I recentLy talked with Bill Andrews, the Town of Vailts representative
who reviewed and approved hrork on the Village plaza, and he provided
ne with the following inforrnation.
1. The concrete slab was needed for the storage sheds. This area
would not have requi.red new concrete under the plans that the
Town had for iurproving the plaza.
2. The labor and naterials for pavers were for work done at the
north entrance to your building in Novenber or December by
Larese Constnrction and were not part of the contract or
improvements to be done by the Town of Vail .

yesterday wr'th Roger Tilkemeyer of Vai'l Associates. At that
tlme'it was agreed by the parties present that Vail Associates
wou'ld provr'de a key to the gate at the south end of the pl aza
Building to me as a representative of plaza Lodge. It was
further agreed that Plaza Lodge and Christy Sports would be
allowed to use the land belonging to plaza at the S.N. corner
of the Plaza Building for loading and unloading. This'land is
further fdentified by the shading on the enclosed xerox copy of
a regr'stered survey of our property.
As part of this agreement it was understood that plaza
Lodge would have the only key or keys to this gate, a'lthough

MEMORANDUM OF AGREEMENT
THIS AGREEMENT, nade and entered into this llthday of

, referred to herein as frApplicanttr,
WITNESSETH:
WHEREAS, the Zoning Ordinance for the Town of Vail
imposes requirements pertaining to off_street parking and
loading of.vehi.cles within the Town of Vail; and
WHEREAS, the said Zoning Ordinance for the Town of vai1,
as the provisions of sane appty to the property of the Applicant,
for which certain building or deveropment work is conternplated
requires the Applicant to provide off-street parking spaces; and
WHEREAS, Section 14.400 permits the Town Counci. 1 to
authorize off-site location of the requi.red parking spaces
and facilities; and
WHEREAS, in accordance with the application that is the
subject of this agreenent and the statenents and agreements of
the Applicant, the Town council has determined that the off-
site location of the required parking facilities within the
parking stluctuxe owned, naintained and operated by the Town
will fu1fi11 the purposes of the Zoning Ordinance of the Town,
will be useable, convenient, and wirl not cause traffic congestion
or unsightly concentration of parked cars; and
I1IHEREAS, the Town council has di,rected that this Menorandum
be fully executed by the parties to ensure compliance with the
Ordinance of the Town; and

WHEREAS, the Applicant has agreed to
requirement of providing parking spaces by
in a parking structure, constructed by the

Town, and to pay the

actual prorated cost of such parking spaces;
NOW, THEREFORE, it is mutually agreed between the Town
and the Applicant as fotlows:
1. The Applicant agrees to pay to the Town the actual
cost for constTucting 1 parking space$t within the parking
structure de'eloped by the Town. In any event, the cost per
parking space shal1 not exceed $3, S00. 00.
2' The Applicant sha1l have the option to paF the anount
as computed in accordance with the provisions of paragraph 1
above as follows:
a. The entire amount in cash at the time of obtain-
ing. a buirding perrnit for any construction or addition
in accordance with the Vdil Zoning Ordinance; or.
b. 25% of the entire cost, as calculated herein,
with the balance payable ovex a period of g years
in equal annual installments r"rith g% per annun
interest, accruing on the unpaid balance. Within
' such an instaLlment arrangenent the Applicant wouLd
have the right at any tine to pay the entj.re unpaid
balance without penalty, by nerely paying the
accrued interest on the unpaid balance.
3. It is understood between the Town and the Applicant
that by paying for a parking space within the parking structure,
the Applicant sha11 not acquiTe any right to use any palticurar
parking space within the parking structure.
4. Any funds derived by the Town in accordance with this
agreement shall be applied to the reduction of debt for the
parking structure referred to herein.
5. It is agreed by the Applicant that the obtigation
created hereunder sha11 become a lien against the rear estate
which is described in the attached Exhibit A, which is incorporated

as such a lien against the described real estate until the entire
obligation is fu11y discharged by the Applicant.
6. This agreenent shalt be binding upon the parties
hereto, their heirs, successors and assigns.

sketches for an addition of a third floor on the VaiI-PIazaBuilding on Bridge Street, originally designed forMr. Richard Hauserman. These drawings will indicate

We have checked the drawings and find that. there is nodj-fficulty in extending Ehe stair to the third floor. We
have made a rough survey of the floor area available after
deducting corridors and stair, and find that we willprobably be able to prepare a layout for at least thirteenunits, the total available area for such units beinq over

In general, the walls are strong enough to support a thirdfloor; although in places, where there are girders overlarge open areas (such as over the shop at the NE corner,#107), the beam will either have to be relnforced or beshortened by an additional post. simirar conditions prevailover Shops ll2 and 113. The building was, after all, designedonly for existing conditions.
Attic floors must be doubled, as the roof construction isdimensioned strictly for supporting a ceiling and not forrooms above.
However, none of these structural additions is complicated.
