no ground
water evident and a water table at an elevation of 7944 feet was in-
cluded in the analysis, therefore we believe the slope is stable for
the proposed development.
The stabitity of the slope is can be influenced by additional factors
which must be considered-and mitigated during construction. The uphill
walls of the proposed structure must be designed as a retaining wall
to support sulchlrges from the slope. The area behind the wal1s and
below-ihe structure-must be drainedio mininize the risk of developing
hydrostatic pressure behind the wal1. Reconmendations for construc-
tion of the watls and d.rain systern are presented later in this report'
The results of our observations indicate the proposed structure can be
constructed with a spread footing foundation systen. We reconmend
footings be designed tor a maximum allowable soil bearing pressure of
3000 pounds per square foot (PSF). Footinqs should be supported by
naturil soil or bedrock. We reconmend ninimum 16 inch wide footings
and rnininum 24 inch square pads beneath isolated columns. Loose soil
should be removed and the footing should be placed on fi.rm natural
soil. Continuous foundation wallJ should be reinforced with at least
two No. 5 bars top and botton. Exterior footings should be protected
from frost action. We recommend 3 feet of earth as frost protection
in this area.
The uphill walls rnust be designed for lateral loads. We reconmend an
equivllent fluid pressure of 55 pounds per cubic foot (PCF) for_rrat
r6str conditions. For ttpassiverr conditibns, we recommend an equiva-
Ient fluid pressure of 55 PCF. A coefficient of friction of 0.5 should
be used fof resistance at the base of walls. These pressures do not
include hydrostatic or surcharqe loads. A foundation drain system
should be installed as indicated below.
The natural soils and bedrock will provide adequate support for slab-
on-grade construction. If new fill is required beneath the s1ab,-the
fill should be compacted to a nininum of 9Oe standard Proctor density.
we recommend the installation of a foundation drain around aII below
grade portions of the structure. The drain should lead to a positive
{ravity outlet or to a sump where water can be renoved by punping.

l-. The drain should include gravel or rrdrain-boardn naterial to within
2 feet of the ground surface.
The ground surface should be graded to provide positive drainage altay
from the structure in all directions. We recouunend a minirnum slope of
1-2 inches in the first LO feet from the structure. Any settlement of
backfill should be inunediately filled and positive drainage away from
the residence re-established.
Along the cutslope itself, we recommend finish grading to est-ablish- a
well-defined slo-pe with positive drainage. The final slope should be
seeded with a native see-d nix which doel not require irrigation.

1. The Developer agrees, at its sole cost and expenses, to furnish all equipment

office of the Community Development Department, the Town of Vail, and to do all work
incidental thereto according to and in compliance with the following:

submitted by the Developer to be approved by any of the abov+referenced
govemmental entities. All said work shall be done under the inspection of, and
to the satisfaction ot, the Town Engineer, the Town Building Official, or other
official from the Town of Vait. as affecJed hv snoeial dist!.icts or sen,ice distncts,
as their respective interest may appear, and shall not be deemed complete until
approved and accepted as completed by the Town of Vait Community
Development Department and Public Works Dspartment.
2. To secure and guarantee performance of its obligations as set lorth herein, the
Developer agrees to provide security and collateral as follows:

3. The Developer may at any time substitute the collateral originally set forth
above for another form of collateral acceptable to the Town to guarante6 the faithful
completion ot those improvements referred to herein and the performance of the terms of this
Agreement. Such acceptance by the Town of alternative collateral shall be at the Town's sole
discretion.
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occuning to the work specified in
his Agreement prior to the completion and acceptance of ffre same, nor shall the Town, nor
any officer or employee thereof, be liable for any persons or property injured by reason of the
nature of said work, but all of said liabilities shall and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
otficers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) that arise oul of or are
based upon any performance by the Developer hereunder; and the Developer shall reimburse
the Town lor any and all legal or other expenses reasonably incurred by the Town in
connection with investigating or defending any such loss, claim, damage, liability or action,
This indemnity provision shall be in addition to any other liability which the Developer may
have.
5. lt is mutually agreed that the Developer may apply to the Town and the Town
shall authorize for parlial release of the collateral deposited with the Town for each category
of improvement at such time as such improvements are constructed in compliance with all
plans and specifications as referenced hereunder and accepted by the Town. Under no
condition will the amount of the collateral that is being held be reduced below the amount
necessary to complete such improvements.
6. lf the Town determines, at its sole discretion, that any of the improvements
contemplated hereunder are not construct€d in compliance with the plans and specifications
set forth in this Agreement on or before the date set forth in Paragraph 2, the Town may, but
shall not be required to, redeem the letter of credit as necessary to complete the unfinished
improvements. The Bank shall release such funds upon written request from the Town stating
that the improvements have not been completed as required by this agreement. The Bank
shall not require the concurrence of the developer prior to release of the funds to the Town
nor shall the Bank be required to verify independently that such improvemenb have not been
completed as required by this agreement, but shall release such funds solely upon the Town's
written request.
lf the costs of completing the work exceed the amount of the deposit, the €xcess,
together with interest at twelve percent per annum, shall be a lien against the property and
may be collected by civil suit or may be certified to the treasurer of Eagle County to be
collected in the same manner as delinquent ad valorem taxes levied against such property. ll
the permit holder lails or reluses to complete the cleanup and landscaping, as defined in this
chapter, such failure or refusal shall be considered a violation of the Zoning code.
7. The Developer warrants all work and material for a period of one year after
acceptance of all work referred to in this Agreement by the Town if such work is located on
Town of Vail property or within Town of Vail right-of-way pursuant to Section 17.16.250.
8. The parties hersto mutuallv agree that this Agreement may be amended from
time to time, provided that such amendments be in writing and executed by all parties hereto.

I have completed the initial review of the Gregg residence Design Fleview Board (DRB)
application. The following items and issues should be addressed before we can schedule
your application for a meeting with the DRB.
1. The application does not appear to conform with certain provisions of the
zoning ordinance as specified below.

5. Please provide additional spot elevations on the retaining wall located in the
northeast corner of the property (uphill side of the driveway). Retaining walls
can be a maximum of 3 feet in height in the lront setback.
6. The building materials list is incomplete. Please provide more delail on types of
materials and colors ProPosed.
7. Landscaping materials proposed are minimal. I would advise that you improve
the landscape plan by adding a significant number of trees and shrubs since
this site is largely devoid of existing trees. lt is unlikely that you will be able to
retain the existing evergreen tree located in the eastern side yard. Grading for
drainage will likely have significant impacts on this tree and it will probably need
to be removed.
8. The driveway does not appear to meet the minimum 20 foot center line radius
and still maintain a minimum 6 foot width on either side of the center line.
Please show the 20 foot center line radius on the site plan and make the
necessary changes so that the driveway conforms to this standard.
9. The Town Engineer has raised the following questions/concerns as stated
below.
A. Verify the existences ol storm sewer along Gore Creek Drive. Curb and
gutter installation may be required at this location.
B. Coordinate house plans with current roadway plans under design by the
Town of Vail.
C. Grades on the driveway appear to be over 87o.
D. Driveway needs to be a minimum of 12 feet in width, it appears that a
portion of the driveway is 11 feet wide.
E. The east elevation shows three retaining walls where the site plan
shows only two. This pertains to the uppermost retaining walls on the
site.
F. Please indicate snow storage areas on the site plan.

10. The proposed grading in the western side yard is at 1-112:1, the maximum
slope allowed for site grading is 2:1. Retaining walls may be required in this
area.
11. The slairutray that provides access to the main level enlryway is only partially
covered. The first set of stairs is totally uncovered. I feel that this is a safety
hazard, and the stairs should be totally covered. This will obviously require you
to reduce site coverage elsewhere.
12. Both the Town Engineer and myself are very concerned about sile grading
especially as it pertains to excavating into a steep hillside. Your site
development plans indicate thal a 22 foot high vertical cut would be required to
install the rear foundation wall. How do you intend to stabilize this cut during
the construction process without grading back up the hill. How do you propose
to meet OSHA's safety requirements. The massive excavation will also require
signilicant removal of earth material. How do you intend to dispose of this
material? Where?
As we discussed on ths telephone last week, I suggest that you set up a meeting with Greg
Hall, the Town Engineer, to address some of the more technical issues listed above. I would
like to attend that meeting. Please notify me when you schedule a time. Once we receivs the
requested information and address all ol the major issues above, I will schedule the
application lor a meeting before the DRB. I have enclosed a meeting schedule for your
convenience. We would need a minimum of two weeks to roule new plans and get comments
back prior to any scheduled DRB meeting. lf you have any queslions regarding this matter,

Enclosed you will find a variety of information concerningdevelopment review procedures for the above referenced lot.This process would involve both staff review and public
meetings, the extent of which will be deterrnined by therequests you make.
This property is within the boundaries of the geologic hazard
map as prepared by Lincoln De Vore, Engineers (analogous to the
Claycomb Engineering study). The enclosed ordinance (Section18.69.052) outlines the special studies that are required for
development in this area. Site specific reports are to besubnitted in conjunction with the initiat review of the
development proposed (be it a review at the Planning Cornrnissionlevel for a variance or the Design Review Board).
Any variance request would be reviewed by the staff andPlanning Conmission at a public hearing. This processtypically involves the submittat of preliminary design drawingsand takes from one to two rnonths. It is difficult to provideany more inforrnation without knowing the nature of the varianceyou would be requesting. I have enclosed the planning
Cornnission schedule, a variance application form, and thevariance section of the zoning code that outlines this processin greater detail.
The Design Review Board reviesrs any project proposed within thetown. This review would follow any requests for variances thatare made to the Planning Cornmission. Enclosed you wilt findthe design review guidelines and related appLication forrns.
