PURPOSE AND NEED AND PROJECT DESCRIPTION The Applicant hired a landscape contractor to daylight a stormwater culvert thar ran along the east boundary of 232 \Uest Meadow Drive. He wanted the exposed water routed into a water feature lined with an impermeable layer and river rock. The lower section of the warer feature is withinjurisdictional wetlands and includes a small aesthetic pool. Approximately Z cubic lards of medium sized (6'12-inch) river rock was used (see PHOTOGRAPHS I &2 of wetland delineationreport)' The contractor removed wetland vegetation fiom approximately 1,459 square feet(calculation does not include removed upland vegetation) and instalred zz4 squarc feet of water feature within the cleared wetland area. The water feature is intended for acsthetic purposes only. The Applicant wanted to udlize the stormwater runoff contained in the buried culvert as an ameniry to his landscape design. hl APPLICANT:Mr. Merv Lapin PROPERTYOWNERS:Mr. Merv Lapin and Town of Vail APPLICANT ADDRESS 23TWestMeadow Dr. Vail, Colorado 81657 75 South Frontage Rd. DESCRIPTIONOFWETIANDSDISTURBED A delineation of wetlands was conducted by Montane on October 7, ZOOZ using the 1982 Corps Manual for \(/etland Delineation. Methods for "Atypical Situations" were uscd due to the recent clearing of vegetation and lack of historic photographs. The full delineation report is attached to this notification. There is one wetland area identified on the property, but again its boundary was approximaced due to the after-the'fact nature of the delineation. It may be classified as slope and low.order riverine wetland, associated with the alluvial aquifer of Gore Creek and groundwater daylighting on the banks of Gore Creek. Wetlands removed, based on what is seen in those remaining, were likely willow dominated shrub wetlands alongside Gore Creek. Past disturbance is evident from the proliferation of weedy, invasive planm strch as Canadian thistle, Native species within the wetlands include Salix rnonticola, S. pktnifolia, S. drummondiana, Distigea inuolucrata, and Agrostis stolonifera. III. DESCRIPTION OF DSruRBANCE The contractor removed wetland and upland vegetation during development of the water feature. The area of removed wetland vegetation is 1,459 square feet. The soil has also been compacted due to heavy equipment and rampling by workers (see PHOTOGRAPHS in wetland delineation report). It appears that only vegetation clearing has occurred with the ordinary high water (OHy4 level. The water feature is located outside of the 100-year floodplain and is therefore also likcly outside of the OH\U plane as well. The water featute permanently af{ects 2?4 square feet of jurisdictional wetland and (FIGURE 2).It is likely the impermeable fabric in the drainage will prohibit any groundwater recharge to adjacent wetlands however the wetlands on the property persisted when the warer was containetl in a culvert, Therefore it is not likely any indirect impacts will occur by its permanencc, \7ater re-directed from the culvert will enter the water feature and discharge into Gore Creek. The location of the discharge will remain the same, in addition, quanrity of discharge into Gore Creek will remain nearly the same wirh minimal evaporare loss, as shown in the table below. COLORADO cRoss-sEcTIoN I I WETLAND DELINEATION REPORI LAPIN RESIDENCE I T I I INTRODUCNON Montane Environmental Solutions, Ltd' (Montane) was retained by Mr. Merv Lapin (Client) to identifu jurisdictional wetlands that occur on his property located at 232 \7est Meadow Drive in Vail, Colorado, Eagle County. lt is also known as a Part of l-at 7, Vail Village Filing No. 2, Iocated at approximatcly 39' 38' 34" North, 106 22' 51" West and the NE t/+ NE V4NE V4 of Section 7, Township 5 South, Range 80 \Yest (FICURE 1). It is accessed from Interstate 70 to Exit 176 (Main Vail) south under l-70 to Vail Road; from Vail Road, west onto West Meadow Drive. The property is immediately across from the Vail Valley Medical Center on the south side of 'lJfest Meadow Drive, house number 732. The delineation was conducted on October 7,7002 and is part of an aftetthe-fact permit application for a Nationwide Permit Number 18 - Minor Discharses. The wetland delineation is an approximation of the former jurisdictional boundary prior to residential hardscaping where water that was once enclosed in an underground culvert has been opened up into a water feature through the property. Part of the water feature, which is lined with PVC liner and river cobble ("5.12 inch diameter cobble), is located within jurisdictional wetlands (PHOTOGRAPH l). ln addition, during construction, vegetation was removed entirely for consrruction access and installation (PHOTOGRAPH 2). According to the Client, no historic photographs are available, however the jurisdictional wetland boundary was approximated based upon remnant native vegetation, adjacent vegetation, remnant and native soil horizons, and indicators of ordinarv hich water of Gore Creek. MCINITY AND CENERAL SITE DESCRIPTION The properry is located in Vail Village at approximately 8,120-foot elevation within the Gore Creek valley, which is also occupied by lnterstate 70. lt is situated in a residential neighborhood and commercial area where significant development has occurred and little remains in native condition. The natural ecosystem of the valley slopes at this elevation is lodgepole, spruce.fir, and aspen forests. \ilest Meadow Drive is on the south side of Interstate 70 and runs east/west paralleling Gore Creek, sepatated by approxima tely Vz rcre single-family residences. Spruce trees dominate the riparian canopy of Gore Creek in this reach, and willows with twinberry, and occasional bog birch dominate the shrub layer. The properry is a sloping parcel, which is part of the former active floodplain of Gorc Creek. The slope is approximately l7 "/o from the main house to the active channel. It is upon this slope where part of the water feature has been located and vegetation has been removed (PHOTOGRAPH 3). The upland areas have been landscaped however a few large native spruce trees remain aror"rnd the I I I t I I t I I t I I I 232 WEST MEADOW DRIVL VAIL COLORADO Vlethnd Deliteation 232 ln/,lt Mealow Dite, VaiI Cnlorado I I I t I I I I I I I I I I I I I I I house. ilI. WETLAND DFSCRIPTION The wetlands that occur on the property are located on the banks of Gore Creek. They are associated with the alluvial aquifer of Gore Creek and groundwater that appears to daylight on the lower elevations of the properry- near the creek. They may be classified as slope and loworder riverine wetlands. The remnant wetland areas that occur on the property are low quality in that they have been significantly invaded by thistle Cirsiurn a-ense (PHOTOCRAPH 4). The Town of Vaii had a culvert along the east property line that conveyed stormwater and surface water from upgradient drainages to Gore Creek. The Client wanted to daylight the water and create a water feature on his property. During construction, the contractor removed all necessary vegetation to accomplish thc project, including some jurisdictional wetland vegetation. The cleared area likely resembled that of the remnant wetlands located east and west of the property. As stated previously, therc are no historic photographs available, according to the Ctient. The dominant wetland vegetation is mountain willow (Salix monticoki with occasional twinberry honelsuckle (Distigea inuoluuata). The understory is primarily C. awense. A HYDROLOCY Both groundwater daylighting on the Gore Creek slopes and the alluvial aquifer support the wetlands located on the property. At the time of the survey which was late in the year and during a drought year, the soil was not sanlrated, but moist. B.SOLS There is no soil survey coverage for the Vail Village area by the Natural Resources Conservation Service (NRCS). However it is possible that the soil identified is the Forsey cobbly loam 3 to I2 percent slope because that is the soil series that is shown immediately downstream in the NRCS soil survey. The Forsey series is a loamy-skeletal, Argic Cryoboroll, this is a like a typic Cryoboroll (a Mollisol) with an argillic horizon. The soil identified on the site appeared to me a mixture of native soil (Sample Point 2) and imported topsoil (Sample Point 1). At Sample Point 1 the horizons appeared to be combined due to the recent disturbance and no moftles were present (PHOTOCRAPH 5). However in Sample Point 2, which was located near thc protection of a spruce tree, the horizons remained intact with the B and C horizons exhibiting moftling PHOTOCRAPH 6), C.VECFTATION The remnant wetlands adjacent to Gore Creek are mesic riverine wetlands dominated by \Yetla . The riverine wetlands were probably much wetter historically, however development along the creek has interrupted any groundwater supplementation. The data for the sampling points included vegeration and hydrology indicators. Soil pits were dug to a depth of 16-inches and were used to identifu the presence ofreduced soil conditions; depth to saturated soil, and depth to free water. V/here indicators had been altered, interviews with contractors, and the landowner were conducted. In addition, inferences were made from adjacent native vegetation, soils, and hydrology. 'Wetland boundaries were determined by the percentage cover of hydrophytic plant species (obligate, facultative wet, and facultative), indicators of wetland hydrology, the presence of hydric soils, and topography. t T I I I I I I Wetland Delineation 232 ]Vut Mealow Dnce, VaiL Colnrado l, ;' I V. Town of Vail Mechanical Codes and Desiqn Criteria You must obtain Design Review Board (DRB) approval if any of the mechanical work will involve ANY exterior work. This includes and is not limited to removal and replacenrent of driveway snowmelt systems. Please contact a planner at 479-2L28 before submitting your mechanical permit application. The Town of Vail has adopted the lggs International Mechanical Code (IMC) with the 1997 Uniform Mechanical Code (UMC) as an acceptable alternative. All new construction within the Town of Vail is considered to be of unusually tight construction, thus all combustion air is required to be drawn from outside the structure for mechanical equipment. Reference the 1997 UMC Sec. 7Ot.Z. Town of Vail Fireplace Ordinance In September of 1991, the Vail Town Council adopted an ordinance which restricts te construction and use of open hearth fireplaces within municipal boundaries. Since that time the ordinance has undergone numerous changes and revisions, striving for compromise, yet effectiveness in addressing the air quality issue. Therefore the following criteria has been adopted: . Construction of open hearth wood burning fireplaces is no longer permitted within Town of Vail municipal boundaries. . Dwellino Units - Each new dwelling unit may contain: One (f) EPA Phase II certified solid fuel burning device and no more than ilro (2) gas appliances (B vent) OR Two (2) gas log fireplaces and no more than two (2) gas appliance fireplaces (B bent). . Restricted Dwellino units - Each new restricted dwelling unit may contain; One (1) gas log fireplace and not more than one (1) gas appliance fireplace. o Accommodation Units - Each new accommodation unit may contain: One (1) gas Iog fireplace or one (1) gas appliance fireplace. o If two or mone separate dwelling units or accommodation units are combined to form one larger unit the combined unit may retain one woodburning fireplace (if one already exists) and no more than 2 gas appliance fireplaces, or may convert up to two existing fireplaces to gas. . If during the course of a remodel an existing woodburning fireplace is altered or moved, the unit must then comply with all provisions of the ordinance. That is, the fireplace must be converted to natural gas or replaced by an EPA Phase fI certified unit. F: / everyone/forms,/ mechperm o Kt'in-As/,Js-'.1. / MWOTVAILIY HOW DID WE RATE WTH YOU? PRINTING & GRAPIIICS Aprll 7, 1977 TO: Design Review Board Lou Parker, member SUBJECT: Applicatlon for proposed residence bv Merv Lapin I am sorry that I am unable to attend a three-day printlng and typography conslder the following thoughts and today's meeting, but I have to be in Denver for semlnar. However, I would ask that the Board oplnlons of mlne concerning this applicatlon. Last Friday I and BilI Bishop along with Bill Pierce , Merv Lapin and his architects, Ron Todd and Iim Morter. viewed the site forMerv's proposed residence whlch is dlrectly to the south and slightly west of the Vail Valley Medlcal Center. After vlewing the site, the model and the plans of the proposed structure I have several objections to state as follows: 1. I am opposed to the predominantly flat roof design tn this location for a number of reasons: a. There are no other structures (resldentiat or commercial) in the lmmediate vi- clnlty which have a predominantty flat roof. There is one resldence two lots to the east whlch has two flat roof portions, but the predomlnant shape of the roof is sloped. The only other bullding in the immedtate viclnity with a flat roof portion is the Cllnic, but again the predominant form of that roof is also sloped. There is one other building which is visible from the site tlat has a flat roof--the newVail Professional Buildtng. I have received more negative comment about that project (which the Board approved) than any other whlle I have been a member of the Deslgn Review Board, with the possi- ble exception of the Hyder houses. The objectlon is not to the building itself, but to the building in that location as it does not relate to lts surroundlngs or to the Village. b. The road from which the publlc will view the proposed house (West Meadow Drive) ls at least three to four feet higher than the grade of the proposed structure whlch means that the publlc will very likely see part of the flat bullt-up roof ltself. c. In my opinion, the archltects' attempt to mitigate the flat roof design by the additlon of sloped elements does not achleve the deslred result because there is only one rather narrow sloped element which will actually be visibte to the public from the road. The other sloped elements are on the other sides of the house and will not be seen by the general public. Ron Todd stated that the major reason forthe flat roof design was that it was necessary to angle the house in order to save as many trees as possible. I understand thls point, however, that in itselfdoes notdictate a flat POST OFFICE BOX zao r VAIL. COLORADO a1657 r TELEPHONE 3()3/476'2248 April 7, 1977 Design Revlew Board Applicatlon for proposed residence by Merv Lapin Page 2 roof as evldenced by two of the Vall Associates' Northwoods buildlngs which have a slmilar angle and a pltched roof deslgn which I feel is quite attractive. There is no reason that I can see why that concept could not be used on a smaller scale for thls residence. 2. I am opposed to the materials and color proposed for the structure--all redwood horizontal lap slding. One of the domlnant characteristics of this neighborhood is a mix of materials and,/or colors and I see no reason why the proposed resldence should devlate from that characteristic. 3. The proposed structure not only does not fit into the nelghborhood scheme, it also contrasts much too sharply with the building whlch is to be left standing on the same site. That existlng structure has a very pttched roof and a verydefinlte vertical shape white the proposed structure is very modern in tone, has a flat roof and a horl- zontal shape. In my opinion, the small bulldlng which Merv lntends to leave standing should also be replaced along with the three smaller buildlngs. The Council and PIan- ning Commission did not approve the variance for separate residences based upon any design--in fact, they were shown no designs other than a veIY basic site plan. If all bulldings were removed, the appllcant could then build truo new slngle-family residences which are compatlbie with each otheras well as the nelghborhood. 4. Ttre Design Revlew Board, at the directlon of the Town Councll , is in the process of trytng to estabttsh neighborhood characteristlcs and to see to it that any new con- struction conforms to or blends wlth those characteristics. The proposed structure confllcts with the characterlstics whlch I find to be predominant in its neighborhood becauseof itsroof design, singularityof materlals, andverycontemporarytheme. In my opinlon, thls is just another example of the gradual deterloratlon of the Alpine characteristic of Vail Village, and I firmly believe this characteristlc is one of the most important assets of VaiI and must be preserved and followed, particularly in the Village area of the valley. Our failure to insist on this in the past has led to much of the crlticism we are now receiving. For the reasons stated above I would vote agalnst approval of thls applicatlon and e other Board Members to do likewise. MEMORANDUM TO: Planning Commission FROM: Department of Community Development DATE: March 10, 1977 RE3 Merv Lapin, Variance from Section 3.505 ofthe Zoning Ordinance for Lot 7, Vail Village Second Filing The applicant, Merv Lapin.., i.s requesting a vari-ance from Section 3.505, Density Control , in order to construct 2 unconnected single-family units on a lot zoned 2-family residentlal . The ordinance as determined by the Zoning Administrator and. the Planning Commi.ssion, speaks directly to the fact that two structures must be eonnected on a duplex zoned lot. Currently, there exists two separate single family residences. The applicant would like to remove the "3-Pod" structure in order to build a single-family residence tbat would better sult his needs for a permanent residence. Eis basis for hardship is the deep, natural drainage ditch tbat runs through his . property which is also used by the Town of Vail to dump snour. CONSIDERATION OF FACTOBS: 1. The relationship of the requested variance to otherexisting or potential uses and structures in thevicinity. The applicant is across the street from the Clinic, and then surroundedon both sides by duplex structures with a southern boundary on GoreCreek. The proposed structure would have no more impact on the surrounding nelghborhood than what presently exj-sts, 2. The degree to which relief from the strict or literalinterpretation and enforcement of a specifled regulation $ i:HffiH{ H":;n::l:,"?l'?l:'}i:lL?;i ll't3'TtlL"'' ' the objectives of this ordinance without grant ofspecial privilege. Lapin Page; Two .. ,. Strict interpretation of the ordinance could produce some environmental problems to both the applicant and the Town -- changing the natural path of a draj.nage area could be very hazardous environmentally. It is for this reason we feel that granting of thls variance would not constitute special privilege . 3. The effeet of the requested variance on light and alr, distributionof population, transportation and traffic facilj"ties, public facilities and utilities' and public safety. We foresee no adverse effects on these factors. FINDINGS: 1. That the granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties in the same district. Other properties in the 2-family residential distrlct have complied with this regulation, but to our knowledge none have been faced with the natural drainage problem that exists here. It should also be noted that the applicant is not completely starting over with a new site p1an. He proposes to remove the one 3-pod structure and replace it with a residence approximately 1,500 square feet less in grfa that what exists,as well as to let the one sirigle family residence located on the eastern side of the property remain. 2. That the granting of the variance wil-l not be detrimental to the public health, safety or welfare or materially injurious to properties or improvements i-n the vicinity IYe foresee no adverse effects in granting of this variance. 3. That the vari.ance is warranted for one or more of the following reasons: (a) The strict or literal lnterpretation and enforcement of the specified regulations woufd result in practical difficulty or unnecessary physical hardship inconslstent with the objectives of this ordinance. Tbe drainage way that runs through the applicant's property is more like a sma1l creek in that water is runing through it at all times of the year; this, in our view, constitutes a physical hardship that would be unnecessarily expensive and environmentally unsafe to try and mitigate. with the applicant's voluntary reduction in grfa, the fact that two separate buildings already exist on the property and the physical hardship created by the drainage, the Department of Community Development recommends approval of the requested varlance.
