recording the plat and accompanying documents with the Eagle county clerkand Recorder upon Town of Vail approval .

DUPLEX SUBDIVISIONS
. 17,24,010 Duplex Subdivjsions - Required Approval
'' A resubdivjsion of an improved duplex lot and structure will require town
of Vai'l approval through the zoning adminjstrator. No duplex subdivision
shall b.e approved unless the lots are improved with at'l east foundations
for both units existing at the time of submittal.
17.24.030 Duplex Subdivision - Submittal Requirements
l. Two mylar copies of the dup'lex subdivision shall be.submitted to the department
of conrnunity development. The plat shall include a s'ite map fol'lowing
the requirement of Section 17.22.A30, The plat must contain the following
. statement: "For zoning purposes,-the two 'l ots created by this subdivision
are to be treated as one entity with no more than one 2-family res'idence
al1owed on the combined area of the two 19t.t. The statement must be modifjed
as to the number of parcels proposed.
2. - A.:capy of the declarations and/or covenants attached to the subdivision
to assure the maintenance of any comrrbn areas which are being created.
17.24.050 Duplex Subdjvision--Procedure
The duplex subdivision procedure will follow the procedure for condominium and
townhouse plats as found in Section 17.22.050 of this tit'le with the addition
of an improvement location certificate.
17.24.080 Criteria for Review
The duplex subdivision wil'l be reviewed to see that it complies with the zoning
ordinance with respect to building locat'ion and other aspects of the structure
and grounds with the original p1 ans as approved by the design review board of
the town and to review the accurateness and jntegrity of the survey data found
on the plat.

17.24.100 Appeal of Zoning Admjnistrator,s Decision :
The zoning administrator's decision may be appealed to the pEC and such
appeal shall follow procedures set forth in section 1g.86.030 of the
Vail Municipal Code.

The department of comrnunity development wi'l'l record the plat with the Eagle

WHEREAS, GARY R. BOSSOW and MARA GRASIS BOSSOW and
RON BYRNE (collectively rrDeclarantrt) , the ordners in feesinple of the following described real property (rrsubjectpropertylr) situate in the Town of Vait located in County ofEagle, Colorado, to wit: Resubdivision of Lot 9, Block 2,Vail Village Third FiIing.
I{HEREAS, there has been constructed on the subjectproperty a building consisting of two dwelling units, whichare separated by a conmon wall, which hereinafter shall bereferred to as a rrparty wallrr i and
WHEREAS, Declarant wishes to provide for theseparate ownership of such units and a division of the landinto two separate states and to create easements relating tothe certain separately owned property and the party wall(placed equally divided on the conmon boundaries separatingthe units), the footings underlying such party wall and theroof over such party wall;
NOW THEREFORE, in consideration of these premises,the Declarant hereby makes, publishes and declares thefollowing easenents and restrictions which shall hereafterrun with the land and be binding upon and inure to benefit ofDeclarant, its successors and assigns foreveri

4. PARTY WALL DECI"ARATIoN. The said party walldividing Units N and S is hereby declared to be a party wall
and shall be construed as a party wall between such
townhouses under the laws of the State of Colorado except asspecifically provided herein.
5. EASEUENT. Each ohrner shall have a perpetualreciprocal easement in and to that part of the subjectproperty owned by the other ohrner and on wbich said partywall is located, for party walt purposes, includingmaintenance, repair and inspection; neither owner shall alteror change said party wall in any manner, interior decorationexcepted, and said party wall shall always remain in the samelocation as when erected.
54. DRMWAY EASEUENT. Each owner shall have aperpetual reciprocal driveway easement as per the registeredplat.
6. !,TAINTENANCE OF PARTY WALL. The cost ofnaintaining the party wall shall be borne egually by bothowners. Maintenance of the external appearance and roofs ofthe party wall shall be undertaken with the unanimous consentof both ownersr and at the egual expense of both olrners unlessthe owners unaninously agree to the contrary.
7. DAMAGE TO PARTY WALL. In the event of damageor destruction of said party wall from any cause, other thanthe negligence of either party thereto, the then ownersshall, at Joint expense, repair or rebuild said party wall,
and each party, his successors and assigns, shall have theright to the full use of said party wall so repaired orrebuilt. If either party,s negligence shall cause damage toor destruction of said party wall, such negligent party strallbear the entire cost of repair or reconstruction. If eitherparty shall neglect or refuse to pay his share, or all ofsuch costs in case of negligence, the other party may havesuch sall repaired or restored and shall be entitled to havea nechanic's lien on the premises of the party so failing topay, for the anount of such defaulting partyrs share of therepair or replacement cost, interest accruing at the rate of18* per annum, costs and attorneyrs fees.
8. DRILLING THRoUGH PARTY WALL. Either partyshall have the right to break through the party wall for thepurpose of installing, repairing or restoring sewerage,water, electric or gas lines, pipes, wires, or conduits orlines, pipes, wires or conduits for other utilities, subjectto the obligation to restore said wall to its previousstructural condition at his own expense and the payment, tothe adjoining owner, of any danages negligently caused
thereby.
9. EXTERIOR DECORATION ORshall make or suffer any structural orSTRUCTIIRES. No onner
design change(including color change) of any type or nature whatever tothe exterior of any inprovement on the subject propertywlthout obtaining the prior written consent of the otherowner, which consent shall not be unreasonably withheld ordelayed. No exterior structures or entrances, in addition tothose placed thereon according to the architectural plans onwhich the buildings are constructed, shall be added to eitherdwelling unit without the consent of all the owners, which
consent shall not be unreasonably withheld or delayed.
10. DAI'IAGE OR DESTRUCTION OF DWELLING IJNIT. Inthe event of destruction or daruage of Units A and/or B, or
any portion thereof, the dwelling so destroyed or damagedshall be restored, by the owner of such unit at its sole costand expense to substantially its condition and finishinmediately prior to such daruage or destruction provided thatif the owner of the danaged or destroyed unit deiires torestore its unit so that its exterior, appearance and/orfinish is different than it was innediately prior to such
danage or destruction, such owner shall not do so unless the
new exterior, appearance and/or finish is approved by theother olrner, such approval not to be unreasonably withheld or
delayed if the proposed exterior, appearance and/or finish isconsistent with the exterior, appearance and finish of the
nondanaged unit. If the owner of such danaged or destroyedunit doeE not comnence repair or reconstruction within 1.80days from the date such danage occurs, the other ohrner may do
soi provided, however, that such repair or reconstructionshall not be undertaken without prior notice to and consentby any holder of a first nortgage or first deed of trust
encumbering the inprovernents danaged or destroyed and furtherprovided that suctr mortgagee may refuse to consent to suchrepair or replacement. Costs of any such repair orreconstruction, to the extent possible, shall be paid for byinsurance applicable to the danaged improvenents. If thecost of repair, replaceurent or reconstruction exceeds suchinsurance, the excess shall be paid for by the owner of the
danaged lnprovenents. Should any otrner fail or refuse to payhis proportionate share of the costs of repair orreplacement, the other owner may nake palment, and shall beentitled to have a mechanicrs lien on the premises of theparty so failing to pay, for the amount of such defaultingparty's share of the repair or replacement cost, interestaccruing at the rate of 18t per annum, costs and attorneyrsfees. The provisions of this paragraph 1O shall not apply tothe danage or destruction of the party wall, which shalL begoverned by the provisions of paragraph 7.
Ll. fNSURANCE. Each ordner shall obtain andmaintain at all times insurance against loss or damage byfire and such other hazards as are generally covered in thearea under standard extended coverage provisions for at leastthe full insurable replacement cost of the improvements onthe subject property owned thereby. proof of such insuranceshall be supplied by each owner upon the reasonable requestof the other owner. The insurance shall provide that itcannot be cancelled by either the insured or the insurance
company until written notice has been sent to the otherowner. Each owner may obtain whatever additional insurancehe so desires. Each owner may, at any tine two years orlonger after the most recent appraisal, dernand of the otherowner an appraisal of the inprovements for insurancepurposes, or, if the requested party fails to obtain anappraisal within 90 days after a request therefor, rnay havesuch appraisal madei in case of any such appraisal , theparties shall share the costs thereof equally.
L2. COVENANTS RUNNING WITH THE I,AND. ThE
easenents and restrictions hereby created are and shall beperpetual and construed as covenants running with the land
and each and every person accepting by deed or otherwise anyportion of the subject property shall be deemed to have
accepted the sarne with the understanding that he is boundhereby and that each and every other purchaser is also bodndhereby, and that he is entitled to the benefits hereof andthat any other present or future owner by deed or otherwiseis sinilarly bound hereby and entitled to the benefit hereof,all to the same extent as though such person had signed thisinstrument. The undersigned, in executing and delivering
deeds to the described premises nay provide, by reference, insaid conveyances, that the same are subject to the terms,conditions, reservations, restrictions and covenants hereincontained, and nay designate the book and page of the recordin which thl-s instrunent is recorded.
13. RESIDENTIAL USE. The units shall be used forresidential purposes and shall at all times be used inconfotnity with covenants of record and ordinances of the
Town of VaiI, Iocated in the County of Eagle or any othergovernmental authority which shall trave jurisdiction, Units Nand S shall be occupied and used by the respective Olrnersonly as private dwellings for the Onner, his farnily, tenants,social guests, and for no other purposei and such use shallbe in accordance and cornpliance with the zoning ordinance ofthe County of Eagle, and State of Colorado. No Otrner shallkeep, allow on the premises, or board any donesticatedhousehold animal , other than a domesticated bousehold anirnal
owned by an Owner, his family, tenants and social guests; andin no event, shall there be allowed to be kept, boarded or
maLntained on the premises more than two (2) donesticated
household aninals for each dwelling unit; and for the purposeof this Declaration, a donesticated household animal shalt
mean the following, to wit: dog, domesticated cat,(excluding mountain lion, tiger, lion, etc. ) , bird. No otheranlnal shall be allowed to be kept, boarded, or reposedwithin a dwellinq unit or upon a parcel , unless writtenconsent of the Owner of the other dwelling unit shall firstbe obtained, and provided that such event is in conformanceand conpliance with the zoning resolution of the County ofEagle, State of Colorado. The respective parcels shall notbe rented by the Owners thereof for transient or hotelpurpose: and such purposes shalt be defined as: (a) rentalto any individual , group or entity for any period less than
one week during any calendar year; or (b) any rental , if the
occupants of the dwelling Unit are provided customaryservice, laundry and linen services, and bellboy service.Other than the foregoing obligations, the Owners of theparcels shall have the absolute right to lease sane providedthat the lease is nade subject to the covenants andrestrictions contained in this Declaration, and is in fullconpliance with the zoning resolution of Town of Vail ,located in Eagle County, Colorado.
L4. AI,IENDMENTS. These easements and restrictions
nay be anended or revoked only by an instrument in writingduly executed and acknowledged by aII ohrners of the subjectproperty and all holders of recorded first nortgages or first
deeds of trust thereon, and upon the recording of said
amending instrunent.
15. SEVERABIIJITY. If any provision of thisDeclaratlon or any section, sentence, clause, phrase or word,or the application thereof in any circunstance, is heldinvalid, the validity of the reniinder of this instrument andthe application of any provision, section, sentence, clause,phrase or word in any other circunstances shalI not beaffected thereby.
16. GENERAL.
a) Any lien filed by an owner pursuant to thisDeclaration shall be subordinate to the lien of any firstnortgage or first deed of trust on the unit.
b) Should either party be reguired to take actionto enforce, by legal proceedings or otherviser ErDy condition,restriction, covenant or other right or obligation inposedpursuant the this Declaration, tht prevailinq party shall beentitled to recover its costs and reasonable attorneyrs fees.
c) Each owner shall register its nailing addresswith the other onner and aII noti6es or demands intended tobe served upon owners shall be sent by registered orcertified nail, postage prepaid, addressed in the name of the
owner at such registered urailing address. fn thealternative, notices may be delivered, if in writing,personally to owners.
d) Prospective purchasers of units shall beentitled to determine if a selling onner is in default withrespect to any naintenance obligation or other obligationunder these covenants by delivering a written inquiry withrespect thereto to the ordner of the other unit. If noresponse is received to such inquiry within 30 days of thedate said notice is received, the nonselling'owner shall be
deemed to have waived any claim of lien or claim for darnage.
The existence of a recorded notice of a lien, however, shallconstitute notice to a prospective purchaser of a clain by anowner of the other unit, and shall not be affected by theforegoing request for infonnation.
e) If any encroachments by the inprovements no!'tlocated on the subject property, or any ninor encroachmentderiving frorn replacement thereof, exists upon any parcel ,provided sane does not render title unmarketable a valid
easement therefore and for naintenance thereof shalt exist.
f) All owners of any interest in the property byaccepting a deed to any interest thereto waive the hornesteadexenption or any other exenption of the State of Colorado orany federal law only as related to any lien filed by any

dimensions or location of any improvement now or hereafter erected on the land, or prohibiting a separation in
ownership or a reduction in the dimensions or area of the land, or the effect of any violation of any such law,
ordinance or governmental regulation.
2. Rights of eminent domain or governmental rights of police power unles notice of the exercise of such rights
appears in the public records at Date of Policy.
3. Defects, liens, encumbrances, adverse claims, or other matters (a) created, suffered, assumed or ageed to by the

1. Definition of Terms
The following terms when used in this policy mean:
(a) "insured": the insured named in Schedule A, and,
subject to any rights or defenses the Company may have
had against the named insured, those who succeed to the
interest of such insured by operation of law as distinguished
from purchase including, but not limited to, heirs; distri-
butees, devisees, survivors, personal representatives, next of
kin, or corporate or fiduciary successors.
(b) "insured claimant": an insured claiming loss or
damage hereunder.
(c) "knowledge": actual knowledge, not constructive
knowledge or notice which may be imputed to an insured
by reason of any public records.
(d) "land": the land described, specifically or by
reference in Schedule A, and improvements affixed thereto
which by law constitute real property; provided, however,
the term "land" does not include any property beyond the
lines of the area specifically described or refened to in
Schedule A, nor any right, title, interest, estate or ease.

edness secured by a purchase money mortgage given by a
purchaser from such insured, or so long as such insured
shall have liability by reason ofcovenants of warranty made
by such insured in any transfer or conveyance of such
estate or interest; provided, however, this policy shall not
continue in force in favor of any purchaser from such
insured of either said estate or interest or the indebtedness
secured by a purchase money mortgage given to such insured.
3. Defense and Prosecution of Action3 - Notice of
Glaim to be given by an Insured Claimant
(a) The Company, at its own cost and without undue
delay, shall provide for the defense of an insured in all
litigation consisting of actions or proceedings commenced
against such insured, or a defense interposed against an
insured in an action to enforce a conract for a sale of the
estate or interest in said land, to the extent that such
litigation is founded upon an alleged defect, l.ien, encum-
brance, or other matter insured against by this policy.
(b) The insured shall notify the Company promptly
in writing (i) in case any action or proceeding is begun or
del-ense is interposed as set forth in (a) above, (ii) in case
klowledge shall come to an insured hereunder of any claimof title or interest which is adverse to the title to the estate

insured, is rejected as unmarketable. If such prompt notice
shall not be given to the Company, then as t-o sucir insuied
all liability of the Company shall cease and terminate in
regard to the matter or matters for which such prompt
notice is required; provided, however, that failure to'notiiy
shall in no case prejudice the rights of any insured under
this policy uniess the Company shall be prejudiced by such
failure and then only to the extent of such prejudice.
(c) The Company shail have the right at its own cost
to institute and without undue delay prosecute any action
or proceeding or to do any other act which in its opinion
may be necessary or desirable to establish the title to the
estate or interest as insured, and the Company may take any
appropriate action under the terms of this policy, whether
or not it shall be liable thereunder, and shall not therebv
concede liability or waive any provision of this policy.
(d) Whenever the Company shail have brought any
action or interposed a defense as required or permitted by
the provisions of this policy, the Company may pursue any
such litigation to final determination by a court ofcompe.
tent jurisdiction and expressly reserves the right, in its sole
discretion, to appeal from any adverse judgnent o! order.
(e) In all cases where this policy permits or requires
the Company to prosecute or provide for the defense of
any action or proceeding, the insured hereunder shall
secure to the Company the right to so prosecute or provide
defense in such action or proceeding, and all appeals therein,
and permit the Company to use, at its option, the name of
such insured for such purpose. Whenever requested by the
Company, such insured shall give the Company all reason-
able aid in any such action or proceeding, in effecting
s€ttlement, securing evidence, obtaining witnesses, or pro-
secuting or defending such action or proceeding, and the
Company shall reimburse such insured for any expense
so incurred,
4. Notice of Loss - Limitation of Action
I
In addition to the notices required under paragraph 3(b)
of these Conditions and Stipulations, a statement in writing
of any loss or damage for which it is claimed the Company
is liable under this policy shall be fumished to the Con.
pany within 90 days after such loss or damage shall have
been determined and no right of action shall accrue to an
ilsured claimant until 30 days after such statement shall
have been fumished. Failure to fumish such statement of
los or damage shall terminate any liability of the Company
under this policy as to such loss or damage.
5. Options to pay or Otherwise Senle Claims
The Company shall have the option to pay or otherwise
settle for or in the name of an insured claimant any claim
insured against or to terminate all liability and obligations
of the Company hereunder by paying or tendering payment
of the amount of insurance under this poiicy together with
any costs, attorneys] fees and expenses incurred up to the
time of such payment or tender of payment, by the insured
claimant and authorized by the Company.
6. Determination and Payment o{ Loss
(a) The liability of the Company under this policy
shall in no case exceed the least of:
(i) the actual ioss of the insured claimant; or

(b) The Company will pay, in addition to any loss
insured against by this policy, all costs imposed upon an
insured in litigation carried on by the Company for such
insured, and all costs, attomeys' fees and expenses in
litigation carried on by such insured with the written
authorization of the Company.
(c) When liability has been definitely fixed in accor"
dance with the conditions of this policy, the loss or damage
shall be payable within 30 Cays thereafter.
7. Limitation of Liability
No claim shall arise or be maintainable under this policy
(a) if the Company, after having received notice of an
alleged defect, lien or encumbrance insured against here-
under, by litigation or otherwise, removes such defect,
lien or encumbrance or establishes the title, as insured,
within a reasonable time after receipt of such notice; (b) in
the event of litigation until there has been a final determin.
ation by a court of competent jurisdiction, and disposi-
tion of all appeals therefrom, adverse to the title, as insured,
as provided in paragraph 3 hereof; or (c) for liability
voluntarily assumed by an insured in settling any claim or
suit without prior written consent of the Company.
8. Reduction of Liability
All payments under this policy, except payments made
for costs, attomeys' fees and expenses, shall reduce the
amount of the insurance pro tanto. No payment shall be
made without producing this policy for endonement of
such payment unless the policy be lost or destroyed, in
which case proof of such loss or destruction shall be
furnished to the satisfaction of the Company.
9. Liability Noncumulative
It is expressly understood that the amount ofinsurance
under this policy shall be reduced by ilny amount the Com-
pany may pay under any policy insuring either (a) a
mortgage shown or refened to in Schedule B hereof which
is a lien on the estate or interest covered by this policy, or
(b) a mortgage hereafter executed by an insured which is
a charge or lien on the estate or interest described or
referred to in Schedule A, and the amount so paid shall be
deemed a payment under this policy. The Company shall
have the option to apply to the payment of any such
mortgages any amount that otherwise would be payable
hereunder to the insured owner of the estate or interest
covered by this policy and the amount so paid shall be
deemed a payment under this policy to said insured owner;
10. Apportionment
If the land described in Schedule A consists of two or
more parcels which are not used as a single site, and a los
is established affecting one or morc of said parcels but not
all, the loss shall be computed and settled on a pro rata
basis as if the arnount of insurance under this policy $rs
divided pro rata as to the value on Date of Policy of each
separate parcel to the whole, exclusive of any improvements
made subsequent to Date of Policy, unless a liability or
value has otherwise been agreed upon as to each such parcel
by the Company and the insured at the time of the issuance
of this policy and shown by an express statement herein or
by an endorsement attached hereto.
11. Subrogation Upon Payment or Settlement
Whenever the Company shall have settled a claim under
this policy, ail right of subrogation shall vest in the Com-
pany unaffected by any act of the insured claimant. The
Company shall be subrogated to and be entitled to all
rights and remedies which such insured claimant would
have had against any person or property in respect to such
claim had this policy not been issued, and if requested by
the Company, such insured claimant shall transfer to the
Company all rights and remedies against any person or
property necessary in order to perfect such right of subro.

such insured claimant in any transaction or litigation in-
volving such rights or remedies. If the payment does not
cover the loss of such insured claimant, the Company shall
be subrogated to such rights and remedies in the proportion
which said payment bears to the amount of said loss. If
loss should result from any act of such insured claimant,
such act shall not void this policy, but the Company, in
that event, shall be required to pay only that part of any
losses insured against hereunder which strall exceed the
amount, if any, lost to the Company by reason of the
impairment of the right of subrogation.
12. Liability Limited to this Policy
This instrument together with all endorsements and
other instruments, if any, attached hereto by the Company
is the entire policy and contract between the insured and
the Company.
Any claim of loss or damage, whether or not based on
negligence, and which adses out of the status of the title to
the estate or interest covered hereby or any action asserting
such claim, shall be restricted to the provisions and con-
ditions and stipulations of this policy.
No amendment of or endonement to this policy can be
made except by writing endorsed hereon or attached hereto
signed by either the President, a Vice President, the Secre.

All notices required to be given the Company and any

Re: Lot 9 Franing Inspection
Dear Joe.
The following are ny responces to your franing inspection of the
Prinary unlt of the Bossow Residence, Lot 9, Beaver Dan Road:
Item 1 - 14" TJI's @ 2'.0" 0.C. will span fron the existing
larninated bean to the south concrete wall and it will not be
necessary to install the other 5 1/8" x 12" laminated beam.
Iten 2 - The lack of double trimmers on the large picture windows
in the living roon can be solved by first adding a 2x4 stud to
the south klng stud and nailing and gluing them together,
followed by adding a light gauge metal plate fron the king studs
to the header. This plate wlll be approximately 8"x12". The plate
will be nailed with Ti.co nails at 2" on center each way.
For the north side the same olate will be used and nailed in a
sinilar manner.
Item 3 - The 2x12 header over the bar in the llving roon can be
omitted because of the additional framing wall at the back of the
bar.
Iten 4 - The header that was overlooked on the second level by
the pool area should be installed and can be a triple 2x8 hung
with 90 degree framing clips.
