SUMMARY
The applicant, Donna Giordano, represented by VAG, Inc., is requesting final review of a
conditional use permit, pursuant to Section 12-6D-3, Conditional Uses, Vail Town Code,
to allow a Type ll Employee Housing Unit (EHU), located at 11O7 and 1109 VailValley
Drive/Lot 7 and part of Lot 8, Block 6, Vail Village Filing 7.
Based upon Staffs review of the criteria outlined in Section Vlll of this memorandum and
the evidence and testimony presented, the Community Development Department
recommends approval with conditions, of the requested conditional use permit subject
to the findings and conditions noted in Section Vll of this memorandum.
DESCRIPTION OF THE REQUEST
The applicant, Donna Giordano,,represented by VAG, lnc., is requesting final review of a
conditional use permit, pursuant to Section 12-6D-3, Conditional Uses, Vail Town Code,
to allow a Type ll Employee Housing Unit (EHU), located at 1107 and 1109 Vail Valley
Drive/Lot 7 and part of Lot 8, Block 6, Vail Village Filing 7.
The applicant is proposing to construct a new single family residence accompanied by a
401 square foot Type ll EHU with 246 square foot, single car EHU garage. The total
area dedicated to the Type ll EHU and garage would be 647 square feet.
A vicinity map (Attachment A), the applicant's reguest (Attachment B), and architectural
plans (Attachment C) have been attached for reference.
BACKGROUND
On Jufy 18, 2007 , the Design Review Board approved the plans for a new single-family
residence with a Type ll EHU, contingent upon the applicant obtaining Planning and
Environmental Commission approval of a Conditional Use Permit for the EHU
ilt.

12-6E-1: P,JRPOSE:
The two-family pimary/secondary residential distict is intended to provide sites
for single-family residential uses or twofamily residential uses lh which one unit
is a larger primary rcsidence and the second unit is a smaller caretaker
apartment, together with such public facilities as may appropriately be located in
the same zone distict. The two-family primary/secondary residential district is
intended to ensurc adequate light, air, privacy and open space for each dwelling,
commensurate with single-family and twofamily occupancy, and to maintain the
desirable residential qualities of such sifes by establishing appropiate site
d ev el opm e nt st a nd a rd s.
CHAPTER 12-13, EMPLOYEE HOUSING: (in part)
12-13-1: PURPOSE:
The Town's economy is largely touist based and the health of this economy is
premised on exemplary seruice for Vail's guesfs. Vail's ability to provide such
service is dependent upon a strong, high quality and consistently available work
force. To achieve such a work force, the community must work to provide qualfi
living and working conditions. Availability and affordability of housing plays a
citical rcle in creating quality living and working conditions for the community's
work force. The Town recognizes a permanent, year-tound population plays an
important role in sustaining a healthy, viable community. Fufther, the Town
recognizes its role in conjunction with the private sector in ensuring housing is
available. The Town Council may pursue additional incentives administratively to
encourage the development of employee housing unifs. Ihese incentives may
include, but are not limited to, cash vouchers, fee waivers, tax abatement and in'
kind seruices to owners and creators of employee housing units. The Town or the
Town's designee may maintain a registry and create lrsfs of all deed restricted
housing units created in the Town fo asstsf employers and those seeking
housing.

REVIEW CRITERIA
The review criteria for a request of this nature are established by the Town Code. The
proposed Type ll EHU is located within the Two-Family Primary/Secondary Residential
District. Therefore, this proposal is subject to the issuance of a conditional use permit in
accordance with the provisions of Chapter 12-16, Vail Town Code.
A. Consideration of Factors Reqardinq Conditional Use Permits:
1. Retationship and impact of the use on the development objectives of
the Town.
When the Town Council adopted lhe Town of Vail Affordable Housing Study
on November 20, 1990, it recognized a need to increase the supply of
locals/employee housing units. The Town encourages EHUs as a means of
providing quali$ living conditions and expanding the supply of employee
housing for both year-round and seasonal local residents. The proposed unit
will have a positive impact on the Town's rental housing needs.
2. The effect of the use on light and air, distribution of population'
transportation facilities, utilities, schools, parks and recreation
facilities, and other public facilities needs.
Staff believes that there will be an insignificant impact from the proposed
Type ll EHU on light, air, population, transportation, utilities, schools or parks'
3. Effect upon traffic with particular reference to congestion, automotive
and pedestrian safety and convenience, traffic flow and control, access'
maneuverability, and removal of snow from the street and parking
areas.
Two additional vehicles are anticipated in association with this EHU, and the
applicant is proposing to accommodate this anticipated parking demand.
Staff believes that this proposal will have an insignificant impact to the above-
referenced criteria.
4. Effect upon the character of the area in which the proposed use is to be
located, including the scale and bulk of the proposed use in relation to
surrounding uses.
The EHU will be located within a proposed new single-family residence. Staff
believes that the Design Review process will ensure that the proposed EHU
will not significantly impact the scale and bulk of this project in relation to

surrounding uses, and that the proposed EHU will be consistent with the
development standards applicable to this property.
The proposed EHU meets the Town's requirements for zoning,
ownership/transference, GRFA, garage crediUstorage, and density.
a. Zonino districts oermitted bv riqht or bv conditional use
A Type ll EHU is a conditional use in the Single-Family Residential, Two
Family Residential, Primary/Secondary Residential, and Agriculture & Open
Space zone districts. The subject proper$ is zoned Two-Family
Primary/Secondary Residential.
b. Ownership/Transference
n tipe ll EHU shall not be sold or transferred separately from the unit it is
associated with. The applicant is not proposing to sell or transfer the EHU
separately from the primary dwelling unit.
c. Additional GRFA
The EHU is entitled to a 550 sq. ft. GRFA deduction' The applicant is
proposing to utilize 401 sq. ft. of that deduction.
d. Garaqe GrediUStoraqe Requirement
n SOO sq.tt. garage area GRFA deduction is allowed for the EHU. lf the
applicant choosesnot to construct a garage for the EHU, then a 75 sq. ft.
storage area is required. The applicant is proposing to construct a 246 sq.ft.
garage for the EHU.
e. Parkinq
The parking requirements for EHUs are subject to the regulations of Chapter
12-10, Vail Town Code. This EHU is proposed to be 401 sq' ft. in size,
therefore two parking space are required. The applicant is proposing to
provide one enclosed and one unenclosed parking space.
f. Minimum/Maximum GRFA of an EHU
Type ll EHUs are allowed with a minimum of 300 sq. ft. of Gross Residential
Fioor Area (GRFA) and a maximum of 1,200 sq.ft. of GRFA. The proposed
EHU will be 401 sq. ft. in size.
g. Densitv
The applicant is proposing to construct a single-family dwelling unit and one
Type ll EHU on this site. Pursuant to Section 12-13-4, Vail Town Code, a
Type ll EHU will not count as density and is allowed as a ihird dwelling unit
on a property in the Two-Family Primary/Secondary Residential district.
VIII. STAFFRECOMMENDATION
The Community Development Department recommends approval with conditions of a
request for a final review of a conditional use permit, pursuant to Section 12-6D-3,
Conditional Uses, Vail Town Code, located al1107 and 1109 Vail Valley Drive/Lots 7
and 8, Block 6, VailVillage Filing 7, and setting forth details in regard thereto and setting
forth details in regard thereto. Staffs recommendation is based upon the review of the
criteria in Section Vll of this memorandum and the evidence and testimony presented.
Should the Planning and Environmental Commission choose to approve this conditional
use permit application, the Gommuni$ Development Department recommends the
Commission pass the following motion:
'The Ptanning and Environmental Commission apprcves, with conditions, fhe
applicant's request for a conditional use permit, pursuant fo Section 12-6D-3,

Should the Planning and Environmental Commission choose to approve this conditional
use permit request, the Community Development Department approves the following
conditions:

Should the Planning and Environmental Commission choose to approve this conditional
use permit application, the Community Development Department recommends the
Commission makes the following findings:
'The Planning and Envircnmental Commission finds:
1. That the proposed location of the use is in accordance with the purposes of
the conditional use permit section of the zoning code and the purposes of the
Two-Famity Pimary/Secondary Residential Distict, based upon the review
outlined in Section Vll of the Sfafls August 13, 2007, memorandum to the
Planning and Environmental Commission.
2. That the proposed location of the use and the rcnditions under which it will
be operated or inaintained will not be detrimental to the public health, safety,
or welfare or materially injuious to properties or improvements in the vicinity,
based upon the review outlined in Section Vll of the Sfaffs August 13, 2007'
memonndum to the Planning and Environmental Commission-
3. That the proposed use will comply with each of the applicable provisions of
the conditional use permit section of the zoning regulations, based upon the
review outlined in Section Vll of the Staff's August 13, 2007, memorandum to
the Planning and Environmental Commission."

Dear Bill:
Thank you for the opportunity to address our request for a "Conditional Use Permit" application with regard to the PEC for
the Giordano Residence in Vail. It is our intent that this letter will detail and clariff what we believe is the intent of this
request.
The Owner's and design team associated with the Giordano Residence endeavor to place restrictions on the use of an
apartnent located ion their Property for the benefit of the Owner and the Town. In doing so, we will dedicate a Type II EHU
as part of the newly desiped home. This use will pose no adverse effect on the light and air, tansportation facilities, utilities,
schools parks and recreation facilities or other public facilities. Likewise, this use will have no inqract on traffic or
congestion, pedestrian safety and convenience, flow and contol, access, maneuverability or removal of snow. The
incorporation of this EHU will be in context with the surrounding neighborhood and will not irpact the overall scale and bulk
of the new home. The dedication of this gnity will likely result in the residence being occupied year round, ihereby impacting
the distribution of tle population

WHEREAS, the Owner wishes to place certain restrictions on the use of a unit or apartment located
on the Property for the benefit of the Owner and the Town of Vail' Colorado ("the Town"')
NOW, THEREFORE, the Owner does hereby impose, establish, acknowledge, and declare for the
benefit of all persons who may hereinafter purchase, or lease, or hold the subject land the following
restrictions, covenants, and conditions, all of which shall be deemed to run with the land and inure to the
beneftt and be bonding upon the Owner, its respective grantees, successors, and assigns.
WHEREAS,

Z. The Type ll EHU shall not be subdivided or divided into anyform of timeshares, interval
ownership, or fractional fee.
3. The Type ll EHU shall be leased to and occupied by tenants who-are full-time employees
who work in Eagle County. The Type ll EHU shall not be leased for a period less than thirty
(30) consecutiv6 days. For the puiposes of this paragraph, a full-time employee is onevtto
woiks an average oi a minimum of thirty (30) hours each week on a year round basis. The
Type ll EHU shlll be continuously rented and shatl not remain vacant for a period to exceed
five (5) consecutive months.
4. Occupancy of the Type ll EHU shall be limited to a maximum of two persons per bedroom'
S. lf the Type ll EHU is constructed without a ded'aated garage, a minimum of seventy-five (75)
square-feet of storage area in addition to normal closet space is required for the exclusive
use of the occupant of the Type ll EHU.
6. The Type ll EHU shall have its own entrance. There shall be no inlerior access from any
EHU to any dwelling unit to which it may be attached.
7. The Type ll EHU must contain a kitchen or kitchenette and a bathroom'
8. The Type ll EHU may not be sold, transferred, or conveyed separately from the unit with
which it is associated.
9. No later than February 15 of each year, the owner of the Type ll EHU shall submit a sworn
affidavit on a form to be obtained from the Community Development Department, to the
Community Development Department, setting forth evidence establishing that the employee
housing unit has been rentedor owner-occupied throughout the year, the rental rate, the
employlr, and that the tenant who resides within the employee housing unit is a full-time
employee in Eagle CountY.

against perpefuities or some analogous slafutory provision, (b) the rule restricling restraint on
alienation, or (c) any other statutory or common law rules imposing like or similar time limits,
then such provision shall continue only for the period of the lives of the curent elected and
seated Town Carncil of the Tourn of Vail, Vail, Colorado, their nor living descendenb, if any,

2. To secure and guarantee performance of the obligations as set forth herein, the
Developer agrees to provide collateral as follows:

3. The Developer may at any time substitute the collateral originally set forth above

the terms of this Agreement. Such acceptance by the Town of altemative security or collateral
shall be at the Town's sole discretion.
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occuning to the work specified in this
Agreement prior to the completion and acceptance of the same, nor shall the Town, nor any
officer or employee thereof, be liable for any persons or propertyjnjur# by reason of the nature
of said work, but all of said liabilities shall be and are hereby *ilrff'$g,he Developer.
The Developer hereby agrees to indemnify and hold harmbsd'the Town, and4tny of its
officers, agents and employees against any losses, claims, damages, or I which the

referred to in this Agreement are not constructed in compliance with the approved plans and
specifications filed in the office of the Community Development Department of the Town of Vail or
not accepted by the Town as complete on or before the date set forth in Paragraph 1 of this
Agreement, the Town may, but shall not be required to, draw upon the security refened to in this
Agreement and complete the uncompleted improvements refened to in this Agreement. Pursuant
to Section 12-11-8, Vail Town Code, the Temporary Certificate of Occupancy refened to in this
Agreement may be revoked until all improvements referred to herein are completed by the
Developer or the Town in accordance with this Agreement.
Town or any of its officers, agents or employees may becdrq su$ect to, ffiil
losses, claims, damages or liabilities (or actions in respect{dSp! d{se out af oTry
any performance by the Developer hereunder; and the Develc*itr {hall reimburse

lf the costs of completing the uncompleted improvements referred to in this Agreement
exceed the dollar amount of the deposit, the excess, together with inlerest at twelve percent
(12o/o) per annum, shall be a lien against the property and may be collected by civil suit or may be
certified to the treasurer of Eagle County to be collected in the same manner as delinquent ad
valorem taxes levied against such property. lf the Developer fails or refuses to complete the
improvements referred to in this Agreement, such failure or refusal shall be considered a violation
of Title 12 (Zoning Regulations), of the Vail Town Code, and the Developer shall be subject to
penalties pursuantto Section 12-3-10 (Violations: Penalties) and Chapter 1-4 (General Penalty),
of the VailTown Code.
7. The Developer shall warranty the work and materials of all improvements refened
to in this Agreement located on Town property or within a Town right-of-way, pursuant to Chapter
8-3, of the Vail Town Code, for a period of two years after the Town's acceptance of said
improvements.

Dear Christy,
The Town of Vail Staff has reviewed the Design Review application for the proposed new single family
residence and Type ll EHU (employee housing unit) located at 1107/1109 Vail Valley Drive. The
following is a summary of the comments from that review:
1. The employee housing unit requires Planning and Environmental Commission approval of a
Conditional Use Permit and the unit will be subject to a Type ll EHU deed resttiction. Final
design review approval can not be issued until a Conditional Use Permit application is submifted
and approval is obtained.2. The plans must be corrected to comply with the maximum GRFA limit of 6,559 sq. ft. The
submitted lower level GRFA calculations are not accurate. The lowesl level GRFA is calculated
as follows: 3,092 total sq. ft., minus the 600 sq. ft. garage deduction, minus the 350 sq. ft. EHU
deduction, minus the 300 sq. ft. EHU garage deduction, equals 1,842 sq. ft. The basement
deduction is applied to this remaining area. 1,842 sq. ft. multiplied by O.a4 equals 81 1 sq. ft. of
GRFA on the lower level (not 1 10 sq. ft.).
3. Submit redlined plans showing the landscape area calculations.
4. Submit redlined plans showing the site coverage calculations.
5. Submit stamped engineering drawings for retaining walls with a height greater than four feet and
all combination retaining walls.6. Submit building cross-section drawings.
7. An exterior color and materials sample board must be submitted prior to the Design Review
Board hearing.
8. Site Plan:. The site plan must be printed to scale.. Label all property and setback lines.. The limits-of-disturbance fence must be located within the side property boundaries.
r The al-grade patios, terraces, steps, stairs, etc. shall be setback a minimum of 7/" leet
from the side and rear property lines.. Retaining walls must have a minimum setback of 2 feet from the property lines.
. Show all required parking spaces with a 9'x18' box for interior spaces and a 9'x19'box
for exterior spaces. (min. of 7 spaces, with 2 for the exclusive use of the EHU)'
. The parking locations must be revised so the primary residence parking does not block
the EHU's garage or surface parking. Reminder: all 7 required parking spaces must be
located within the properg boundaries (parking is not permitted in the street rightof-way).
o Demonslrate that vehicles can pull-in and back-out of the garages by showing a 20 ft.
centerline radius.

(minirnum 10% equivalent of driveway area). Snow storage shall not be located within
the Vail Valley Drive rightof-way.. The driveway snowmelt system must be on a separate zone within the Vail Valley Drive
right-of-way and labeled as such at the control box.. The concrete pan musl be 4 feet in width with a 2" invert and no snowmelt heat.. The address markers must be lowered lo a maximum height of 3 feet to meet the
driveway site distance requirements.. Show the site drainage on and off site.o Contact the Eagle River Water and Sanitation District to coordinale the proposed fire
hydrant relocation.. Submit details for the proposed site wall (fence) located in the rear yard. The wall shall
not exceed 6 feet in height.r Submit rear patio pedestal details.. Submit water feature and reflecting pool details.
9. Landscape Plan:. The limits-of-disturbance fence must be relocated to be within the side property
boundaries.r Label the tree sizes on the plan.
10. Roof Plan:r True roof ridge, eave, and chimney elevations (not finished floor based elevations) must
be labeled for all proposed roof elements.. The proposed roof must be revised to not exceed 33 feet in height for pilched roofs as
measured from both existing and finished grade, whichever is more restrictive.
1 1. Architectural Elevations:. One set of 'red-lined' plans must be submifted demonslrating how the GRFA basement
deduction was calculated.. The drawings must be fully dimensioned.. True finished floor and roof elevations must be lbbeled.. Show any new exlerior utility meters and screening methods.. Show any proposed building drainage syslems (i.e. gutlers, downspouts, etc.). Please be aware that all chimney shrouds must be UL listed.
12. Exterior Lighting:o No more than one non-exempt exterior light is allowed per 1,000 sq. ft. of lot size.
Therefore, the lighting plan must be correcled to have no more than 15 non-exempt
exterior lights.. The lighting plan table shown on sheel L-2 must be updated lo coordinate with the' submitted light fixture cutsheets.. Luminance calculations must be submitted for all fixlures.r Exempt landscape, path, driveway, etc. lights shall not exceed 18 inches in height.
This proposal is tentatively scheduled for review by the Design Review Board at its July 18, 2007 public
hearing. To remain on this schedule, please submit revisions addressing the above listed items by no
later than Noon on Friday, July 6,2OO7 .
