I have received only favorabl-e comments for approva.l- of the dormer
design criteria for the south side of the buitding as proposed by Jim
Guiffre and one conment that the owner wanted to study it for a l-ittle
whil-e -
so unless there is some new feed back I am going to provide Jim with a
l_etter on behaff of the Association approving the addition of the dormer
window - this will be done on Eeb 24.
Regarding the roof Jirn is aware that Turner Morris must be used for all
roof construction- repair etc when the dormer is constructed and a
l_etter from Turner Morris reaffirming the warranty must be provided to
the association

General Information:
The review process for new construction normally requires two separate meetings of the Design Review
Board: a conceptual review and a final review. Applicants should plan on presenting their development
proposal at a minimum of two meetings before obtaining final approval.

not being affected by the proposed improvements and grading.
o Indicate all existing ground cover and shrubs.
a Detailed legend, listing the type and size (caliper for deciduous trees, height for conifers, gallon size
for shrubs and height for foundation shrubs) of all the existing and proposed plant material including
grouno cover.o Delineate critical root zones for existing trees in close proximity to site grading and construction.
o Indicate the location of all proposed plantings.
o The location and type of existing and proposed watering systems to be employed in caring for plant
material following its installation.

II. IMPROVEMENT LOCATION CERTIFICATE (ILC)
Once a building permit has been issued, and construction is underway, and before the Building

WHEREAS, the Developer is obligated to provide security or collateral sufficient in the
judgement of the Town to make reasonable provisions for completion of certain improvements set
forth in the attached estimated bid(s) in accordance with the approved plans and specifications
filed in the office of the Community Development Department of the Town of Vail; and
WHEREAS, the Developer wishes to provide collateral to guarantee performance of this
Agreement, including completion of the all improvements referred to in this Agreement, by means
of the following:
The Developer agrees to establish a cash deposit account with the Town of Vail, as
escrow agent, in tie amount of $ 7t 3'/. 50 (125% oI the total costs of the

NOW THEREFORE, in consideration of the following mutual covenants and agreements,
the Developer and the Town agree as follows:
1. The Developer agrees, at its sole cost and expense, to furnish all equipment and
materials necessary to perform and complete all improvements referred to in this Agreement. The _
Developer agrees to complete all improvements referred to in this Agreement on or before the lsdayof Turne- ,20O5. The Developer shall complete, in a good workmanlike
manner, all improvements refened to in this Agreement, in accordance with all approved plans
and specifications filed in the office of the Community Development Department of the Town of
Vail, and to do all work incidental thereto according to and in compliance with the following:
a. All said work shall be done under the inspection of, and to
the satisfaction of, the Town Planner, the Town Engineer, the Town Building
Official, or other official from the Town of Vail, as affected by special districts or
service districts, as their respective interest may appear, and shall not be deemed
complete until approved and accepted as completed by the Community
Development Department and Public Works Department of the Town of Vail.

2. To secure and guarantee performance of the obligations as set forth herein, the
Developer agrees to provide collateral as follows:
A cash deposit account with the Town of Vail, as escrow agent, in the amount of
$ '7p','-'/,5O (125% of the total costs of the attached estimated
bid(s)) as collateral for the completion of all improvements referred to in this
Agreement, in the event there is a default under this Agreement by the Developer.
3. The Developer may at any time subslitute the collateral originally set forth above
for another form of security or collateral acceptable to the Town to guarantee the faithful
completion of those improvements referred to herein in this Agreement and the performance of
the terms of this Agreement. Such acceptance by the Town of allernative security or collateral
shall be at the Town's sole discretion.
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss oi damage happening or occuning to the work specified in this
Agreement prior to the completion and acceptance of the same, nor shall the Town, nor any
officer or employee lhereof, be liable for any persons or property injured by reason of the nature
of said work, but all of said liabilities shall be and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) arise out of or are based upon
any performance by the Developer hereunder; and the Developer shall reimburse the Town for
any and all legal or other expenses reasonably incurred by the Town in connection with
investigating or defending any such loss, claim, damage, liability or action. This indemnity
provision shall be in addition to any other liability which the Developer my have.
5. lt is mutually agreed that the Developer may apply for and the Town may
authorize a partial release of the collateral deposited with the Town for each category of
improvement after the subject improvement is constructed in compliance with all plans and
specifications as referenced hereunder and accepted by the Town. Under no condition shall the
dollar amount of the collateral that is being held by the Town be reduced below the dollar amount
necessary to complete all uncompleted improvements referred to in this Agreement.
6. lf the Town determines, at its sole discretion, that any of the improvements
referred to in this Agreement are not constructed in compliance with the approved plans and
specifications filed in the office of the Community Development Department of the Town of Vail or
not accepted by the Town as complete on or before the date set forth in Paragraph 1 of this
Agreement, the Town may, but shall not be required to, draw upon the security referred to in this
Agreement and complete the uncompleted improvements referred to in this Agreement. Pursuant
to Section 12-11-8, Vail Town Code, the Temporary Certificate of Occupancy refened to in this
Agreement may be revoked until all improvements referred to herein are completed by the
Developer or the Town in accordance with this Agreement.

lf the costs of completing the uncompleted improvements referred to in this Agreement
exceed the dollar amount of the deposit, the excess, together with interest at twelve percent
(12%) per annum, shall be a lien against the property and may be collected by civil suit or may be
certified to the treasurer of Eagle County to be collected in the same manner as delinquent ad
valorem taxes levied against such property. lf the Developer fails or refuses to complete the
improvements referred to in this Agreement, such failure or refusal shall be considered a violation
of Title 12 (Zoning Regulations), of the Vail Town Code, and the Developer shall be subject to
penalties pursuant to Section 12-3-10 (Violations: Penalties) and Chapter 1-4 (General Penalty),
of the Vail Town Code.
7. The Developer shall warranty the work and materials of all improvements refened
to in this Agreement located on Town property or within a Town right-of-way, pursuant to Chapter
8-3, of the Vail Town Code, for a period of two years after the Town's acceptance of said
imorovements.
8. The parties hereto mutually agree that this Agreement may be amended from time
to time, provided that such amendments be in writing and executed by all parties hereto.

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Depaftment review, and a review
by the Building Depaftment, the estimated time for a total review will take as long as three (3)
weeKs.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projecLs may also take three (3) weeks to

ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
/ffi The Town of Vail Public Works Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culverts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Depadment for footings, temporary electrical or any other

the Public Works Department, Allow a minimum of 24 hour notice.

CODE 5-2-10: DEPOSfTS ON PUBUC WAYS PROHIBITED
U/Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be liftered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
f Notice; Abatement: The Director of Public Works may notify and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rock, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.

any person who violates or ca uses another to violate the same, may be issued a summons to appear

INTRODUCTION:
On May l1th, 2004, an inspection/survey was conducted and 5 bulk
samples were collected from the:

433 Gore Creek Drive
Unit #15
Vail, CO. 81658
The purpose of the inspection/survey w.rs to locate and sample
suspected asbestos containing materials that might be present in the Building
that is planned for renovation.
The inspection was made, and the samples were collected by John R.
Peterman, an A.H.E.R.A. and State of Colorado Certified Asbestos
Inspector. Great care was taken during the inspection and sampling to be as
accurate as possible. It should be noted ttrat minimal damage was done to
the existing building structures during the inspection so there is no
documentation for unseen conditions or stored items.
All samples were analyzed by DcM Science Lab in wheatridge, co.
This laboratory is deemed "Proficient" in the E.P.A.Quality Assurance (QA)
program for the determination of asbesuos in bulk materials, and is
accredited by the American Hygiene Association (AHA)-
SAMPLING PROTOCOL:
e ranaom sampling scheme was used to sample the suspect materials that
were discovered. If during any future demolition or renovation wotk,
suspect material is discovered that hasn't been sampled and would be
disturbed. work should be haited until the material has been tested.

RENOVATION AREA DESCRIPTION:
Vail Trails East, Unit #15, is a three story unit. The interior walls are
wood frame with sheetrock; with a light texcure, and the ceilings are
sheetrock like the walls. At the time of the inspection, a large amount of the
sheetrock walls and ceilings had been removed. The composite sheetrock
samples were collected from the undisturbed areas of the unit. The floors
are exposed wood; all coverings had been removed prior to the inspection.
The heating is provided by a baseboard heating, and a fueplace. No suspect
T.S.I. was visible on the heating system at the time of the inspection.
CONCLUSIONS & RECOIUMENDATIONS :
Laboratory analysis indicates that two of the f,tve composite sheetrock
samples contain Asbestos. The Asbestos content of the two positive samples
is less than the Regulatory Limit ( Greater than lVo Asbestos ). The
Asbestos content was verified by the required Point Count Analysis. The
composite sheetrock may be removed by non-abatement tnethods. The
O.S.g.A. regulations that protect workers from Airborne Asbestos are still in
place.

In order to prevent a non-emengencY nesponse from the Vail Fire
Depaftment
Suppression crews to the construction location you may be working on we
ask that you perform the following tasks:
Determine what kind of firc alarm system exists within the
structure you ane working in with the owner or the manager of
the propefi involved or by contacting the Vail Fire DepartmenL
Determine with the owner or manager of the PrcPettl' which
alarm oompany services the system for them.
Become familiar with the diffierent components that are
associated with the fire alarm system and how they operate
before the DEMO begins.
Never paint a smoke detecbr, thermal detector, or any ot{rer
compohent of the fire alarm system, and never paint a sprinkler
head.
For small projects bag detector within the area you will be
working in before you start, and remove the bags after work is
done for the day.
For larger projects, please contact the Vail Fire Depa-ttment so
thatwe can workwith vou in determinins what needs to be dtthatwe can work you in determining what needs to be done
to alter or "Zone Out" specific aneas of the alarm sysbm for the

The ADEMC0 !19? Series low profile, addressable V-Plexil smoke detectors deliver state-of
the-art features and benefits in a cost-effective package. These detectors are designed to
provide open area coverage and are compatible with ADEMCO s VISTA controls supporting V-
plex technology. An LED on the detector will blink periodically during normal conditions, remain
on steady during alarm and cease to pulse if the chamber is out oi acceptable sensitivity
range.
An extremely powerful feature available within the 5192 Series is the Automatic Maintenance
Alert/Beporting capability - a feature normally found in todays high end analog addressable
svstems. The detectors continually monitor their own sensitivity levels in addition to the basic
normal and alarm conditions. These HIGH and LOW SENSITIVITY signals are communicated
back to the control, via the V-Plex addressable loop, to indicate locally and at the cental station
that the detector may not be able to detect smoke or may false alarm. This feature works with
Vista-32FB, 1 28FB, 1 2BB and First Alert Professional FA1600C.
More important is the cost saving associated with Automatic Maintenance Reporting. The
feature is an approved alternate to NFPA 72 field sensitivity calibration testing that require
external test meters. This eliminates the need to schedule inspections to determine detector
sensitivity/viabi lity.
Another important benefit of these V-Plex (addressable) smoke detectors is their ability to
operate on existing wiring. There is no need to run special twisted pair, data grade or shielded
wires, providing you with the right choice for all your retrofit applications. That equates t0
cost savings in time and materials!

tomized English language display that indicates warnings and zone messages - there are n0

This smartly-styled console is the system's information center, providing the status of your
security system at-a-glance. with all information clearly displayed in a bright, extra large liquid
crystal display (LCD) window. Ananged in a telephone touchpad configuration, the keypad is
easy to understand and operate. Keys are backlit to make nighttime operation possible.
Gustomized to meet your needs and preferences
Your system is programmed to your specific needs. Each protection zone is custom-pro-
grammed into the control by your alarm installer and is identified by name. You are instantly
aware of the status of your security system. Depending on your system, different emergency
situations can signal a Z4-hour central station in case of a fire, police, or personal problem.
Built-in self-help
A self-help feature (on select controls) reviews the basic system functions and operalion, dis-
playing them in the console window; especially helpful to new users. lt is activated by simply
pressing any desired function key for five seconds.

The Heat Detecfors Series 600 are supplied

The Series 600 Heat Detector is attractive, durable and
features combination rate-of-rise and fixsd t€mDerature
operation. Heat deloctors are available in 135"F and 200"F
temperature ratings,
Rateof-rise detects heat by quickly responding to a rapid
t€mperature increass. Rate-ol-rise units have a wide spacing
allowance ol SGloot centers. See specilication tabl€ lor
dstails.
Fixed temperalure reacts 10 heat by responding lo a specific
lemperatur€ setting.
Series 600 Dotectors use lhe sarne reliablE pneumatic rale-of-
rise elem€nt of former models, but ofter added aesthetic
appeal.
The pneumatic rate-of-rise element responds lo a rapid rise in
lemperature, approximately 15"F. (8"C) per minule, by
expansion of air within the sealed chamber fasler lhan it can
€scape through a calibrated vent. The tesultant increase in
pressure depresses ihe diaphragm, causing the electrical
contact to close the circuit.
The lixed lemperatur€ elemenl uses a Jusiblo alloy. When
activated, the exlemal heat collector drops away to provide
quick visual confirmation that the elemenl has operated.
The units protrude only 1-3/8 inch f rom the ceiling surface with
a junction box mounling. They have pleasing @ntours and an
all-white finish that conforms to ceiling aesthetics.
lnstallation
Each detector includ€s a patented reversible rnounting plate.
In one position, it easily attaches to 3.25' or 4' octagonal box,
or plaster ring.
ln reverse, lhe plate can be used lor opon wiring without a
junction box. A 1/4' space belween detector and mounting
surface allows {or wire conneclions. All rnounting screws are
concealed,
The detector attaches €asily to the nDunting plate with a push
and twist motion. No lools are required.
Mounting plate is molded ol white self-extinguishing thermo-
plastic rated at 221'F (105"C). The plate is eldremely strong
yel adapts lo unsven mounting surfacos.
Series 600 Testing Methods
Models 60f /621 and @21622 can b€ tested by the quick
application ol heat lrom any convenient source. A portable hair
dryer is recommended. However, do not apply heat that
exceeds the lixed temperature rating of the detector.
Models 603/623 and 604/624 cannot be tested. However, lhe
fusible alloy element used is considered so reliable that lesling
is not necessary.

The Multi-Alert models mount directly to 4" square back boxes. Optional mounting
plates are available for either flush or semi-flrsh installations' Model MA124D is suiable

MultlAlert strobes, System Sensor's Multi-Alert strobes are UL1538 compliant
electronic visible warning signals that flash approximately every 1'5 seconds' All
circuits are polarized to be compatible with DC alarm supervision.
Mlnl-Alort sounders, System Sensort PA400 series Mini-Alert sounders operate
at'J.2 and 24 volts and are ideal for hotel, motel or residential fire system
applications, where a smaller notification device is desired. The PA400
sounders are available with or without FIRE identification. and are offered in
red, beige, and white.
MuftlAlert sounders shall be a System Sensor Model MA lU24D capable of operating at 12 and 24YDC, Sounder shall be
listed to Underwriter's Laboratories Standard lJL464 tor fire protective signaling systems. Sounder shall have an operating
temlrcrature berween -31'F and 151oF. Sounder shall have eight tone options, selected by means of clips.
Mfnl-Afert Sounderc shall be a System Sensor Model

Connecting The Battery
ln the event of an AC power loss, the Control panel will still operate for a period
of time (time period varies depending on size of battery used) because the
control has a back-up, rechargeable gel type (sealed) lead acid battery. YUASA
NP4-12 (12V, 4AH) and NP7-12 (12V, 7AH) batteries are recommended.
