I have several questions and comments. 1) Do you have to replace the windows to remove the rnullions or are they exterior to the panes of glass? 2) Are you changing the window openings or keeping the existing window openings? 3) Are you proposing to remove the mullions from all windows in the house? Are you removing the mullions in the rounded/sern i-circle windows at the top of the rectangular windows? Staff is concerned that conrpleteiy rernoving the mullions will create an architectural inconsistency in the style of Unit 9. Unlike the adjacenl Unit I which is contemporary, Unit 9 is more traditional. Staff would suggest that windows rvith fev,rer mullion divisions would be acceptable, or possibly windows which have no mullions in the rectangular windows but mullions in the serni-circle windows. DESCRIPIION OF THE VARTANCES REOUESTED The applicant is proposing a najor remodel- to Unit 9 of theVaiI Row Houses. The remodel includes a reconfigrurration ofthe existing floor layout, an increase in the buil-ding roofbeight by approxiurately l-L feet and the addition of windowseats on the north and south elevations. Ibe proposal doeEnot include a request for any elditional cRl'A over tbeallorable. The Vail Row Houses are zoned HDMF, and as such the setbacksare 20 feet on al-l sides of the property. The Vail Row Houses were originally subdivided in a way which created nonconforming side setbacks. The units and lots are only2L-I/2 feet wide, with each unitrs side wall being right onthe side property lines, leaving a zero setback. ft is forthis reason that a side setback variance is always requiredfor any rnodifications to the Vail Row Houses. The request for the side setback encroachnents are to acconmodate window seats on the north and south elevationsof the building, a reconfigured bedroorn area on the secondfloor, an expanded entry on the south elevation and theaddition of tuo upper floors. The roof height is proposedto be increased by llt. The Tovtn of VaiI Zoning code reguires a stream setback of 50feet frorn the centerline of core Creek. The existingbuilding currently encroaches 7 feet into this setback, asindicated on the attached survey. Although the proposed rernodel does not aLter the existing footprint of thebuilding, the 11 I height addition for the tvo upper floors does require that a strean setback variance be obtained.This increase i-n height is considered an expansion of a pre-existing, non-conforning use. rT. CRITERIA AND FINDINGS Upon review of the Criteria and Findings, Section l-8.62.060 of tne Vail Municipal Code, the Department of Coronunity Development recommLnds approval of the requested variances based upon the following factors: A. Consideration of Factors: 1. The relationship of the recruested variance to the vicinity. However, the existing setbacks are currently zero feet on both sides. The proposed alterations will create a slightly larger area of encroachment into the setbacks, as indicated on the attached floor plans. The encroachnents will inpact an gPper 1evel deck on the unit directly west of this property. However. this ia an inherent problem with zero setback developments such as the Rowhouses. Because the existing building footprint nrill not be erryanded, the staff believes that the requested streat setback variance witl have no significant effect upon other existing or potential uses and structures in the innediate area. The 11 foot increase in building height would place the overall height at 36 feet, which is still 12 feet below the maximum allowed height of 48 feet. The VaiI Row Houses have lot configurations which nake it almost inpossible to rnodify the units without requiring variances. In fact, tlreexisting units already encroach significantly into the required side yard setbacks. These encroachments are due to the fact that the lots are very narrou. staff strongly believes that there are extraordinary circumstances due to theoriginal lot layouts of the vail Rorr Houses andthat approval of the variance requests would not be a grant of special privllege. other Vail Row Eouses have received sinilar setback variances for rernodels. The effect of the recruested varlance on liqht and The staff finds that the requested variances will have no significant effect uPon any of the above considerations. IV. SUCH OTHER FACTORS AND CRITERIA AS THE COI.{!{TSSION DEEMS APPLICABLE TO THE PROPOSED VARIANCE. V. FINDINGS That the granting of the variance will not constitute agrant of special privilege inconsistent with thelimitations on other properties classified in the samedistrict. That the granting of the variance will not be detrimental to the public health, safety or welfare, or raaterially injurious to properties or improvenents in the vicinity. That the variance is warranted for one or more of thefollowing reasons: 1. The strict literal interlretation or enforcernentof the specified reg'ulation would result inpractical difficulty or unnecessary physical hardship inconsistent nith the objectl-ves of thistitle. 3.air, distribution of noputation, transportation and traffic facilities. public facilities andutilities. and oublic safetv. A. B. c. t 2. There are exceptions or extraordinary circumstances or conditions applicable to the Bamesite of the variance that do not apply generally to other properties in the same zone. 3. The strict interpretation or enforcenent of the specified regrulation would deprive the applicantof privileges enjoyed by the owners of otherproperties in the same district. VI. STAFF RECOUIIENDATION The staff reconnendation is for approval of both the side setback variance and the stream setback variance. we believe there are extraordinary circumstances on this site(i.e. lot layout) which do not generally apply to otherproperties in this same zone district. It is al-so felt that the granting of the variances nould not be detrimental to the public health, safety or general welfare to properties or persons in the vicinity.
