erty owner may be required to replace trees that are removed. If required to replace, applicants must replant trees by
November 1st of the following year from the date of approval. Please be prepared to provide a tree replacement plan.

Mike,
I'm moving forward with the tree application regardless of your joint approval
signature tomorrow afternoon.
I'd prefer you do the right thing and sign the application but I have other
things more important to attend to and need to clear the TOV from my list of
to -do's.
Just be fully aware that if you choose not to sign and approve the removal these
trees you may be in violation of the protective covenants of our land under the
Property Maintenance section on page 2. State law takes these covenants very
seriously and so will we.

Hi Woodsie.
I wish to acknowledge receipt of your text message this afternoon posing the question, "Do you still refuse to
sign the tree application unless I sign a walkway approval?"
The simple answer is, I never have refused to sign the tree application. Furthermore. I nave
never asked you to approve a walkway as a condition to approve your application... I asked your approval to
place a heated mat along the Town of Vail Street Easement, during the winter months.
You had approached me earlier, asking if I had any concerns about removing the trees along
the property line and I stated if was fine with me if you wished to remove them. At that time,
I suggested that you check with the Town of Vail because you would probably need a permit to
remove them. I then asked you what your plans were, to provide screening of the adjacent
residence if you removed the trees.
Your reply was,..." I plan to plant something there but not sure at this point... I do not want to plant any trees
until next spring."
When I reviewed the tree application you asked me to sign, I noted the line item for number of
trees you would plant, was left blank.
I brought your application to your residence, unsigned, because I wanted to discuss your plans
for tree replacement, and informed you of the fact.
I also brought you my application for consideration, installing a heated mat along the street to
provide safe passage for family and guests to the parking area. I provided you with a technical
data sheet with specifications for the heat mat. To date, I have not received any reply to my request for
consideration by you to help us with that endeavor.
Since I never heard back from you regarding your plans for providing tree screening, I assumed you
did not plan to file the tree application.
As a co operative neighbor, I welcome the opportunity to meet and discuss the above matters and sign my
approval of your tree application.
