DENVER, ("Declarant") is the owner of the real property situate
in the county of Eagle, state of colorado described as Lot 4A
and Lot 4e, White River Estates, in Exhibit A attached hereto

ally or in any form of concurrent ownership recognized in
Colorado. In case of any such concurrent ownershipr- each

and observance of all the duties and responsibilities of an
"owner" with respect to the unit-in which he owns an interest.
For all purposes herein, there shall be deemed to be only two
owners, the owner of Unit 4A and the owner of Unit 48. The
parties, if more than one, having the ownership of each such un-
it shall agree among themselves how to share the rights and
obligations of such ownership; provided, however' that if a
corporationr partnership, association or other legal entity
shall become an owner or the partiesr if more than one, have the
concurrent ownership of a unit, then such entity or concurrent
owners strall from ti.me to time designate one individual who
shalI represent such entity or concurrent owners in all'matters
concerning all rights and obligations pursuant to this
Decfaration. Any such entity or concurrent owners shall give
written, notice to the other owne! designating the individual to
act on its or their bebalf and such notice shall be effective
until revoked in writing by such entity or ovrners. Any act or
omission by such designated individual shall be binding on the
entity or owners having designated him in favor of the other
owner or any person who may rely thereon.
(d) Any contract of sale, deed, Iease,
deed of trustr rror tgage, will or other instrument affecting a
unit may describe it by its unit letter and by reference to this
Declaration.
(e) Each unit shall be considered a sepa-
rate parcel of real property and sha11 be separately assessed
and taxed.
2. ENCROACHMENTS. If any portion of Lot 4A and
Lot 48 now encroach6E-ip6n-Th6-other parcel as a result of the
construction of any building, or if any such encroachment shall
occur hereafter as a result of settling or shifting of any
building, a valid easement for the encroachment and for the
maintenance of the same so Iong as the building stands shall
exist. In tbe event any building shall be partially or totally
destroyed as a result of fire or other casualty or as a result
of condemnation or eminent domain proceedings and then rebuilt,
encroachments of parts of the building on the other parcel , due
to such rebuilding, shal1 be permitted, so long as such
encroachments are of no greater extent than those previously
existing, and valid easements for such encroachments and the
maintenance tbereof sba11 exist so long as the building shall

below, if, because of any act or omission of any owner r aDY

(b) Each owner shall provide and keep inforce for the protection of himserf general pubric liability andproperty damage occuring in, on or upon his parcer owned in feesimpre and the improvements thereon, in a 1i;it of not Less thans3gg'agg in respect of bodily injury or death to any number ofpersons arising out of an accident or disaster, or ior damage toproperty, and if higher limits shatr at any time be customary toprotect against possible tort liability, such higher limitsshall be carried and each owner sharl name the other owner as anadditional insured party under such policy.
(c) Each owner shall deliver to the otherowner certificates evidencing all insurance required to be car-ried under this Paragraph 7, each containing agreements by theinsurers not to cancel or rnodi fy the pol icies wi thout gi.v-ing theother owner written notice of at least 30 days. Each ownershall have the right to inspect and copy alr such insurancepolicies of the other owner and require- evidence of the paymentof premiums thereon.
(d) Nothing provided in this paragraphslrall prevent the owners from jointly acquiring a single poticyto cover any one or more of the hazards required in this para-graph to be separtely insured against by each owner.

a first mortgage or first deed of trust of record on any portion
of Lot 4A or Lot 48.
13. EFFECT OF PROVISIONS OF DECLARATION. Each pro-
vision of this oe covenant and
undertaking to comply with each provision of this Declaration,
and any necessary exception or reservation or grant of title,
estate, right or interest to effectuate any provision of this
Declaration: (i) shall be deemed incorporated in each deed or
other instrument; (ii) shall, by virtue of acceptance of any
right, title or interest in any portion of Lot 4A or Lot 48 by
an owner, be deemed accepted, ratified, adopted and declared asa personal covenant of such owner and, as a personal covenant,
sha1l be binding on such olrner and his heirs, personal
representatives, successors and assigns; and, shal1 be deemed a
personal covenant to, with and for the benefit of each owner of
any portion of Lot 4A or Lot 48; and, (iii) shall be deemed areal covenant by Declarant, fox itself, its successors and
assigns, and also an equitable servitude, running, in each case,
as a burden with and upon the title to each and every portion of
Lot 4A and Lot 48.
14. ENFORCEMENT AND REMEDIES. (a) Each provision
of this Declaratffi by any owner by a pro-
ceeding for a prohibitive or mandatory injunction or by a suit
or action to recover damages. If court proceedings are insti-
tuted in connection with the rights of enforcement and remediesprovided in this Declaration, the prevailing party shal1 be en-titled to recover its costs and expenses in conncectiontherewith, including reasonable attorney's fees,

following exterior changes. Thete aie a dlew minor changes
that CDS have requestecl Columbia Construction Coporation to
make. In all cases the changes are a matter of function,practicality and do not affect the aPgearance of the buildinE
in a negitave $ray. The proposed chanEes are as followrs:
REAR ELEVATTON
1. add a 1x10 cedar facia with a 1x4 ceilar drip edge
a. to be staineil the same color as the siding
b. to be continous on all sides of the building
The purpose of this detail is to a11ow the cold
roof to vent properl-y Detail 1.
2. Change 6-0x5-8 sliding glass door to fixed glass
This chanEe occures in the stair tower between the
second and third floor landing in the B unit.
a. there is not enough room on the landing to
effectivly walk out of the door, also I believe
that it would not gass code Detail 2.
3. Deck at stair tower in the B unit
a. in as much as the door is not functional we
propose to lower the deck to grade DetaiJ-s 3 14
4. Dormer at stair tower unit A
a. the plan calls for the dormer to have wing walls
and a roof overhang extending to the back waII
with the winilow inset approximatly 7 feet. The
change woul-d involve stopping the ilormer at the
stairwell. In doing this the stair tower will
get better natural light and a better view

1. The plan cal1s for the entry stePs to both A and
B unit to be concrete. Due to the severe weather
conititions and temprature changes the concrete
will- spa11 and crack' over time it will all have
to be replaced. We woulil Propose changing the
material to a conbination of redwooil and preasure
treated lumber. These have proven to be a more
effective method. Detail 7
2. The last change involves the masonry veneer on
retaining and wing wal-1s. The plans call for the
material to be river rock.
