International Building Code, 2003 International Residential Code, 2003 International Mechanical
Code, 2003 International Fuel Gas Code, 2003 International Plumbing Code, 2003 International
Energy Conservation Code and 2002 National Electrical Code as modified and adopted by the Town of
Vail.

permit application number noted.
• Please be sure to include on the resubmittal the engineer's or architect's ��wet" stamq, sianature,
registration number and date on the cover page of any structural calculations, all structural
details and structural sheets of the plans For commercial or multi-familv proiects all sheets of
the plans must be stamped.
1 Please include an asbestos test and report for the building.
Architectural Comments:
2 Specify on the plans and in the scope of project that the building will be provided with an automatic
fire sprinkler system throughout per NFPA 13.
3 Revise referenced codes on sheet ID 0.1 to indicate the appropriate codes adopted by Town of Vail.
UMC and UPC are not the adopted codes.
4 Revise occupant load factor for room 101 to 30. Occupant load is 59. IBC Table 1004.1.2
5 Clarify existing floor/ceiling construction and the 2 hour Floor/ceiling assembly detail shown on the
plans. Existing construction appears to be precast concrete tee. Floor/ceiling assemblies under type
III-A construction are required to be 1 hour. The required separation between occupancy uses are
permitted to be 1 hour per Table 302.3.2 with the use of footnote a. Plans also reference 2 hour
floor/ceiling in areas. Coordinate accordingly.
6 Include a proposed 1 hour assembly detail for the unprotected steel beams mentioned in the project
scope. IBC Table 601.
7 Revise plans to show 1 hour wall types between the bathrooms and the exit stairway enclosure on
level one and two. IBC 1019.
8 Revise plans to show 1 hour wall types between the exit corridor (C2) on level two and the exit
stairway on this level. IBC 1019
9 Revise plans to show 2 hour wall types at the elevator shaft enclosure walls. IBC 707.4
10 Please clearly specify on the plans for all duct penetrations into the exit corridors to receive
combination smoke/fire dampers. Duct penetrations into fire resistive walls or floor/ceilings
separating occupancies require fire dampers. IBC 716
11 Please clearly specify on the plans for all penetrations in fire resistive walls or floor/ceilings to be
provided with firestopping per IBC 712
12 Clearly show all doors requiring replacement on the plans. Indicate fire resistive rating of doors.
Doors into the exit corridors require 20 minute listing IBC 1016.1, IBC 708, 715.3
Doors into the exit enclosure require 60 minute listing. IBC 715.3
Doors in the separation between occupancies require 60 minute listing. IBC 715.3
13 20 minute doors are required on all elevator openings into the exit corridor. IBC 715.3 �
14 Amend wall type shown on level 3 between dwelling units. Separation is required per IBC 708.1.
15 Amend plans to clearly show locations of all required exits and exit signs on each floor level. IBC ch.

16 Two exits do not appear to be provided for the Blue's restaurant space. Hall to the parking garage is

19 Include a site plan showing location of property lines and an analysis of the existing wall opening
locations per IBC Table 602 and Table 704.8. Opening protection was to be provided where required
as part of the fire resistive upgrades to the building.

This meeting was held to in response to the Ietter issued i�y Mike McGee last year to The �
Boa��d, for the purpose of coordinating the Gore Creek Plaza's efforts to itnplement its
recommendations and further issues discussed during the earlier site visit. lt is the Board's
intent to develop a plan for the implementarion and submit an associated schedule for
documentation and installation. As many factors will affect schedule it is acl.-nowledged that
adjustmenrs may be needed to schedule and sequence to accommodate tenants' requirerr�ents
and other factors that may arise. The Town will be appraised if and when they do occur
A. Slifer Residenbial Remodel (Unit 3):
Mike McGee indicated that with the start of work towards the improvements and upgrades to
the entire building the Slifers could proceed with the remndel of their unit.
B. Fire Protection and Suppression System:
Mike McGee made the following comments regarding the fire protection and suppression
system:

The Sweet Basil restaurant will probably reyuire additional capacity due to its size.

6. The gazage fire protection could most likely be served with the installarion of an
anti-freeze loop (approxunate cost: $500).
7. Tha fire protectian piping rmtning throu�h the garage area will need to be run in an
insulated, horizontal chase and may need to be further tempered with iieat tape to
protecfied it from &eezing. T'his will be especially irnportant, in spite of Rod
Slifer's assertion that the ga�•age often remains above fraezing during the winter, as
this line will not hold moving water like the other domestic service water lines.
Ed Lowrey was asked by Chuck Rosenquist to solicit proposals from fire protection
engineei�s. The services of this consultant will be retained directly by The Board.
Fire protection scope of services likely to include the following, Other services may be
requu'ed by The Tow,i of Vail:
1. Review of the existing instalfation with an accompanying report to the Owners
assessing compliance to fire protecrion and suppression codes and standards
including Standard NFPA 13.
2. Preparation of all fire protection and suppression documentation (drawings and
specifications) for any remedial work reported du.ring the existing conditions
assessment and all new work to comply to fire protection and suppression code and
standards including Standard NFPA 13.
3• Any revisions or additional documentation requested as a result of the Fire
Deparhnent's review of the design documents submitted for pertnit.
4. Assistance to general contractor with subcontractor bid review for adherence to the
engineer's design docuinentation and specifications.
5. Construcrian adtninistrarion. The fire protection engineer wiil review and retum all
%re protection and suppression shop deawuigs a�td any associated calculations with
the en�ineer's action stamp and any comments, clarification or corrections. The
tiining atid mm�ber of site observation visits must be at the discretion of the engineer
and coordinated with the general contractor and Owner. Each visit must be
accompanied with field reports d'uected to The Board and the general contractor.
C. Vertical Chase (ShaR);
Cha�•lie Moore indicated that there are several alternative responses to reconstruct the chase
according to code. Charlie recominended that che shaft should be protected by the spruzicler
system and Ue consfiructed to obtain a one�hour rating, A pre-designed, oii�how• rated shaft-
wall construction systern will likely be empioyed without horizontal separarions.
Ed Lowrey indicated that tliere is need for service access to the shaft at alI three levels;
therefore there will most likely be one-how rated access panels at ail levels. 5ome degree of
relocation of utilities, iu the chase, wi11 likely be reyuireti.
D. Unprotected Openings:
Chazlie Moore indicated that the Tnternational Building Code (not yet adopted) allows for up
to 3S% of totaI glazing be unprotecied.
Mike McGee recornmended that the fire protection engineer be retained to design an
appropriate alteinative to the UBC "window wash" approacl�.

E. Penetrations of Rec�uired Fire-rated Floor/Wall/Ceiling Assemblies:

At separarions (exterior and interior walls, floors and ceilings) requiring one or two hour
rated construction assemblies, all un-rated penetrations will need to be exposed
and either eliminated or corrected with the addirion of ratea penetration devices (fire-rated
dau�pers, fire-rated intumescent sealant, etc.). Required, rated doorways that need to remain
opan during noxmal business use will be fitted with Town of Vaii and UBC approved
ina�,netic hold-open devices.
F, Seconda�y Egress
Rod Slifer requested t1�.at a secondary egress solution be designed to meet building code
approval and possibly inte�rate the solution derived by The Vail Architecture Group. Michael
Hazazd will request a copy to see how it might be implemented. Rod and Chuck will seek an
agreement for implementation with The Bell Tower homeowner's association.
G. Water Seivice Entry:
Mike McGee and Charlie Davis agreed that the water service eiitry, at the basement, can be
completed in coordination with the anticipated street work at Gore Creek Drive
H. Miscellaneous Issues
The following building code compliance items were noted by Michael Hazard during tha
meeCing, as some of the issuas previously identified by Charlie Da�is:
The unprotected steel beam, at the basement, shall be properly enclosed.
The existing sump pit, at the mechanical room, will be verified to ensure that
there is an adequate cover to prevent the seepage of sewer gasses.
The doors separating the Mechanical Room form the Garage will be veriiied to
comply with code reqwirements £or a one hour-rated asseinbly.

Chuck Rosenquist anticipated that ti�e renovation of the vertical chase would likely be the
first scope to be completed. The Board, general contractor, Fire aud Build'uig Deparnnents
wiil review duis assumprion aud recoxnmend t��e proper sequ�nce of implementation of al1 the

Michael Hazard Associates was asked by Rod and Chuck to provide a fee proposal for
services including the documentation of existing conditions and a schematic design for
building code compliance issues, identified above. Once the desired sequence of work is

GORE CREEK PLAZA, Town of Vail, Colorado." , some building separation distances and
opening sizes are not accessible at this time due to snow on roofs and the only access to some
windows is on roof tops. We request a temporary waiver on this item until later in the spring. We will
deliver these dimensions and calculations on or about April 30 weather permitting. We request that
the Town of Vail give some relief on this due to the urgent need to get this permit issued in order to
begin the fire sprinkler and the other health safety work at the close of this season to avoid the
economic burden on the businesses which will have to close for the duration of this work.

PROJECT HISTORY
In cooperation with the Town of Vail Building Department, the owners of Gore
Creek Plaza have had an ongoing plan to improve the property relative to fire
safety over recent years. This work has included adding sprinklers to the upper
stories (residential units) of the building. As the property has seen improvements
the commercial portions of the building have experienced some expansion in
use. As is the case with most decades old commercial and multi-use buildings
there hav� been rn�difications to the infrastructurP �f the building which d� �c�t
meet the currently adapted versions of thP buif`ding and fire safety co�es.
At the request of the owners of Gore Creek Plaza and the Town of Vail, Chief
Building Inspector this report was assembled to aid in the assessment of the
current condition of fire safety measures in place and fire prevention measures
that may be addressed at this time.
The owners have agreed to add sprinklers to the entire building and to take other
measures which are intended to aid in the upgrade of the fire safety for the users
of the building. Some existing conditions have been discovered that do not allow
the structure being completely modified to meet an existing tested fire safety
system without demolition of the building to an extent that would be considered
economically unfeasible. We address this situation later in this report.

SCOPE OF THE PROJECT
This project and report was begun to assess the extent of the work required to
achieve as closely as possible current fire safety standards of the Town of Vail.
It is the purpose of this summary to discover what fire rated separations between
occupancies will be required when the building is fitted throughout with a
sprinkler system which conforms to Section 903.3.1.1 of the IBC.
The following summary of the work is intended to supplement the work shown on
the attached plans and the wall & ceiling system sketches shown on Sheet No.
ID 9.1 of this report. A room by room schedule of Required Fire Rated Walls &
Ceilings follows:

meet the code on Sheet Na. 9.1. Those walls or ceilings referenced are
only a suggested approved wall or ceiling type and the contractor is invited
to submit to the chief building inspector any other UL or similarly tested
and approved wall or ceiling system that will meet the criteria acceptable
to the Town of Vail chief building inspector.
2. The Code does not require separations between the same type of
occupancies. The Code also gives specific credits (lesser rated time) for
sprinkler fitted areas, therefore eliminating certain requirements for walls
and ceilings. These credits have been allotted in the following summary,
except in areas that would require these separations regardless of the
credits.
Note: All separations which require two hour fire rated construction have
been reduced to one hour because of note on Table 601 of the IBC which
gives a one hour credit for sprinkler systems which conform to Sec.
903.3.1.1 of the IBC.

GENERAL
All exit corridors are to be fitted with fire doors rated at 20 minutes and shall be
fitted with automatic closers and magnetic release devises where required by the
Fire MarshalL
FIRE PROTECTIVE MEASURES
All walls and ceilings shown as requiring a fire rated separation shall be
investigated on site by the contractor and the Fire Protection Consultants to
determine if the existing wall or ceiling system does meet the criteria of an
approved, tested & rated system. Those walls and ceilings which are
constructed in such a way as to not meet an approved & tested, rated system
consistent with the rating shown on the plan and in this report shall be
supplemented and or replaced with a wall or ceiling system which will meet such
a criteria.
It is the vision of the architect that some walls may be installed that are
constructed in such a way that they meet the desired rating and are placed
immediately adjacent to existing walls. The electrical devises shall be installed in
the new walls to match the existing walls.
Ceiling systems which meet the criteria could be suspended ceilings which are
rated for one hour.
Penetrations which are existing or proposed between occupancy types requiring
a rated separation shall be fitted with a device and or a fire & smoke barrier
which will meet the required separation. In areas where access to such
penetrations is so limited that it is not possible that these penetrations can not be
suitably fitted with the above noted devices the Fire Protection Consultants shall
propose a system that wili achieve such a barrier and v�hich is a�proved by the
chi�f buil�lin� inspector.
There are some existing conditions ir� areas ir� the building which hduse
unprotected steel beams. These areas and their protective meas�res shatl be the
result of investigation evaluation and recommendations of the Fire Protection
Consultant as may be approved by the Town of Vail chief building inspector
and/or the Fire Marshall.
This process has already been initiated by the discovery of an existing vertical
shaft in the building for which it is not practicable to attempt build a new shaft and
it is more practical to protect this shaft by adding sprinklers. The Town
inspectors have agreed to this process to date.
In conclusion, this building when being fully sprinkled will be much safer place to
reside, visit and work than ever before. Other measures taken with fire resistive
wall and ceiling separations is another protection required by the code. The chief
building inspector and the architect agree that it would not be a practical
endeavor to attempt to bring this building to a state which a new building of this
type would be required to achieve, however the building will be vastly improved
from a fire safety point of view.

INSULVAIL CONSULTING ROLE
The architect and the contractor agree that as a practicai matter it is important to
have a Fire Protective Consultant available during the demolition and
reconstruction of the walls, ceiling and beam enclosures which will reveal the
buildings now hidden penetrations and unprotected components.
As a practical matter that consultant must be available on a local level so as to
provide on the spot inspections that will lead to the best fire safety solutions to
the yet to be discovered areas which need attention from a fire safety
perspective.
We have therefore secured the services of Rodger A. Duckstader of InsulVail,
LLC. Mr Duckstader has provided the attached letter of his qualifications for this
work. It should be noted that it is
