H. lf this application requires a separate review by any local, State or Federal agency
other than the Town ol Vail, the application fee shall be increased by $200.00.
Examples of such review, may include, but are not limiled to: Colorado Department of
Highway Access Permits, Army Corps of Engineers 404, etc.
The applicant shall be responsible lor paying any publishing fees which are in excess
of 50% of the application fee. lf, at the applicant's request, any matter is postponed for
hearing, causing the matter to be re-published, then the entire fee for such re
-publication shall be paid by the applicant
Applications deemed by the Community Development Department to have significanl
design, land use or other issues which may have a significant impact on the
community may require review by consultanls other than town staff. Should a' determination be made by the town staff that an outside consultant is needed to review
any application, the Community Development Department may hire an outside
consultant, it shall estimate the amount of money necessary to pay him or her and this
amount shall be fonvarded to the Town by the applicant at the time he files his
application with the Community Development Department. Upon completion of the
review of the application by the consultant, any of the funds fonrrarded by the applicant
for payment of the consultant which have not been paid to the consultant shall be
returned to the applicant. Expenses incurred by the Town in excess of the amount
fonuarded by the applicant shall be paid to the Town by the'applicant within 30 days of

Discussion took place as follors:
Lamb - There has been many times to consider altemative plans.
John Becker - Tried to sell Kravis on the idea of working with the fown. ftadi6niShannon
Watson design a revised lighting plan. Altemative plan would have tripled-the cost. The new
plan may not have really solved lhe problem, anyway. Applicant would consider a new plan
to place all lights on the south side of all trees.
Ned - Should the Board table this item for 2 weeks to consider this alternative? Doesn't think
the Ordinance allows for this kind of lighting. Relocating lights on south side of trees would
still not meet the standards of the ordinance. Any change must do more than just putting lhe
lights on the south side of the trunks.
John Becker - Given that position of the Board, his understanding from New York was lo state
that the existing lights 3!q the proposed plan, and are what is submitted for approval.
Ned - The Board understands that is your submittal, and with that in mind, is there any more
discussion from the Board?
George - Motion for denial, given that the plan is not compatible with the neighborhood, and it
should have been designed and located in a manner to'ininimize impact of lighting upon living
areas within the proposed project, as well as upon adjacent structures and properties."
George further stated that his motion for denial was based on Section 18.54.050(CX11) of the
Vail MunicipalCode.
Pat Herrington - seconded the motion.
The vote was 4-0-1, with Chuck Crist, the PEC representative, abstaining.

I am sorry | cannot attend the council meeting, However, I did want to express my thoughts
concerning the landscape illumination work complsted in Vail the week of June 10, 1991.
On the e\rening of June 12, 1991, I met with members of the Design Revievv Board and Planning
Committee at the Henry R. Kavis residence. lt was a pleasure to speak with each represertative
and discuss their ideas regarding outdoor lighting in Vail. I also met wilh Art Abplanalp and Glen
Ellison regarding the beautiful landscape illumination at Mr. Renato lbana's home. At both of these
homes, our firm reduced the brightness by lowering the wattage of the lighting units.
h was my intention this week to work as a team on the proiects in Vail and come to a mutually-
acceptable compromise for both the city of vail and rny clients. I have never had any reasion to
cause friction between our company and the City of Vail. Our firm is the most prestigious
landscape illumination design company in the world and has been in business for over forty years.
All of our designs are created to reflect a soft and subtle outdoor lighting environment and also
incorporate security requirements. We use the 24,000 hour-life mercury vapor gas discharge
lamps for the beautiful lively color.
This color represents the liveliness of the garden areas during all four seasons of the year. Our
company vieurpoint concerning this issue in Vail is as follows.
Whether it is been in the City of Vail or anywhere else in the world, we have always succeeded in
creating a beautiful nighttime ambiance that is greatly appreciated personally by the client but also
by the city in which the client lives.
l'm confident the City of Vail strongly believes in a great sense of security and safety for their
homes. That is why John Watson Landscape lllumination has succeeded in our aesthetic creations.
Whatever lies in the future concerning the actions taken from this meeting, I would like to stress the
willingness ot our company to work together with the City of Vail for a mutual agreement,

I understand you received rny letter of JanuarY 24, 199f in which
I explained that the current exterior lighting on,the above-
refe-renced property is in violation of the Town of vail zoning
code. That code section, once again, states that:
rrExterior tighting shall be designed and located in a manner
to rninirnize inpac! of lighting upon living areas within a
proposed project and upon adjacent structures and
properties.rt Section 18.54.050(C) (L1)
As no submittal has been made in order to :neet the February 25,
1991 deadline, as identified in ny previous letter, the Town may
have to issue a citation because the correct process for
obtianing Design Review Board approval has not been followed. A
"ititiorr-rnay r6guire a court appearance here in the Town of VaiL.
We would rather not resolve this issue in that forumi however, we
must resolve this problen irnnediately. Without prornpt attention
to this matter, the Town will be forced to cite you for the
violation.
The Tortn of Vail is reguiring you to subroit a Design Review Board
application as soon as possible. The application needs to
ai-dress how the lighting will be redesigned and/or removed so
that it meets the Standirds of the zoning code listed above.

r- am writing this letter to confirm our conversation concerningthe Kravis swirnming pool building perrnit drawings. The stepsup to the pool on the west side of the property may not encioachmore then 7.5 feet into the L5 foot setback. In other words,7.5 feet must be naintained between tbe west edge of the stairand the west property line. In addition, I had asked that youprovide the east and west elevations for the pool area thatclearly show that it is an open air structure.
