Hello Bill. My name is Greg Vickers. I think we've met or at least chatted on the phone in
the past regarding the redevelopment of the Vickers Residence at375 Forest Rd. Joe Suther
referred me to you as my Planner.
Just to give you a brief history, wo built our house in 1968 w/ the traditional Vail Tyrolean
Chalet design with Fitz-Hughes. My mother and her seven kids have enjoyedthe house
thoroughly over the years, however, given the change in times and need to refurbish
the house, I began studying our options in the late 90's. Having said that, due to the fact that
we put the house into a Family Partnership and there is so many adult kids, agendas, wants
and needs, etc., the redevelopment has changed scope several times.
If you look in our file in the Community Development office, you will notice that we
submitted an application to DRB in February, 2003, with Architect, Ned Gwathmey.
Originally, ouiptan was to remodel the existing house and add a Secondary unit, but I ended
up withdrawingthat application, as our family could not get on the same page and get
comfortable with the various studies, and the proposed Primary-Secondary designs.
Furthermore, that was also when the TOV was rewriting the GRFA Ordinance. We were
advised by our architects atthattime to wait, as the newly contemplated language could
increase the amount of buildable Sq ft. As it turns out, nearly 2 yens later when
they completed the new rules, it didbehoove us to wait. With the new measurements, which
weie completed by Architect, Dave Peel, with new surveys and topo done by Intermountain
Engineering in January, we increased our total allowable GRFA'
From a Site Plan point of view, the significance of the original studies, was that
we requested a separation request for a garage to build it in the front setback in order to
attempt to save a couple of very mature trees on our Lot. As you will see from our
correqpondence with Allison Ochs, we looked at a couple of different options W the DRB
and Pianning Dept and Public Works to either separate the garage and build it in front
setback or push it back within the setbacks. And ftankly, we all went back and forth on this
issue. We even had an arborist come out and give us the opinion that we could probably
work around a sixty-foot Pine and save it, given our proposed placement of the
driveway/garage & house addition, with sensitivity given to to drip-line, and roots.

At any rate, fast forwarding to the new conceptuals I've submitted - the scope of the project
has taken another turn. At this time, the plan is to redevelop the pfoperfy with new
construction of a Single Family Residence. This is due in large part to the unknowns of
renovating the existing 40-yr old house! I think the TOV will be pleased however, that our
proposed designs are to keep with the same traditional Swiss Chalet look and feel as Vail
was originally trying to achieve. As a matter of fact, we are going to mimic much of the
existing house * expand it from its current 4,494 Sqft to our total allowable GRFA of 7,302
sq ft.
As you will also notice from the conceptuals that I submitted, that I pushed the garage back
to the north on Lot to be able to abide within the proper building setbacks. However, I would
very much like to discuss this with you as I feel it could compromise design and require
additional trees to be removed.
Furthermore, as we continue to study the best design possible given the Rules and
everybody's best interest in mind, my architects are advising me that I should consider a
couple of tweaks to the plans you are reviewing, i.e. :
. Move the structure approximately 30' to 40'to the north in order to take advantage of
the best building envelope available within the trees. In addition, this will allow for
more room to facilitate the proper width, approach for the new driveway, tum-a-
rounds and proper building setbacks.
. Also, as we move the structure back on the LOT, we'd like to rotate the entire structure
approx. 30 degrees clockwise towards the SW to better orientate the house to optimum
sunlight, views, and orientation to Forest Rd.
. We would also like to put approx.25%o of the structure below grade (unexposed),
in front (south) and sides (east & west). to receive credit for unexposed building and
maximize "usable" Sq ft. In other words, we'd drop the front door to grade. Note,
we'd make certain we are within the 33' height restriction in the process.
. And once again, I'd like to at least discuss the optimum placement for the garage & a
possible EHU.
I hope to present these modifications to you at the time of our review on May 2nd, subject to
the architects availability. If not, we can discuss these options and I will incorporate when a
submit for final approval (ASAP). I also look forward to the site review so that we can get

Effective September 1, Dn , CRS 30-10406 requires that all do€r'ments received for recording or filing in the
clerk and recorder's office shall contain a top margin ofat least one inch ald a left, right and bottom margin of
at lease one half of an inch. The clerk and recorder may refuse to record or file any document that does not
confomr, except that, the requirement for the top margin shall not apply to documents using forms on which
space is provided for recording or filing information at the top margin of the document.
Note: Colorado Division of Insuance Regulations 3-5-1, Paragraph C of Anicle VII requires that 'Every
title entity shall be responsible for all matters which appear of record prior to the time of recording
whenever the ritle entity conducts the closing and is responsible for recording or filing of legal
documents resulting from the transaction which was closed". Provided that Land Title Guarantee
Company conducts the closing of the insured transaction and is responsible for recording the

Dear Greg,
The Department of Community Development has received your application for an
addition to the Vickers Residence, located at 375 Forest Rd. / Lot 3, Block 2, Vail Village
3' Filing. While the review you have requested is a conceptual review and a separation
request, there is some additional information required prior to an adequate review. The
following items must be submitted prior to review by the Design Review Board:
1. Please provide a stamped topographic survey, in accordance with the application
submittal requirements as outlined on the Design Review Board application.
2. Please provide a site plan, in accordance with the application submittal
requirements as outlined on the Design Review Board application. At this time,
staff is unable to make a determination as to whether or not the garage is
allowed to be located in the front setback without a variance. However, based on
a preliminary review of the information provided, the slopes are not in excess of
30olo. Therefore, the garage would not be allowed in the front setback without a
variance.
3. I am assuming that the separation request is based on the large spruce tree
between the proposed addition and the garage. Because the proposed addition,
garage, and associated improvements will cut off the root system of this tree on
three sides, staff does not believe that this tree will survive for the long-term.
However, if an arborist can provide direction as to how to save the tree, staff will
reconsider the tree's survival chances. Should you choose to pursue a
separation request, an arborist report will be required. Otherwise, I would
recommend that you review the Town regulations regarding the requirements for
a GRFA connection of structures and revise the plans accordingly. The Vickers
residence was previously reviewed by the Design Review Board for a conceptual
review and separation request. The Design Review Board did not look favorably
upon the separation request. However, no formal action was taken and the
application was subsequently withdrawn.

4. In addition to indicating the caliper of the existing spruce trees, please indicate
the height of all spruce trees on the site.
5. The Town of Vail regulations do not allow parking in the right-of-way. The
existing parking is considered non-conforming. Any addition of GRFA requires
that the parking in the right-of-way be removed.
6. The Department of Community Development offers pre-application meetings on
Thursday afternoons. This gives applicants an opportunity to sit down with a
planner and an engineer to go over preliminary issues, such as those identified in
this letter. I would highly recommend that you schedule a pre-application
meeting with us. Public Works has completed a preliminary review of the site
plan, and due to the lack of information on the site plan, they are unable to
complete a review of any substance.
The Vickers Residence is currently scheduled for review by the Design Review Board on
March 5, 2003. However, due to the above requirements, I am tabling the item until
March 19, 2003. All of the above items must be submitted to be no later than noon on

Dear Allison:
Pursuant to our last DRB hearing, please find the enclosed plan which maintains the large evergreen
adjacent to the house and requires the removal of only two trees. We understand that the
implementation of this plan requires the following:
1. DRB ruling on the separation of units due to the need to maintain the existing tree.
2. DRB approval.3. Variance for garages to be in the front setback; the hardship is created by the owners'
absence of spacabased upon the DRB ruling that the trees could not be removed.
4. EHU approval.5. 250 approval6. Variance for some parking to be in right of way
This plan is acceptable to the owners who are anxious to get feedback fiom the DRB.

to the 80-foot tall evergreen, which would otherwise have to be removed. We propose to placi the
addition in the open area between trees and minimize site grading so as not to disturb the root
systems.
We plan to have the proposed addition straked out in time for the May 3d, 2000 Meeting for DRB
consideration.

Dear Ned and Brian,
The Design Review Board conceptually reviewed the secondary unit addition and remodel to
the Vickers Residence, localed at 375 Forest Rd. The following were their commenls and
concerns:
1. The Board felt that the original concept was more architecturally sound than the proposal for
the separation request.
2. The Board, while disappointed, is now supportive of removing the 80 ft. tree adiacent to the
house, but added that as many lrees as possible should be saved with this proposal. Any
trees removed must be replaced foot for fool.
3. A lree preservation plan must be submitled for final approval. This preservation plan must
include tree prolection during construction and will be included as requirements of the
building permit.
Please submil lhree sets of plans, including a site plan, landscape plan, floor plans, and building
elevalions. I will schedule the Vickers Residence for linal Design Review Board approval once
lhese have been received and reviewed by staff. Currently, your Planning and Environmenlal
Commission application for the Conditional Use Permit for the EHU has been withdrawn until
you let me know if you are still proposing it. Should you have any queslions, please do nol
