A complete application form and all accompanying material must be accepted by the Community Development Department prior to application deadlines. A schedule of DRB meetings and associated application deadlines may be found on the World Wide Web at htto://ci.vail.co.us/commdev/olannino/drb/meetings/default.htrn For a new residential development, the application deadline is typically 3.5 weeks prior to a Design REyiew Board hearing. Review Criteria The proposal will be reviewed for compliance with the Design Guidelines as set forth in Title 12, Chapter 11 (Design Review) and Tifle 14 (Development Standards) of the Municipal Code. Reouirements for orooerties located in hazard areas If a property is located in or adjacent to a mapped hazard area (i.e. snow avalanche, rocldall, debris flow, floodplain, weUand, poor soils, etc.), the Community Development DeparUnent may require a site-specific geological investigation. If a site-specific geological investigation determines that the subject property is located in a geologically sensitive area, the property owner(s) must sign an affidavit recognizing the hazard report prior to the issuance of a building permiL Applicants are strongly encouraged to consult with Community Development sbff prior to submitting a DRB application to determine the relationship of the property to all mapped hazards. Reouired Plan Sheet Format For all surveys, site plans, landscape plans and other site improvement plans, all of the following must be shown. 1. Plan sheet size must be 24''x 36", For large projects, larger plan size may be allowed.2. Scale. The minimum scale is 1"=20'. All plans must be at the same scale. 3. Gnphic bar scale. 1. Desiqn Review Board Meetinq Requirements For new conskuction and additions, the applicant must stake and tape the project site to indicateproperty lines, proposed buildings and building corners. All trees to be renpved must be taped. The applicant must ensure that staking done during the winter is not buried by snow. All site tapings and staking must be completed prior to the day of the DRB meeting. Applicants who fail b appear before the Design Review Board on their scheduled meeting date and who have not asked in advance that discussion on their item be postponed, will have their items removed from the DRB agenda until such time as the item has been republished. If the DRB approves the application with conditions or npdificaUons, all conditions of approval must be resolved prior to the issuance of a building permit. Staff Aooroval The Administrator (a member of the planning staff) may review and approve Design Review applications, approve with certain modifications, deny the application, or refer the application to the Design Rwiew Board for a decision. All staff approvals are reviewed by the Design Review Board and any staff decision is subject to final approval by the DRB. Additional Review and Fees If this application requires a separate review by any local, state or Federal agency other than the Town of Vail, the application fee shall be increased by $200.00. Examples of such review, may include, but are not limited to: Colorado Department of Highway Access Permits, Army Corps of Engineers 404, etc. The applicant shall be responsible for paying any publishing fees in excess of 50% of the application fee. If, at the applicanfs request any matter is postponed for hearing, causing the matter to be re-published, then the entire fee for such re-publication shall be paid by the applicant. Applications deemed by the Community Development Department to have design, land use or other issue, which may have a significant impact on the community, may require review by external consultanE in addition to Town stafF. Should a determination be made by Town staff that an external consultant is needed, the Community Development Department may hire the consultant. The Department shall estimate the amount of money necessry to pay the consultant and this amount shall be forwarded to the Town by the applicant at the time of filing an application. The applicant shall pay expenses incurred by the Town in o(cess of the amount forwarded by the application to the Town within 30 days of notification by the Town. DESCRIPTION OF THE REOUEST The Sitzmark Condominium Association, represented by Bob Frilch, is proposing to add a dormer to an existing multi{amily residential unit at the Silzmark Lodge. The building was conslrucled prior to the adoption of the "Commercial Core l" zoning in Vail Village and it currently exceeds the allowable building height. Therefore, additions of gross residential floor area (GRFA) on the upper levels that increase building height require the granting of a variance. REVIEWING BOARD ROLES Order of Review: Generally, applications will be reviewed first by the PEC for impacts of the proposed variance and then by the DRB for compliance of proposed buildings and site planning.. Planning and Environmental Commi$sion: Action: The PEC is responsible for final approval/denial of a variance. The PEC is responsible for evaluating a proposal for: 1. The relationship of the requested variance to other existing or potential uses and structures in the vicinity. 2. The degree to which relief from the stricl or literal interpretation and enforcement of a specified regulation is necessary to achieve compatibility and uniformity of treatment among sites in the vicinity, or to attain the objectives of this Title wilhout grant of special privilege. 3. That the granling of the variance would conslitute a grant of special privilege inconsislent with the limitations on other properties classified in the same dislrict. MAJOR EXTERIOR ALTERATION - REVIEW CRITERIA The review criteria for a request of this nature (additions of >100 square feet of floor area) are established by the Vail Town Code. The emphasis of this review is on the proposal's compatibility with the zoning code, the Town of Vail Streetscape Master Plan, the Vail Village Urban Design Guide Plan, the Vail Village Design Considerations and the Vail Comprehensive Plan. Compliance with the Town of Vail Zoninq Code COMMERCIAL CORE IZONE DISTRICT Pursuant to Section 18.24.010 of the Town ol Vail Municipal Code, the purpose of lhe CommercialCore 1 Zone District is, "To provide sites and maintain the unique character of the Vail Village ammercial area, with its mirture of lodges and commercial establishments in a predominantly pedestrian environment. The Commercial Core 1 Zone District is intended to ensure adequate light, air, open space, and other amenities appropriate to the permitted types of buildings and uses. The district regulations in accordance with the Vail Village Urban Design Guide Plan and Design Considerations prescribe site development standards that are intended to ensure the maintenance and preseruation of the tightly clustered arrangements of buildings fronting on pedestrian ways and public greenways, and to ensure continuation of the building scale and architectural qualities that distinguish the Village." A major exterior alteration involves any addition of greater than 100 square feet of floor area within the CC1 zone district. The following development standards apply to this request: PERMITTED AND GONDITIONAL USES: ABOVE SECOND FLOOR Permitted Uses: Lodges. Multiple{amily residential dwellings. Conditional Uses: Retail stores and establishments Eating and drinking establishments Prolessional offices, business offices, and studios. Banks and financial institutions. Personal services and repair shops, including the following: Thealers. -3- c. Type lll employee housing unit (EHU) Type lV employee housing unit (EHU) SETBACKS No required setbacks, except as may be established pursuant to the Vail Village Urban Design Guide Plan and Design Considerations. HEIGHT Building height regulations in the CC1 zone district are addressed specifically in lhe Vail Village Design Considerations. The plan requires that 60% of the building may be built to a height of 33 feet or less while 40% of the building may be built to a height of up to 43 feet. Currently, the Sitzmark Lodge exceeds allowable height per both ratios. Slaff believes this proposal would exacerbate the existing inconsistency between the Sitzmark Lodge and the building height guidelines for Vail Village. Therefore, stalf believes this proposal is inconsistent with the objectives for building height outlined in the Vail Village Design Considerations. Allowable Height: Up to 43 feet Exisling Height (Max.): 57.1 feet Proposed Dormer Height: 52.5 feet DENSITY CONTROL The CC1 regulations allow/require a m.uimum GRFA ratio of 80% and a maximum density of 25 units/acre. This application involves the utilization of approximately 256 square feet of "available" GRFA. The building is in conformance with the requirements for densily (both GRFA and unitVacre). SITE COVERAGE The code allows a site coverage of 80% of lot area. This proposal will not add any additional site coverage. The existing building conforms to site coverage restrictions for the CC1 zone dislrict. LANDSCAPING AND SITE DEVELOPMENT Landscape objectives are outlined in the Vail Village Urban Design Guide Plan. However, lhis proposal will not impact those objectives. PARKING AND LOADING This proposal will not trigger the need for any additional parking or loading at this site. Comoliance with the Vail Villaoe Urban Desion Guide Plan Staff believes this proposal is consistent with the "Gore Creek Drive/Bridge Street Sub- Area" objectives outlined in the Vail Village Urban Design Guide Plan. Staff believes this proposal complies with this elemenl of the design guide plan. The Town of Vail Design Review Board, at its June 21"rmeeting, found the proposal to be in compliance with lhe Town's guidelines for roof elements. Staff does not believe this proposal will impact any of lhe other objectives outlined in the Vail Village Urban Design Considerations. D. Gompliance with the Town of Vail Streetscape Master Plan. Upon review of the Town of Vail Streetscape Masler Plan, staff has determined thal no recommended improvements or opportunities are directly related to the applicant's proposal. -5- E. Compliance with the Vail Gomprehensive Plan Vail Village Master Plan The Vail Village Master Plan has been adopted as an element of the Vail Comprehensive Plan. The Vail Village Master Plan is intended to guide the Town in developing land use laws and policies for coordinating development by the public and private sectors in Vail Village and in implementing community goals for public improvements. Most imporlantly, the Vail Village Master Plan shall serve as a guide to the statf, review boards, and Town Council in analyzing future proposals for development in Vail Village and in legislating effective ordinances to deal with such development. For the citizens and guests of Vail, the Master Plan provides a clearly stated set of goals and objectives outlining how the Village will grow in the future. Upon review of the Vail Village Master Plan, the staff believes the following goals, objectives and policies are relevant to the applicant's request: Goal #1 Encourage high quality redevelopment while preserving the unique architectural scale ol the Village in order to sustain its sense of community and identity. 1.1 Obiective: lmplement a consistent Development Review Process lo reinforce the character of the Village. 1.1 .1 Policv: Development and improvement projects approved in the Village shall be consislent with the goals, objectives; policies and design considerations as outlined in the Vail Village Master Plan and Urban Design Guide Plan. 1.2 Obiective: Encourage the upgrading and redevelopment of residential and commercial facilities. 1.2.'1 Policv: Additional development may be allowed as identified by the Action Plan and as is consistent with the Vail Village Master Plan and Urban Design Guide Plan. VI. CRITERIA AND FINDINGS FOR A VARIANCE REQUEST A Gonsideration of Factors Reoardino Variance Reouests: 1. The relationship of the requested variance to other existing or potential uses and structures in the vicinity. The existing Sitzmark Lodge building, although non-conforming with regard lo building height, is surrounded by buildings that are as large or larger in scale. The Design Review Board found lhe proposed addition to be acceptable in terms of bulk and mass. Staff believes the proposed roof bump-out may help 1o break up some of the existing roof plane on the building. The use of the subject property (multi{amily residential) is consistent with the uses outlined for Vail Village and the Commercial Core I Zone District. 2.The degree to which relief from the strict and literal interpretation and enforcement ol a specified regulation is necessary to achieve compatibility and uniformity of treatment among sites in the vicinity or to attain the obiectives of this title wlthout a grant of special privilege. The "Soecial Privileoe" and "Hardshio" lssues - The Planning and Environmental Commission has consistently held that non-conforming properties constructed legally prior to the adoption of zoning experience a hardship when more stringenl regulations render a building non-conforming (Maynor 1110100 variance, for example). However, all properties within Vail Village are subject to the height provisions in lhe Vail Village Master Plan and the Vail Village Urban Design Guide Plan and Design Considerations. Statf believes any proposals for additional height should conform to the standards that are applied throughout the CC1 zone district. Therefore, staff does not believe this proposal meets the above-referenced criteria. Section 12-18-5 of the Vail Town Code states that "struclures or site improvements which do not conform lo requirements for setbacks, distances between buildings, height, building bulk control, or site coverage, may be enlarged; provided that the enlargement does nol furlher increase the discrepancy belween the total structure and applicable building bulk control or site coverage standards; and provided that the addition fully conforms with setbacks, distances between buildings, and height standards applicable lo the addition." The intent behind this clause is to encourage the elimination of non- conforming properties through large-scale redevelopment. The effect of the requ6led variance on light and air, distribution of populatlon, transportation and traffic facilities, public facilities and utllities, and public safety. Slaff does not believe this proposal will impact any of the above-listed facilities. New proposed building elements will be lower than the existing roof ridge of the building and will be set back a minimum of 34 feet from property lines and 56 feet from the street edge. Such other factors and criteria as the Commisslon deems applicable to the proposed variance. Since this proposal is located in Vail Village, it is subject to the criieria and guidelines described in the Vail Master Plan and its assorted Vail Village elements. As mentioned previously, staff believes that the proposal does not substantially comply with lhe Vail Village Urlcan Design Guide Plan and the Vail Village Design Consideralions, with specific reference to the building height objectives outlined in the Vail Village Design Considerations The Plannino and Environmental Commission shall make the followino findinos before orantino a variance: 1. That the granting of the variance will not constitute a grant of special privilege inconsislent with the limitations on other properties classified in the same district. 2. The strlct interpretation or enforcement of the specilied reguhfion would deprive the applicant of privileges enjoyed by the owners of other properties in the same district, o o RECDJULOS2OOO fjiiJzmarlelndge SITZMARK AT VAIL REQUEST FOR A DORMER ADDITION The following statements address the nature of the variance requested and the relationship ofthe requested variance to other existing structures in the vicinity. o There are only two buildings adjacent to the Sitzmark in the same zoning distict --Gore Creek Plaza and the Lodge at Vail. Gore Creek Plaza, to the east, is the same height as the Sitzrnark. About ten years ago considerable amount of their roof was raised, up to their ridgeline. The Lodge at Vail exceeds the cunent zoning and is higher than the proposed dormer on the Sitzmark. The ridge line of the dormer is two and a half feet below the existing Sitzmark ridgeline. o There is no effect on light and air, distribution ofpopulation, transportation, traffrc facilities, utilities, and public safety. o There is no effect on Vail's Comprehensive Plan. o This application is made under the dormer addition provision. The impact is only positive with respect to the neighbors. The view from the Gore Creek Plaza penthouse living room window is now a very large gravel roof with numerous pipes and ventilator outlets (see picture #1). With the dormer addition, their view will improve dramatically (see picture #2). The Lodge at Vail, Village Center, and Riva North Condominiums will have a small, but positive, impact by breaking up the roofline. The Summers Lodge to the west will not see the dormer addition. It is the feeling of the applicant that the addition of the dormer is in keeping with the objectives of the dormer addition provision in that it will improve the appearance of the building to the public and the adjacent buildings. The small height addition requested makes the total height of the Sitzrnark less than the building next door and is in keeping with the height of the adjacent buildings. The requested height variance relates to the proposed dormer addition on the east side of the Sitzmark Building. The average height over the existing roof increases 2.5 feetand is approximately 3.6Yo of the footprint of the building. There are only two buildings adjacent to the Sitzmark in the same zoning district -Gore Creek Plaza and the Lodge at Vail. Gore Creek Plaza, to the east, is the same height as the Sitzmark. About ten years ago considerable amount of their roofwas raised, up to their ridgeline. The Lodge at Vail exceeds the current zoning and is higher than the proposed dormer on the Sitzrnark. The dormer is four feet below the existing Sitzmark ridgeline. There is no effect on light and air, distribution ofpopulation, transporiation, traffic facilities, utilities, and public safety. There is no effect on Vail's Comprehensive Plan. This application is made under the dormer addition provision. The impact is only positive with respect to the neighbors. The view from the Gore Creek Plaza penthouse living room window is now a very large gravel roof with numerous pipes and ventilator outlets (see picture #1). With the dormer addition, their view will improve dramatically (see picture #2). The Lodge at Vail, Village Center, and Riva North Condominiums will have a small, but positive, impact by breaking up the roofline. The Summers Lodge to the west will not see the dormer addition. It is the feeling of the applicant that the addition of the dormer is in keeping with the objectives of the dormer addition provision in that it will improve the appearance of the building to the public and the adjacent buildings. The small height addition requested makes the total height of the Sitzmark less than the building next door and is in keeping with the height of the adjacent buildings.
