I talked to Stan Berr)rman, and he doesnot remember Public Works taking the bench. He does remembertalking to you about the renoval of the bench, and he felt thatperhaps there sras a possibility that someone from your maintenance crew picked up the bench and stored it somewhere onthe Sitzrnark property. If no one from your rnaintenance crewpicked up the bench, then it seems evident that it was stolen. I also talked to Steve Barwick, our insurance and financeperson for the Town of Vail . His opinion is that you havefulfilled your obligation. f am not sure when the Town will beable to replace the bench, as no money is budgeted for thisexpense. Our deductible is $10,OO0, so our insurance will notbe able to cover this itern. I will ask Public Works to propose money for a new bench during this upconing budget review for 1989. Within the immediate area of any construction, maintenance or repair project of any sheet or alley or of any water main, sewer main, electricity line, gas line, telephone line or any appurtenance thereto; 2. To deposits of sand, dirt or materials necessary for the protection ofthe public safety; and 3. To public areas desigrnted for the dumping or depositing of said materials. D. Summons; Penalty: As an ahernative to the notice for removal provided in subsection B above, any person who violates or causes another to violate the same, may be issued a summons to appear before the Municipal Court of the Town for said violations, and upon being found guilty of a violation hereunder be punished as provided in Section l4-l ofthis code.
