Dear Bill,
I have received your request for a final certificate ofoccupancy for the Ausuia Haus.
In response to your request, I completed a site visit to the Austria Haus to inspect the completion status of the
project. Upon the completion of my inspection I determined that the fnal certificate of occupancy can not be issued
until the non+onforming storage areas constructed in the garage are removed or approved by the Town of Vail. All
the othcr aspects of the project looked great.
As you are aware, the approval ofthe special developmcnt district requires that 66 vehicle parking spaces be
provided on sit€. The construction of the storage areas in the garage severely reduces the available pmking spaces
on site and creates a non-conforming situation.
As briefly mentioned above, there are two possibie altematives to resolving the parking situation. The first is to
rcmove the slorage areas entirely and restore the rcquired 66 vehicle parking spaces. A second ahemative is to seek
an amendment to thc spccial development district whereby requiring fewer parking spaces on site. Either a.ltemative
is acceptable to the Community Developmcnt Depanment.
I would like to point out that the Town is currently in the process of studying our parking requirements. The
preliminary findings of the study indicate that a reduction in the parking requirement for hotels and fractional fee
clubs should be pursucd. As such, you may choose to await the final outcome of the parking study in hopes ofbeing
able to lake advantage of a reduced parking requirement. Given the proposed new pzrking requirements I would
anticipate a rcdur:tion in required parking for the Austria Haus by as many as 28 parking spaces (onc pcr fractional
fee club unit versus two per lractional fee club unit). The parking sudy process is currenrly on schedule and should
be completed by late C)ctober or early Novcmbcr.

The purposc of this letter is to clarify a condition of approval for the Austria Haus Redevelopment.
Condition #2 stales, '"That the applicar'L prepare a deed restiction or covenant, subject to the review and
approval of the Town Attomey, thereby restricting the current and future owner(s) ability to locate a
restaurant, or similar food service operation on thc Austria Haus prope y. Said deed restriction or
covenant shall be recorded with the Eagle County Clerk and Recorder's Office prior to the aprpllcant
submitting for a building permit."
The intent of Condition #2 was to minimize the negative impacts of restaurants and similar ford service
operations on adjoiaing properties. The negative :rnpacts that bave bcen identified include odors, noise,
trash removal and food service deliveries. The intent of the condition was not to prohibit the Austria Haus
from obtaining the appropriate liquor licenses. The Town is open to discussing amending eud ciarifuing
the original condition to more accurately state the true intent.
A condition of approval can be amended and clarificd furthcr clarified by the Town Council. The Town is
willing to accept such an application. If amended and clarified, the process would involve a public hearing
with the Planniog & Environmental Commission and two readings of an amending ordinance by the Town
Council. The timeliarne for such an application is approximately 6-8 wceks.

Dear Bill,
The purpose of this letter is to inform you of my telephone conversation with Matt Cook of the Division of
Enforcement with the Colorado Deparunent ofRevenue.
As promised, Lorelei Donaldson and I spoke with Matt Cook regarding the issuance of a hotel and
restawant liquor license for the Austria Haus. Following our discussion, Mr. Cook concluded that in order
for a hotel and restaurant license to be issued, complete cornpliance rvith the rcspective code requirements
will be required. This would include, in part, the installation of restaurant equipment and the preparation of
food on site.
As we have discussed, the installation of restauant equipment and the preparation of food at the Austria
Haus will violate the terms of the Special Development Distict approval. At this point, it appears you will
need to request a change to the conditions ofthe Special Development District approval. A change to the
conditions requcst. rvould need to bc revierved and approt,cd by thc Vail Tou'n Council.
