The community Development Departmenl has reviewed your request to remove the
planler located at 311 Bridge St. The Hill Building is located in the Commercial Core I
zone districl, which states the following in regards to landscaping:
12-78-16: LANDSCAPING AND SITE DEVELOPMENT:
No reduction in landscape area shall be permitted without sufficient cause shown
by the applicant or as specified in the Vail Village Design Considerations as
adopted in Section 12-78-20 af this Article.
This regulation has been interpreted to mean that the removal of landscaping area is
considered a variance from the Town code. As such, should you choose to remove the
planter without replacing an equal area of landscaping either at the same location, or
somewhere else on the property, you must apply to the community Development
Department for a variance request. I have included that application for your use.

General Information:
This application is required for proposals involving minor exterior alterations and/or site improvements,
Proposals to add landscaping do not require DRB approval unless they involve the addition of patios,
water features, grading, or the addition of retaining walls.
I. SUBMITTAL REOUIREMENTS

Pre-aoplication Meetinq
A pre-application meeting with Town of Vail staff is encouraged. The purpose of a pre-application
meeting is to identify any critical issues pertaining to the applicant's proposal and to determine the
appropriate development review process for an application. In many cases, the pre-application meeting
helps to expedite the development review process as critical issues are identified and dealt with in the
preliminary stages. A pre-application meeting may be scheduled by contacting Judy Rodriguez at

Time Requirements
The Design Review Board meets on the 1st and 3rd Wednesdays of each month. A complete application
form and all accompanying material must be accepted by the Community Development Department prior
to application deadlines. A schedule of DRB meetings and associated application deadlines may be found
on the World Wide Web at http://ci.vail.co.us/commdev/planning/drb/meetinos/default.htm For a new
residential development, the application deadline is typically 3.5 weeks prior to a Design Review Board
hearing.
Review Criteria
The proposal will be reviewed for compliance with the Design Guidelines as set forth in Title 12, (Zoning
Regulations) and Title 14 (Development standards) of the Town of Vail Municipal code.
Reouirements for prooefties located in hazard areas
If a property is located in or adjacent to a mapped hazard area (i.e. snow avalanche, rockfall, debris flow,
floodplain, wetland, poor soils, etc,), the Community Development Department may require a site-specific
geological investigation. If a site-specific Aeological investigation determines that the subject propefi is
located in a geologically sensitive area, the propefty owner(s) must sign an affidavit recognizing the
hazard report prior to the issuance of a building permit. Applicants are strongly encouraged to consult
with Community Development staff prior to submitting a DRB application to determine the relationship of
the property to all mapped hazards.
Required Plan Sheet Format
For all surveys, site plans, landscape plans and other site improvement plans, all of the following must be
shown.
1. Plan sheet size must be 24"x 36". For large projects, larger plan size may be allowed.2. Scale. The minimum scale is 1"=20', All plans must be at the same scale.3. Graphic bar scale.4, Nofth arrow.
5. Title block, project name, project address and legal description.6. Indication of plan preparer, address and phone number.7. Dates of original plan preparation and all revision dates.8. Vicinity map or location map at a scale of 1"=1,000,or larger.9. Sheet labels and numbers.

Desiqn Review Board Meetinq Requirements
For new construction and additions, the applicant must stake and tape the project site to indicate
property lines, proposed buildings and building corners. All trees to be removed must be taped. The
applicant must ensure that staking done during the winter is not buried by snow. All site tapings and
staking must be completed prior to the day of the DRB meeting.
The applicant, or their representative shall be present at the Design Review Board Hearing. Applicants
who fail to appear before the Design Review Board on their scheduled meeting date and who have not
asked in advance that discussion on their item be postponed, will have their items removed from the DRB
agenda until such time as the item has been republished.
If the DRB approves the application with conditions or modifications, all conditions of approval must be
resolved prior to the issuance of a building permit.
Staff Aoproval
The Administrator (a member of the planning staffl may review and approve Design Review applications,
approve with ceftain modifications, deny the application, or refer the application to the Design Review
Board for a decision. All staff approvals are reviewed by the Design Review Board and any staff decision
is subject to final approval by the DRB.
Additional Review and Fees
If this application requires a separate review by any local, state or Federal agency other than the Town of
Vail, the application fee shall be increased by 9200.00. Examples of such review, may include, but are
not limited to: Colorado Department of Highway Access Permits, Army Corps of Engineers 404, etc.
The applicant shall be responsible for paying any publishing fees in excess of 500/o of the application fee.
If, at the applicant's request, any matter is postponed for hearing, causing the matter to be re-published,
then the entire fee for such re-publication shall be paid by the applicant.
Applications deemed by the Community Development Department to have design, land use or other
issues, which may have a significant impact on the community, may require review by external
consultants in addition to Town staff. Should a determination be made by Town staff that an external
consultant is needed, the Community Development Depatment may hire the consultant. The
Depaftment shall estimate the amount of money necessary to pay the consultant and this amount shall
be forwarded to the Town by the applicant at the time of filing an application. The applicant shall pay
expenses incurred by the Town in excess of the amount forwarded by the application to the Town within
30 days of notification by the Town. Any excess funds will be returned to the applicant upon review
completion.

Pre-application Meeting
A pre-application meeting with Town of Vail staff is encouraged. The purpose of a pre-application meeting is to
identify any critical issues pertaining to the applicant's proposal and to determine the appropriate development
review process for an application. In many cases, the pre-application meeting helps to expedite the
development review process as critical issues are identified and dealt with in the preliminary stages. A pre-

Tiqe Requirements
The Design Review Board meets on the 1st and 3rd Wednesdays of each month. A complete application form
and all accompanying material must be accepted by the Community Development Department prior to
application deadlines. A schedule of DRB meetings and associated application deadlines may be found on the
World Wide Web at http://ci.vail.co.us/commdev/planning/drb/meetings/default.htm For a new residential
development, the application deadline is typically 3.5 weeks prior to a Design Review Board hearing.

Requiremenls for properties located in hazard areas
lf a property is located in or adjacent to a mapped hazard area (i.e. snow avalanche, rockfall, debris flow,
floodplain, wetland, poor soils, etc.), the Community Development Department may require a site-specific
geological investigation. lf a site-speciiic geological investigation determines that the subject property is located
in a geologically sensitive area, the property owner(s) must sign an affidavit recognizing the hazard report prior
to the issuance of a building permit. Applicants are strongly encouraged to consult with Community
Development staff prior to submitting a DRB application to determine the relationship of the property to all
mapped hazards.

For all surveys, site plans, landscape plans and other site improvement plans, all of the following must be
snown.
1. Plan sheet size must be 24"x36". For large projects, larger plan size may be allowed.2. Scale. The minimum scale is 1'=20' .All plans must be at the same scale.3. Graphic bar scale.4. North arrow.
5. Title block, project name, project address and legal description.6. Indication of plan preparer, address and phone number.7. Dates of original plan preparation and all revision dates.8. Vicinity map or location map at a scale of 1"=1,000' or larger.L Sheet labels and numbers.
10. A border with a minimum left side margin of 1.5,'.
11. Names of all adjacent roadways.

Design Review Board Meetinq Requirements
For new construction and additions, the applicant must stake and tape the project site to indicate property lines,
proposed buildings and building corners. All trees to be removed must be taped. The applicant must ensure
that staking done during the winter is not buried by snow. All site tapings and siaking must be completed prior
to the day of the DRB meeting.
The applicant, or their representative shall be present at the Design Review Board Hearing. Applicants who fail
to appear before the Design Review Board on their scheduled meeting date and who have not asked in advance
that discussion on their item be postponed, will have their items removed from the DRB agenda until such iime
as the item has been reoublished.
lf the DRB approves the application with conditions or modifications, all conditions of approval must be resolved
prior to the issuance of a building permit.
Staff Approval
The Administrator (a member of the planning staff) may review and approve Design Review applications,
approve with certain modifications, deny the application, or refer the application to the Design Review Board for
a decision. All staff approvals are reviewed by the Design Review Board and any staff decision is subject to
final approval by the DRB.

lf this application requires a separate review by any local, state or Federal agency other than the Town of Vail,
the application fee shall be increased by $200.00. Examples of such review, may include, but are not limited to:
Colorado Department of Highway Access Permits, Army Corps of Engineers 404, etc.
The applicant shall be responsible for paying any publishing fees in excess of 50% of the application fee. lf, at
the applicant' sequest, any matter is postponed for hearing, causing the matter to be re-published, then the
entire fee for such re-publication shall be paid by the applicant.
Applications deemed by the Community Development Department to have design, land use or other issues,
which may have a significant impact on the community, may require review by external consultants in addition
to Town staff. Should a determination be made by Town staff that an external consultant is needed, the
Community Development Department may hire the consultant. The Department shall estimaie the amount of
money necessary to pay the consultant and this amount shall be forwarded to the Town by the applicant at the
time of filing an application. The applicant shall pay expenses incurred by the Town in excess of the amount
forwarded by the application to the Town within 30 days of notification by the Town. Any excess funds will be
returned to the applicant upon review completion.

Dear Mr. Sheehy,
I presented this project today before the Planning Staff, at which time it was decided that due to the sensitive
nature of design considerations within the Village, the replacement of the existing window with a door at the
Mountain Adventure Center is a proposal that should be heard before the Desigi Review Board. The next
Design Review Board meeting for which I can schedule this project is on Wednesday, September 7th at 3 p.m.
The meetings are held in the Town council chambers at 7s south Frontage Road.
In sum, the Design Review Board is a group of individuals who review development proposals within the Town
on a bi-weekly basis. The Board will visit the site on the day of their meeting and will approve, approve with
conditions, or deny lhe application based on the aesthetics and design continuity of the proposed change.
I will assume that a solution to the lighting dilemma, which we discussed this morning, will be decided upon
before then. Please inform me in writing on or before Friday, September 2nd regarding such solution. l'm sorry
to have to postpone furtherance of the project until the meeting on the 7th, Out appreciate in advance your
patience and cooperation with the Town.

DESCRIPTION OF THE REOUEST
Joe Joyce, the owner ol Joe's Famous Deli is requesting a conditional use permit to
allow for the creation of an outdoor patio dining area located at244Wall Stieet / "One
Vail Place," a portion ol Block 5C, Vail Village First Filing. Outdoor patios are
considered a conditional use in the ccl zone district, according to chapter 'lz-7B.-3
(PERMITTED AND CONDITIONAL USES; FTRST FLOOR OR STREET LEVEL) of rhe
Town Code. The request is to allow lor six tables with umbrellas and twenty-four chairs
as an outdoor dining area during the spring, summer, and fall. During the winter months,
the applicant is proposing only three tables and twelve chairs. Also, the stools that have
been added to the storefront counter are included in this conditional use permit
application. The outdoor dining area is to be located on the private property between
First Sport of Vail and One Vail Place. The property owner's letter of agreement and the
applicant's proposal have been attached for reference.

STAFF RECOMMENDATION
staff is recommending approval of the conditional use permit to allow for the
establishment of an outdoor patio dining area located al244wall Street / "one Vail
Place," a portion of Block 5c, vait Viilage First Fiting subject to the foilowing findings:
1. That the proposed location of the outdoor patio dining area is in
accordance with the purposes of the conditional use permit section of the
zoning code and the purposes of the CC1 zone district in which it is
located.
2. That the proposed location of the use and the conditions under which it
would be operated or maintained would not be detrimental to the public
health, safety, or welfare or materially injurious to properties or
improvements in the vicinity.
3. That the proposed use would comply with each of the applicable
provisions of the conditional use permit section of the zoning code.

1. That the outdoor dining area is only permitted from the first of May to the
first of November, and due to the heavy pedestrian traffic and ski racks
located here during the ski season, no outdoor dining area is permitted
from the first of November to the first of May.
2. The outdoor dining patio is subject to design review by staff and/or the
Design Review Board. Alllurniture (i,e. chairs, tables, and umbrellas)
must meet the Town Code, as approved through the Design Review
application.
ROLES AND RESPONSIBILITIES OFTHE REVIEW BOARDS
The Planning and Environmentat commission is responsibte for evaluating the
conditional use permit for:
Relationship and impact of the use on development objectives of the Town.
Effect of the use on light and air, distribution of population, transportation
facilities, utilities, schools, parks and recreation facilities, and other public
facilities and public tacilities needs.
Effect upon traffic, with particular reference to congestion, automotive and
pedestrian safety and convenience, traffic flow and control, access,
m-aneuverability, and removal of snow from the streets and parking areas.
Effect upon the character of the area in which the proposed use is to be located,
including the scale and bulk ol the proposed use in relation to surrounding uses.
Such other factors and criteria as the Commission deems applicable to thL
proposed use.
The environmental impact report concerning the proposed use, if an
environmental impact report is required by Chapter 12 of this Title.

associated with this conditional use permit for:
Compatibility with other structures, the land and surroundings
Acceptability of materials and colors of proposed furniture
CRITERIA AND FINDINGS FOR A CONDITIONAL USE PERMIT
The proposal is subject to the issuance of a conditional use permit in accordance withthe provisions of ritle 12, chapter .l6. For the planning and Environmental
Commission's reference, the conditional use permit purpose stateirent indicates that:
ln order to provide the flexibility necessary to achieve the objectives of this title,
specified uses are permilted in certain districts subject to the granting of a
conditional use permit. Because of their unusual or special characteristics,
conditional uses require review so that they may be located properly with respect
t0 the purposes of this title and with respect to their effects on surrounding
properties. The review process prescribed in this chapter is intended to assure
compatibility and harmonious development between conditional uses and
sunounding properties in the Town at large. Uses listed as conditional uses in
the various districts may be permitted subject to such conditions and limitations
as the Town may prescribe to insure that the location and operation of the
conditional uses will be in accordance with the development objectives of the
Town and will not be detrimental to other uses or properties. Where conditions
cannot be devised, to achieve these objectives, applications for conditional use
permits shall be denied.
Upon review of chapter 16 of the Zoning Regulations, the community Development
Department recommends approval of the conditional use permit request to aliow for
{ow fol a restaurant expansion and an outdoor dining deck, located at "one Vail
Place'7Joe's Famous Deli, based upon the following fictors:
A. Consideration of Factors
1. Relationship and impact of the use on the development objectives of
the Town.
Staff believes he applicant,s proposal is in concert with the Town
development objectives and will have minimal, if any, negative impacts on
existing or potential uses in the surrounding area. However, the
advertisements on the umbrellas do not meet Title 11 (Sign Ftegulations)
of the Town Code. Staff is recommending, as part of the Design Review
application, that the proposed green umbrellas be used for all six tables.
2. The effect of the use on light and air, distribution of population,
transportation facilities, utilities, schools, parks and recreation
facilities, and other public facilities needs.
Staff believes that the proposal will have minimal negative impacts on the
above-described criteria.

ski season, this is a highly congested area. As one of the primary access
routes to the vista Bahn ski Lift and the location of the lift ticket office,
this is a highly travelled pedestrian route. Also, there is a proliferation of
ski racks located there during the winter months. Staff is recommending
that the outdoor patio only be allowed between the dates of May 1$ to
November 1"'.

be located, including the scale and bulk of the proposed use in
relation to surrounding uses.

character of the area will be enhanced as a result of the proposed
outdoor dining patio.

front of First spon of vail's west entrance. This will be done during spring
surrtrner and fall.
I also request to piace up to 3 tables and i2 chairs during winter months. The tables
in the winter months will be placed just to the nonh of First Sport of vail's west
enffance.
I believe this type of outdoor seating is exactly wtrat is needed in this area. It
provides a convenient and attractive area for my customers as well as brown
baggers to sit and arjoy the view of the mountain. They match very weli with the
pedestrian area that has been built over the last year. As well they match well with
the tabies vail nssc. has already placed on their & Forest service property. I also
believe this will help with pedestrian safety as it seems to slow down bikers that
come through this area at a high rate of speed. Finally all local businesses that I have
spoken with are very happy with the bistro style ambiance that has been created in
this area. I do accept aii responsibility for seeing to it that these tables are always
kept in a neat and orderly malurcr.

DESCRIPTION OF THE REQUEST
Joe Joyce, the owner of Joe's Famous Deli is requesting a conditional use permit lo
allow for the creation of an outdoor patio dining area located at244Wall Street / "One
Vail Place," a portion of Block 5C, Vaii Village First Filing. Outdoor patios are
considered a Conditional Use in the CCI zone district, according to Chapter 12-78-3
(PERMITTED AND CONDITIONAL USES; FIRST FLOOR OR STREET LEVEL)ot the
Town Code. The request is to allow for six tables with umbrellas and twenty-four chairs
as an outdoor dining area during the spring, summer, and fall. During the winter months,
the applicant is proposing only three tables and twelve chairs. Also, the stools that have
been added to the storefront counler are included in this conditional use Dermit
application. The outdoor dining area is to be located on the private property between
First Sport of Vail and One Vail Place. The property owner's letter of agreement and the
applicant's proposal have been attached for reference.
1I. STAFF RECOMMENDATION
Staff is reiomm6nding approval of the conditional use permit to allow for the

2. That the proposed location of the use and the conditions under which it
would be operated or maintained would not be detrimental to the public
health, safety, or welfare or materially injurious to properties or
improvements in the vicinity.
3. That the proposed use would comply with each of the applicable
provisions of the conditional use permit section of the zoning code.
Staff is recommendin g approval oI the conditional use permit with the lollowing
conditions:
1. That the outdoor dining area is only permitted from the f irst ot May to the
first of November, and due to the heavy pedestrian traffic and ski racks
.ocated here during lhe ski season, no outdoor dining area is permitted
from the first of November to the first of May.
2. The outdoor dining patio is subject to design review by staff andior lhe
Design Review Board. Alliumiture (i.e. chairs, tables, and umbrellas)
must meet the Town Code, as approved through the Design Review
application.
III. ROLES AND RESPONSIBILITIES OF THE REVIEW BOARDS
The Planning and Environmental Commission is responsible for evaluating the
conditional use permit for:
1. Relationship and impact of the use on development objectives ol the Town.2. Effect of the use on light and air, distribution of population, transportation
facilities, utilities, schools, parks and recreation facilities, and other public
facilities and public facilities needs.3. Effect upon traffic, with particular reference to congestion, automotive and
pedestrian safety and convenience, tralfic flow and control, access,
maneuverability, and removal of snow Jrom the streets and parking areas.4. EfJect upon the character of the area in which the proposed use is to be located,
including the scale and bulk of the proposed use in relation to surrounding uses.5. Such other factors and criteria as the Commission deems applicable to the
proposed use.6. The environmenial impact report concerning the proposed use, if an
environmental impact report is required by Chapter 12 of this Title.7. Conformance with development standards of zone district

The Design Review Board is responsible for evaluating the Design Review application
associated with this conditional use permit for:
Compatibility with other structures, the land and surroundings
Acceptability of materials and colors of proposed fumiture
CRITERIA AND FINDINGS FOR A CONDITIONAL USE PERMIT
The proposal is subject to the issuance of a conditional use permit in accordance with
the provisions of Title 12, Chapter 16. For the Planning and Environmental
Commission's reference, the conditional use permit purpose stalement indicates that:
In order to provide the flexibility necessary to achieve the objectives of this title,
specified uses are permitted in certain districts subject to lhe granting of a
conditional use permit. Because of their unusual or special characteristics,
conditional uses require review so that they may be located properly with respect
to the purposes of this title and with respect to their etfects on surrounding
properties. The review process prescribed in this chapter is intended to assure
compatibility and harmonious development beWveen conditional uses and
surrounding properties in the Town at large. Uses listed as conditional uses in
the various districts may be permitted subject to such conditions and limitations
as the Town may prescribe to insure that the location and operation of the
conditional uses will be in accordance with the development objectives of the
Town and will not be detrimental to other uses or properties. Where conditions
cannot be devised, to achieve these objectives, applications {or conditional use
permits shall be denied.
Upon review of Chapter 16 of the Zoning Regulations, the Community Development
Department recommends approval of the conditional use permit request to allow for
allow Jor a restaurant expansion and an outdoor dining deck, located at "One Vail
Place"/Joe's Famous Deli, based upon the following lactors:
A. Consideration of Faetors
1. Felationship and impact of the use on the development objectives of
the Town-
Staff believes the appiicant's proposal is in concert with the Town
development objectives and will have minimal, if any, neEative impacts on
existing or potentiai uses in the surrounding area. However, the
advertisements 0n the umbrellas do not meet Title 11 (Sign Fegulations)
of the Town Code. Staff is recommending, as part of the Design Review
application, that the proposed green umbrellas be used for all six tables.
2. The effect oi the use on light and air, distribution of population,
transportation lacilities, utilities, schools, parks and recreation
facilities, and other public facilities needs.
Staff believes that the proposal will have minimal negative impacts on the
above-described criteria.

3. Effect upon traffic with particular relerence to congestion,
automotive and pedestrian safety and convenience, lraffic flow and
control, access, maneuverability, and removal of snow from the
street and parking areas.
Staff believes there will be minimal, if any, negative impacts on the
above-described criteria during the summer months. However, during the
ski season, this is a highly congested area. As one of the primary access
routes to the vista Bahn ski Lift and the location of the lift ticket office,
this is a highly travelled pedestrian route. Also, there is a proliferation of
ski racks located there during the winter months. Staff is recommending
that the outdoor palio only be allowed between the dates of May 1$ to
November 1"'.
4. Effect upon the character of the area in which the proposed use is to
be located, including the scale and bulk of the proposed use in
relation to surrounding uses.
Staff believes that the proposal has many positive aspects and that the
character of the area will be enhanced as a result of the proposed
outdoor dining patio.
B. Findinqs
The Planninq and Environmental Commission shall make the followino findinos

I also request to place up to 3 tables and 12 chairs dunng winter months. The tables
in the winter months will be placed just to the north of First Sport of Vail's west
entfance.
I believe this type of outdoor seating is exactly what is needed in this area. rt
provides a convenient and attractive area for my customers as well as brown
baggers to sit and enjoy the view of the mountain. They match very well with the
pedestrian areathathas been built over the last year. As well they match well with
the tables vail Assc. has already placed on their & Forest service property. I also
believe this will help with pedestrian safety as it seems to slow down bikers that
come through this area at a high rate of speed. Finally all local businesses that I have
spoken with are very happy with the bistro style ambiance that has been created in
this area. I do accept all responsibility for seeing to it that these tables are always
kept in aneat and orderly manner.

As a follow up to our previous discussions, I felt that I should convey to you the staff concerns
on the proposed renovation to Curtin Hill Spofis-,1 am also in need of some further
information to complete the stalf review for this project before it can be scheduled for a PEC
hearing.
The firSt issue, as we previously discussed, is with the proposed removal of a substantial
portion of the existing landscaping along the north side of the building and at the east entry to
the shop. The staff feels that it is critical to maintain existing landscaping within the Village
and we have some question as to the necessity of the removal of the landscaping and the
viability of the remaining landscaped areas.
A second concern deals with the proposed renovations to the existing bay windows. As
proposed, there would be a single pane of glass with vertical mullions, essentially creating a
single bay window from the existing multiple bay windows. This is a concern to the staff as it
is not in keeping with the Urban Design Guidelines for the Village, A third concern deals with
the proposed electric glass doors on both the east and west entries. Per the Urlcan Design
Guidelines for the Village, this type of door treatment is undesirable for the area. Please see
the attached sections of the Vail Village Urban Design Guide Plan and Design Considerations
that call for decoralive door and window treatments for projects in the Village'
The staff requests the following information in order to further review this item. First, we
would like to have a site plan with property lines indicated, as well as a clear indication of
existing building and proposed additions. This is especially a concern on the west elevation
where new doors are being added and also on the south elevation where an existing area is
being enclosed. The current drawings are unclear. For example, as you indicated, the doors
on the west elevation are not to be modified, but are shown as such. The property lines,as
they relate to the proposed improvements, are also important in order to determine the
implications on snow removal as well as fire access.

A site coverage and landscape variance may also be necessary as the improvements will add
site coverage and remove landscaping. lt is unclear on the plans if there is building above the
proposed additions which would already count as site coverage. Additional applications and
fees for these variances may be necessary.
ln addition, we would also request building elevations at a larger scale than submitted.
Currenlly, there is no scale indicated on these drawings. Our requirements specily 1/8" =1'
for building elevations. lt is very difficult to understand what is proposed and the impact of the
proposal from the submitted elevations. I would ask that the changes be noted on the
elevations. The perspectives are quite helpful, however, they do not cover the entire project.
As you have seen in other projects in the Village, the Town of Vail is embarking on the
implementation of the Streetscape Plan for the Seibert Circle area. We would like to discuss
with you further this project's relationship to the Streetscape Plan, specifically Seibert Circle
and the Vista Bahn skier accessory.
A final issue related to the review of this project deals with the on-site parking located on the
east side of the building. In a previous review of this building, the staff mentioned this item,
however, because of the location of the improvement, we did not require the parking issue to
be resolved. Because of the growing congestion in this area, we feel that it is now important
to address this item. Unless the applicant is able to provide documentation, of the approval
from the Town to park in the Town right-of-way, the staff believes that it is appropriate to
require that the vehicle be parked either in the existing garage or off-site out of the restricted
vehicle area. By removing the vehicle, the pedestrian character of the Village is improved.
Two unrelated issues to this project, but related to the building, have been brought to the
staff's attention. First, the applicant has placed two to three tables in the walkway between
the One Vail Place Building and the Hill Building. lf these are available to the general public,
then the applicant is asked to submit a DRB application. lf they are restricted for the use of
the Hill Building users, then this area would be considered a dining deck and the approval of a
conditional use permit is necessary to continue the use. The second issue relates to the
exterior storage of ski equipment. This includes both the coin operated fixtures and the
monitored storage for the off-site lodges located on the property. While the staff feels that the
use is appropriate, we feel that the signage and aesthetics of the use may not meet the DRB
guidelines or the sign code. The staff again would ask that the applicant submit this item for
review by the staff and the DRB. I would appreciate your help in resolving these concerns.

evaluation of the parking fees for your project which was under construction this summer. ln
Ordinance 6 of 1991 , approved in April ol 1991, the Town of Vail amended the parking fee
structure to annually adjust the fee according to the Denver/Boulder Consumer Price Index
(CPl). The Denver CPI was 1.0743 and the fee tor a full space was increased by $594.40.
Because your project constituted only a portion of a full space the fee is $1 99.42. Please
send a check for $199.42 to the Town of Vail to the attention of Kristan Pritz. Upon receipt of
the check, Kristan will write you a letter confirming the payment.

I appreciated the opportunity to solve some Iogistic problems concerning
the various construction activjties surrounding the Founders Plaza Area.
