Dear Warren:
The Sun Vail Condominium Association (SVCA) is concemed about a potential change in use ofthe Lazier garage building located at Sun Vail. Robert Lazier owns a parcel of land that is anisland located in the middle of the condominium complex. He has expressed an interest in
changing the use ofthat property to a condominium garage development.
Although I have spoken to you and other members of your staff regarding Lazier's comments
about changing that use, the members of the SVCA Board of Direc-tors wanted me to formally putin writing our opposition to any plans that Lazier may submit. My understanding is that Lazier
has not made any submittal to change the use or subdivide the property at this time. your staff
has also assured m9 th1 no change in use would be allowed without SVCA approval. If at somepoint in the future he decides to request a change the following concerns will need to be resolved:
1 . The parcel of land does not have proper egress easements fbr access across our SVCAproperty.
2. The parcel of lard does not have proper building setback requirements for the existing garage
building and actually encroaches on to SVCA propirty at the Northwest end.

General Information:
This application is required for proposals involving ONLY wildlife resistant enclosures. Ordinance No. 20, Series
of 200'6, require thai all resldential customers with curbside trash removal seruice within the Town of Vall utilize
a wildlifereiistant container and that all commerchl and mulU-family customers utilize a wildlife-resistant
container by April 15, 2007. If these requirements are not me! residential and commercial customers shall

SUBMITTAL REQUIREMENTS
Ordinance No. 20, Series of 2006, requires that all residential customers with curbside trash removal seruice
withln the Town of Vail utilize a wildlife-resistant container and that all commercial and multFfamily customers
uufize a wildlife-resistant container by April 15, ZOO7. If these requirements are not met, residentlal and
commercial customers shall mnstruct a wildllfe-resistant enclosure by August t,2007. The Administrator (a
member of the planning staff) may review Wildlife Reslstant Enclosure Design Review applications and apprwe,
appro\re with certaln modifications, deny the application, or refer the applicaUon to the Design Review Board for
a decision. All staff approvals are reviewed by the Design Review Board and any staff decision is subject to final

During removal of an old timber wall in front of the ramp on the east end of the
parking lot, we discovered that the ramp had been constucted very poorly. Instead of
just replacing the wall in front of the ramp per the original plan, we would like to
reconstruct the ramp to meet code.

lnrnix that will not only enhance the aesthetics of their neighborhood, but increase its
Sturr,r lir. environmental value. The planting concept is based on the reduction of tur:f areas;
si. tlnrrlo replacing those high-maintenance surfaces with native draught-tolerant plantings. The
existing irrigation syst€m will be updated with drip-irrigation used to establish the new
plantings.
Lighting will be added only for safety on the stairs and entries to the pool area. The
pool and spas have component lighting, and up-lighting will be added at the new entry
monuments. We recommend seasonal lighting only on the treed areas along the
cobbled swales.

Here's two copies of the Sun Vail Pool House indicating the roof line
revisions requested by the DRB on 3-19-03. As you requested in your
phone message, I've attached an updated DRB application cover
sheet indicating Final Review and checking the "New Construction"
box.
Since this item will be coming in on April 2nd under the umbrella of
Design Workshop's total proposalfor Sun Vail, application fees are
being submitted by Sun Vail's property manager, Vail Management
Gompany (Mr. Bobby Goates, 4764262), and coordinated with
Design Workshop (Ms. Kim Swanson, 746-8408).
Ms. Swanson asked that since they have already submitted a $250 fee
for the project under "Minor Alterations", do they need to submit a new
total of $650 or can they submit another $400 to bring the fee total up
to speed?
I will be out-of-town starting tomorrow, 3-21-03, until 3-31-03. lf you
don't reach me before I leave, please coordinate the required DRB fee
check with Ms. Swanson and/or Mr. Coates at the above phone
numbers.

I. PRE-APPLICATION CONFERENCE
A pre'application conference with Town of vail staff is required. No application can be accepted unless the mandatory pre-applicationmeeting has been completed. lt is the applicants responsibility to schecjute this meeting by c;lling 970-479-2128.
II. TIME REQUIREMENTS
The Design Review Board meets on the 1st and 3rd Wedne.sdays of each month. A complete application form and all accompanyingmaterialrnust be accepted by the Community Development Depirtment a minimum of three and'i halt (3 1t2) weeks prior to the dateof the DRB public hearing.

Your proposal will be reviewed for compliance with the Design Guidelines as set forth in Section 12- j 1 of the Municioal Code.
IV. NOTE TO ALL APPLICANTS:
A. lf a property is located in a mapped hazard arca (i.e. snow avalanche, rocKall, floodplain,
d-elris flow , wefland, etc), a hazard study must be submitted and the owner must sign anaffidavit recognizing the hazard report prior to the issuance of a building permit. Applcants
are encouraged to check with the planning staff prior to submittal of a DRB applicaiion to
determine the relationship of the property to all mapped hazards.
B. Basic Plan Sheet Format. For all surveys, site plans, landscape plans and other site
improvements plans, all of the following must be shown.

For new construction and additions, the applicant must stake and tape the project site to
indicate property lines, proposed buildings and buitding corners. All irees to be removed
Inu:t P9 taped. The appticant must ensure that staking done during the winter is not
buried by snow. All site tapings and staking must bt completed prior to the day ofthe DRB meeting.
D. Applicants who fail to appear before the Design Review Board on their scheduled meeting
date and who have not asked in advance that discussion on their item be postponed, will
have their items removed from the DRB agenda until such time as the item has been
republished.
E. lf the DRB approves the application with conditions or modifications, all conditions of
approval must be resolved prior to the issuance of a building permit.
V. STAFFAPPROVAL
The Ad-ministrator.may review and approle Design Review applications, approve with certain modifications, deny the

A' Any application for an addition to an existing building that is consistent with the architectural

of the building and is generally consistent with the architectural design, materials and colors of thebuilding, including, but not limited to exterior building finish materialJ(e.g. stonework, siding, roofmaterials, paint or stain,), exterior lighting, canopiegor awnings, fencesfantennas, satellite dishes,windows, skylights, siding, minor commeicial facade improvements, and other similar modifications:
C' Any application for site improvements or modifications including, but not limited to, driveway
modifications, site grading, site walls, removal or modifications to existing landscaping, installation ofaccessory structures or recreational facilities.
VI, ADDITIONAL REVIEWAND FEES
A. lf this application requires a separate review by any local, state or Federal agency other than the

PRE-APPLICATION CONFERENCE
A pre-application conference with Town of Vail staff is required. No application can be accepted
unless the mandatory pre-application meeting has been completed. It is the applicant=s
responsibillty to schedule ths meeting by calling 970-479-2128.
TIME REOUIREMENTS
The Design Review Board meets on the lst and 3rd Wednesdays of each month. A complete
application form and all accompanying material must be accepted by the Community Development
Deparrnent a minimum of three and a half (3 1/2) week prior to the date of the DRB public
hearing.
REVIEW CRITERIA
Your pmposal will be reviewed for complhnce with the Design Guidelines as s€t forth in Section 12-
11 of the Municipal Code.
NOTE TO ALL APPUCANTS,
A. ff a property is located in a mapped hazard area (i.e. snow avalanche, rockfall, floodplain,
debrb flow, wetland, etc), a hazard study must be submitted and the owner must sign an
affidavit recognizing the hazard report prior to the issuance of a building permit. Applicants
are encouraged to check with the planning staff prior to submittal of a DRB application to
determine the relationship of the property to all mapped hazards.
B. Basic Plan Sheet Format. For all surveys, site plans, landscape plans and other site
improvements plans, all of the following must be shown.
L. Plan sheet size must be 24'x 36". For large projects, larger plan size may be
allowed.2. Scale. The minimum scale is 1"=20'. All plans must be at the same scale.
3. Graohic bar scale.4. North arrow.5. Title bloclt project name, project address and legal description.6. Indication of plan preparer, address and phone number.7. Dates of original plan prepamtion and all revision dates.8. Vicinity map or location map at a scale of 1"= 1,000' or larger.
9. Sheet labeb and numbers.10. A border with a minimum left side margin of 1.5".11. Names of all adjacent roadwala,12. Plan legend.
C. For new construction and additions, the applicant must stake and tape the project site to
indicate property lines, proposed buildings and building corners. All trees to be removed
must be taped. The applicant must ensure that staking done during the winter is not
buried by snow. All site tapinge and staking must be completed prior b the day
of the DRB meeting.
D. Applicants who fail to appear before the Design Review Board on their scheduled meeting
date and who have not asked in advance that discussion on their item be pos@oned, will
have their items removed from the DRts agenda until such time as the item has been
republished.
E. If the DRB approves the application with conditions or modifications, all conditions of
approval must be resolved prior to the irsuance of a building permit.

V.STAFF APPROVAL
The Administrator may review and approve Design Re/iew applications, approve with certain modfications,
deny the application, or may refer the application to the Design Rs/iew Board for decision, All staff
approvals are subject to final approval by the DRB. The following types of Design Review applications may
be staff apprwed:
A. Any application fur an additjon to an existlng building that is consistent with the architectural design,
materiab and colors of the building, and approval has been received by an authorized mernber of
a condominium association, if applicable;
B, Any application to modifu an exHing building trat does not significantly change the existing planes
of the building and is generally consistent with the architectural design, materials and colors of the
building, including, but not limited to exterior building finish materiab (e.9. stonework, siding, roof
materials, paint or stain,), exterior lighting, canopies or awnings, fences, antennas, sakllite dishes,
windows, skylighE, siding, minor commercial facade improvements, and other similar modifrcations;
C. Any application for site improvements or modifications including, but not limited to, driveway
modifications, site grading, site walb, removal or modifications to sdsting landscaping, installation
of accessory structures or recreational facilities.
ADDMONAL REVIEW AND FEES
A, ff this application requires a separate review by any local, state or Federal agency other than the
Town of Vail, the application fee shall be increased by $200.00. b(amples of such review, may
include, but are not limited to: Colorado DeparEnent of Highway Access Permits, Army Corps of
Engineers 404, etc.
B. The applicant shall be responsible for paying any publishing fees which are in o<cess of 50o/o of the
application fee. It at the applicant's requesq any matter is postponed for hearing, causing the
matter to be re-published, then the entire fee for such re-publication shall be paiti by the applicant.

consultant b needed, the Community Development Department may hire the consuftant. The

After our phone conversation today I went to the site to check out
the paint samples applied to the building.
These colors are only "similar" to what I had specified and will not
accomplish what we are trying to do and are therefore, not
acceptable to me.
Kent, at this point I suggest that you insist that the painter uses the
original paint product I had specified, or, that the painter tells you
what product he intends to use so that I can then adjust the colors.

The Sun Vail Board has approved this application for permission to use an exterior cedar
product when replacing failed siding now existing.
The proposed product is I Xl 0 R /L Bevel cedar siding Item #5905 I 200H, available
through Northstar Lumber, 926-8733. This material was selected because it is more
structurally sound than existing, the few knots that are in the board have been glued from
the backside, it is/was readily available and with proper preparation it closely matches
what exists. Note: the association anticipates on-going replacement as the existing
boards fail over time.
Based on our visual examination of the current work product (where the cedar was used)
we find no noticeable change in appearance (the Board has directed its painting
contractor to do extla sanding and use extra primer so as to closely match the appearance
of the current siding product). We are satisfied that this approach is in the best interests
of the association (cost and timeliness is/was a consideration in our decision).
Please accept our apology for this after-the-fact application. We went forward based on
an incorrect assumption that this was acceptable (management company personnel
confirmed that no building permit was necessary for this work, change in material was
not part ofthat conversation).

A pre-application conference with Town of Vail staff is required. No application can be accepted
unless the mandatory pre-application meeting has been completed. It is the applicant=s

TIME REOUIREMENTS
The Design Review Board meets on the lst and 3rd Wednesdays of each month, A complete
application form and all accompanying material must be accepted by the Community Development
Departrnent a minimum of three and a half (3 1/2) weeK prior to the date of the DRB public
hearing.

L1 of the Municipal Code.
NOTE TO ALL APPUCANTS:
A. ff a property is located in a mapped hazard area (i.e. snow avalanche, roclfall, floodplain,
debris flow, wetland, etc), a hazard study must be submitted and the owner must sign an
affidavit recognizing the hazard report prior to $e issuance of a building permit. Applicants
are encouraged to check with the planning staff prior to submittal of a DRB application to
determine the relationship of the property to all mapped hazards.
B. Basic Plan Sheet Format. For all surveys, site plans, landscape plans and other site
improvements plans, all of the following must be shown.
1. Plan sheet size must be 24'x 36". For large projects, larger plan size may be
allowed.2. Scale. The minimum scale is 1"=20'. All plans must be at the same scale,3. Graphic bar scale.4, Nofth armw,5. Title bloclg project name, project address and legal description.6. Indication of plan preparer, address and phone number.7. Dates of original plan preparation and all revision dates.8. Vicinity map or location map at a scale of 1"=1,000' or larger.

C, For new construction and additions, the applicant must stake and tape the pmject site to
indicate property lines, propmed buildings and building corners. All trees to be removed
must be taped. The applicant must ensure that staking done during the winter is not
buried by snow, All site tapings and staking muet be completed Prior to the day
of the DRB meeting.
D. Applicants who fail to appear berfore the Design Review Board on their scheduled meeting
date and who have not asked in advance that discussion on their item be postponed, will
have their items removed from the DRB agenda until such time as the item has been
republished.

V.STAFF APPROVAL
The Administrator may review and approve Design Review applications, approve with certain modifications,
deny the applhation, or may refer the application to the Design Review Board for decision. All staff
approvals are subject to final approval b,y the DRB. The following types of Design Rwiew applications may
be staff approved:
A. Any application ficr an addition to an odsting building that is consistent with the architectural design,
materials and mlors of the building, and approval has been received by an authorized member of
a condominium association, if applicable;
B. Any application to modifo an odsting building that does not significantfi change the existing planes
of the building and is generally consistent with the architectural design, materials and colors of the
building, including, but not limited to ofterior building finish materiab (e.9. stonework, siding, roof
materials, paint or stain,), exterior lighting, canopies or awnings, fences, antennas, satellite dbhes,
windows, skylights, siding, minor commercial facade improvenrents, and other similar modifications;
C. Any application for site improvements or modiflcations including, but not limited to, driveway
modifications, site grading, site walb, removal or modifications to existing landscaping, installaton
of accessory structures or recreational facilities.
ADDMONAL REVIEW AND FEES
A. If this application requires a separate review by any local, state or Federal agency other than the
Town of Vail, the application fee shall be increased by $200.00. Examples of such review, may
include, but are not limited to: Colorado DeparUnent of Highway Access PermiE, Army Corps of
Engineers 404, etc,
B. The applicant shall be responsible for paying any publishing tues whhh are in excess of 50% of the

Department shall estimate the amount of money necessary to pay the consuhant and thb amount
shall be forwarded to the Town by the applicant at the tirne of filing an applbation. Expenses
incurred by the Town in excess of the amount fonvarded by the application shall be paid to the
Town by the applicant within 30 dap of notificatjon by the Town. Any o(cess funds will be retumed
