All benches, planters, ski racks, and trash receptacles must be moved out ofthe dedicated
handicapped accessible route. Includes path by retail stores and along front planters.
A discussion about options to use as much of the existing sidewalk layout as possible took
place. SH gave an overview on how we have reached this point. At the meeting dated 12-
10-98 between the town, the owner, the architect, and the contractor it was approved that if
there were two stair risers or less; handrails would not be necessary. Also the road was
raised 3" at that time. As a result the area between the road and the stairs was reshaped to
cover up the bottom stairs so only two risers are exposed. Final approval was postponed at
that time until the end of ski season. It has now been ruled that the handrails will be
necessary even for 2 risers due to accessing commercial areas. Also, the reshaping ofthis
area exceeded the2Yo maximum cross slope allowed on the handicap accessible route that
connected the upper route and the lower route. SH pointed out that there are two accessible
routes to different parts of the building and it appears to be overkill to have them
connected. This led to further discussion about the possibility of adding a curb cut and
using the designated public way along the road as the connecting route. CD mentioned that
this route is not snowmelted and therefore could not be used by a handicapped person in
the winter. It also exceeds the correct amount ofslope for a handicapped route. Thus this
is discriminating against a handicapped person. They cannot follow the same route as other
pedestrians. He did not feel comfortable approving that option and does not agree that
having a connecting route is overkill. GR mentioned that if Austria Haus sidewalk had not
been snowmelted we wouldn't have this issue. Therefore, by requiring the sidewalk to have
snowmelt has in part created the problem. CD stated that the state regulations require all
new construction to abide by the Fair Housing Act and ADA. Providing such access to the

new building dictates the snowmelt. He also pointed out the area next to the building at the
base of the stairs cunently does not meet code, as the slope exceeds that required at the
base of a stair. This area needs to be reshaped regardless of the handicapped route access.
With all of these issues mentioned it was determined by all that the only option might be to
putl up the pavers from the joint by the curved part ofthe stairq over to a point towards the
ind of the stairs by "scotch on the Rockies". We would not disrupt where the stairs die
into the sidewalk for fear of making the stopes in this area more severe. The new exposed
area would be reshaped to expose the existing coveied 3'o riser. Two handrails will be
installed out from the columns in this area. The handicapped accessible route will follow a
path along the road and connect the two access routes on either end. It will have a cross
slope ofless than2Yo. (See attached proposal request for sketches).
Discussion about designating the accessible route led to everyone agreeing that it would be
a maintenance issue to require that the pavers are painted. CD agreed that once the above
revised grading takes place the accessible route areas will be more obvious to anyone
moving through this area. No designation markers will be required.
Discussion moved to the area in front of the entrance. Along the accessible route there are
several pavers that are popping up due to the concrete surface below. DL mentioned that
these are already on his list to be fixed. The pavers will be pulled up and the concrete
below will be shaved down to allow for a smoother transition.
Likewise, at the drop off parking area the pavers need to be raised so there is no level
change or "lip" between them and the curb surrounding this space. This forces this area to
be unusable by the handicapped.
There will need to be a handrail installed along the planter wall in front of the real estate
office where there are stairs.
Driveway slopes will be approved as is. The town needs a stamped copy of the spot
elevations from High Country Engineering for their records.
The access to the site at the east end needs to be revised so that the slope is no greater than
5olo. There are two points where it currently exceeds that slope.
These minutes will be filed as part of permanent records for this project. Any questions
regarding discrepancies andi/or exclusions are to be raised within seven (7) days for possible
amendment. If no questions are raised, these minutes will stand approved as written.

Austria Haus Construction Project
Gary, here is the results of my research concerning the use of Fire Retardant Treated
plywood and backing ('NONCOM") at the Austria Haus project
1) The Austria Haus has been determined to be a Type ll F.R. building. This designation
has occurred as a result of the Town's Plan review completed on 1Ol21lg7.
2) The Town is currently using the 1991 Uniform Building Code for regulating building
construclion and inspection.
3) Based on my research of the 1991 UBC, here is my interpretation of what must occur.
A) Chapter 19, specifically Section 1901, states "Walls and permanent partitions of
Type ll F.R. buildings shall be of noncombustible fire resistive construction throughout,
except that permanent nonbearing partitions of one and two hour fire resistive
construction, which are not part of a shaft enclosure may have fire-retardant{reated wood
within the assembly". Table 17-A also confirms this with item #5 (Partitions-Permanent)
must be t hour fire resistive construction, this includes ALL walls constructed within
individual units. Footnote 2 in Table 17-A states " Fire-Retardant-Treated wood may be
used in the assembly, provided fire resistance requirements are maintained."
4) Chapter 4 contains definitions of terms used in the UBC.
A) Noncombustible Material is defined as: a) "Material of which no part will ignite and
burn when subjected to fire. Any material conforming to UBC Standard No. 4-1 shall be

considered noncombustible within the meaning of this section." b) "Material having a
structural base of noncombustible material as defined in ltem (a), with a surface material
not over 1/8 inch thick which has a flame spread of rating of 50 or less." (Gypsum
Wallboard)
Based on our conversation on 8112198, if you provide information that the wood products
being used within the Austria Haus as backing material, conform to UBC Standard 4-1,
then it can be considered "noncombustible", and can still be used in the fashion it is now.
lf not then ALL the wood products must be removed and installed WITHIN the wall
assembly, or not used at all. The installation as it is currently being used, is replacing
Gypsum Wallboard, which cannot be done based on my research of the code. One hour
fire resistive construction is required throughout all individual units, based on Table 17-A.
I have not seen any tested assemblies that can resist fire for one hour using any wood
products in place of Gypsum Wallboard.
The argument of not having to provide one hour fire resistive construction within each unit
is not supported by eitherTable 17-Aor Section 1901. lmust support Gary Goodell's
request to remove or replace all wood products after notification on 7128198,

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Enginee/s (Public Works)
review and approval, a Planning Department review or Health Depaftment review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projecB should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
> Fill out the attached check list with the Building Permit Aoolication.
If yes was answered to any of the questions then a "Public Way" permit is required. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Work, located at 1309 Elkhorn Drive.
> Notice sign-offs for utility companies. ALL utilities must field verifo (locate) respective
utilities prior to signing application. Some uUlity companies require up to 48 hours notice to
schedule a locate.
i A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and t}te work zone, (area of construction, staging, etc.). This
plan will expire on November lst and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.

"Building Permit" to be released. Please do not confuse the "Public Way Permif' with a
"Building Permit".
) NOTE: The above process is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal.

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Depaftment, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this depaftment to expedite this permit as soon as possible.

that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.
