As we have discussed, the enclosed application is lacking lhe signature of Bob Fritch, owner of
the Sitzmark, because he is on vacation in the South Pacific. We are aftempting to contact Bob
by e-mail to allow him to review the final format of the sign and give us his approval.
Meanwhile, I would appreciate your help in getting the application far enough into the review
process to allow me to determine what conditions will be imposed and whether or not I need to
plan for a DRB review.

Dear Mr. Brandmeyer,
Thank you for submitting an application lor design review of a new sign at the above address. Please note that
one change must be made to the proposal before a staff approval may be granted. Per the design guidelines of
Section 11-5-2:G, Sign Begulations, Vail Town Code:
"Use inconspicuous lighting: lighting should be integrated into the overall design of the sign, both in color
and placement, and should be of no greater illumination than is necessaty to make tha sign visible at
night. Recessed and indirect light sources are encouraged.'
Furthermore, Section 1 1-5-3:D, Sign Regulations, Vail Town Code, states that "lighting shall be white in color.
LighB shall not shine or reflect onto adjacent propefties".
Gurrently, a series of floodlighls is being used for sign lighting along the north wall of the Sitzmark Building.
However, each new sign application/accompanying lighting proposal which is submitted prompts the contormance
of the sign/accompanying lighting with the design guidelines listed above. I have already spoken with Gwen
Scalpello, who suggested that I communicate with you about lhis delail.
Please do not hesitate to contact me regarding any questions or concerns you might have. Again, thank you for
submitting your application. I look forward to receiving an amended application rellecting the Town's concerns
with the existing lighting.

BUILDING PERMIT ISSUANCE TIME FRAME
if this permit requires a Town of Vail Fire Depaftment Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
depaftments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

Elisabeth gave a presentation per the staff memorandum. Dominic Mauriello, representing the
applicant, gave a presentation regarding the proposal. The Commission made inquiries into
whether or not the examples of previous variance approvals were on existing structures or for
new construction. Mr. Mauriello stated that he did not know but he would guess most were
granted for existing structures. David Viele stated that he was on the DRB when this project was
approved and the applicant had ample knowledge and time to redesign the project so as to be in
compliance. Commissioners Bernhardt, Jewitt, and Kjesbo agreed with David Viele. The
applicant requested to table the proposal for the chance to do further research regarding the
background of other similarly granted variances.

Warren Campbell presented the proposal according to the memorandum. Jim Brandmeyer, the
applicant's representative and executive director of the Betty Ford Alpine Gardens, explained the
background of the request. He mentioned that it was natural to request that at least some of a
retail space be used for office purposes. Jim Lamont, representing Vail Village Homeowners,
asked about the number of instances in which the percentage of retail vs. office space within a
building had been an issue. Russ Forrest answered that this was a rare discussion and that the
most similar issue was related to ski storage within a retail space.
Gwen Scalpello, operations manager for the gift shop, stated that it was unfortunate that the
application was being presented as an application for an office, instead of for a retail space. She
stressed that the proposal could create a successful and beautiful shop. Dean Hall, Vail
homeowner and board member of the Betty Ford Alpine Gardens, verified that the primary
interest of the new space would be to earn money for the Gardens. He stressed the importance
of earned income for museums, gardens, and zoos. Amy Phillips, first a volunteer and then a
member of the board of directors for the Gardens spoke about the severe financial fundraising
challenges that once existed for the Gardens.
Bill Jewitt stated that many aspects of the proposal would obviously be of great benefit to the
community, but that the request did not fit in with the horizontal zoning that is regulated by the
Town. Rollie Kjesbo asked how the increase from 35% to 75o/o retail space came about from the
applicant. The applicant responded that the request was modified and submitted as a request
for minimal office space needed. George Lamb stated that much of the proposal was subject to
interpretation and asked why the amount of retail in all offices wasn't being encouraged to
expand. Russ Forrest agreed that the Gardens had an incredibly good impact within the Town of
Vail. Anne Gunion stated that the proposal did not fit the definition of office and therefore was
retail under the Code. Additionally, she mentioned that a gift shop was a permitted use on the
ground floor in that area; therefore there was no ground for not allowing the use as proposed.
David Viele agreed with Ms. Gunion and stated that the business environment within the village
had changed enough to warrant a change in the code, which was written in the mid 70's. Chas
Bernhardt stated that the success of Vail was based on Ordinance No. 16. He felt most strongly
that the entire storefront was used as retail space. Doug Cahill finished by saying that the space
proposed was more office than retail space, according to the code. He preferred to see this use
defined in the code as a public benefit for the community. He stated that he could not vote any
particular way without a definition for office space.
3. A request for a recommendation to the Vail Town Council of a proposed text amendment to
Section 12-7H-3, Permitted and Conditional Uses, first floor or street level, and Section 12-71-3,
Permitted and Conditional Uses, first floor street level, Vail Town Code, to allow for temporary
business offices as conditional uses in the Lionshead Mixed Use | & ll zone districts, and setting
forth details in regard thereto.

the "sunset provision", that would guarantee the end of this use after 2 years. He also
mentioned that the reason for this proposal was because the use was going to be displaced only

SUB'ECT PROPERTY
The subject property is a Commercial Core 1 zoned property located at 183 Gore Creek
Drive (Sitsmark Lodge)/ LotA, Block 58, VailVillage Filing 1 (AttachmentA). The appellant
is proposing to locate the business offices of the Betty Ford Alpine Gardens on the "Frisf
Flar or Strcet Level" on the Gore Creek Promenade frontage of the SiEmark Lodge. A map
identifying the retail space and the proposed floor plan is attached for reference (Attachment
B).
STANDING OF APPELLANT
The appellant, Bob Fritch, represented by Jim Brandmeyer, has standing to file an appeal as
the property owner.
REQUIRED ACTION
The Planning and Environmental Commission shall uphold, overturn, or modlfy the
administrative denial of a request for a "business office" on the first floor or street level of the
SiEmark Lodge, pursuant to Section 12-78-3, Permitted And Conditional Uses; First Floor
Or Street Level, Vail Town Code located at 183 Gore Creek Drive (SiEmark Lodge)/ Lot A,
Block 58, VailVillage Filing 1
Pursuantto Section 12-3-3-85, Findings, Vail Town Code, the Planning and Environmental
Commission is required to make findings of fact in accordance with the Vail Town Code:
"The planning and envircnmental commission (or the design review board in the
case of design guidelines) shall on all appeals make specific findings of fact based
dircctly on the particular evidence prcsented to it. These fiNings of fact must
support conclusionsthatthe standads and conditions imposed bythe requirements
of this title have or have not been met."
BACKGROUND
On August 3, z0o4', the administrator (staff) responded in writing to the appellant that a
request to convert the retail space currently occupied by Gore Creek Fly Fishermen, located
tv.
v.
at 183 Gore Creek Drive (SiEmark Lodge)/LotA, Block 58, VailMllage Filing 1, to the new
business offices for the Betty Ford Alpine Gardens must be denied as the request did not
meet the requirements of the Code. In that letter staff responded to a proposal to establish
the retail space with approximately 35% (552 square feet) of the space devoted to retail use
and 6506 (1 ,020 square feet) of the space devoted to business office use.
On August 25, 20(X, the administrator (staff) again responded in writing to the appellant that
a new proposal to convert the retail space currently occupied by Gore Creek Fly Fishermen,
located at 183 Gore Creek Drive (Sitzmark Lodge)/Lot A, Block 58, Vail Village Filing 1 , to
the new business offices for the Betty Ford Alpine Gardens must be denied as the request
did not meet the requirements of the Code. In that letter staff responded to a proposal to
estabf ish the retail space with approximalely 75o/o (1 ,175 square feet) of the space devoted
to retaif use and 25o/o (397 square feet) of the space devoted to business office use.
In both letters to the appellant staff identified that the Vail Town Code requires retail spaces
on the first level or street level of a building to have retail uses occupy them per Section 12-
7B-3, Permitted And Conditional Uses; First Floor Or Street Level, Vail Town Code. ln
responding to the request to locate the business offices of the Betty Ford Alpine Gardens
staff identified that there is currently no definition for retail spaces in the Vail Town Code.
Staffdetermined that in orderfora use to be considered "retail" it must have 90o/o of thetotal
area of a tenant space utilized as sales area and 10olo devoted to office space and storage
which is the inverse of the space requirements for uses identified as Tluslness Ollice". Staff
believes that the definition above is supported by the need to create vitality and life along
pedestrianways and to generate revenue through sales tax. Copies of the letters dated
August 3 and 25, 2OO4, are attached for reference (Attachment C).
On September 2,2004, the appellant filed an appeals form appealing the administrative
action denying the location of the Betty Ford Alpine Garden offices on the 'Ffsf Floor or
Strcet Level" of the Sitsmark Lodge. The appeals form and lefter from the appellant are
included for reference (Attachments D).
APPLICABLE REGULATIONS OF THE TOWN CODE

12-2-2: Deftnitions (in part):

12-&3: Appeals (in part):
A. Administntive Actions: Any decision, determination or interprctation by any tewn
administntive offtcial with respect to the provisions of this title and the standads and
procedures hereinafrer set fotth shall become final at the next planning and envircnmental
commission meeting (or in the case of desrg n related decision, the next design rcview board
meeting) following the administrato/s decision, unless the decision is called up and modified
by the boad or commission.
B. Appeal Of Administntive Actions:
1. Authority: The planning and environmentalcommission shall havethe authorityto
hear and decide appeals from any decision, determination or interprctation by any
town administntive official with rcspect to the provisions of this title and the

4. Effect Of Filing An Appeal: The filing of a notice of appeal shall stay all permit
activity and any proceedings in fufthennre of the action appealed unless the
administrative official rendeing such decision, determination or interprctation
certifies in writing to the planning and environmental commission (or the design
rcview board inthecase of design guidelines) andthe appellantthatastay posr,san
imminent peril to life or propefty, in which case the appeal shall not stay further
permit activity and any proceedings. The commission (or board) shall rcview such
certification and grant ordeny a stay of the prcceedings. Such determinatbn shall be
made at the next regularly scheduled meeting of the planning and environmental
commission (orthe design rcview boatd in the case of design guidelines).
5. Findings: The planning and environmental commission (or the design rcview
boad in the case of design guidelines) shall on all appeals make specific findings of

The Commercial Core 1 Di$nd is intended to ptovide si'tes and to maintain the unique
chancter of the Vail Village commercial arca, with its mkturc of lodges and commercial
establishments in a predominantly pedestian environment. The CommercialCorc 1 District is
intended to ensurc adequate light, air, open space, and other amenities apprcpiate to the
permitted tyoc,s of buildings and uses. Ihe Distict rcgulations in arcordance with the Vail
Village Urban Design Guide Plan and Design Considerations prescibe site development
standards that arc intended to ensurc the maintenance and prcservation of the tightly
clustercd amngementsof buidingsfronting on pedestrianways and publicgreenways, andto
continuation of the building scale and architecturcl qualities that distinguish the

floor within a structurc, subject to issuance of a conditional use permit in accotdance with the
provisions of Chapter 16 of this Title:

VI. STAFF FINDINGS
In response, to the appellant's request staff used a train of logic which utilized the Vail To,vn
Code definition for a 'Business Offce" which restricts the floor area in an establishment
defined as a ?usiness Office"to 90% of the floor area devoted to office and no more than
10olo devoted to retail. The complete definition is found in Section V of this memorandum.
Due to there being no definition for a retail establishment staff reviewed the uses listed
within the Commercial Core 1 Zone District, found in 12-78, for compatibility with the uses
listed and the appellant's proposal. After review staff deduced that a retail space must have
a majority of the space dedicated to retail and in an effort to be consistent that break down
must be at a minimum of 90o/o retail and a maximum oI 10o/o office. the inverse of the
definition of a ?usrhess Office".
The appellanfs request was administratively denied by the Community Development for the
following reasons:
. The proposed use is in direst conflict will ihe development objectives and
goals of eth Vail Village Master Plan to foster a strong tourist industry and
promote year-round economic health and viabilig for the Village and for the
Community as a whole, and;o The proposed use will function more like a business office than a retail
establishment, and;o The proposed use fails to further the purposes of Ordinance No. 16, Series
of 1975, and;. Approval of this request sets precedence for future requests for business
office uses to occupy retail space along pedestrian ways in VailVillage and
Lionshead.
Horizontal zoning within the Town of Vail was established pursuant to Ordinance No. 16,
series of 1975, to generate activity and street life along pedestrian ways. lt has long be held
that in order to have a successful pedestrian environmental there must be uses located
along pedestrianways which generate street life activity. There is a cyclical occurrence of
pedestrian activity on pedestrianways creating the desire of people to be involved in the
activity of a space and as crowds grow more people desire to become apart of the activity.
The requirement for retail on "First Floor and Sfueet Level" spaces within the Commercial
Core 1 Zone District is there to help provide the life and vitality along our pedestrianways. In
addition. the focation of uses identified on the "First F/oor aN Street Level"are those which
typically generate a great deal of sales tax, which is the primary source of revenue for the
Town's operational budget.
On August 23, 20O4, the Planning and Environmental Commission denied a conditional use
application by a vote of 3-3-1 to place a real estate office, Nico Vail, Inc., represented by
John Slevin, within the Vail Village Inn along Meadow Drive because of the impacts to the
vitafity and excitement desired along Meadow Drive. On September 21,2004, the Town
Council heard an appeal of the Planning and Environmental Commission denial of the
conditional use permit requested by Nico Vail, Inc. The Town Councilvoted 4-2-0 to uphold
the Planning and Environmental Commission denial because they agreed that the vitality
and excitement along Meadow Drive would be impacted as well as the economic generation
of the space would be impacted.
Staffs denial of the appellant's request was not arbitrary and the denial is not an expression
of the value the Town places in the Betty Ford Alpine Gardens. There are other locations in
Town in which zoning would permit this allocation of retail and office space in an individual
use. The two previous paragraphs detail staffs reasoning and logic in denying the
appellant's request based on the four bullet points identified above.
The Vail Town Code does not cunently have a definition for a "retail establishmenf. This
appeal has identified the need to have a definition of what a retailspace entails and horrvthe
space is operated. With the existence of horizontal zoning, the practice of restric{ing uses
not only by district but by floor level within an overall district, in several of ourzone districts it
will become increasingly neoessary to have a definition of retail space.
Staff would suggest that after this appeal is determined that we would proceed fonrard with
a telt amendment to add a definition for retail space establishments. After reviewing the
definitions above and several other planning definition publications staff would suggest that
a definition for'retail establishment" be added to the Vail Town Code which states:
?n establishment in which nineg (90o/) percent or more of the gross floor area is
devoted to the sale or rental of goods or merchandise to the general public for
personal or household consumption or to services incidental to the sale or rental of
such goods or merchandise."
STAFF RECOiIMENDATION
The Community Development Department remmmends that the Planning and
Environmental Commission upholds the administratlve denial of the requestfora tusliness
offtce" on the first floor or street level of the Sitsmark Lodge, pursuant to Section 12-78-3,
Permifted And Conditional Uses: First Floor Or Street Level, Vail Town Code, located at 183
Gore Creek Drive/Lot A, Block 58, Vail Village Filing 1, subject to the following finding:
'l . That the standards and conditions imposed by the requirements of Title 12
(Zoning Regulations) have been enforced correctly by the zoning
administrator.
Additionally, the Community Development Department recommends that the Planning and
Environmental Commissions directs staff to amend Sec{ion 12-2-2, Definitions, Vail Town
Code, to create a definition for retail establishment which states:
"RETAIL ESTABLISHMENT: An establishment in which ninety (90o/o) percent or
more of the gross floor area is devoted to the sale or rental of goods or merchandise
. to the general public for personal or household consumption or to services incidental
to the sale or rental of such goods or merchandise.'

On behalf of the Board of Directors of Betty Ford Alpine Gardens we respectfully request
an Appeal of the decision rendered by the Community Development Department
pursuant to our request to occupy First Floor or Street level tenant space for a
combination of Retail 75%) and Ofiice/Storage (25o/o).
Through a geneKrus offer from Bob and Helen Fritch (Owner/Landlord) the Betty Ford
Alpine Gardens have been offlered 1572 square feet of retail space at 183 Gore Creek
Drive. The unique opportunity was presented to the Garden Board at a cost that is more
than 50% less than current market rates for similar retail space.
By taking advantage of this opportunity the Betty Ford Alpine Gardens administrative
function would vacate their cunent offrce space, 150 square feet located behind the Front
Desk of the Sitzrnark Lodge.'lhese offices have become inadequate for staffand, do not
project a positive image for one of the most visible public summertime entities in the
Town of Vail.
Were it not for the Fritch's below market offer the Betty Ford Alpine Gardens Board of
Directors would not be in the position to consider establishing a year round gift shop and
upgrade administrative offices. Permission to do so from the Town of Vail would
enhance the Gardens the opportunity to rise to the next level as a professional
organization remaining in Vail Village while at the same time conducting a vibrant retail
operation. Our sales in the current School House Shop have risen sigrificantly over the
past five years. Along with the continued generation of sales tax revenue for the Town of
Vail the promotional value of summer in Vail would be extended throughout the fall and
winter months.
We feel that this issue is less about square foot percentages and more about the Town of
Vail recognizing the overall contribution of the Betty Ford Alpine Gardens as an key
member of the Art's and Cultural Entertainment economy.

The Board of Directors of the Betty Ford Alpine Gardens (BFAG) is appealing the
decision by the Community Development Department rendered on August 25,2004to
disallow BFAG from occupying first Floor or Street level retail space at 183 Gore Creek
Drive based on a proposed 75Yo retail and 25Vo ofhce/storage space allocation.
In the referenced decision letter staffcites "the Vail Town Code requires tenant spaces on
the first level ofa building or street level location to have retail uses occupy them per
section 12-78-3 Permitted and conditional Uses: First Floor Or Street Level, Vail Town
Code. Further the letter states that "Staffhas determined that in order for a use to be
considered "rctaif it must have 90% of the total area of a tenant space utilized as a sales
area and l0% devoted to office and storage."
The referenced Vail Town Code does not specifically mention the 90-10% space
allocation which leaves the Staffto interpret its meaning. By allowing the Betty Ford
Alpine Gardens to take advantage of the unique below market offer to lease this space we
feel the 75-25% proposed space allocation puts both the Town and the Gardens in a
winning situation. It will allow us to generate additional sales tax rev€nue over and above
current School House operation, promote summertime tourism on a year round basis,
and at the same time raise the overall image and professional approach to many of the
Gardens programs. In addition, it would allow another non-profit organization to remain
as a visible part of Vail Village.
The decision letter also states that "This requirement for retail on first floor or street level
spaces exists in order to generate activity and street life along pedestrian ways."
We know by looking at historical revenue growth in our Gift Shop operation, increased
numbers of visitors to the Gardens and increasing interest in alpine gardening that
through both our retail and administrative activities we would indeed generate activity
and street life.

Purpose: To provide a presence of our organization in Vail Village.
To expand the success ofour Schoolhouse Gift Shop by increasing the inventory
diversity and value to appeal to the winter guests of Vail.
To provide access for members & guests to our r€sources, including our
professional staff, on a year round basis.
Inventory:/ Alpine Treasures will feature original works of art, available on consignment, which are
painted and created in the Gardens by local and nationally known artists.
t/ Many pieces will be reproduced as gift cards & prints that are easy for cash & carry sales.
r' Alpine Treasures will feature unique gift items from Colorado artisans and craftsman.
r' Alpine Treasures will provide a selection of children's gifts, including books that
embrace ecology and educate our children to the importance of plants, animals & people.
Layout The Gallery & Gift Shop will have all windows used for merchandising of our
products. The majority of the space will be dedicated to the display and sale of these
items. The pres€nce of original art from the gardens in full bloom will be displayed for
our rnany winter guests who have not yet experienced the beauty of the Vail Valley in the
summer.
A small section of the shop will be used for access to our botanic library and
database for the educational benefit of our guests and members'
The shop will have small ofiices in the rear that are used for the year round
management of the Gardens. This includes staffthat book and arrange the many
educational tours and programs that are held each year in the gardens. Our Executive
Director, Director of Horticulture and our Head Gardner will all operate out of this space.
This will benefit the many visitors to Vail that are interested in our work and who have
questions about our unique Alpine Ecosystems.

VARIANCE FOR RESIDENTIAL ADDITION, SITZMARK LODCE
DESCRIPTION
The Property Owner desires to add space to the existing Dwelling Unit on the Site. The
existing structure exceeds the Height Regulations (Section 12-78-12 of the Zoning Regulations).
The site currently has Retail and Restaurant uses, Accommodation Units and related accessory
uses, as well as a single Dwelling Unit. The structure was built a considerable number of years before
the current Zoning Restrictions were developed. There is a considerable amount of CRFA that can be
added to the structure. The Dwelling Unit is on the top floor of the structure. The only location for the
addition of residential space to the existing Dwelling Unit is on the top floor.
The proposed addition is created by the expansion of the descending roof eave on the west
side of the sbucture making the addition visually compatible and minimizing the volume needed for
the new space.
The proposal also involves extension of two chimneys. These extensions are NOT related to
the expansion of the Dwelling Unit. The existing chimneys being extended do not meet Building
Code requirements at this time and are considered "architectural projections" by zoning regulations.
RELATIONSHIP TO OTHER STRUCTURES IN THE VICINITY
Adjacent structures exceed cunent height limib therefore there the additjon would not
constitute the granting of special privilege. Due to the minimal volume being created, the addition will
have litde impact on adjacent structures. The height of the proposed additjon is considerably lower
than the current ridgeline of the structure.
A similar variance was granted in July of 2000 for an addition on the east side of the structure.
Adjacent structures were granted Variances, similar to this request, over the years.
Due to the limited size of the addition and its location on the site, the effect on light and air,
distribution of population, transportation, traffic facilities, utilities, and public safety will be non-
existent.
COMPLIANCE WITH PLANNINC AND DEVELOPMENT OBJECTIVES
. lt is clear that it is desirable to maintain mixed uses in the CCI zone district. The proposed
addition will extend the livability of the existing Dwelling Unit. The existing site does not approach ib
capacity in terms of Dwelling Unit CRFA. lf the Properly Owner were to locate the proposed uses
elsewhere on the site it is most likely it would require the loss of Accommodation Unit uses on the site.

Town Code, to allow for a new residential addition, located at 183 Gore
Creek Drive (Sitzmark Building/Lot A, Block 58, Vait Viilage Fiting 1, and
setting forth details in regard thereto.

SUMMARY
The applicant, Bob Fritch, represented by Fritzlen Pierce Architcts, is requesting
a variance from Section 12-78-12, Height, Vail Town Code, and a major exterior
afteration pursuant to section 12-78-7, Exterior Alterations or Modifications, Vail
Town Code, to allow for a new residential addition at the Sitsmark Building.
Based upon staffs review of the criteria in section Vlll of this memorandum and
the evidence and testimony presented, the community Development Department
recommends approval, with condiflons, of the variance and major exterior
alteration subject to the findings and conditions noted in section tX of this
memorandum.
DESCRIPTION OF REQUEST
The applicant is proposing an approximately 167 sq. ft. addition to the west side
of the existing condominium located on the top floor of the sitsmark Buibing.
This addition would be accomplished by extending an existing down-sloping roof
line. The applicant is also proposing to raise the height of two existing chimneys
on the sitmark Building to bring the chimneys into compliance with the adopt6d
building codes. A more detailed description of the applicant's request and
architectural plans have been attached for reference (see Attachments B and c).
The Sitmark Building was originally constructed in 1969, prior to the Town of
Vail's adoption of zoning regulations, and is cunenfly zoned commercial core 1
and is non-conforming in regard to several provisions of the Town's cunent
zoning regulations.
Due to its scope of work, this proposal requires Planning and Environmental

Pursuant to section 12-7Y12, Height, Vail rown code, the maximum allowable
building height in the commercial core 1 district is determined by the VailVillage
urban Design Guide Plan. The VailVillage Urban Design Guide'plan states that:
" .. .Building height restictions in the commerciat core I shall be as follows:1- up to 60% of buitding (buitding covenge area) may be buift to a height of
33 feef ofless.
2. No more than 48/o of the building (buitding coverage area) may be higher

The existing SiEmark Building exceeds both the average and maximum buildingheight limits with the highest point of the existing building at a height of 57.1 ft.The proposed dormer additions and chimney extensions also Jxceed thesebuilding height limitations. Therefore, this proposal requires planning andEnvironmential commission approval of a variance from ihe Town's uiitaing
height limitations.
BACKGROUND
on July 10, 2000, the Planning and Environmental commission approved a
similar building height variance and a major exterior alteration for an addition onthe east side of the applicanfs condominium at the SiEmark Building.

The review criteria for a request of this nature are established by Chapter 12-16,
Vail Town Code.
A. Consideration of Factors Reqardinq Variances:

This proposed addition is associated with a remodel of an existing
residence at the Sitsmark BuiEing which was originally
constructed in 1969. The existing building is non-conforming in
regard to the building height provisions of the Town's zoning
regulations. The Planning and Environmentral Commission has
consistently held that construetion of a sbucture prior to
annexation or the adoption of the cunent zoning regulations may
be a basis for granting a variance ftom the Town's cunent zoning
regulations.
The existing SiEmark Lodge building, although non-conforming
with regard to building height, is sunounded by buildings that are
as large or larger in scale. Additionally, the use of the subjectpropefi (multi-family residentiat) is consistent with the uses
ouflined forVailVillage and the Commercial Gore I disbict

The applicant is proposing to construct a 167 sq. ft. addition to this
unit by extending an existing shed-type roof approximately 13 feet

to 53 fi. Staff believes that most any expansion to this dwelling
unit would reguire the approval of a building height variance;
therefore, Staff believes this proposal will provide the minimum
relief from the strict and literal interpretation and enforcement of
the building height regulations necessary to achieve compatibility
and uniformity among sites in the vicinity and within the
Commercial Core 1 district.
The Planning and Environmental Commission has consistenfly
held that constuction of a structure prior to the adoption of the
cunent zoning regulations may be a basis for granting a variance
ftom the Town's cunent zoning regulations. Therefore, Staff does
not believe this proposal will constitute a grant of special privilege.
The effect of the requested variance on llght and alr,
dlstrlbutlon of populatlon, transportatlon and trafflc facilites,
publlc facllitles and utllltles, and publlc safety.
Staff does not believe this proposal will have a significant impact
on the public health, safety or welfare, public facilities, utilities, or
light and air in comparison to existing conditions of the site. A
sun/shade analysis shows the proposed addition will not cast'shadows any further off the site than the existing Sitmark building.

applicable to the proposed variance.

condominium at the Sitzmark Building.
The design review application associated with this proposal is
tentatively scheduled for review by the Town of Vail Design
Review Board at its September 15,2004, public hearing

the proposal substantially complies with all other elements of the Vail
Comprehensive Plan.
STAFF RECOMMENDATION
The Community Development Department recommends apBroval, wlth
condfdong, of a variance, variance, pursuant to Chapter 12- 17 , Variances, Vail
Town Code, to allow for a variance from Section 12-7B.-12, Height, Vail Town
Code, to allow for a new residential addition, located at 183 Gore Creek Drive
(Sitzmark BuildinglLot A, Block 58, Vail Village Filing 1, and setting forth detrails
in regad thereto. This recommendation is based upon the review of the criteria
in Section Vlll of this memorandum and the evidence and testimony presented,
subject to thefollowing findings:
1. That the granting of the variance will not constitute a granting of special
privilege inconsistent with the limitations on other properties classified in
the same district.
2. That the granting of the variance will not be detrimental to the public
health, safety, or welfarE, or materially injurious to properties or
improvements in the vicinity.
3. That the variance is wananted for the following reasons:
a. The strict literal interpretration or enforcement of the specified
regulation would result in practical difficulty or unnecessary
physical hardship inconsistent with the objectives of this title.

VARIANCE FOR RESIDENTIAL ADDITION, SITZMARK LODCE
DESCRIPTION
The Property Owner desires to add space to the existing Dwelling Unit on the Site. The
existing structure exceeds the Height Regulations (Section '12-78-12 of the Zoning Regulations).
The site currently has Retail and Restaurant uses, Accommodation Unib and ielated accessorv
uses, as well as a single Dwelling Unit The stucture was built a considerable number of yearc before
the current Zoning Restrictions were developed. There is a considerable amount of CRFA that can be
added to the structure- The Dwelling Unit is on the top floor of the structure. The only location for the
addition of residential space to the existing Dwelling Unit is on the top floor.
proPosed addition is created by the expansion of the descending roof eave on the west
side of the structure making the addition visually compatible and minimizingihe volume needed for
the new space.
The proposal also involves extension of two chimneys. These extensions are NOT related to
the expansion of the Dwelling Unit- The existing chimneys being extended do not meet Building
Code requiremenb at dris time and are considered "architectural projections" by zoning regulatiins.
RELATIONSHIP TO OTHER STRUCTURES IN THE VICINITY
Adjacent structures exceed current height limits therefore there the addition would not
constitute the Snnting of special privilege. Due to the minimal volume being created, the addition will
have little imPact on adjacent structures. The height of the proposed addition is considerably lower
than the current ridgeline of the structure
A similar variance was granted in July of 200O for an addition on the east side of the structure.
Adjacent shuctures were granted Variances, similar to this reques! over the yean.
Due to the limited size of the addition and ib location on the site, the effect on light and air,
disbibution of population, transportation, traffic facilities, utilities, and public safety will be non-
ex istent.
coMPLtANCE W|TH PLANNtNC AND DEVELOPMENT OBJECTTVES
. lt is clear that it is desirable to maintain mixed uses in the CCI zone district. The proposed
addition will extend the livability of the existing Dwelling Unit. The existing site does not approach ir

This letter is to inform you that staff has reviewed your inquiry to allow the Betty Ford Alpine Gardens lo
occupy the Gore Creek Promenade retail space currently occupied by the Gore Creek Fly Fishermen
establishment. Per the documentation you faxed me it appears you would like to eslablish the Betty
Ford Alpine Gardens as a relail establishment with 552 square feet ol the tenant space devoted to gift
shop and 1020 square feet devoted to office area.
As you are aware lhe Vail Town Code requires tenant spaces on the first level of a build or on a streel
level location to have retail uses occupy them per Section 12-78-3, Permitted And Conditional Uses;
First Floor Or Street Level, Vail Town Code. Staff has determined that in order for a use to be
considered "retail" it must have 90% of the total area of a lenant space utilized as sales area and 107"
devoted to office space and storage. This requirement for retail on firsl floor or streel level tenant
spaces exists in order to generate activily and streel life along pedestrian ways.
Your proposal is for approximately 35% of the tenant space to be used for retail and 65% to be used for
otfice. Staff has determined that your proposal does not meet the Code reguiremenls for a retail
establishment. In order to allow the Betty Ford Gardens to occupy the space 90% of lhe floor area
needs to be devoted to retail sales and 10% devoted to office and storage.

Re: Garden Gift Shop
The Betty Ford Alpine Crardens would like to have a presenoe in the Vail Village for a
year-round gift shop and largeroffice space. The gift shop would not onlygenerate
revenue for the garden and sales tal< dollars for the Town but provide in-town exposure
for one of the most important assets of the Town. Many of the items in the shop would be
garden oriented, as well as garden-oriented afi.
The Garden office currently is located in donated space in the Sitzmark Building, but the
space is not adequate. We would plan to have some ofth€ gift shop art in the office area
for sale.
Unlike other charitable organizations in the valley that have moved out of Vail for lower
rentg the Garden feels very strongly that it is important to stay in Vail. Breeze Ski
Rentals is not renewing tleir lease on the Gore Crck Promenade and I have offered the
space to the Garden at a rent less than what I have been getting in order for them to afford
such an ideal location.
Attached is proposed layout. The gift shop occupies the entire front ofthe space using all
the windows for display, with an opening into tJre offrce.

I would like to draw your attention to the 1997 Uniform Building Code (UBC) Section
603.1 regarding stuctural elements of Type II buildings. The Sitzmark is a Tlpe II One-
hour building, and as such combustible materials are not permitted in the structural
elements. This will require a revision to the structural drawings to remove any wood in
the proposed addition as well as removing any existing structural wood.

If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a
review by the Building Department, the estimated Ume for a total review will take as long
as three (3) weeks.
All commercial (large or small) and all multFfamily permits will have to follow the above
mentioned maximum requirements. Residential and small projecb should take a lesser
amount of time. However, if residential or smaller projects impact the various above

construction sites have adequately established proper drainage from building sites along and
adjacent to Town of Vail roads or streets,
The Town of Vail Public WorK Departrnent will be required to inspect and approve drainage
adjacent to Town of Vail roads or streets and the installation of temporary or permanent culverb at
access points from the road or street onto the construction site, Such approval must be obtained
prior to any requests for inspection by the Town of Vail Building Department for footings,
temporary electrical or any other inspection. Please call Leonard Sandoval at 479-2L98 to request
an inspection from the Public Work Department. Allow a minimum of 24 hour notice.
