The Stemplers request you give consideration to the following small addition to their
existing residence:
The zoning is two family primary/secondary.
The use is single family residence.
Their lot size is: I1,064 sq ft
Under the new GRFA rules:
.46 x 10,000 sq ft = 4,600 sq ft
.38 x 1,081 sq ft = 404 sq ft
Total Allowable: 5,004 sq ft
Existing Square Footage = 4,518 sq ft (This needs new confirmation based on new
GRFA rules)
Remaining Allowable = 486 sq ft
Proposed Addition = 108 sq ft
The addition proposed will add storage for:
l) Upper level: Kitchen
2) Lower level: off-season storage
Do we need to have a pre-application conference with the staff or is this staff approvable?
Also will we need a new title report and survey for this minimal square footage? Please

B. No labor or materials have been furnished by mechanics or materialmen for purposes of construction on the
land described in Schedule A of this Commitment within the past 6 months.
C. The Company must receive an appropriate affidavit indemnifying the Company against unfiled Mechanic's
and Materialmen's Liens.
D. The Company must receive payment of the appropriate premium.
E. If there has been construction, improvements or major repairs undenaken on the propeny to be purchased,
within six months prior to the Date of the Commitment, the requirements to obtain coverage for unrecorded
liens will include: disclosure of certain construction information; financial information as to the seller, the
builder and/or the contractor; payment of the appropriate premium; fully executed Indemnity agreements
satisfactory to the company; and, any additional requirements as may be necessary after an examination of
the aforesaid information by the Company.

CONDITIONS
1. DEFINITIONS
(a) "Mortgage" means mortgage, deed of trust or other security instrument. (b) "Public Records"
means title records that give constructive notice of matters affecting your title - according to the
state statutes where your land is located.
2. LATERDEFECTS
The Exceptions in Schedule B - Section II may be amended to show any defects, liens or
encumbrances that appear for the first time in the public records or are created or attached between
the Commitment Date and the date on which all of the Requirements (a) and (c) of Schedule B -
Section I are met. We shall have no liabilitv to vou because of this amendment.
3. EXISTTNGDEFECTS
If any defects, liens or encumbrances existing at Commitment Date are not shown in Schedule B, we
may amend Schedule B to shown them. If we do amend Schedule B to show these defects, liens or
encumbrances, we shall be liable to you according to Paragraph 4 below unless you knew of this
information and did not tell us about it in writine.
4. LIMITATION OF LIABILITY
Our only obligation is to issue to you the policy referred to in this Commitment when you have met
its Requirements. If we have any liability to you for any loss you incur because of an error in this

Dear Brian,
Thank you for providing as-buill drawings of the Stempler Residence. I have digitized the plans,
and the following are my calculations for GRFA and site coverage:
GRFA Existing: 3,655 sq. ft.
Site Coverage Existing: 2,408 sq. ft.
Should the Stemplers wish to eliminate the EHU, the total GRFA cannol exceed 3,441 sq. ft.
However, should the Stemplers wish to revise the EHU, the total GRFA cannol exceed 4,61 6
sq. ft. The primary unit cannot exceed 3,441 sq. ft. while the EHU can be up to 1,175 sq. ft.
Please refer to my letter of February 15'n. The GRFA credits from the EHU cannot be
transferred to the primary unit.
425 Credit
The EHU regulations were amended in April of 2000 for various reasons. First, Town Council
identified the difficulty of enforcing the previous deed restrictions, and saw a need to creale
deed restrictions that are more enforceable. Second, Town Council identified the need for
additional incenlives lo encourage the construction of EHUs. The Town Code previously stated
with regards to Type I EHUs:
It shall be entitled to a gross residential floor area credit of four hundred twenty five (425)
square feet, as set forth in subsections 12-6C:882 and 12-6D-BB2 of this Title.
When the EHU amendments were completed last April, the EHU regulations were simplified and
additional GRFA credils were allotted to the employee housing unit. Previously, lhe total GRFA
credit for a Type I EHU was 675 sq. ft. (425 credit + 250). Any GRFA constructed for a Type I
EHU beyond 675 sq. ft. was subtracted from the GRFA allowed for the primary unit. With the
current revisions to the GRFA credits for a Type I EHU, the total GRFA credit is 925 sq. ft. (425
credit + 500). The revisions also allowed EHUs to apply for an additional 250 sq. ft. as outlined
in Section 12-15-5 of the Town Code. Because a property is only eligible for the additional
credits when an EHU is proposed on the site, the GRFA credits are applied only to the EHU and
cannot be transferred to the other unit on the site.

The intention of the GRFA bonuses for EHUs is to creale incenlives for lhe construction of
additional employee housing units scattered throughout town. The credits are intended to allow
for the creation of EHUs without having an effect on the developmenl potential of the site. By
allowing for additional credils, the GRFA of the primary unit is not effecled by the creation of the
EHU. The intenl was not to make the primary unit on the site larger.
As stated above, the 425 credit has consistently only been allotted to the Type I EHU. I can
provide many examples of this policy (see below) and believe that to be consistent and fair, I
have to deny your request to use the 425 credit in the primary unil.
Recent examples ol Type I EHUs where the GRFA has been allocated correctly are:

There are mulliple lot sizes indicated in the legal file for Lot 4, Block 6, Vail Village 7th.
According to the application for a remodel in 1991 , the total site area is listed at 11,799.44 sq. ft.
Other older documents within the legal file indicate that the lot size is 11,064. As in all cases
where there are discrepancies with lot sizes, the Town will require a verified lot size lrom a
stamped survey of the lot. I have therefore calculated your allowable GRFA based on both lot
sizes.
I have reviewed the Town's file regarding Lot 4, Block 6, Vail Village 7rh wilh consideration of
your request to eliminate the existing deed reslriclion for the employee housing unit. I am
basing the following calculations on the information in the file. All existing square footages must
be verified with as-built drawings.
Lot Size: 1 1,7'l7.64 sq. ft.
GRFA allowable:
Allowed on lot with 1 dwelling unit: 3354 + 250 = 3604 sg. fl.
Allowed on lot with dwelling unit and EHU: 3280 + 2(250) + 500 = 4780 sq. ft.

Following is a request for design review approval for adding a moss rock stone
veneer to the first story of the Stempler Residence at lO44 Homestake Circle.
I am enclosing this letter of explanation to make sure that there is no
misconception regarding events leading up to this application. I was
approached by Ned Gwathmey and the stemplers toestimate this job.
Iwas told by Ned Gwathmey that DRB had approved this application of stone tothis residence. I signed the contract with thebwners anO tbiO the mason to go
ahead and stock the stone onsite while I applied for a permit.
upon coming to the office to apply for the permit I found out that no DRB
approval had been issued. I checked with Ned who s,wore it had been done but
co-uld find no paperwork in his files to support that thmry. Therefore I amsubmitting the enclosed application.
I a-m enclosing this letter of explanation so that anyone that travels to the sitewill not be surprised by the fact that the stone is already there. we are not

A pre-application meeting with a member of the planning
staff is strongly encouraged to deternine if any additionalapplication information is needed. It is the applicanttsresponsibility to make an appointnent with the staff to

rII. IMPORTANT NOTTCE REGARDING ALL SUBMISS]ONS TO THE DRB:
A. In addition to meeting submittal requirements, theapplicant must stake and tape the project site toindicate property lines, building lines and buildingcorners. A11 trees to be removed nust be taped. A11site tapings and staking must be conpleted prior to the
DRB site visit. The applicant must ensure that staking
done during the winter is not buried by snow.
B. The reviehr process for NEhl BUILDINGS normally requirestwo separate meetings of the Design Review Board: aconceptual approval and a final approval. Applicants
should plan on presenting their development proposal ata minimum of two meetinqs before obtaininq final
approval.
C. Applicants who fail to appear before the Design Review
Board on thej-r schedufed meeting date and who have not
asked in advance that discussion on their item bepostponed, will have their items removed from t.he DRB
docket until such time as the item has been
republished.
D. The following items may, at the discretion of the
zoning administrator, be approved by the Community
Development Department staff (i.e. a formal hearing
before the DRB may not be required):
a. Windows, skylights and sinilar exterior changes
which do not alter the existing plane of thebuilding; and
b. Building addition proposals not visible from anyother lot or public space. At the time such aproposal is submitted, applicants must include
letters from adjacent property owners and/or fromthe agent for or manager of any adjacent
condominium association stating the association
approves of the addition.
E. If a property is located j.n a napped hazard area (i.e.
snow avalanche, rockfall-, flood p1ain, debris flow,
wetLand, etc) r a hazard study must be submitted and the
owner must sign an affidavit recognizing the hazard
report prior to the issuance of a building permit.
Applicants are encouraged to check with a Town Plannerprior to DRB application to determine the relationship
of the property to all mapped hazards.
F. For alI residential construction:
a. Clearly indicate on the floor plans the inside
face of the exterior structural walls of the
building; andb. Indicate with a dashed Line on the site plan a
four foot distance from the exterior face of the
building walls or supporting columns.
G. If DRB approves the application with conditions or
modifications, al] conditions of approval must be
resolved prior to Town j.ssuance of a building permit.

It has come to my attention that Tom Francis, part-time resident of Home StakeCircle, has prevaiied upon the town to assume liability of his damaged split railfence. I protest the use of tax payer's money for thi! purpose on lhe f6ttowing
grounds:
1. A1 though it is possible that the snow plow collided with the fence, it is
more likely that the pressure of the enorfious quantities of snow placed
undue weight on the fence. There is no evidence that the snow plow isdirectly responsible.
2. The fence is il1egal. I have ascertained that the fence was never approved
by the Design Review Board. If such a request had come before the D.R.B.
surely my wishes would have been considered. I am not an adjacent property
owner, but the opposite one. (Enclosed is a copy of the letter I sent toTerry Minger and his reply re: Francis fence and problems of snow removal
as it might affect our property and its drainage problems.) The fence was
constructed during our vacation last fall. When we got home, there it wasl

fence is placed on the town's right-of-way rather than on Francis property.
If the town accedes to this claim two things can happen; the snow plow will haveto be especially careful with snow removal on the Francis side to avoid further
costs-and my property will probably be the recipient of most of the snow and spring
f1 ooding; any property owner with a fence bordering a public road can claimproperty damages to their fence from the l:own, whether the damages are legitimateor not.
I therefore request that the town of Vail disclaim responsibi'l ity for this request.I also suggest that the town councjl consider passing legislation forbidding theerection of fences bordering public roads. (Imagine if I had a fence opposite the
Francis fence and the Donovans had a fence opposite the Seiberts who also had an
imaginary fence. where would the snow plow push the snow?) It is a matter ofsetting a dangerous precedent and also of principle.
