PUBLIC WORKS PERMIT PROCESS
How it relates to Building permits:
1) Fill out our check list provided with a buildino oermit application.lf yes was answered to any of the aoove questions tnen a "public way,' isrequired. You can pick up an application at either community Developmeni
located at 75 S. Frontage Road or Public Works, located at 13d9 Vait Valley Diive.
2) Notice sign offs for utility companies. All utilities must field verify (locate)
respective utilities prior to signing application. Some utility companies iequire up
to a 48 hour notice to schedule a locate.
3) A construction traffic control/staging plan must be prepared on a separate sheet
of paper'An approved site plan may also be used. This plan will show locationsof all traffic control devices(signs, cones, etc..) and the work zone, (area ofconstruction, staging, etc..). This plan will expire on oct. 1Sth. and will need tobe resubmitted for approval through the winter.
4') Sketch of work being performed must be submitted indicating dimensions (length,
width & depth of work). This may be drawn on the traffic controt ptan or a iiteplan for the job.
5) Submit completed application to the Public Works's office for review. tf required,
locates will be scheduled for the Town of VailElectricians and lrrigation crew. The
locates take place in the morning but, may require up to 4g houls to perform.
6) The Public Work's Construction Inspector will review the application and approve
or disapprove the permit. You will be contacted as to the status and any thai mayneeded' Most permits are released within 48 hours of being received, but ptease
allow up to one week to process.
7) As soon as the permit is processed, a copy will be faxed to community
Development allowing the "Building Permif'to be released. Please do not confuse
the "Public Way Permit" with a "Building Permit" to do work on a project itself.
NOTE:
I Jh9 above process is lor work in a pubilc way onty.* Pubtic Way permits are valid onty uhtit November isth.* A new Public way permit is required each year if work is not complete.

4.5 Exclusive Possessi-on and Use Restrictions. Each 0wner shal1 be entit-
led to exclusive ownershi-p and possession of each Ownerts Apartrnent Unit. Each
Owner may use the Connon Elenents in accordance with the purposes for which they
are intended without hinderi-ng or encroaching upon the 1awfu1 rights of the other0wner. Each Apartrnent Unit shal1 be used and occupied solely for the purpose of
lodging or as a dwelling by the 0wner or by the 0wnerrs farnily, guests, agents,
enployees, invitees and tenants,
4.6 Rj-ght of Access and Ernergency Repairs. The Association sha1l have
the right of access to each Apartnent Unit frorn tine to tine during reasonable
hours as nay be necessary for the maintenance, repair or replacenent of Conmon
Elenents rvhich may be located in the Apartnent Unit, or at a\y tine deened
necessary for the making of energency repairs to prevent damage to the Cornmon
Elements or to the other Apartnent Unit.
4.7 No Partition. No 0wner shall bring an action for partition of his

unincorpotated association composed of the 0wners of the Condoninium. An Owner

and shall renain a member for the period of ownership,
5.2 Association l.lanagenent. The Association shall conduct the general
management@anceoftheCondoninium,theCondoniniumUnits
and the Apartment Units, and the enforcement of the provisions of this Declara-
tion and the Articles of Association of The Newcomb-Eddy Condominiun Association
and the rules and regulations adopted by it.
ARTICLE VI
Corunon Expenses
6.1 Common Expenses. The costs and expenses (Conmon E:rpenses) of mana-
ging, operating and naintaining the Condominium and the Condoninj.um Units by
the Association shall be borne by the Owners. Connon Expenses include the
overhead expenses of the Association, costs of naintenance, repair and opera-tion of the Connon Elenents, taxes and special assessments, unless separately
assessed to Owners, insurance premiums for insurance coverage as deemed desir-
able and necessary by the Association, utili-ty charges, i-f any, which are notbilled directly to individual Owners and which nay include trash and garbage
collection, landscape rnaintenance and snow removal , lega1 and accolnting fees,
n€rnagenent fees and the creati.on of a reasonable contingency or other reserve.
6.2 Assessment.. Initially, Comrnon Expenses shall be estimated by the
Association-T6FEe period fron the date the Condominiun is created and each
Owner shall be assessed his pro rata share thereof at such date. Thereafter,
Conunon Expenses shall be estimated by the Association annually for the ensuing
calendar year and each Owner shall be assessed for his pro rata share thereofin advance according to each Orvnerrs percentage of interest. The Association
nay establish any reasonable system for periodic collection of assessments in
advance or arrears as deened desirable. At the end of each calendar year, the
Association sha11 deternine actual expenses and either assess each Or,rner orcredit him against the next ensuing calendar year, as the case may be. Thefailure of the Association to fix the assessment for Erny assessnent period
sha1l not be deerned a waivet, modification or a release of Owne rs frorn their
obligation to pay Cornmon Expenses,
6.3 Non-Payment of Assessments and Liens. A11 firnds assessed but unpaidfor Corunon ll constitute a lien on such
Ownerrs Condoninium Unit superior to all other liens and encumbrances exceptfor: (i) tax and special assessment liens on the Condominiurn Unit in favor of
any taxing authority; and (ii) the lien of a first mortgage. The Association
nay inpose penalties for delinquent payments of assessments in an amount notto exceed two percent of the del inquency per nonth.
6.4 Statenent of Assessnents. In connection wi.th any sale ox othertransfero@Association,uponthewrittenrequestof
any 0^tner, or prospective transferee oa mortgagee, shall issue a written state-
nent with respect to the subject Condorninium tlnit setting forth the amount of
any mpaid assessments, the anount of the current periodi-c assessnent, the
date that such assessnent becomes due, any penaliies due, and credit for
advance payrnents or for prepaid items, which statenent sha1l be conclusive
upon the Association in favor of all persons who rely thereon in good faith,
ARTICLE VII
Maintenance and Alterations
7.L lvlaintenance. The responsibility for the maintenance of the Condo-niniun and-lE3iffitE-ns upon thl alteration thereof shall be as folrows:
a. By the Owner, The Owner shall naintain and keep in
good condition (ordinary weax and tear excepted) the Apartment

be responsible for repairs occasioned by darnage as defined in
Article IX hereinafter rmles s such darnage is due to the act or
negligence of the Owner, his guests, invitees or tenant.

7.2 Alterations. No Owner shall rernove or destroy his Aparturent lhit or

out the consent of the Association or of the other O,rner, provided that no suchalteration or rnodification sha11 affect the structural appearance or integrityof the conmon wal1 of the Apartnent Units or of the Building. Prior to corunence-
nent of any such alteration or rnodification, an 0wner shall subnit to the Asso-ciation copies of all plans and specifications therefor which shal1 indicatein reasonable detail the work to be performed, the estimated time of conpletion
and an estimate of the cost i.nvolved. No work sha11 be performed without the
approval of any governnental authority having jurisdiction thereof, and allwork shall be perforned in a good and worknanlike manner. No owner shall per-
rnit a lien to be filed with respect to any alteration or rnodification, and anylien rernaining so unpai.d and not discharged may be paid by the Association orthe othet Owner, who shall have a lien upon the affected Apartrnent Unit to theextent of the amount so paid.
ARTICLE VIII
Insurance
8.1 fnSurance Coverage, The Association shal1 obtain and pay, as aConmonrxp@rcasua1tyinsuranceontheBui1dingandre1ated
improvements in an anomt equal to the maximrm insurable repracement valuethereof, affording protection against loss or damage by fire or other hazards
covered by standard extended coverage endorsement, and such other risks as may
from time to tine be customarily insured against with respect to buildings,sirnilar in construction, location and use as the Building, including by way of
example, vandalisrn and nalicious mischief. The Association shal1 deterrnine atleast bi-annually the replacement value of the Building, and in so doing nay
enploy such experts as it may deern necessary. The Association shall also
obtain and pay, as a Conrnon Expense, the premi"uns for public liability andproperty damage insurance against claiurs for bodily injury or death or pro-perty darnage occurring upon or with respect to the Coinnon Elernents, in limitsinitially of not less than $300,000 in respect of bodily injury or death to
any petison, and not less than $500,000 for bodily injury or death to any
nurnber of persons. arising out of one accident or disaster, and in rimits ofnot less than $10,000 for darnage to property, and if higher limits shall at
any tine be customary to protect against possible liability, such higherlimits shal1 be carried. rnsurance required to be carried pursuant to this
secti.on 8.1 shall be in favor of the Association, the 0wners and all first
mortgagees, as their respective interests nay appear. Each policy of insur-
ance shal1 contain a standard mortgagee clause in favor of each first nortgageeof a condoninium unit, which shall provide that the loss, if any, theretndershall be payable to such first mortgagee, as its interest nay appear; subject,
however, to the loss-paynent provisions in favor of the Association herein setforth. A1l policies of insurance against damage to the Building and fixturesshall provide that lossess shall be payabLe to and adjusted with the Associa-tion as attorney-in-fact for the owners. The Association shal1 hold and applythe proceeds of such insurance as set forth in this Declaration. Each insur-
ance policy shall provide that no cancellation thereof nay be nade by theinsurance carrier without having given at least ten days' prior written notice

insurance policy shall also provide that in case of violation of any provision
thereof by one of the Owners, the coverage of such policy shall be suspended
or invalidated only as to the interest of the 0wner corunitting the violati-on
and not as to the interest of the other Owner. Al1 policies of physical
damage insurance sha1l contain waivers of subrogation and any defense based on
co-insurance. Each Owner may obtain and pay the premiurn for insurance coverage
of such 0merrs Apartment Unit and the contents thereof and public liability
and property damage on such Apartrnent Unit in his discretion.

Damage and Reconstructi-on

the cost of reconstruction or repair exceeds the insurance proceeds, the
necessary balance shall be obtained by the Association by assessment againstall Owners as a Comnon Expense, If the insurance proceeds exceed the cost of
reconstruction or repair, the Associ.ation shall distribute such excess to all
Owners subject to the rights of first nortgagees, in accordance hrith the
Ownerrs interest in the Conmon Elenents.
9.2 Reconstruction or Repair Aft"t Danage - By One O*aer. If the Build-ing or any and one ow.ner
wishes to reconstruct or repair and the other does not, the Ovmer not deslringto reconstruct or repair (the "selling 0wnerr') shall be deemed to have offeredhis condominiun unit for sale to the other Owner (the t'Purchasing 0wner"), andthe Purchasing Owner shall have the right and option to purchase the iJni-t upondeternination of the purchase price.

acquires its title as a result of foreclosure proceedings or
conveyance in lieu thereof; any transfer, sale or lease by
any such nortgagee after acquisition of the Condominiurn Llnit.
b. A transfer, conveyance or lease between or anong the
persons or entities who together own the sarne Condorniniurn lJnit.
c, A transfer, conveyance by gift, devise or inheritance
or by operation of law.
d. A transfer or conveyance, whether or not for considera-tion, by an Owner to any one or rnore of such Owners t followingrelatives: spouse, parent or parents, son, daughter, son-in-law. or daught er- in- laiv.
ARTICLE XI
Condernnation
If all of the Land and Building of the Condominiun sha1l be taken for anypublic or quasi-public use, under any statute, by right of eninent d.ornain, orby purchase in lieu thereof, the Declaration shall terninate on the date of
such taking anC the award or awards granted for such taking shall be received
by the Association as attorney-in- fact for the Ovmers and first mortgagees ofthe Condornini.un Llnits. The part of such award or awards collected by the Asso-ciation shall be divided into.separate accounts for each Ouner in accordancewith each ownerts ownership interest. From each such separate account the
Association shal1 forthwith di.sburse the total anount of such account, wj.thoutcontribution from one accor.mt to another, toward the partial or full paymentof the lien of any fi.rst mortgage of record against the Condomi.niun Unit repre-
sented by such separate account. The balance of each account, if any, shall
then be paid to the Owner.
ARTICLE XII
Miscel laneous Provisions
L2.l Sepdrrate Tax Assessrnent. Declarants shal1 advise the Assessor of
Eagle County, Colorado of the creation of the Condorniniurn ownership of the
Condorniniurn so that each Condorniniun llnit shall be deened a separate parcelof real property and subject to separate assessnent and taxation.

the provisions of this DeElaratioil the Articles of Incorporation, By-Laws,

L2.5 Disputes Between Owners. Should any dispute arise between the Owners
with respect to the interpretati.on of or conpliance with this Declaration, theArticles of Incorporation, By-Laws, rules, regulations and resolutions of the

be resolved by arbitration; first, by the Owners attempting to agree upon a
single disinterested third party to hear and resolve said dispute; but failingto agree upon such a person, then by submission of the dispute for arbitration

12.6 Provision Regarding Changes in Percentage Ownership of the Cornrnon
Elements. Notwithstanding the deternination herein of each Ovrnerts percentage
Interest in the Corunon Elements at fifty percent, nothing in this Declarationshall prevent the owners fron agreeing fron tine to tine to allocate a diffe-
rent percentage interest in the Comrnon Elernents attributable to each of themfor purposes of assessments of the Comrnon Expenses, for purposes of the allo-
cation of insurance proceeds and the duty to pay insurance premiuns, and for
purposes of allocati.ng any award in condennation, all of which changes may be
based upon the difference in the size of the Cornmon Elements used by or attri-
butable to the Owner of a Condorninium Unit. Any such change in percentage
interest in the Conrnon Elements shall not, however, be interpreted to change
