Minor Exterior Alteration
General Information: This application is required for all proposals involving minor changes to buildings and site improve-
ments, such as roofing, painting, window additions, landscaping, fences, retaining walls, etc. Applicable Vail Town
Code sections can be found at www.vailgov.com under Vail Information - Town Code Online. All projects requiring de-
sign review must receive approval prior to submitting a building permit application. An application for Design Review
cannot be accepted until all required information is received by the Community Development Department, as outlined in
the submittal requirements. The project may also need to be reviewed by the Town Council and /or the Planning and
Environmental Commission. Design review approval expires one year from the date of approval, unless a building per-
mit is issued and construction commences.

Klmmelman and Stacey Kimmelrrman, the buyer9 of 11518 Casolar Drive, Vail, Colorado ( "Buyers').
RECITALS
A. Casolar is the Association responsible fvr overseeing common areas (Common Areas ") located
in the subdivision known as Casolar Del Norte( "Subdivision "), located in the Town of Vail,
Colorado, which Commoon Areas are intended to be devoted to the common use and en)oyment
of the owners of lots located within the Subdivision,
B. Casolar is also responsible for maintaining and administering the Common Areas pursuant to the
terms and provisions of the Amended and Restated Deaa,ration of Covenants and Restrictions
for Casolar Det Norte, as recorded on December 11, 191)2 with the Eagle County Clerk
( "Declaration ").
C_ Buyers wish to undertake work to mitigate water from damaging their home on the west and
north sides on or after the closing date of September 2 :8, 2012: The. work will include building a
swale on common.area to redirect the water away from the west side of the house. On the,
north side, a berm commencing behind the west end of the existing brick wall behind tho house,
continuing east behind both sides of the duplex and ending at the bottom of the cornmon.area
.close to the road atthe east side of his duplex neighbor's house at 1151A Casolar Dr. There will
also be a pond liner placed with gravel below the bean to aid in water mitigation. 'the stone
pavers near the sprinkler box on the west side will also be removed, and replaced with.a deers
material to.tie the two existing decks together (on west: and south side), to assist with water
mitigation. The pavers will then be placed next to the planters down to the driveway in a stair
Case formation, to help the current erosion of soil, There will also he some relocation of the
existing sprinkler system. 'his work will require encroachment Into the Common Areas and may
result in damages to elements of Common Areas, which may Include (but is not limited to)
landscaping ( "Damaged ImprQvements "),
D. Buyers wish to replace the garage and front door.
E. Buyers have indicated their commitment to.undertake :he repair and/or restoration of any and
all Damaged Improvements to the satisfaction and standards of Casolar and the parties are
entering into this Agreement to memorialize that commitment.
NOW, THEREFORE, for and in consideration of the promise!, and covenants contained herein; and
other good and valuable consideration, receipt and sufficie cv is acknowledged by the parties, the
parties agree as follows:
1) Pre Construction Beaulrements and mutual understandin�t
a) Buyers shall provide Casolar with a description of the work to be done in the Common Areas.

a) On completion of work Buyers shall notify Casolar that wort; (and to Buyers' belief all repair to
Damaged Improvements) has, in Buyers opinion, been completed.
b) Within fifteen (15) business days of such notice Casolar will review the Common Areas.
C) If Casolar agrees that all work has been completed In a sati!�actory fashion, Casolar shall
provide Buyers with written notice conflrening that Buyers' obligations to Casolar under this
Agreement have been met.
d) Alternatively, if Casolar finds defector issue in Damaged improvements, within that same
fifteen (15) business day period Casolar shall provide Buyers with'written notice and list of
which damaged improvements have not been repaired or rt stored to the satisfaction or
standards of CasolararW the terms of section 3.: below shall ;tppiy.
3) Undertaking by Homeowner of Repair(Restora iM
Upon'receipt of the list of Repair /Restoration items from Casola • (if. any from section. 2d above),
Buyers shall promptly, at.no cost to Casolar, effe&.the repair and/or restoration of all
Repair /Restoration items ( "the Work "). All :of the Work shall be'property performed by Buyers aitd
their contractors, shall be in material compliance with applicabk� construction standards; laws and
codes, and.all of the Work shall be of good workmanship and mi!iterials. All of the Work. shall be
substantially completed by July 31, 2013. B'uyeta shall warrant ttte Work against defects in
workmanship and materials for two (2) years after the date of sr bstantia.l completion. All of the
Work shall be undertaken in a commercially - reasonable manner and in such manner as to minimize
interference with the use of the Common Areas .by the owners of lots, in Casolar Del Norte, and.
others entitled to undertake such use.
4) Indemnlficatlon. Buyers shall defend, indemnify and hold Casola.•, and Casolar's members, directors
and officers, harmless from all actions, claims, demands, liabilitks s, and damages, resulting'to or
arising out of any injury to persons, damage to petsonal propert!i,.or physical damages to the
Common Areas (or any structures or improvements located therein), which are threatened, imposed
on or incurred by Casolar as a consequence of any acts or omissions on the part of Buyers, its
employees, agents, contractors or subcontractors, or anyone acting on behalf of the
aforementioned parties in connection with any of the construction:actMties undertaken by
Homeowner within Subdivision.
5) Insurance, Buyers and their contractors shall carry and maintain in force, at their expense, at all
times during the performance of any of its construction activities within the Subdivision the
following minimum insurance coverage:

SPECIAL MEETING
November 4t'', 2012
A special meeting of the Casolar Del Norte Homeowners Association was duly held
November 4t', 2012 at 3PM via teleconference. The following members participated in the
meeting: Nancy Bigsby, Brendan McCarthy, Charles Reyner, John Uhley and Seth Kimmelman.
Commencement
John called the meeting to order at 3:02pm. With 5 members present and 22 voting
responses via fax, email or postal mail a quorum was established. All participating confirmed
that they had received proper notice of the meeting.
Vote on easement request, Kimmelman Deck Project
The results of the special vote called on behalf of Seth Kimmelman were 21 votes to approve the
easement requested by Mr Kimmelman. The balance of homeowners either did not reply at all or
did not reply with a specific approval vote. There were not any "no" votes returned. With 21
votes out of 28 homeowners the request exceeded the threshold of approval that the association
lawyers have opined as being sufficient to authorize the board to grant the requested easement.
As a result the request is approved.
Adjournment
At 3:05 pm Nancy motioned to adjourn the meeting, seconded by Charles, and passed
unanimously.

Just got back from the site and the my only comment is that I can approve everything so long as you confirm the new
garage door and new front door will be painted to match the other side's door and garage door. [)r you confirm that all

I just looked at your DRB application and identified the following materials are still needed.
An elevation drawing showing the deck expansion. Please note that you will paint the deck to match the east side deck.
The application states that the front door and garage door are being replaced. I do not see a copy of the proposed front
door or garage door. As discussed at the counter the front doors and garage doors on the duplex need to match or be of
the same architectural character /vein. Please provide me a copy (cut sheet /manufacturers brochure) for the new doors.
I am still hopeful of an administrative approval, but I need this information and I need it to meet our Design Standards
and guidelines.
