BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a
review by the Building Depaftment, the estimated time for a total review will take as long
as three (3) weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser
amount of time. However, if residential or smaller projects impact the various above
mentioned departments with regard to necessary review, these projecls may take five
(5) weeks to review and approve.
Every attempt will be made by this department to expedite this permit as soon as
possible.
I, the undersigned, understand the plan check procedure and time frame. I also
understand that if the permit is not picked up by the expiration date, that I must still pay
the plan check fee and that if I fail to do so it may affect future permits that I apply for.

PUBLrc WORKS AND THE PUBLE WAY PERMIT PROCESS

If yes was answered to any of the questions Sren a 'Public Way" permit is required. You
can pick up an application at either Community Development, located at 75 South Fronbge
Road or Public.Works, locaEd at 1309 Elkhorn Drive.
Notjce sign-offs for utility companies. ALL utilities must field verifo (locate) -respective
utilities prior to signing application. Some utility companies require up to 48 hous notice b
schedule a locaE.
A construction trafflc contro/sbging plan must be prepared on a separale sheet of paper'
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and tte work zone, (area of consbuction, staging, etc.). This
plan will expire on November 1st and will need to be resubmitted for consideration for
approval through the winter. Be awarc that your resubmission for winter may be denied
depending on the location of construction.
Skebh of work being performed must be submitEd indicating dimensions (length, width
and deptr of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. If required, locabs will
be scheduled fortre Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up trc 48 hours to perform.
The Public Work's Construction Inspector will review the application and approve or deny
f;e permit. You will be conbcted as to the sbtus and any requiremen$ that may be
needed. Most permib are released witrin 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Departrnent will be notified, allowing the
"Building Permit" to be released, Please do not confuse the'Public Way Permit" with a
"Building Permit".
NOTE: The above process is for ulork in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if r,vlcrk is not complete. Re-application each November 15th does not
mean an aubmatic renewal. I

o You must obtain Design Review Board (DRB) approval if any of the mechanical pork will involve
ANY exterior work. This includes and is not limited to rcmoval ald replqgemeint of driveway snow

o The Town of Vail has adopted the 2OO3 InternaUonal Medranical Code ind the 2003 ihternational
FuelGas Code.
r All new construction within the Town of Vail is considered to be of unusualty tight construction,
thus all combustion air is required to be drawn from outside the structure for mechanical
equipment.
Town of Vail Fireolace Ordinance
In September of 1991, the Vail Town Council adopted an ordinance which resEicts te construction and
use of open hearth fireplaces within municipal boundaries. Since that Ume the ordinance has
undelgone numerous changes and rcvisions, striving for compromise, yet effectiveness in addressing
the air quality issue. Therefore the following criteria has been adopted:
r Construction of open heafth wood burning fireplaces is no longer permitted within Town of Vail
municipal boundaries.
r Dwellino Units - Each new dwelling unit may aontain:
One (1) EPA Phase II certified solid fuel burning device and no more t{ran two (2) gas applhnces
(B vent)
OR
ftio (2) gas log fireplaces and no more than two (2) gas appliance fireplaces (B bent).
r Restricted Dwellino Units - Each new restricted dwelling unit may contain:
One (1) gas log fireplace and not more than one (1) gas appliance fireplace.
r Accommodation Units - Each new accommodaHon unit may contaan:
One (1) gas log fireplace or one (1) gas appliance fireplace.
o If two or more separate dwelling units or accommodation units are combined to form one larger
unit, the combined unit may retain one woodburning fireplace (if one already exists) and no more
than 2 gas appliance fireplaces, or may convert up to two existing fireplaces to gas.
r If during the cource of a remodel an existing woodburning fireplace is altered or moved, the unit
must then comply with all provisions of the ordinance. That is, the fireplace must be converted to
natural gas or replaced by an EPA Phase II certified unit.
