Dear Galen:
on Tuesday, January 29, l-99L, I checked the survey you submitted
to the Planning Department for the Wittemeyer construction on Lot
L, Block L, VaiI village Third Filing. The stoltzer residence
does conform to the approved plans, and meets the side yard
setback requirement. The Wittemeyer residence conforms to the
approved plans concerning height of the new garage. However' the
location of the two gondola towers has been modified from the
approved drawings.
It appears that the revised location wiII significantly alter the
landscaping and the retaining walls which were planned to be
buiLt around the lower base. The planning staff would like to
know why they were moved and how you will redesign the land-
scaping. Because of these differences, the plan may need to 9o
back to the Design Review Board for approval. I have enclosed a
Design Review Board apptication and schedule for 1991' so that
you will know the subrnittal deadlines and corresponding meeting
dates.

SURTECT: Franing Inspection ILC
On January 29, 199L, I approved the framing inspection for the
Wittenyer garage. A note on the survey, rolled up in the
building permit plans, says that the applicant must subnit
separate franing inspection ILc for the gondola terminals. fn
the project file, there is a staff approval dated october 8, 1990
for a rel-ocation of the Iower gondola terminal 5 feet to the
north. However, the ILC shows that the gondola terminals have
not been built according to the revised plan of october 8. Galen
Aasland, in a conversation on January 30, said that the
foundation and footers poured for the base of the gondola
terninals are much larger than the actuaL structures will be.
This is because the gondola needs significantly stronger
foundations and bases than typical accessories structure would.
With a framing inspection specifically for the gondola terminals,the surveyor will be able to identify the walls that will be
built. These walls, then, will be able to be compared to the
approved structures on the plans that the Cornmunity Development
Department has. The framing inspection for the gondola tennj-nals
rnust be completed prior to the issuance of a TCo for the
Wittemyer residence.
Based on the latest infonnation frorn Galen, he will bring a
revised landscaping/gondola plan to DRB for approval .

Pursuant to our conversation this morning regarding GRFA on thewlttenyer residence, r have reviewed the-Townrs permanent recordsand the prans which you have recently submitted, and have drawnthe following conclusj-ons:
236 sq. ft.
Subtracting the above square footages from the previouslyapproved 250 sq. ft. request, the witternyer residence now has 14sq. ft. of GRFA remaining. prior to the issuance of a Temporarycertificate of occupancy for the newly constructed areas oi tne-wittemyer residence, the Town planning oepartment will be fieldchecking the dimensions of the garage, the south addition and allthe entry and vestibure changes to the existing residence. rt.should be noted that any field changes made during construction,or enlargements made beyond the approved drawings, will bereduced from the remaining 14 sq. ft. of GRFA. A Temporarycertificate of occupancy wilt not be lssued if the exteedence isgreater than 14 sq. ft.

Dear Mike,
This letter is to follow-up our meeting on regarding the lfittemyer
Residence. Enclosed are dravings describing our request to change the
front entry. We would be using a portion of the 250 application for the
GRFA ve need for this. The site coverage vill not change from the
previously approved plans. This new area lrill become part of the entry
vestibule.
The upper Gondola terminal vill have earth and natural grasses added
around it so that the mncrete does not stick so prominently out of the
ground.
The lower Gondola terminal has moved forvard from the plans approved
by the DRB. We did submit plans to move the terminal moved northvard.
Hovever, the landscaping area has been affected. The enclosed drawing
shovs our revised landscape plan for that area.
We would also request that some of the remaining 250 a;pplication space
be used in the garage. This is all new construction, therefore it should fit
Larry Eskvilh's interpretation of allowable additions.
Please forurard, to me, any modifications or changes to the above items
that the town would reguest.

,I items for conditional use. After some discussion, Andy then answered questions ofCouncil. Merv Lapin then made a motion to approve the ordinance, which,lim Gibson
seconded' Larry Eskwith suggested comblnlng the two conditional uses shown in the
ordinance into only one. Merv then amended his rnotion to approve the ordinance andto combine both conditional uses into one, and Jim amended his second. A vote was
taken and the motjon passed unanimously 7-0.
Seventh on the agenda was an!hppeal-of;the'PEC:decislbnlto approve requests for an
exterior. alteration and landscape variance in order to construct an addition to the
Lancelot Restaurant at the Bell Toner Bulldtng 'located at 201 Gore Creek Drive (Partof Tract A, Block 58, Vail Village lst Fi'ling) (Applicant: Hermann Staufer,
Lancelot Restaurant). Kristan Pritz gave background information on the exterioralteration request and explained why staff recommended approval with two conditions:
1. The appllcant must remove railings surrounding the patio from November 1to
May 1 of each year.
2. The app'licant must particlpate ln a project lnvo1vlng the property owners
and the Town's Publlc Works Department ln an effort to reso1ve drainage problems
adJacent to the Be1 I Tower Buiiding. These drainage prob'lems are a resuit of the
undirected drainage off of the building. Staff does not fee'l that the applicant
should be required to provide the solutlon individual'ly. However, staff feels it isfair to require him, as a property owner ln the building, to participate and pay forhls fair share as deemed by the building association. Any draiirage improvements
necessitated by the deck enclosure shall be addressed by the app'licant ln the Deslgn
Review Board submitta'l and building permit plans.
Krlstan then revlewed the landscape variance request and exp'lained Lhe reasoning for
the request. She stated the staff recommended approval of the variance, and
reviewed the P'lanning and Envlronmental Commission's vote for approval of 5-2.
Kristan answered questions of Council. Peggy Osterfoss felt these were good ideasfor the area. Tom Steinberg cormented there shou'ld be an agreement with the
applicant that he pay a parking fee, and if Council amends the ordinance and
increases stated fees sometlme during the next year, he would be increased as well.
Peggy Osterfoss made a motion to uphold the PEC's decision to approve an exterior
addition to the Bell Tower Building, finding that the granting of this variance
would not constitute a grant of special privilege, and was substantiated by the Vail
Village Master P'l an which encourages a wide variety of activities, events, and
street life along pedestrian ways and plazas, and lncluding the conditions required
in the staff memorandum dated July 23, 1990. The motion was seconded by tlerv
Lapin. A vote was taken and the motion passed unanimously 7-0. Peggy 0sterfoss
then made a motion to upho'l d the PEC's decision to approve a variance request to
reduce the landscaping to increase the Lancelotrs deck. She stated the granting of
this variance wou'l d not constitute a grant of special privilege, and was in
compllance with the Vail Uillage Masler Plan, and lncluding the conditions that the
landscaping be added between the two buildings, and bench/possib'le boulder/Aspen
tree be added to the Gore Creek Promenade greenspace as mit'igation for the reductlon
of the landscaped area. Tom Steinberg seconded the motion. A vote was taken and
the motion passed unanimously 7-0.

Drive (Lot 4,'block !, Vait'Vtttage llth Fill;g) (owner: eforde'pFCaulklirillJr.)$ Shelly Mello 6ave background lnformatlon regarding the request. Eliot Goss,
an architect represent,ing the Caulkins, presented the Council with drawings of the
building in question. Kristan and Shelly then answered questlons of Counci'| .
lrlerner Kaplan presented to Council for their review photographs of residences ln the
nelghborhood, stating reasons why he was opposed to the building of the new home
next door. Harry Frampton, a neighbor, requested Councll overturn the DRB decision
because he felt the Swiss style chalet ln a contemporary neighborhood was total'ly
out of place, plus the house needed a garage. August Grassls and Byron Rose,
neighbors, supported Mr. Frampton's statements. Pepi Gramshammer felt the house was
fini and inouii be approved, that €veryone should have the right to build his/her
own home. George Cau'l kins read aloud a letter he recelved from Rod Slifer in
support of the chalet style as far as real estate price was concerned. After much
dlscussion by Council, staff, and the publlc, ltlerv Lapin made a motion to uphold the
DRB decision with the condltions the shutters be done in a solid color, a
Iandscaping plan be incorporated on the open area, and a two car garage be put on
the property. Rob LeVine seconded the motlon. Ned Gwathmey stated how the DRB had
come to its decision. A vote was taken and the motion passed 4-3, wlth Mayor Rose,
Tom Steinberg, and Lynn Fritzlen opposed. Mike Cacioppo gave reasons why he was
agalnst the Council's decision.

Kathy Uarren and Diana Donovan opposed both requests because
they did not see sufficient cause to warrant the removal of
the planter area or pavers. They a1 so felt that the
proposal was not in keeping with the Master Plan's intent.
0n July 24, 1990, the Council voted to cal'l up for further
review the PEC approval of the two requests.

Background Rationa'le: The appf icant received fina] approval
from the DRB on July 11, 1990. At that time, the Board put
the following cond'itions on the application: 1) the wood
color of the building be natural red cedar; 2) 'l ighter wash
type colors be used on the window shutters; and 3) the south
facing deck be centered rather than set to the east.
(Enclosed p'l ans do not reflect deck change.) The approval
was appealed by the adjacent property owner Werner and Gilda

Background Rationale: The DRB, at their July 18, 1990,
Fublic hearing unanimously approved the l|ittemyer request.
The vote was 4-0 and there were no conditions of approval .

10. Action on proposed 'l ease between the TOV and the Eagle
County School District for a playground at the Red Sandstone
E'l ementary School site at 551 North Frontage Road
Actjon Requested of Council: Approve,/deny the 'l ease
agreement betwien the Town and the School District.
Eackground Rationale: The School District wou'l d like to
expand the Red Sandstone Elementary SchooI playground onto
Town land. Staff supports the request since it will benefit
the schoo'l utilizing 'land which the Town is not using.
Additjonal information is provided in the enclosed memo from
Community Development staff. Staff recommendation is for
approval of the lease agneement with the condition that the
Town of Vail 'l ease on the Red Sandstone gym be extended.
Staff Recommendation: Approve the lease agreement.
11. Appointment of a Design Review Board Member
Action Requested of Council: Appoint one member to the DRB.
Background Ratjona'l e: Jamie McCluskie has resigned his post
on the ORB aE oT August 1, 1990. Jam'ie is moving out of the
Vail Valley. As of August 1, 1990, we have 2 applicants for
the vacancy: Fitzhugh Scott and Sherry Dorward. The
applicant wjll complete Jamie's term ending February, 1991"

Background Rationale: The applicant's brew pub proposal
cannot currently be'l ocated in the TOV since the code does

approval (7-0) of the code changes, with three amendments to
the staff recorunendation. The PEC increased the brewing

Dear Mr. Burke:
On January 31, L990, Mr. John l{itterneyer appeared before the Town
of Vail Design Review Board and received approval to construct a
second dwelling unit separated frorn the existing dwelling on the
above property. The Design Review Board felt that sufficient site
constraints existed which would nake it difficult to connect a
second dwelling to the first dwelling.
In order to construct a second dwelling, there must be an
application made to the Design Review Board. The Design Review
Board nust approve the proposed dwelling. The next step would be
to obtain a building pernit in order to construct the proposed
dwelling.
A duplex subdivision allows for tvo parcels to be created on one
lot. Once two parcels are created, they may be conveyed
separately. If Mr. Wittemeyer wishes to subdivide the lot, he nay
apply to the Comnunity Developrnent Departnent after the foundation
for the proposed dwelling is in place.
Assuming that all requirements as set forth in the Town of Vail
zoning and subdivision regulations have been net, l.!r. wittemeyerwill receive the approval for the duplex subdivision.

Dear Galen:
I am writing with regard to the changes made to the floor plans of the StolEer Residence and
the resulting GRFA. The totalGRFA allowed on tre site ls 4,782 sq. ft. The existing GRFA of
the secondary unit is 1,911 sq. ft. Therefore, the remaining GBFA for the site which is
available tor the primary unit is 2,871 sq. tt. The primary unit's gross square footage is 4,023
sq. ft., less the credits of 585 sq. ft. for tre garage, 200 sq. ft. for storage, 50 sq. ft. lor
mechanical, 258 sq. ft. lor the stairs, 25 sq. ft. for the airlock, and 34 sq. ft. for ths voids,
bringing the totral GRFA of the primary unit to lhe allowed 2,871 sq. ft.
Please submit two clean copies of the revised lloor plans to the Building Department lor
inclusion into the "Field' and "Office'sets.
As discussed earlier, due to he time involved in re-checking the primary unit's GRFA, we feel
it necessary to assess an additional plan check fee for 2 hours of review time at $30 per hour.
Please submit payment, in the amount of $60, to the Community Development Department
prior to requesting a framing inspection for the property.

Betsy Rosolack made the staff presentation. she explained that
this was a gondola that would serve one residence from the
gtarage near the road up to the residence, a distance of about 80
feet. BiII Pierce, architect on the project, explained more
about the project. BiII said the gondola would have to be
approved and inspected by the State Tramway Board. BilI felt
that gondola was more like a dumbwaiter in mechanism. The
height frorn the ground would be 55 feet. The gondola is
designed so that it could be put into a building at the foot of
the hill and locked up when not in use.
Diana Donovan noved and Pam Hopkins seconded to approve the
request per the staff memo. The vote in favor was 7-0.
A request for a condominiun conversion of the Plaza Lodqeat 2l-L Bridqe street.Applicant: Plaza Lodqe Associates, Ltd.
Rick Pylnan explained the request and Jay Peterson, representing
the applicant, answered questions. Diana ltas concerned about
the parking for the project. She felt that when there are
condos, they are used nore by the ogirners, and therefore, need
nore auto usage than that of a transient. The transient is rnoreapt to leave his car in the TRC. Diana asked that the staff
consider charging an additional fee when apartments that arerentable are condominiunized. Rick agreed, and said that fron apractical standpoint, it was sornething to think about.

construct a personal gondola on Lot l, Block 1, Vail
Village 3rd Filing.Applicant: John Wittenyer
I. DESCRIPTION OF PROPOSED USE
The applicant wishes to construct a personal gondola on the
above property. The gondola would transport people to and
from the prking area at the foot of the lot to the residenceat the top of the property. The gondola would be stored muchof the tine in an enclosure located adjacent to the parking
area.
The application states:
ItThe applicant desires to construct a personal
mechanical conveyance, primarily intended to transport
relatives who are physically incapabLe of ascending to
the residence. The installation will convey people fromthe parking area to the rear (south) deck of the
existing residence (adjacent to the rnain living level),
an ascent of approxinately fifty feet.rl
ski lifts and tows are condltional uses in the Primary/
secondary zone district. Staff feels this proposal issinilar in nature to a ski lift (physically) and have
determined the Conditional Use Permit process to be
appropriate.
II. CRITERIA AND FINDINGS
Upon review of Section 18.50, the Community Development
Department reconmends approval of the conditional use permit
based upon the following factor:

conveyance will not be available to the public and
will be stored in the locked enclosure.rr
The staff feels that the effect of the enclosure andgarage as proposed will be minimal . The structure is
cornpatible with the existing residence and is notlarge (I4' x L4"). The cable should be nearly
invisible, and there will only be a support post at thetop of the cable.
