A request for a Conditional Use Permit to allow for the installation of an Automatic
Teller Machine to be located at thb One Vail Place Building, located at 244 Wall
Street, a part of Block 5C, Vail Village First Filing.

I. DESCRIPTION OF THE REOUEST.
First Bank of Vail has requested Conditional Use Permit approval to allow for the installation of
an automatic teller machine (ATM) to be located at the One Vail Place Building, 244Wall Street,
a part of Block 5C, Vail Village First Filing. Staff has determined that an automatic teller machine
falls under the category of "Banks and Financial lnstitutions." This type of use is subject to PEC
Conditional Use Permit review and approval prior to being located on the "first floor or street
level" within the Commercial Core | (CCl) zone district. Banks and Financial lnstitutions are
permitted uses 0n all other levels of buildings within the ccl zone district.
The applicant is proposing to locate the proposed automatic teller machine on the eastern side of
the One Vail Place Building, immediately adjacent to Wall Street. Specifically, the machine will
replace a portion of one of the southeast facing display windows of the commercial space
currently occupied by Curtin-Hill Ltd. The ATM is proposed to be operational 24-hours per day,
As shown on the attached drawings, the ATM will occupy the left half 0f the display window. lt
will be flush with the existing exterior building wall and therefore will not add any additional
commercial square footage to the building. The stainless steel housing of the machine will be
faced with new wood paneling (not plywood, which is used now) and painted to match the'
existing paneling color on the building. The existing flower planter, located directly below the
display window, will be removed to allow for convenient access to the ATM machine. This
landscaping is proposed to be replaced at other portions of the property in the form of 3 ft.
diameter wood planters and two 2 ft. diameter hanging baskets.
The applicant has indicated that the mall pavers are currently in place under this planter,
therefore, when the planter is removed, these pavers will be exposed and the street surfacing
material will be consistent with existing. The sides of the remaining flower planters on each side
of the display window will be iinished to match the rest of the planter box. The applicant is
proposing to install a 1-112 sq. ft. white and green hanging sign directly above the machine. The
sign would match fte First Bank logo. The sign would be suspended above the mall by a
hammered wrought iron bracket, attached to the building between the transom windows. Inside
the building, a portion ol the display platform and the cash register counter will be modified to
allow for a new wood frame enclosure to be built around the ATM. The applicant has stated that
there will be no net loss of retail floor area as a result of the addition of the proposed automatic
teller machine.
The owner, Blanche Hill, indicated that she has contacted the leaseholders in the building,
including Vail Associates (who occupy the southern portion of the building) to determine their
interest in having the ATM located within their leased space, however, none of these
leaseholders were interested. Since Mrs. Hill owns the Curtin-Hill Ltd. commercial space, she is
able to place the machine within the floor area controlled by her. Additionally, the owner has
indicated that this particular display window produces a very small percentage of sales for the
business and is one of the few display windows on the building which may be reduced in size
without a detrirnental effect on retail sales,
II. REVIEW CRITEBIA FOR THIS REOUEST
The review criteria for a request of this nature are established by the Town of Vail Municipal
Code. In addition to the conditional use criteria, staff has included criteria from the zoning code,
the Vail Comprehensive Plan, and the Vail Village Design Considerations, as we believe this will
help the PEC in its evaluation of the request.
A. THE TOWN OF VAIL MUNICIPAL CODE
The One Vail Place Building is located in the CClzone district. According to Section
1 8.24.010 of the zoning code, the purpose of the CCI district is:
"to provide sites and to maintain the unique character of the Vail Village
commercial area, with its mixture of lodges and commercial establishments in a
predominantly pedestrian environment. The Commercial Core I district is intended
to ensure adequate light, air, open space, and other amenities appropriate to the
permitted types of buildings and uses. The district regulations in accordance with
the Vail Village Urban Design Guide Plan and Design Considerations prescribe
site development standards that are inlended to ensure the maintenance and
preservation of the tightly clustered arrangements of buildings fronting on
pedesfian ways and public green ways, and to ensure continuation of the building
scale and architectural qualities that distinguish the village."
Banks and Financial lnstitutions on the "first floor" or "street level" shall be permitted in
the CCI zone district subject to the issuance of a Conditional Use Permit in accordance
with provisions of Chapter 18.60. For the PEC's reference, the Conditional Use Permit
purpose statement indicates that :
"in order to provide the flexibility necessary to achieve the objectives of this title,
specified uses are permitted in certain districts subject to the g{anting of a
Conditional Use Permit. Because of their unusual or special characteristics,
conditional uses require review so that they may be located properly with respect
to the purposes of this title and with respect to their affects on surrounding
properties. The review process prescribed in this chapter is intended to assure
compatibility and harmonious development between conditional uses and
surrounding properties in the Town at large. Uses listed as conditional uses in the
various districts may be permitted subject to such conditions and limitations as the
Town may prescribe to insure that the location and operation of the conditional
uses will be in accordance with the development objectives of the Town and will
not be detrimental to olher uses or properties. Where conditions cannot be
devised, to achieve these objectives, applications for conditional use permit shall
be denied.'
B. VAIL COMPREHENSIVE PLAN
Several elements of the Vail Comprehensive Plan indirectly address Banks and Financial
Institutions . The relevant elements and sections are listed below :
1. Vail Land Use Plan
1.1 Vail should continue to grow in a controlled
environment, maintaining a balance between
residential, commercial and recreational
uses to serve both the visitor and the
permanent resident.
The community should emphasize its role as
a destination resort while accommodating
day visitors.
The ski area owner, the business community
and the town leaders should work together
closely to make existing facilities and the
town function more efficiently.
The ski area owner, the business community
and the lown leaders should work together
to improve lacilities lor day skiers.
Services should keep pace with increased
growth.
Services should be adjusted to keep pace
with the needs of peaked periods.

Vail Village Design Considerations
A. Transparency
Pedestrian scale is created in many ways, but a major factor is the
openness, attractiveness, and generally public character of the ground
floor facade of adjacent buildings. Transparent store fronts are "people
attracters." Opaque or solid walls are more private, and imply "do not
approach."

On pedestrian oriented streets such as in the village, ground floor
commercial facades are proportionately more transparent than upper
floors. Upper floors are typically more residential, private and thus less
open.
As a measure of transparency, the most characteristic and successful
ground floor facades range from 55% to 70o/" of the total length of the
commercial facade. Upper floors are often the converse, 307"to 45/"
transparent.
B, Windows
In addition to the general degree of transparency, window details are an
important source of pedestrian scale-giving elements.
III. CRITERIA AND FINDINGS
Upon review of Section 18.60 of the Municipal Code, the Community Development Department
recomrnends approval of the Conditional Use Permit request to allow for an automatic teller
machine to be located atThe One Vail Place Building, 244Wall Street, a part o, Block 5C, Vail
Village First Filing, based upon the following factors:
A. CONSIDEHATION OF FACTORS:
1. Relationship and impact of the use on the development objectives of
the Town.
Staff believes that the proposed automatic teller machine, in the location
proposed, has both positive and negative aspects. On the positive side,
staff believes that an automatic teller machine is very much needed in the
Village core. At this time, the nearest location of an automatic teller
machine is in the lobby of the First Bank of Vail Building, located on Vail
Rd. (directly west of the Sonnenalp Hotel). The proposed ATM is not only
convenient in relation to its location in the core, it is also immediately
adjacent to the Vail Associates ticket office, which is especially useful to
the public and Vail Associates, as well as other businesses in the Village.
Another positive aspect of this particular location for an ATM is that it is
set back approximately 10' from the more heavily traveled portion of the
pedestrian mall, thereby allowing customers to wait in line to use the
machine without congesting pedestrian traffic flow to the ski mountain.
Statf is concerned, however, that during especially busy times of the ski
season the ATM, even as setback as it is, may cause congestion in
pedestrian traffic flow.
As previously mentioned, staff is recommending approval ol the proposed
ATM, however, we feel it is important to relay to the PEC our concerns
with regard to what we perceive are the negative aspects of the proposed
location.

The Vail Village Design Considerations strongly encourage transparent
store fronts along ground floor facades, as these "people attracters" carry
out the goal of providing openness, attractiveness and a public character
to ground floor facades. The addition of the ATM machine, in what is
currently a large display window, will reduce the amount of transparency at
the One Vail Place Building.
An additional concern of statf has to do with the location ot the proposed
ATM. Staff has conducted a site visit to the One Vail Place property and
believes that there are alternative locations within this building that would
appear to be more convenient, visible and functional. Additionally, the
western wall of the Curtin Hill Buibing, located directly to the east of the
One Vail Place Building, would appear to also have better opportunities for
an ATM location then the one chosen by the applicant. However, the
applicant's representative has stated that the property owner has certain
constraints with regard to the location of the ATM and has explored all
options in the two buildings and has chosen the one under consideration
today as their preferred alternative.
Finally, staff is concerned that litter from discarded receipts from the ATM
may be a problem unless a fash receptical is located immediately
adjacent to the machine.
Although staff does have some reservations about the proposed ATM
location, we do not feel that the negative impacts are significant enough to
warrant the denial ol this application.
The etfect of the use on light and air, distribution of population,
transportation facilities, utilities, schools, parks and recreation
lacilities, and other public facilities needs.
The proposed automatic teller machine will have little or no negative
impact on the items listed above.
Effect upon traffic with particular reference to congestion, automotive
and pedestrian satety and convenienee, traffic flow and control,
access, maneuverability, and removal of snow from the street and
parking areas.
The proposed automatic teller machine will have little or, no negalive
impact on the items listed above.
Effect upon the character of the area in which the proposed use is to
be located, including the scale and bulk of the proposed use in
relation to surrounding uses.
As mentioned previously, staff believes that the proposed ATM has both
positive and negative etfects on the character of the area in which it is
proposed to be located. However, after much consideration of the

application, staff believes that overall, the positive effects of providing an
automatic teller machine in a convenient location outweigh the negative
effects associated with the loss of a display window in this particular
building.
Initially, staff was concerned with the proposed loss of the flower
landscape planter, which is located directly below the display window.
Although the amount of landscaping to be lost by this proposal is minimal
(5 sq. ft.), the property does not currently meet the minimum landscape
requirement in the CCI zone district and any loss of existing landscaping
would be considered negatively. However, after further consideration,
staff realized that due to the minimal width of the planter (approximately
9"), it did not serve to provide for year round landscaping and is only used
for flowers during the summer months. The owner has agreed to mitigate
the loss of approximately 5 sq. ft. of llower bed, by providing a
combination of flower pots and hanging baskets along the north and
northeast portions of the building (see attached site plan). staff felt this
was an acceptable trade-off for the removal of the existing flower planter in
the location of the proposed ATM machine.
B. FINDINGS
The Planning and Environmental Commission shall make the following findings before
granting a conditional use permit:
1. That the proposed location of the use is in accordance with the purposes
of the conditional use permit section of the zoning code and the purposes
of the district in which the site is located.
2. That the proposed location ol the use and the conditions under which it
would be operated or maintained would not be detrimental to the public
health, salety, or welfare or materially injurious to properties or
improvements in the vicinity.
3. That the proposed use would comply with each of the applicable
provisions ol the conditional use permit section of the zoning code.
IV. STAFF RECOMMENDATION
The staff recommendation lor this request is approval. Staff finds that the applicant's request
complies with all of the above criteria and findings necessary for granting Conditional Use Permit
approval in the CCI zone district, as well as the relevant elements of the Vail Commprehensive
plan. Staff's recommendation for approval includes the following conditions:
1. A reduced version of a "Streetscape Plan" trash container must be placed
next to the ATM.
2, The staff will monitor the use of the facility during next ski season and if
congestion or trash are found to be a problem, the staff will "call up" this
use for further evaluation, and possible permit revocation by the PEC.

determined by the zoning adninistrator) will be accepted bythe planning staff before or after the designated submittaldate.

I visited Vail ski Rentals located at one Vail Place Building on
December 29. 1989. A majority of the shop space is used foreither skj- storage or boot lockers. f asked the employee if
anybody could use the boot lockers. His response was that yourrjust pay with six quartersrr and anyone may use the lockers. Healso stated that when the Vail Ski Rentals ski storage space inthe Hill Building is full, people may store their skis at the OneVail Place Vail ski- nentals.
fn your letter you state that the storage lockers inside the shopare only for people who rent ski equiprnent frorn Vail Ski Rentals.According to the employee, this is not the case. Regardless, thespace appears to be used for commercial ski equiprnent storage.Staff also questi-ons whether the space is used primarily as a skirental operation when only three sets of skis are available forrent. In addit.ion, the sign and awning at the One Vail PlaceLocation did not receive DRB approval.
The staff opinion is that the Vail Ski Rentals operation locatedat One Vail" Place does not meet the zoning code. The intent ofOrdlnance No. 26 Series of 1989 which relates to comnercial skistorage r^ras clearly to allow ski storage only at basement orgarden Ievels. This space is considered to be on flrst floor orstreet 1evel . The storage use that is now operated from the VaiISki Rentals locati-on in the One Vail place is exactlv whv wewrote this ordinance.

The Bridge street Photo Lab is a new business that is locatedbetween the Rucksack and the A & D Building. The shop is aL200 square foot space and the proposed principal use of thespace is for a retail film developinq lab. As an accessoryuse to the photo rab, the applicant r.rishes to utilize a portionof the space for qonmercial ski and boot locker rental . Thecornmunity-Development Department has denied the appricant thisuse. rt is our opinion that, the pennitted and conbitional usesfor first floor or street revel oi the commercial core r zonedistrict do not al}ow this specific type of use. A camerastore and photographic studio is an allowed use in CCI . A skishop is also allowed, but there is no specific allowance forcommercial ski and boot storage and lockers.
There are severaL ski and boot locker rental faciLities withinthe CCI zone district, one in the basement of the Golden peak
Housef in the basement of the Hill Building, and in thebasement of the waIl street Building. theie uses have beenapproved and are arlowed as an accessory to a ski shop and as apersonal service business on the basement or garden level .The community Deveropment Department feels th;t the use ofstreet level retair space foi conrnercial ski and boot rockersis not consistent or sirnilar to the other conditional orpernitted uses allowed on street level. Maintaining ski andboot storage for employees of the business or even ternporaryski and. boot storage for custorners of the business would beinterpreted as an accessory use to the photo rab. The staffdoes not feel , however, that seasonal locker rentals or weeklyor rnonthry locker rentals is an accessory use to a photo lab -
and should not be a perrnitted use on street level .

to provide better service and conven i ence for our customers,
we have decided to install a small facility for storage of skis
and boots in our retai I seace. After nearly comrllet inet construc-
tion on thi.s pro ject, we discovered Lhat VaiI has zoninq restric-
tions prohibitinq ski storage in shops on Bri.dqe Street. we
feel that ski. storage r"rou I d be an imrrortant factor in our success
as a business and rarould aLso benefit the gues ts of VaiI, as
well as all other shoes and restaurants in the Vail ViLlaqe.
Our experience and market research indicates that the primart/
attracti.on of a "mini-lab" such zrs ours is convenience. Con-
veni.ence is the sinqle most important factor influencinq a custo-
mer's decision to utilize a 1-hour photo lab. We have therefore
attempted to make Bridcre Street Photo Lab as convenient and
accesible as possible. The location on Bridge SLr€jet was a
major consideration in this respect, steps from the Vista-Bahn
and conven i ent to many restaurants and shops. The onl.y major
inconvenience tc, visitinq Bridse Street Photo Lab, or indee-d
to shoppins Bridse Street in qeneral , is the difficultv of f indincl
a secure place to leave . awkward ski equipment. We seek to
alleviate this problem by creating a very small storaqe facility
in our shop ,
We have built an eiqht-foot square rack for hanqing skis and poles
and a small one-by-ei<lht foot set of strelves for b<:ots in the
very back of our store. fn all, this construction represents
only 6? of our total f loor area (12OO square feet). Much thoucjht
went into this desiqn to mahe it efficient- and trnobtrusive.
He inLend to offer ski storaqe for ()ur customers, either free or
at minimal cost while their film is being processed. In addition
we would like to offer ski storaqte during the day and overniqht
at reasonable cost for anyone, whether a photo-finishing custo-
mer <rr not. We feel the chance to ski doqrn, droe off equipment
and film wiLh us, then peruse the other fine shops and restau-
rants of the Vail Village unencumbered by gear while wai.tinq
for ehotos to be processed, r,*ould be wel comed by many visitors
to Vail. Without this conventence we feel we will lose manvpotential, clients. Proprietors of other shops nearby agree that
our ski s Eorage should benefit them as well by increasingtraffi<:.

Beginning wiltr ttrL requestfor the amendment, she compared the proposed deveroprnent to tneArterial Business zone District, stating that only in the areasof.height, setbacks and randscaping were there any deviations.Kristan then reviewed the design ciiteria for spelialDeveloprnent Districts, stating that the proposar provided forsignificant upgrading of the existing development-on the site,it provided for a mix of uses, and served as a transition zonebetween Lionshead and Cascade Vil1age.
Parking and loading was explained and a report by TDA coloradoconcerning rrParking Demand Analysis and parkj-ng ManagernentPlanil was discussed. Kristan then explained how the projectconformed to applicable elements of the Vail ComprehensivePlan, Town policies and the Urban Design plans and went on todiscuss the applicable geological hazards.
The memo also dealt with the site pranning, circulatiort system,landscaping, and phasing of the work on the project. The-staffrecommendation was for approval of the anendment to Area D withthe stipulation that the owner agree in writing to thefollowing conditions which shall be recorded by the Town ofvail clerk at the Eagle county Assessor,s offiie within 30 davsafter the Town council's finar approval of the sDD ordinance:
L. The owner shall agree to construct the bus shelter per
Town of VaiI standards. The bus shelter will beconstructed subsequent to the issuance of a buildingpenn+!.and prior to the issuance of a temporarycertificate of occupancy for either the brewery addition,office expansion, east office building, or parkingstructure.
The owner shall relocate the bike path and provide a bikepath easement across the Glen Lyon property and CDOHproperty. The bike path sha11 be constructed per Town ofVail standards. The bike path shall be constrircteasubsequent to the issuance of a building permit and priorto the issuance of a temporary certificate of occupancyfor either ;ithe brewery.addition, office expansion, elstoffice.building, or parking structure. A site visit was made to One Vail Place by myseif and another member of
our department in response to your request to install an additional automated
ticket'i ng machine in Vail Viliage. This sjte visit was made on I'lednesday
August 18. Upon visiting the sjte, I was somewhat surprised to see that two
machines had already been installed in th'i s area. I find it very aggravatingto have spent my time making a s'i te visit to revieu/ this request when. there'is
obviously little regard for our imput on your behalf, I recognize thatin and of itself the installation of the rnachine js not a terribly significantissue. l'lonetheless, the Town has its review processes in place for a reason.I would hope to receive greater cooperation from you on any future applications.
l.'lith respect to signage, I feel it is totally unacceptable for the three
faced sign to be located on each',machine. When one considers the decalsyou have placed on your machines, the instructions on the face of the machjne
and the proposed three sided signs atop the machine, there is more signage
on these ticket dispensers than many busjnesses jn Vail Vi11age. Whi'l e you
may consider the location of the second machine to be approved, the signage
as proposed in your letter of September 12 js not approved,

Pursuant to your letter of November 28, L9g9 which I received onFriday, November 30th, f inspected the facilities run at Vail SkiRentals located at the one Vail place Buitding which you stated are inviolation of the Town of vail zoning ordinances. currently that shopis being used as a ski rental shop ind also the for the sale of rski
typett accessories rnuch like any olher ski rental operation in vailVillage. while there are storage lockers inside the shop thesestorage lockers are onry for people who rent ski equipment from vairski Rentals. There is no separate rental or storage lockers on thepremises. As in any ski rentar operation, after a person rents theireguipnent they would obviousry reave at least their shoes at the skirental store after renting their ski eguipment. rn some ski rentaroperations I assume those shoes are meiely placed on shelves or hiddenaway. Because of security reasons, however, Vail ski Rentars has seenfit.to provide separate lockers for their ski rental patrons as intheir other operations. This operation is no different than thecurrent vail ski Rentals operation located next door or for thatmatter other ski rental operations in town.
rn addition, Jack curtin did have conversations with Rick pyrenan
before Rick left the Town of vair and inforrned Rick that th1soperation would be exactry as Vail ski nentals operation next door.This was acceptable to Rick at the tirne, as rong as the premises werenot used for only storage lockers.

Dear Jay:
f visited Vail ski Rentals located at one Vail Place Buildinq on
December 29, 1989. A majority of the shop space is used foreither ski- storage or boot lockers. f asked the employee if
anybody could use the boot lockers. HJ-s response was that youttjust pay with six quartersrr and anyone may use the lockers. Healso stated that when the Vail Ski Rentals ski storage space inthe Hill Building is full, people may store their skis at the OneVail Place Vai"I Ski Rentals.
In your letter you state that the storage lockers inside the shopare only for people who rent ski equipment from Vail Ski RentaLs.
According to the employee, this is not the case. Regardless, the
space appears to be used for cornmercial ski equiprnent storage.Staff also questi-ons whether the space i-s used prinarily as a skirental operation when only three sets of skis are available forrent. In adcition, the sign and awning at the One Vail Placel-ocation did not receive DRB approval-.
The staff opinion is that the VaiI Ski Rentals operation locatedat one Vail Place does not meet the zoning code. The intent of
Ordinance No. 26 Series of 1989 which relates to comrnercial ski-storage was clearly to alLow ski storage only at basenent orgarden levels. This space is considered to be on first floor orstreet l"eve]. The storage use that is now operated frorn the VaiISki Rentals location in the One Vail- Place is exactlv whv wewrote this ordinance.

III. CONFORMANCE WITH THE CCI DISTRICT
A. Project Descri ption:
1) 0verview:
The system is a close-circuit, subscript.i on radio systemthat is specifically designed to serve the downhirl skiingindustry. The skier, using a specially designed miniiture, receiver with micro-headphones, will be able-to pick upfour channels of hjgh quality music. Breaks jn the muijcalprogranrning will be-scheduled at regular intervals toprovide the skier with ski area inf6rmation plus ,aiutymessages. If emengency situations present themselves,"Vajl Associates can.use the system io communicate directlywith the skiers on the mountain side. interruptions tothe programming on ail four channers can be made at anytimefor emergency messages. The FM radio signals will be "
generated by a transmitter/antenna systei depl.oyed through_out the ski area. Since thjs is a sibscription-radiosystem, the program signal will be scrambled to preventclear reception by anyone other than a person renting oneof the special receivers.
The system, as configured for the Vail ski area, would becomposed of a minimum of three FM transmitter/antenna siteslocated on or about the mountain in a widely spaced i.rtionwith non-over-lapping RF fierds. The sites-wourd be rinkeothrough telephone broadcast ioops to a sudio rocated in tneTown of Vail. The same program material will be .onu"y.jtg egch antenna/transmjtter site. The antennas will behighly directional with the intent oi directing a highquality.signal to the ski area. There is no r6qu.i refrentto provide.signai beyond the boundaries of the ski area.The transmitter power to each antenna will not exceed10 watts.
2) Programming:
The.program plans revolve around the concept of four sep_arate.channels (frequencies) to provide the skier with iselection of music. progranrning'for the four channels canbe accomplished in a number of iays. One approach wouldbe to have different styles of muiic on eacir'of the four
:l]inn"]t: E.G., popuiar music, including sone ,'oldies', onunannel I; classical music on Channel 2l country and west_ern on channel 3; and rock and roil on itrannet q, Anotherapproach would be,to base the programming on music styleand rhythm. A skier may want to coordinite the rtrythm otthe.music with the djfficulty of the s.lopes that h; i;skiing. For jnstance, Channil f mav i.luui u slower-rhyttrmto coordinate wjth an easjer slope, while the tempo iorChannel! 2, 3, and 4 could pick lp'increasingly fbr themore difficult slopes. The musical progra*ning pactages
w] 11 be tajlored to meet the demographics of the market atthe ski area.
It 'i s expected that the musjcal programming on all channelswill be interrupted at regular jntervals, say every 20-30
minutes, for periods of about 30-45 seconds to provide the
skier with important information. Some of the i,deas fon
these public servjce announcements include:
Weather information: Including temperature on@he mountaii, snow depths and
cond'i tions, and forecasts.

the cars at home and use the Town,s bus system.
Safer skjing reminders: The programming plan calls forffi to ue iaoeo to these 'information
breaks periodicaily. In just a fet,l seconds, one of
the safety tips usually found on the trail maps could
be highl ighted. Two exampies might be: "When entering
a trajl or starting downhill, yield to other skiers;"or "Do not stop where you obstruct a trail or are notvisible from above." Parts of the "Ski Safety Act of
1979", or U.S. Forest service rules could be mentioned.
A1 so, reminders deal ing w'i th weather conditions might
be helpful . Mention of the symptoms of frostbjte or
the recommended use of glasses or goggles and suntan
cream on sunny days could be appropriate. If a diff-
erent reminder were inserted once or twice each hour,thjs could prove to be an excellent way to better
educate skjers to the suggestions and rules for saferskiing. Care wou'ld be taken not to belabor these
reninders to the point where people may not want to
use the radio system.
Emergency messages: Programming on all four channels
Tfrequeftleil-l^,6uTd be iiterrupted to get emergency
messages out quickly. All emergency messages would be
authorized by the Ski Patrol .
Indjvidual message: The Skj Patrol may want to locate
one person to sign a medical release for a member ofthejr famjly who was skiing separately and was injured,for example.
Emergency message to all skiers: Severo weather cond-itions, such as an electrical storm or "white-out"
condit'ions, may prompt the Ski Patrol to evacuate the
mountajn or to give skiers immediate instructions fortheir safety.
It is recognjzed that not all skiers will be us'i ng the
radio system. When emergency messages are maden a re-
quest to skiers using the radio to "pass-the-word" to
those not using the system would be made. In the caseof an individual page where that person may not be
using a radio, perhaps someone who knows that personwill have heard the page and alert them to it.
Ski area announcementg: In addition to getting "skier@oomed trail announcemenls andlift line status, the ski area operator will find the
rad'io system helpful in alerting skiers to certainsituations. If a ski lift has a mechanical problem
and stops operat'ing, all skiers could be alerted to
avoid that particu'lar lift. For those that are still
on that l'ift, they could be kept updated on the problem
and jts repair progress by being instructed to tune to
a specific channel. If the lift di.d have to be evac-
uated, the procedures could be expla'ined on that channel .
People would be asked to "pass-the-word" to those on the
chairs in front or behind them. This should reduce the
information burden on the Ski Patrol and allow themto do their job more qu'ick1y and efficiently. 0f course,it would be emphas'ized that people should remain intheir chairs--and not to jump from them, Having periodic
updates on the situation should help deter prople fromjumping from the chairs and preventing injury.
The use of this radio system offers the ski area operator
a unique communications capability. Now the operator has
a means of communicating with the skier in addition to thechalk board at the end of the lift.
All musical program material would be recorded on long-play
tapes for playback on each of the four channels. Skier in-
formation breaks and emergency messages will be "live,' ann-
ouncements coming from the studio operator.

c) Queuing: The space for queuing will occur on the
deck surrounding the rental booth windows. It isnot believed that a queuing space prob'lem will

present itself. Stephens Communicatjons plan to
have three rental positions open during all peak
use periods for both the rentals and return of radios.
Normally about five of the seven lift ticket,sales
positions are open during the morning peak.period.It's projected that one person out of every 1.0 pur-
chasing lift tickets will rent a radio. By comparison,
there will be three rental positions open for 280
radio rentals as compared to five lift ticket positions
open for 2,800 ticket sales. The objective is to be
able to process rental transactions quickly to minimize
people's wait and space requirements for qqeuing.
The positioning of the rental operations center should
not jnterfere with any of the lift ticket lines.

Peter Patten mentioned that they had just vjsited this site and explained the
four conditions the staff felt shou'ld apply if the request were approved.
Fred Hibberd stated that he had no problem with conditions 2 or 3 but questioned
#4. Patten explained that there had been a number of spaces designated when
the bui1ding was constructed, (fewer than would be required now), and if any
of these parking spaces were converted to retail , a parking fee must be paid.
Donovan wondered if there was anyth'ing to prevent all of the parking spaces from
being converted to retail, and Patten stated that a parking variance would be needed.
Hlbberd explained that no parking spaces werel designated for the condominiums as
opposed to the retail space, and that he did not want to mark the two spaces as
such, Trout moved and Piper seconded to approve the conversion with the 4 conditions
as listed, but #3 wou'ld read, "The ramp spaces musr be pajnted and designated as
parking spaces." The vote t'las 6-0 in favor of approval.

to a collection point. Pat Dodson of the Recreat'ion Department answered questions
concerning the management of the cages, stating that the town would enter into
an agreement wjth the owner as to hours, etc. He felt that the concession would
generate dollars for the recreation department, and that the cages would alleviate
the need for batters to have roorn to practice without using too much space.
lrlhen asked about the sewer'l'ine, Dodson stated that they were not locked into thats'lte. Corcoran replied that the application was for that specific site. Dodson
stated that the concessjon had to be put up soon, or the season would be nearlyover. Trout asked'if the structure ciuld be a temporary one with possibly canvas,
sleeves and p'ipes. Dodson answered that he had done that with certain tennjs courts,
and found that the life expectancy of the materiai was cut about in half as opposedto leaving the fences up. Buis added that one reason for starting the bui'lding

V. ZONING CODE CONSIDERATIONS
This proposal meets all Town of Vail zoning regu'laticns.
VI. STAFF RECOMMENDATION
The Department of Community Development reconrrnends approvai of the requested
outdoor djning area with the following conditions:
'1. That there be no preparation of food outside of the building.

Peter Jamar said that the staff was request'ing that the jtem be tabled
because of lack of information. Jack Curtin representing Qne Va'i1 Place
condo association and l4rs. Hjll, stated that the restaurant was already
using the outdoor space, and that the space was not well defjned, so that
the tables were being moved onto other property and jnto the fjre lane.
He requested that there be strong demarcation for the dining area.
Trout requested that the item not be tabled, and Jamar replied that he
did not recejve part of the necessary information untii Friday of the
previous week, ahd that therefore the staff had not had time to prepare
a memo on it. Elliot Alport replied that everything else in the applica[ion
uras timely, with the exception of the letter from VA. After more discussion,
Piper moved to table until Ju'ly 12, and Corcoran seconded the motion.
The vote was 2-3 with Viele, Morgan and [dwards voting against tabl'ing.
After more djscussion, Larry Eskwith po'inted out that because VA had certain
easements reserved to them, there was n0 rllay a decision could be made by
the staff or the commission without knowing what those easements were.

Dick Ryan explained that one of the requirements of the new Arterial Busjness
District was a general circulation and access pian to be used as a guide for
the subsequent development of the area. He pointed out one change in the Texaco
site, and that was that the entrance had been moved to the opposite end of the
property. Neil Clark of I-Plan showed the site plan and showed the Texaco entrance
on the west side. He pointed out that ntost of the exjts vrere evenly spaced along
the Frontage Road. Trout stated that he had suggested planning jnterior pedestrian
pathways, and did not see any on the pians" Ryan answered that he felt that
street side sjdewalks were needed al ong the frontage road. Clark added that
each owner would have to show a pedestrian connection to th'e propert.ies on either
side of him. Deceleration 1anes, connecting bridges a.nd bike paths were djscussed.
Bob Voliter wanted to know ali the costs.
After more discussion, Piper moved and Viele seconded to approve with the one
access change the general circulation and access p1 an as per the staff nemo dated
June 23, 1982. The vote was 4 in favor,0 against, with Viele and Morgan absraining.

Ryan presented the memo, and Jay Peterson explained that he and Peter
Patten had listened to all of the tapes of the council when the ordinance
had been discussed. Peterson felt that all references in the ordinance
were to do w'ith lodge rooms, not condos. Ryan disagreed.
Discussion follor^red concerning whether or not a'l odge un'it contained kitchens.It was expla'ined that a lodge unit did not contain a kjtchen, and was
synonymous with "accomrnodation unit." Jay fe'l t that the ordinance should
apply only to lodge rooms because the ordjnance wasn't cl ear and because
the Town has been concerned with helping lodge owners, and this interpretation
would make it possibie for the Inn at West Vail to stay in bus'iness by
condominimizing their accommodation unjts, which are difficult to rent.
He added that he could see no adverse consequences for the Town. Edwardsagreed. Larry Eskwith pointed out that the ordinance dealt with the
question ambiguously and could be interpreted either way.
Chuck Anderson felt that there has been serious concern about the lack of
lodge roons, and that maybe this would be an incentive, and that it was
important not to have an ordinance in opposition to this concern.
Edwards moved and Trout seconded to interpret the paragraph referred in
the memo dated June 24, 1982 to apply to accornmodation units only. The
vote was 5*0 in favor with Corcoran abstaining.
Trout was appo'inted to the DRB for July, August and Septenrber. The meeting
was adjourned at 5;30 pm.

In October, 1995, we issued a building permit for the Meal Ticket Cafe, located in the One Vail
Place Building. The space was formerly occupied by Curtin-Hill, Ltd. Because there was a
