PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Apolication.
If yes was answered to any of the questions then a "Public Way" permit is required. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verify (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November 1st and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to perform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permit".
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal.

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineert (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Departmen! the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
depaftments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

from building sites along and adjacent to Town of Vail roads or streets.

or permanent culverts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the

the Public Works Department. Allow a minimum of 24 hour notice.

MATERIAL STORAGE AND CONSTRUCTION PARKING

CODE 5-2.10: DEPOSITS ON PUBLIC WAYS PROHIBITED
Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or ctuse to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
Notice; Abatement: The Director of Public Works may notify and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or @uses another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such Hnd, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 14-1 of this code.
tr Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of
this Code. (1997 Code: Ordinance 6 (1979).
CODES 7-3A-1 AND 7-3A-3: PARKING OBSTRUCTING TRAFFIC & IMPOUNDMENT AUTHORIZED
No person shall park any vehicle upon a street or at any other place within this Municipality in such a
manner or under such conditions as to interfere with the free movement of vehicular traffic or proper
street or highway maintenance. (Ord. 2(1968) 5 1)
Whenever any police officer finds a vehicle attended or unattended, standing upon any portion of a
street or upon any place within this Municipality in such a manner as to constitute a violation of any
section of this Afticle, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 42-4-1102, as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in
addition to a ten dollar ($10) impoundment charge. (Ord. 2(1968) $ 3: Ord. 28(1981) 5 1)

Time Reouirements
The Design Review Board meets on the lst and 3rd Wednesdays of each month. A complete application
form and all accompanying material must be accepted by the Community Development Department prior
to application deadlines. A schedule of DRB meetings and associated application deadlines may be found
on the World Wide Web at htto://ci.vail.co.us/commdev/planning/drb/meetinqs/default.htm
Review Criteria
The proposal will be reviewed for compliance with the Design Guidelines as set forth in T'itle 12 (Zoning
Regulations) and Title 14 (Development Standards) of the Town of Vail Municipal Code.
Desiqn Review Board Meetinq Requirements
For new construction and additions, the applicant must stake and tape the project site to indicate
property lines, proposed buildings and building corners. All trees to be removed must be taped. The
applicant must ensure that staking done during the winter is not buried by snow. All site tapings and
staking must be completed prior to the day of the DRB meeting.
The applicant or their representatMe, shall be present at the Design Review Board Hearing. Applicants
who fail to appear before the Design Review Board on their scheduled meeting date and who have not
asked in advance that discussion on their item be postponed, will have their items removed from the DRB
agenda until such time as the item has been republished.
If the DRB approves the application with conditions or modifications, all conditions of approval must be
resolved prior to the issuance of a building permit.
Staff Aooroval
The Administrator (a member of the planning staff) may review and approve Design Review applications,
approve with certain modifications, deny the application, or refer the application to the Design Review
Board for a decision. All staff approvals are reviewed by the Design Review Board and any staff decision
is subject to final approval by the DRB.

A request for a conditional use permit to allow for the operation of a
"professional otfice" within Special Development District # 35 / Austria
Haus, located at 242 East Meadow Drive/Part of Tract C, Block 5-D, Vail
Village First Filing.
Applicant: Johannes Faessler & Ginger Tofferi, representing

I. DESCRIPTION OF THE REQUEST
The applicants, Johannes Faessler and Ginger Tofferi, owners of Tofferi/Faessler Real
Estate are requesting a conditional use permit to allow for the operation of a professional
office within the Austria Haus Hotel & Club. The proposed real estate office would be
located on the first floor at the west end of the building in an existing space comprising
approximately 725 square feet. The applicant's real estate otfice is currently located on
the first floor of the Swiss Chalet at 62 East Meadow Drive.
II. BACKGROUND
According to the Official Zoning Map of the Town of Vail, the applicant's property is
located within Special Development District #35, Austria Haus. The underlying zoning
for the district is Public Accommodation (PA). The permitted, conditional and accessory
uses affowed within the district are prescribed in Sections 12-7A-(24J of the Zoning
Regulations. According to the Zoning Regulations, "professional and business offices"
are conditional uses subject to the issuance of a conditional permit in accordance with
Chapter 16 of the Zoning Regulations.
Section 12-7A-'l of the Zoning Regulations identifies the purpose of the Public
Accommodation Zone District. According to Section 12'7A-1, the Public
Accommodation Zone District is intended t0,
"provide sites for loctges and residential accommodations for visitors, together
with such public and semi-public facilities and limited professional offices,
medical facilities, private recreation, and related visitor oriented uses as may
appropriately be located in the same district. The Public Accommodation District
is intended to ensure adequate light, air, open space, and other amenities
commensurate with lodge uses, and to maintain the desirable resort qualities of
the District by establishing appropriate site development standards. Additional

nonresidential uses are permitted as conditional uses which enhance the nature
of Vail as a winter and summer recreation and vacation community, and where
permitted are intended to lunction compatibly with the high density lodging
character of the District. The Public Accommodation District is intended to
provide sites for lodging units at densities not to exceed twenty five (25) dwelling
units per acre. (Ord. 30(1977) $ 7: Ord. 8(1973) S 7.100)."
As previously mentioned, a "professional or business otfice" shall be allowed in the
Public Accommodation Zone District subject to the issuance of a conditional use permit
in accordance with chapter 16 of the Zoning Regulations. Pursuant to section 12-16-1
of Chapter 16, the purpose of a conditional use permit is,
"ln order to provide the flexibility necessary to achieve the objectives of this Title,
specif ied uses are permitted in certain districts subject to the granting of a
conditional use permit. Because of their unusual or special characteristics,
conditional uses require review and evaluation so that they may be located
properly with respect to the purposes of this Title and with respect to their effects
on surrounding properties. The review process prescribed in this Chapter is
intended to assure compatibility and harmonious development between
conditional uses and surrounding properties and the Town at large. Uses listed
as conditional uses in the various districts may be permitted subject to such
conditions and limitations as the Town may prescribe to ensure that the location
and operation of the conditional uses will be in accordance with development
objectives of the Town and will not be detrimental to other uses or properties.
Where conditions cannol be devised to achieve these objectives, applications for
conditional use permits shall be denied. (Ord. 8(1973) S 18.100)."
III. CONDITIONAL USE PERMIT REVIEW CRITERIA AND FINDINGS
The review criteria and findings for a request for a conditional use permit are outlined in
Section 12-1 6-6 ol the Zoning Regulations. Upon review of Section 1 2-1 6-6' the
Community Development Department recommends approval of the conditional use
permit request to allow lor a real estate office (professional and business office) in the
Austria Haus Hotel & club, located at 242 East Meadow Drive.
A. Before actang on a conditional use permit application, the Planning &
Environmental Commission shall consider the follorving factors with respect to
the proposed use:
1. Relationship and impact of the use on development obiectives ot the Town.
The applicant is proposing to convert approximately 725 square feet of existing retail
space to real estate office space on the first floor of the Austria Haus Hotel & Club.
According to the purpose statement of the Public Accommodation Zone District, in
part, the district is intended to provide sites for lodging development for our guests
and visitors, together with limited professional and business offices.
The total allowable retail square footage in the Austria Haus is 5,402 square feet.
Based on the total allowable square footage of retail space, the applicant is
proposing to convert only 13% of the allowable area to professional office space.

The retail space that is proposed to be converted is located on the west end of the
building. The space on the west end is the least visible and most remote of all the
retailspaces within the Austria Haus from the pedestrian way along East Meadow
Drive. The Staff believes that the proposed use would have no negative impacts on
the existing use or the development objectives of the Town
Effect of the use on light and air, distribution of population, transportation
facilities, utilities, schools, parks and recreation facilities, and other public
facilities and public tacilities needs.
Staff believes that the proposed request for a conditional use permit would have no
negative effects on the above-described criteria.
Etfect upon traffic, with particular reference to congestion, automotive and
pedestrian safety and convenience, traffic flow and control, access,
maneuverability, and removal ol snow from the streets and parking areas.
The conversion of 725 square feet of retail space to professional off ice will have an
impact on the number of required parking spaces in the Austria Haus Hotel & Club.
The parking requirement for retail/commercial use is one space per 300 square feet
of floor area while the parking requirement for office use is one space per 250 square
feet of floor area. Due to the increase in parking requirement, the applicant will be
required to provide one additional parking space on-site. The applicant has
proposed to meet the increased requirement by providing one additionalvalet
parking space in the existing underground parking structure.
Effect upon the character of the area ln whlch the proposed use is to be
located, including the scale and bulk of the proposed use in relation to
surrounding uses.
While the Town encourages commercial/retail uses on the first floor of buiHings in
the vicinity of the Town's commercial core areas, we do recognize that the Public
Accommodation Zone District allows a limited amount professional office uses. In
the case of the Austria Haus Hotel & Club, only 13% of the allowable retail floor area
will be utilized for office space. Staff believes that the proposed request for a
conditional use permit would have no negative effects on the above-described
criteria.
The Planning and Environmental Commission shall make the following
findings before granting a conditlonal use permit:
That the proposed location of the use is in accordance with the purposes of this Title
and the purposes of the district in which the site is located.
That the proposed location of the use and the conditions under which it would be
operated or maintained will not be detrimental to the public health, safety, or welfare,
or materially injurious to properties or improvemenls in the vicini$.
That the proposed use will comply with each of the applicable provisions of this Title.

IV. STAFF RECOMMENDATION
The Community Development Deparlment recommends approval ol the request for a
conditional use permit to allow for a real estate office to be located within the Austria
Haus Hotel & Club. Staff's recommendations are based upon our review of the criteria
outlined in Section lll of this memorandum. Staff believes that given the relatively
minimal amount of area the real estate office will occupy and the location of the space
relative to the pedestrian way, the use will not result in serious negative impacts
inconsistent with the Town's development objectives.
Should the Planning & Environmental Commission choose to approve the request lor the
condilional use permit, staff would recommend that the Commission make the following
findings:
1. That the proposed location of the real estate office is in accordance with the
purposes of the Zoning Regulations and the purposes of Special Development
District #35 (Austria Haus).
2. That the proposed location of the real estate office will not be detrimentalto the
public health, safety, or welfare, or materially injurious to properties 0r
improvements in the vicinity of the Austria Haus Hotel & Club.
3. That the proposed real estate office will comply with each of the applicable
provisions of the Zoning Regulations.

I have reviewed your request for a new wall sign at the Austria Haus for Sonnenalp Real Estate.
Upon the completion of my review I have determined that several revisions must be made to the application
before it can be approved.
Section I l-4B-19(B) of the Town of VaiI Sign Regulations prescribe the applicable regulations for wall
signs proposed for individual businesses within a multi-tenant building such as the Austria Haus. Pursuanl
to the purpose section of the regulation, it states, \n paft, "in no instance, however, shall the total portion of
the sign describing the general nature of the business exceed 40%, ofthe total area ofeach sign permitted
for this purpose. " Therefore, the maximum size allowed for that portion of the sign stating "real estate" is
40% ofthe total sigrr area. The current proposal exceeds 40%.
