RE: Flequest to rezone the Vail Chapel property
Dear Carl:
Enclosed please lind the application from the Vail Religious Foundation to rezone the Vail
Chapel from Agriculture Open Space to Public Use District. As you can see, it was submitted
April 28, 1994. We understood that the primary Vail Religious Foundation concern was that
the Chapel would become a nonconforming use under changes to the Zoning Code that were
initiated by the Town. However, since April 28th, the Town's effort has been modified. At the
requesl of other individuals within the community, the Town has not eliminated the Agriculture
Open Space zone district nor has the Town changed any ol the uses within the Agriculture
Open Space zone district. We have created a new General Use District (GUD). lt is hoped
over time, that all exisling Agriculture Open Space properties will be rezoned to GUD.
In summary, there is no risk for the Vail Chapel to become a nonconforming use. As a result,
we recommend that you wait on any rezoning request. ln the future, the Town may rezone
many Agriculture Open Space tracts lo GUD. At that time, we would request your support.
However, at this time, there is not a need for you to rezone this property,

1. DESCRIPTION OF THE PROPOSED USE
The Vail Religlous Foundation is requesting a conditional use permit to op€rate a religious
education preschoolprogram at he Vail Interfaith Chapel, located at 19 Vail Hoad. According
to the Vail Religious Foundation, the program is designed as a preschool program, and not as
a day care, which they believe is essentially an extension of fielr Sunday School Program.
The property on which the Vail lnterfaith Chapelis located, is zoned Agricultrraland Open
Space. Ghurches, rectories and related structures, as well as seml-public and institutional
uses, such as convents and religious retrsats, are all listed as conditional uses in this zone
district. Because this preschool program is a change in use, a conditional use permit is
required.
The preschoolwould be located on the lower floor of the north wing of the Vail Interfaitfi
Chapel. This is an existing space and there are no modiftcations proposed to the structure.
The number of children anticipaled to be enrolled in the preschoolwill range from 12 to 15 per
day, with !r maxlmum of 15 children. fwo instruAors woutd run h The program
would run from 8:30 A.M. to 11:30 A.M., live days a week. orr Monday, Wednesday and
Frlclay the class will be for 4 year olds. Tuesdap and Thursdays will be reserved for 3 year
olds.
II. CRITERIA AND FINDINGS.
Upon review of Section 18.60, the Community Development Department reoommends
approval of fie conditional use permit based upon the following factors:

The Community Development Departrnent believes ftat the attlity to provide a quality
preschool is a benefit to he citizens and guesb of the Town of Vail. As stated in the
Town's Land Use Plan, Goal No. 1.1 malntalns that Yail should continue to gror in a
controlled environment, maintaining a balance betwgen residential, commercial and
recreational usss to serve boUr the visitor and the psrmanent reskJent.' Additionally,
the Land Use Plan statos hat'communltv services should keep pace wih increaqed
guo!!{h'and the Town of Vail should day a role in future development hrough
balancing growth with services.'
!t is the staff's belief that the proposed use would support the abovs{sted goals of the
Land Use Plan.in short

It is the opinion of the Planning stafl that the proposed preschoolwill have no impact
upon any of the above-mentioned criteria.

The staff does have some conoems wlth regad to the potential tratfic impacts
associaled with lhe preschool. Assuming ttat the morimum number of children attend
the preschool, and assuming that each ons of the children anives via a separate
vehicle, then the maximum increase in traffic would be a total of 15 vehicles utilizing
the 'drop-ofi' area at approximately 8:30 A.M, and fien again at 11:30 A.M. The
cunent parking/drop off area, located lmmediately in front ot the Chapel, is generally
viewed as a very congested area with both vehicles and pedestrians. Ihgre cunelty

The Vail Religious Foundation has modifled some of the meeting times of oher groups
utilizing the Chapel so that therE will be no ovedap with the preschool schedule. On
Tuesdays and Thursdays, an Alcoholics Anonymous group meets from 6:45 to 7:45
A.M. The size of this group is approximably 10 to 12 people. On Monday,
Wednesday and Frlday, a larger Alcoholics Anonymous meeting of approximately 30
people, would mest at 12:30 P.M. These meeting times have been modified to
accommodate the proposed preschool hours.

The stafi's only concem with regard to the proposed preschool, and its potentlal affect
upon the character of the area, is with refsrence to traffic congestion as indicated in

B. Findinqs
The Plannino and Environmental Commlssion shall make the followino findinos before
orantino a conditional use oermit:
1. That the proposed location of the use in accord with the purposes of the conditional
use permit section of the zoning code and the purposes of he district in which the site
is located.
2- That the proposed location of the use and the conditions under which it would be
operated or maintiained would not be detrimental to the public health, safety, or welfare
or materially inJurious to properties or improvements in the vicinity.
3. That the proposed use would comply with each of the applicable provlsions of the
conditional use permit section of the zoning code.
III. STAFF RECOMMENDATIONS
The staff recommends aPProval of the applicant's request lor a conditional use permit to
operate a preschool out of the Vail Interfaih Chapel. We believe that the proposed use would
provide a benefit to the community. Because the statf has soms oonosms with regard to
safety and traffic congestion along Vail Road, we would recommend the following conditions
of approval:
L That the drop-off area be dearly identified (i.e., signs) and the pavement striped
accordingly. A minimum of 3 dropotf spaces shall be provided.
2. That this approval shall be valid for a period of 1 year only. This will allow the
staft the opportunity to review the traffic/pa*ing concems and to reovaluate the
conditional use permit after a year ol operatlon.
Please note that, under Section 18.60.080 of he Town of Vail Zoning Code, the approval shall
lapse lf construction is not commenced within two years of the date of lssuance and diligently
pursued to completion, or it the use for which he permit is granted is not commenced wlhln
two years.

bank. The circle drive in the front of the Chapel can also be
used as a drop off area since we have ground level sidewalk to
the rear of the building. The bank has assured us that it will

luile Ricks made a motion to call for the question, It was
\ approved and restated. It was approved by a 9-3 vote in favor of
\ the Preschool Ministry.
Art Alplanalp officially resigned as President of the VRF. The
meeting was officially turned over to the Vice-President, Benny
Clark. A motion was made by uike Ricks and seconded by Bob
Scheid that the Board formally ask Art to reconsider his
resignation and appointed Cissy, Don, and Benny to meet with Art.
It was approved.
Regarding the organi t{e will call the company to make sure it
will be delivered on June 16th. Bonnie can call to set uP a
training session with Mr. Barbor on the 15th. A dedication date
for the organ has not been decided at this time. Cissy will
contact the Vail Valley Foundation for contributions toward the
purchase of the organ.
Investment Policy: This item will be continued at the next
meeting.
Chapel tighting: Rich Brown reported that the North Chapel
lighting will be installed in the near future. They will install
a 12'track. (8 12 ft. tracks with 3lights on each track.) the
coEt will be approximately $3,500.00. (92,000 for fixtures and
S1,5oo for labor. )
Exterior Painting: Touchups will be done before winter. Waituntil our finances are back in line.
Transient Aid: Police are sending the people to Subway. Rich
suggested that Tsu Brown and Joe Chessman seem to know the
procedure and that Jerry Milsap and Cissy get together with thepolice to verify need. The police seem to have Lhe vouchers made
up.
The next Vail Religious Foundation l'leetins wiII be July 14th.

1. The Design Review Board has the ProPosal of the fenced play
ground--Approval in the July rneeting. The Town of vail has been
iequested to grant a conciitional use Permit for a 3 & 4 year old
prJschool . Ii wili iakes 3 to 4 ueeks for aPProval .
2. Enclosed is a iist, and cost of the comrnon equiPment that
Vail Baptist will purchase.
3. The tuition will be on a cost recovery basis.
4, The playground lawn will be restored each sPring at the
expense of the preschool ministry.
5. The children uill not be in the chapel area so it wili not
prohibit meditation.
6. The First tsank of Vail has no problenr with the parking area
being used for Freschool drop off.
7. The insurance company is aware of the presence of Gore Creek
and has taken that into consiCeration when giving our liabiiity
guote. Vail Baptist Church will increase their iiability
insuranee to $1,000,000.

8. The children will be present in the building from 9100 a.m.-
12;00 noon, I{onciay through Friiay. They will be contained in lhe
designated area and will have a maximum of two bathroom breaks
and the children will always have a teacher with them. The
clerical staff does not see a problem with the program.
9. Groups using the Chapel could use the f ellor.rship area or tbe
North Chapel. if ihe group neeCs storage cabinets, some of the
cabinets in the fellowship area could be made available or the
north entry area ca:1 have a cabinet placed j.n 1i.
10. Any major Camage caused by tre preschcol ministry I'ilI be
repaired by the pre-"chool ninistry. The preschool will paint the
walls as needed and wilI keep the area clean Caily.

That the roofing will be installed according to the manufacturers
specifications and the Town of VaiL BuiLding Codes. The existing
roof is shakes. We will remove the existing shakes, install two
inch roof insulation, cover with plywood then cover the entire
deck with Bituthene fce & Water Shield Waterproofing Membrane and
FTx shakes (!'ire-treated). There will be no alteration in the
appearance of the building.

Dear Tom:
As I believe you are aware, the Vail Religious
Foundation met shortly before my receipt of your letter of the
10th of May, relating to the condition of the west end of theparking lot serving the Vail Interfaith Chapel and. FirstBank of
Vail. On the l4th of June, members of the Board personally
inspected the problem and concluded that revegetating the area
was not an appropriate solution to any problem which exists. The
difficulty with revegetation is the fact that the area inquestion is essentially a snow storagle area whictt receives snow
and everything deposited in snow between Vail Road and the west
end of the parking area. Were the area revegetated this summert
it would simply be overrun with next yearrs deposit of snow,gravel, cinders, and such other debris as might be brought into
the parking lot by vehicles through the winter.
The Board of Directors of the Foundation is not
unsympathetic to the occupants of the neighboring condominiums
who are apparently concerned regarding the condition of the
Foundation's property. The Board is willing to work with the
Town to improve the condition of this part of its property in a
way which is logical and consistent with its use during thewinter season. The Board has considered the possibility ofeither expanding the paved parking lot or creating a gravel
parking area at this location as possible alternatj.ves. The
difficulty with the former solution is the fact that the
extension of formal paved parking may simply push the problem
further to the west, thereby effecting the slope toward Gore
Creek and adversely impacting the residences to the south and
east. On the other hand, simply graveling an additional area may
be no improvement over the existing situation, and may be
inconsistent with the Town's requirements for parkinq 1ots.

The Chapel, as with many projects in the community, cannot always
meet the projected deadlines due to unforeseen circumstances. We

The Vail Religious Foundation (Vail Interfaith
Chapel) has applied for a Conditional Use permit in order to
construct a Chapel addition of approximately 2,0OO square feet.
The Department of Cornrnunity Development has
reviewed the criteria and findings provided for in section 18.600
of the Zoning Ordinance and our conclusions are as follows:
Relationship and impact of the use on
development objectives of the Town.
We find that no adverse affects will occur
from the proposed addition, Addition conforms to Town Master plan.
Effect of the use on light and air, distributionof populati-on, transportation facllities, uti.lities,schools, parks and recreation facJ-1ities, andother public facilities and pub11c faciLities
needs.
No adverse affects are foreseen at this time.
Effect upon traffic, with particular referenceto congestion, automotive and pedestrian safety
and convenience, traffic flow and control ,access, maneuverabi 1i ty , and removal of snowfrom the streets and parking areas

The appli.cant is proposing to add 13 additional
parking spaces, which meets the requirement for an addition of
this size. The main use of the Chapel would be at times when
other adjacent parking is also available. New Chapel addition
rryould house people who are presently being jammed into the present
existing space.
Such other criteria as the Commission
deems applicable to the proposed use.
There are no other criteria that we feel is
applicable to the proposed addition.
The following findings must be made prior to
the grant of the Conditional Use Permit;
