Asbestos Testing & Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. The Town of Vail asbestos abatement program is in addition to the State of Co�orado's regu-
lations. It is your responsibility to be in compliance with the State. Please contact the State directly for their requirements
at the contact info listed below.
When is asbestos testinq required?
ANY building projects disturbing more than these threshold levels of building materials require asbestos testing:
One- and Two-Family Dwellings: 30 square feet
All Others: 160 square feet
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State-certified and Vail-registered abate-
ment contractor. An asbestos abatement permit must be approved, and the clearance letter must be submitted to the
Town of Vail before the building permit will be issued
Project Checklist

Tips & Facts:
• Even recent construction projects may include asbestos-containing materials, so buildings of � age require testing.
• The "1989 Ban" on asbestos-containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so-called "Asbestos Ban and Phaseout" rule and remanded it to the EPA. Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce
of many asbestos-containing product categories was set aside and did not take effect." - CDPHE

Dear Mr. Farrar:
Attached is the report for the asbestos survey and bulk sampling of suspected asbestos-
containing building materials at Lions Square Lodge, unit 370, 660 W. Lionshead Pl.,
Vail, Colorado.
This investigation was conducted on behalf of and for the exclusive use of Mr. Doug
Farrar (client), solely for use in a limited asbestos survey of the property. This report
and the findings herein shall not, in whole or in part, be disseminated or conveyed to any
other party, nor used by any other party, in whole or in part, without prior written consent
of Boulder Environmental Management.
The results of this survey are limited to materials that were assessable and foreseeable.
Additional materials may exist behind hard surfaces. Personnel knowledgeable of
asbestos containing materials should always oversee demolition activities. Demolition
work should be halted and sampling performed by a state of Colarado licensed building
inspector if additional materials, which are suspected of containing asbestos, are
encountered.

BULK SAMPLING REPORT
Lions Square Lodge, unit 370, 660 W. Lionshead Pl., Vail, Colorado
Introduction:
On October 27, 2009, Boulder Environmental Management, Inc.'s building inspector,
Mark Symmank, conducted bulk sam�lin og f suspected asbestos-containin� materials
under the direction of our client.
Sampling:
During the sampling process, suspect ACM was separated into three EPA categories.
These categories are thermal system insulation (TSI), surfacing ACM, and miscellaneous
ACM. TSI includes a11 materials used to prevent heat loss or gain or water condensation
on mechanical systems. Examples of TSI are pipe coverings, boiler insulation, duct
wrap, and mud packed fitting cement. Surfacing ACM includes all ACM that is sprayed,
trowelled, or otherwise applied to a surface. These applications are most commonly used
in fireproofing, decorative and acoustical applications. Miscellaneous materials include
a11 ACM not listed in the thermal system insulation ar surfacing categories, such as
linoleum, vinyl asbestos flooring, and ceiling tile.
Boulder Environmental Management, Inc. followed EPA recommended sampling
guidelines for identification of asbestos in bulk matrices. A set of three (3), five (5), or
seven (7) samples were collected for each material type and analyzed by Polarized Light
Microscopy (PLM). Each sample set was systematically analyzed. Upon determination
that a sample in a set contained asbestos, analysis of the remaining samples in the set was
discontinued. If no asbestos was detected during the analyses, the suspect material was
determined to be negative for asbestos content.

Results:
The following materials were analyzed and determined to be trace asbestos-containing
utilizing polarized light microscopy (PLM).

**Sample was further analyzed by point count method. The analysis determined that the
material contained 1% asbestos or less. The Environmental Protection Agency and the
state of Colorado Department of Public Health and Environment do not regulate materials
that have an overall asbestos content of 1% or less. However, Occupational Safety and
Health Administration regulations apply to workers handling the material.
The following materials were analyzed and determined to be non asbestos-containing
utilizing polarized light microscopy (PLM).

Discussion:
Sample analyses results are reported in percentages of asbestos and non-asbestos
components. The EPA defines any material that contains greater than one percent (1%)
asbestos, utilizing PLM, as being an asbestos containing material. Materials that are
identified as"none detected" are specified as not containing asbestos.

Conclusion:
The following materials were determined to contain less than one percent asbestos:
• Orange peel textured drywall and joint compound system in the kitchen
The demolition of materials that contain 1% asbestos or less require OSHA handling
guidelines be followed. However, a state licensed asbestos abatement contractor is not
required to perform such work. It is recommended that a licensed asbestos abatement
contractor be retained for this demolition to comply with OSHA requirements regarding
the demolition of asbestos containing materials that contain less than 1% asbestos.
The OSHA regulation 29 CFR 1926.11 O 1(g)(1)(ii) and (iii), as well as record-keeping
requirements under 29 CFR 1926.1101(n) that are associated with the negative exposure
assessment, apply so long as neither asbestos permissible exposure limit (PEL) is
exceeded or might be exceeded.
29 CFR 1926.1101(g)(1)(ii) requires:
"Wet methods, or wetting agents, to control employee exposures during asbestos
handling, mixing, removal, cutting, application, and cleanup, except where employers
demonstrate that the use of wet methods is infeasible due to for example, the creation of
electrical hazards, equipment malfunction, and, in roofing, except as provide in paragraph
(g)(8)(ii) of this section;"
and 29 CFR 1926.1101(g)(1)(iii) requires:
"Prompt clean-up and disposal of wastes and debris contaminated with asbestos in leak-
tight containers except in roofing operations, where the procedures specified in paragraph
(g)(8)(ii) of this section apply."
The results of this survey pertain only to materials tested. The laboratory reports
supporting these findings above are attached.
