SUMMARY
The applicant, Vail International Condominium Association, represented by Heidi
Hansen, has submitted a development review application to the Community
Development Department to allow for the rezoning of Lot 4, Vail Lionshead Filing 3,
from High Density Multiple Family (HDMF) District to Lionshead Mixed Use-1 (LMU-
1) District. The applicant has submitted this application in anticipation of the
redevelopment of the Vail International Condominiums. Staff is recommending
approval of the applicant's development review application.
DESCRIPTION OF REQUEST
The applicant, Vail International Condominium Association, represented by Heidi
Hansen, has submitted a development review application to the Town of Vail
Community Development Department. The purpose of the application is to amend
the Official Zoning Map of the Town of Vail whereby Lot 4, Block 1, Vail Lionshead
2no Filing is rezoned to Lionshead Mixed Use-1 zone district. According to the
applicant, lhe rezoning is intended to facilitate the redevelopment of the Vail
lnternational Condominiums.

ROLES OF THE REVIEWING BODIES
Rezoninq/Zone District Boundary Amendment
Planning and Environmental Gommission:
The Planning and Environmental Commission is advisory to the Town Gouncil. The
Planning and Environmental Commission shall review the proposal and make a
recommendation to the Town Council on the compatibility of the proposed zoning
with surrounding uses, consistency with the Vail Comprehensive Plans, and impact
on the general welfare of the community.
Design Review Board:
The Design Review Board has no review authority on zoning/rezonings.
Staff:
The staff is responsible for ensuring that all submittal requirements are provided.
The staff advises the applicant as to compliance with the Zoning Regulations. Staff
provides a staff memo containing background on the property and provides a staff
evaluation of the project with respect to the required criteria and findings, and a
recommendation on approval, approval with conditions, or denial. Staff also
facilitates the review process.
Town Council:
The Town Council is responsible for final approval/denial of a zoning/rezoning.
The Town Council shall review and approve the proposal based on the compatibility
of the proposed zoning with surrounding uses, consistency with the Vail
Comprehensive Plans, and impact on the general welfare of the community.

12-6H-1: Purpose;High Density Multiple Family District
The high density multiple-family district is intended to provide sites for multiple-family
dwellings at densrlies to a maximum of twenty five (25) dwelling units per acre,
together with such public and semipublic facilities and lodges, private recreation
facilities and related visitor oiented uses as may appropiately be located in the
same district. The high density multiple-family dlsfricf ls intended to ensure adequate
light, air, open space, and other amenities commensurate with high density
apartment, condominium and lodge uses, and to maintain the desirable residential
and resort qualities of the district by establishing appropriafe sde development
standards. Certain nonresidential uses are permitted as conditional uses, which
relate to the nature of Vail as a winter and summer recreation and vacation
community and, where permitted, are intended to blend harmoniously with the
residential character of the district.

12-7H-1: Purpose; Lionshead Mixed Use-1 District
The Lionshead Mixed lJse 1 District is intended to provide sffes for a mixture of
multiple-family dwellings, lodges, hotels, fractional fee clubs, time shares, lodge
dwelling units, restaurantg or?ceg skierseruices, and commercial establishments in
a clustered, unified development. Lionshead Mixed Use 1 District, in accordance with
the Lionshead Redevelopment Master Flan, is intended to ensure adequate ltght, air,
open space and other amenities appropriate to the permifted types of buildings and
uses and to maintain the desirable qualities of the Distict by establishing appropiate
site development standards. This District is meant to encourage and provide
incentives for redevelopment in accordance with the Lionshead Redevelopment
Master Plan.
This Zone District was specificatty aevetofi{ilq.provide incentives for properties to
redevelop. The uftimate goal of these lnod;Ht#&.ls to create an economically vibrant
lodging, housing, and commercial core are'a. The incentives in fhis Zone District
include i''ncreases in allowable gross restdential floor area, building height, and

conditions favorable to inducing private redevelopmenf conslstenf with the Lionshead

herein, the following amenities will be evaluated: sfreefscape improvements,

improvements, and similar improvements.

3.3 Hotels are important to the continued success of the Town of Vail,
therefore conversion to condominiums shou/d be discouraged.

vil.CRITERIAAND FINDINGS
Amendment to the Official Zonino Map of the Town of Vail (rezoninq)
Chapter 3, Administration and Enforcement, Title 12, Zoning Title, of the Vail Town
Code authorizes amendments to the Official Zoning Map of the Town of Vail.
Pursuant to Section 12-3-7, Amendments, in part,
"an application to amend the district boundaries of the Zoning Map may be
initiated by petition of any resident or property owner in the Town."
Furthermore, Section 12-3-7 C prescribes the criteria and findings the Planning and
Environmental Commission and Town Council shall consider with respect to a
request to amend the Zoning Map.
The applicant is seeking a recommendation of approval to rezone Lot 4, Block 1, Vail
Lionshead 2no Filing, from High Density Multiple Family (HDMF) District to the
Lionshead Mixed Use-1 (LMU-1) District.
According to Section 12-3-7 C, of the Vail Town Code,
Before acting on an application for a zone district boundary amendment, the
Ptanning and Environmental Commission and Town Council shall consider the
following factors with respect to the requested zone district boundary amendment:
1. The extent to which the zone district amendment is consistent wilh
all the applicable elements of the adopted goals, objectives and
policies outlined in the Vail Comprehensive Plan and is compatible
with the development objectives of the Town; and
Section lV of this memorandum outlines all of the goals and policies
implemented or that are relevant to the proposed rezoning of Lot 4, Block
1, Vail Lionshead 2no Filing. The proposed rezoning specifically
implements the Vail Land Use Plan land use designation of Lionshead
Mixed Use - 1.
According to Section 12-7H-1: Purpose; Lionshead Mixed Use-l Districl,
"The Lionshead Mixed Use 1 District is intended to provide sites for a
mixture of multiple-family dwellingq /odges, hotels, fractional fee
clubs, time shares, lodge dwelling units, restaurants, offices, skier
services. and commercial establishments in a clustered, unified
development. Lionshead Mixed Use 1 District, in accordance with the
Lionshead Redevelopment Master Plan, is intended to ensure
adequate light, air, open space and other amenities appropriate to the
permitted types of buildings and uses and to maintain the desirable
qualities of the District by establishing appropriate site development
standards. This District is meant to encourage and provide incentives
for redevelopment in accordance with the Lionshead Redevelopmenl

The proposed rezoning is consistent and compatible with the Vail
Comprehensive Plan and the Town's development objectives.
The extent to which the zone district amendment is suitable with the
existing and potential land uses on the site and existing and
potential surrounding land uses as set out in the Town's adopted
planning documents; and
The Lionshead Mixed Use-1 District establishes zoning that is
consistent with both existing and proposed uses on the parcel.
The proposed use of the property will remain residential thus
providing permanent and short-term accommodations for guests
and visitors to the Town. Special attention should be given
however to the proposed Detailed Plan Recommendations
outlined Chapter 5 of the Lionshead Redevelopment Master Plan.
The zone district amendment is consistent with existing and potential
uses on surrounding properties. According to the Vail Land Use Plan, the
adjoining land use designations include Lionshead Redevelopment
Master Plan, Resort Accommodations and Services, Tourist Commercial,
Public/Semi Public and Medium Density Residential. Pursuant to the
Plan, the existing land use designations are Lionshead Redevelopment
Master Plan, Resort Accommodations and Services. The area governed
by the Lionshead Redevelopment Master Plan is designated as Tourist
Commercial. A review of the Zoning Regulations demonstrates that the

uses allowed in the Lionshead Mixed Use-1 zone district are compatible
with both the intent and purposes of the Lionshead Redevelopment
Master Plan, Resort Accommodations and Services and Tourist
Commercial land use designations.
The extent to which the zone district amendment presents a
harmonious, convenient, workable relationship among land uses
consistent with municlpal development objectives; and
The Lionshead Mixed Use-1 (LMU-1) District is consistent with the
existing and proposed use of the property. The proposed zone dislrict
implements specific goals of the Vail Land Use Plan and Lionshead
Redevelopment Master Plan. Staff believes that the proposed re-zoning
presents a harmonious, convenient, and workable relationship wiih land
uses in the area consistent with the existing and proposed use of the
property. For example, while the overall density of development on the
Vail International Condominium development site will increase as a result
of the zone district boundary amendment, the proximity of the
development site to the South Frontage Road, the detailed plan
recommendations for the development site, and the anticipated off site
vehicular and pedestrian improvements ensures a workable relationship
among land uses. A review of the purpose statements of the Lionshead
Mixed Use-1 zone district and the High Density Multiple Family zone
district reveals that both are intended to provide sites for "multiple family
dwellings, lodges, hotels and other uses relate to winter and summer
recreation".
The extent to which the zone district amendment provides for the
growth of an orderly viable community and does not constitute spot
zoning as the amendment serves the best interests of the
community as a whole; and
The proposed re-zoning establishes consistent zoning for the property.
This re-zoning will create a zone district consistent with the existing and
proposed use of the property. The proposed re-zoning and development
plan provide for the development of an orderly viable community
consistent with the Town's development interests as expressed in the
Lionshead Redevelopment Master Plan. For instance, the Vail Land Use
Plan designates the site as "Lionshead Redevelopment Master Plarf'.
The purpose of this land use designation is, in parl, "to provide areas
where hotel uses wil/ be concentrated, reflecting the community's goal to
concentrate hotels within the core areas". The purpose of the Lionshead
Mixed Use-1 zone district is, in part, "to provide sttes for lodges, hotels,
fractional fee clubs, lodge dwelling units, and timeshares" , "to provide
economic incentives for properties to redevelop" and "fo create an
economically vibrant lodging, housing and commercial core area." Staff
believes that this amendment furthers the development objectives of the
Town and serves the best interest of the community as a whole.
The extent to which the zone district amendment results in adverse
or beneficial impacts on the natural environment, including but not
limited to water quality, air quality, noise, vegetation, riparian
corridors, hillsides and other desirable natural features; and
The proposed re-zoning will not significantly alter the existing character or
uses allowed on the site. As such, staff does not for see any adverse
impacts on the natural environment to include water quality, air quality,
noise, vegetation, etc. In fact, given the language as adopted for the
detailed recommendations for the site, it could be reasonably expected
that beneficial impacts muld result from the rezoning and redevelopment
of the site.
The extent to which the zone district amendment is consistent with
the purpose statement of the proposed zone district.
The Lionshead Mixed Use-1 (LMU-1) District is proposed for the subject
property. The proposed zone district is consistent with the intended
purpose of that zone district. A copy of the purpose statement of the
Lionshead Mixed Use-1 zone district is provided in Section lV of this
memorandum.
The extent to which the zone district amendment demonstrates how
conditions have changed since the zoning designation of the
subject property was adopted and is no longer appropriate.
Since the original adoption of zoning on the property, the Town of Vail
has undergone an extensive study for the redevelopment of the
Lionshead area of Town. As such, the Town has adopted clearly
identifiable goals and objectives for development in this general area of
Town. In order to ensure that these goals and objectives for development
are carried out, the Town adopted two new zone districts; one of which is
the Lionshead Mixed Use-1 District. lf approved, the applicant will be
afforded the opportunity to redevelop the site with the Town's goals in
mind.
Such other factors and criteria as the Commission and/or Gouncil
deem applicable to the proposed rezoning.
VIII. STAFFRECOMMENDATION
The Community Development Department recommends that the Planning and
Environmental Commission fonrvards a recommendation of approval of an
amendment to the Official Town of Vail Zoning Map, pursuant to Chapter 3, Title 12,
Zoning Regulations, Vail Town Code, to rezone Lot 4, Block 1, Vail Lionshead 2no
Filing to the Vail Town Council.

ACCORDANGE WITH TITLE 12, ZONING REGULATIONS, CHAPTER 5, ZONING MAP;
REZONING LOT 4, BLOCK 1, VAIL LIONSHEAD 2ND FILING, FROM HIGH DENSITY
MULTIPLE FAMTLY (HDMF) D|STR|CT TO LTONSHEAD MIXED USE-I (LMU-1) D|STRICT,
AND SETTING FORTH DETAILS IN REGARDS THERETO.
WHEREAS, Chapter 5, Zoning Map, of the Vail Town Code establishes the procedures for
evaluating changes to the Official Zoning Map of the Town of Vail ("Zoning Map"); and
WHEREAS, the proposed amendment to the "Zoning Map" has been reviewed in
accordance with the prescribed requirements outlined in Sections 12-3-1 through 12-3-7 of the
Zoning Regulations of the Vail Town Code; and
WHEREAS, on January8,2007, the Planning and Environmental Commission of theTown
of Vail reviewed and fonrvarded a recommendation of approval of the proposed amendment to the
"Zoning Map" to the Vail Town Council in accordance with the criteria and findings outlined in
Section 12-3-7 of the Zoning Regulations of the Town of Vail; and
WHEREAS, the Vail Town Council finds the proposed amendment to the "Zoning Map" is
consistentwith the adopted goals, objectives and policies outlined in the Vail Comprehensive Plan,
the Vail Village Master Plan and is compatible with the development objectives of the Town; and
WHEREAS, the Vail Town Council finds the amendment to the 'Zoning Map" is compatible
with and suitable to adjacent uses and appropriate for the surrounding areas; and
WHEREAS, the Vail Town Council finds the amendment to the'Zoning Map" promotes the
health, safety, morals, and general welfare of the Town and promotes the coordinated and
harmonious development of the Town in a manner that conserves and enhances its natural
environment and its established character as a resort and residential community of the highest
quality.

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
VAIL, COLORADO, THAT:
Section 1. Zoning Map Amendment:
The purpose of this Ordinance is to amend the Official Zoning Map of the Town of Vail. The
Official Zoning Map of the Town of Vail is hereby amended as follows:
Lot4, Block 1, Vail Lionshead 2nd Filing shall be rezoned from High-Density Multiple
Family (HDMF) district to Lionshead Mixed Use-1 (LMU-1) district, as illustrated on
Exhibit A attached hereto.
Section 2. lf any part, section, subsection, sentence, clause or phrase of this ordinance
is forany reason held to be invalid, such decision shall not effectthe validityof the remaining
portions of this ordinance; and the Town Council hereby declares it would have passed lhis
ordinance, and each part, section, subsection, sentence, clause or phrase thereof,
regardless of the fact that any one or more parts, sections, subsections, sentences, clauses
or phrases be declared invalid.
Section 3. The Town Council hereby flnds, determines and declares that this ordinance
is necessary and proper for the health, safety and welfare of the Town of Vail and the
inhabitants thereof.
Section 4. The amendment of any provision of the Town Code as provided in this
ordinance shall not affect any right which has accrued, any duty imposed, any violation that
occuned prior to the effective date hereof, any prosecution commenced, nor any other
action or proceeding as commenced under or by.virtue of the provision amended. The
amendment of any provision hereby shall not revive any provision or any ordinance
previously repealed or superseded unless expressly stated herein.
ORDINANCE NO. 5, SERIES OF 2OO7
Section 5. All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent
herewith are repealed to the extent only of such inconsistency. This repealer shall not be
construed to revise any bylaw, order, resolution or ordinance, or part thereof, theretofore
repealed.

If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Depaftment the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

n The Town of Vail Building Depaftment has developed the following procedures to
ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
g The Town of Vail Public Works Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culverts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other
inspection. Please call Leonard Sandoval at479-2198 to request an inspection from
the Public Works Department. Allow a minimum of 24 hour notice.
o Also, the Town of Vail Public Works Department will be approving all final drainage
and culvert installation with resulting road patching as necessary. Such approval

fl Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or deposited, snd, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street sidewalk, alley or public place, or any portion thereof.
n Notice; Abatement: The Director of Public Works may notiff and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dift, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rock, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified,
a Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 14-1 of this code.
+ Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of
this Code. (1997 Code: Ordinance 6 (1979).

Report: Visually inspected the field welding & high strength bolting at
the structural steel connections for the new addition- 4325 3/4" diarneter
TCB bolts had been used through out with the ends fully twisted off
except for some locations where the steel erectors could not get there
power wrench on the bolts these bolts were tightened with a hand
wrench.
The field welding & high strength bolting inspected above appeared to
be as shown on the drawings and met the quality requirements of the
AWS Dl.l structural welding code & the AISC Specification for
Struchral Joints Using ASTM A325 or A490 Bolts.

Amendment to the 1999 N,E.C. Town of Vail Ordinance 10-1-6.
Overhead services are not allowed in the Town of Vail.
Underground services have to be in conduit (PVC) from the transformer to the electric meter, main disconnect
switch and to the first electrical distribution circuit breaker panel.
The main disconnect switch shall be located next to the meter on the exterior wall of the structure easilv
accessible.
All underground conduits are required to be inspected before back-filling the trench.
In multi-family dwelling units, no electrical wiring or feeder cables shall pass from one unit to another. Common
walls and spaces are accepted.
NM Cable (Romex) is not allowed in commercial buildings or structures exceeding three (3) stories.
No use of aluminum wire smaller than size #8 will be permitted with the Town of Vail.
TOWN OF VAIL ELECTRICAL PERMIT GUIDELINES
All installations of exterior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
If this permit is for installation of an exterior hot tub or sDa on a new elevated platform or deck over
30" above grade, you must also obtain a building permit.
If this permit is for inshllation of an exterior hot tub or spa on any existing deck or elevated platform,
a structural engineer must review the existing condition and verify that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.

from the association is required.
