The meeting was called to order by Chairperson Diana Donovan at 2:05pM.

Shelly Mello explained the staff appnrval stemmed from discrepancies between the original
survey, completed by Fagle Valley Surveying, and the Improvement Location Certificate
(I.L.c.) by Robillard Associates. Pam Hopkins, rcpresenting the applicant, said fre new
building had been located per the survey conducted by Dan Corcoran. They used Robillard
and Associates because they wcrc conducting the on-site road improvemcnt suveys and
where thus more easily accessible. Pam and Shelly both stated the building appeared to be
sited correctly, and the discrepancies were related to lot line lengths.
Kristan Pritz explained one survey needed to be chosen for use as the legal description for the
SDD Ordinance. Kathy Langenwalter agreed, stating therc was a need for documentation.
Diana Donovan was concemed how the discrepancies might affect the ridge line height and
the correqponding view corridor. Kristan said staff felt the building was in the right location,
but staff needed only one base map document. Staff would have the ridge elevation shot
when appropriate from the original vicw corridor location. Shelly indicated a third survey to
be performed would determine the survey of record, since neither of the two previous
surveyors could frnd fault with their original suwcys. Diana stated there was a need to find
the mistake and establish a legal description. Kathy suggested researching to delerminc if
there was more than one title repon for the property, and if perhaps that could have been rhe
basis for any discrepancies. Pam agrced to do that research.

Kathy Langenwalter moved to approvc the staffs approvd of a minor amendment to
Community Development Dcpartment No. 22, Garden of the Gods, Lot K Block 5A, Vail
Vitlage 5th Filing/365 Vail Valley Drive with the condition that the discrepancics bctween the
surveys be resolved. Ludwig Kurz seconded the motion. It was approved GO.l, with Connie
Knight abstaining.

Andy Knudtsen explained the changes from the previous hearing on the request, and
inroduced into the rccord a petition from the neighborhood asking the Commission to deny
the request fm a setback variance. Staff recommended approval of the variance with
conditions as listcd in the memo.
E.J. Meade, architect for the applicant, explained that the most significant change ftom the
previous hearing was that the primary unit had been moved to the west, out of the setback,
and the garage doors had also been shifted to the west. These changes resulted in a decrease
of 100 sq. ft. from the building. Another improvement was the landscaping location, which
would dccrease the visual impact of the structurc. Addressing the safety issue, E.J. indicated
the building would not block the view from the interscction. E.J. stated the owners had no
intention of developing the portion of the lot on the other side of the creek, further rcducing
the impacts of the development.
Since flooding had been an issue raised at the previous PEC meeting, the ownen were
working with engineen and a hydrologist to pmtect not only the Tupy residcnce, but the
neighbors as well. Mitigation being proposed included a berm along the side of the structur€
and the placcment of a gravel swale.
A neighbor asked if cars would be able to turn around in the driveway, or if they would have
to back out. E.J. indicated they would back out, similar to the adjacent lot to the south.
Neighbor Clnthia Srcitz asked what the fr,ont wall was for. E J. said it was terraced to
prcvent erosion.
I-oyette Goodell, a neighbor, said that although staffhad looked at the development potential
during the summer, there were winter impacts as well. Specifically, the Town uses the lot for
dumping snow. In addition, it had been indicated to thc neighbors previously that the lot was
unbuildable.
Another neighbor, Marka Moser, was conccrned with the safety, given that tlre lot was being
developed in this manner. She said the addition of trees and the fact the sun would no longer
warm the road to the same extent in the winter seated safety and visibility problems for the

Ludwig Kurz excused himself from the discussion of this item due to a conflict.
Jill Kammerer presented thc ap'plication for a site coverage variance in order to allow thc
construction of additional display windows for thc Super Star Studios and Gorsuch, Ltd. retail
spaces. She further explained the allowed site coverage for structures in the CCI zone distict
is 80%, and the existing site coverage for this parcel was 87%. T"he proposed display
windows would further increase the site coverage on this parcel to 87.4Vo. Staff
recommended denial of the site coverage rcquest as they found it would be a grant of special
privilege not given to other merchants with similar circumstances. She did state that the
applicant believcd there was a hardship due to his basement location. If the variance request
was approved, the applicant would have td come back before the PEC for exterior alteration
approval.
Thc applicant, Paul Golden, indicated the hardship was a business owner could not do
business in the Village without some store front visibility, and that the nature of his business
relied on impulse purchasing. He reminded the Comrnissionen that all but the original
lonants of the space, Gorsuch Sports, had failed in that location. He disagreed with the
Community Developrnent DeparUnent that to approve the site covenge variance would be a
grant of special privilege. He simply wanted store front exposure, and that the other
basement locations in the area werc bars, and they did not need the window display area his
business required. His business is unique, and provided additional family enerEinment
options for Town guests. He did not b€lieve the variance request would impact adjacent uses
in the area.
Gena Whiuen asked if there would be sound associated with the video monitors, which would
be placed in the Super Star Studio display window. Paul replied he did not believe the code
would allow it. Kristan Pritz did not believe it was appropriate, and believed it was
prohibited by the code. Further, the sign code only rcgulated signage within 3 feet of a
window.
Kathy Langenwalter inquired as to the rcason fsr proposing the additional Gorsuch display
window. Paul said it was designed for balance, and that his architects believed it was
necessary. Kathy stated she could not support the request as submitted, as she believed the
resulting step down to the landing would be unsafe, and the proposed window addition would
crowd the area at the top of the stairway. Paul said the stairway was heated, and the step
ffit
down was within the building codcs. Kathy reitcratcd that the arpa would be tm tighV
crowded, and she also did not believe the Gonsuch display window was necessary.
Chuck Gist asked if thc new step would have b be put in. Paul said his architects, Gordon
Pierce, believcd it would me€t the applicable building codcs.
Gena Whitten agreed the step would be dangerous, and that most people would not see ir
She could see the need for the display window for the business, but believed Mr. Golden's
landlord, Gonuch, should accommodate his need. Paul stated Mr. Gorsuch had becn flexible
in granting other display areas, but they did not work, because Paul needed display area at the
top of the stain leading to the business cntrance.
Diana Donovan was sympathetic to *re applicant's rEquest, but could not consider it a
hardship, as she felt Gorsuch could accommodate Super Sur Studio product display needs
without any variance. Diana also cited the safety issue as a rEason why she could not support
the variance requcst.
Kathy Langenwalter also believed it was the responsibility of the landlo'rd to prcmote a
tenant's business, and did not see a physical hardship. Diana added that the basement
location was a sclf-imposed hardship which the applicant had control ovcr.
Chuck Crist moved the request for a site coverage variance for Super Star Studios, Gorsuch
(Clock Tower) Building, Lots C, D and E, Block 5, Vail Village First Filing/263 East Gore
Creek Drive be denied per suff memo. Ttc motion was seconded by Kathy Langenwaltcr. It
was approved,4-0-1, with Ludwig Kurz abstaining.
In the interest of time, item 6 was delayed, and action on item 7 of the agenda was
considered next.
7. A reouest to amend the conditions of apnroval for Phases II and Itr of Vail Point

and E, Block 5, Vail Village First Filing263 E. Gore Creek Drive.

I. DESCRIPTION OF TTIE VARIANCE REOI]ESTED
The applicant prcposes to add 28 sq. ft. of site coverage to the Gonuch Building in order to
construct two new window spaces for the display of promotion materials for Super Star
Studios and for the display of promotional materials for Gorsuch Ltd. The new 3'-6 U4"
x 4'-1" Super Star Studio window would be located immediately o the east of the existing
Gorsuch entrance, and at the top of the stairs leading down to the basement rctail space
occupied by Super Sur Studios (see attached rendering). The promotional material to be
displayed would be in the form of two T.V. monitors which would be set back 3'-0" from the
face of the glass and therefore are not covered by the Town of Vail Sign Code. Because the
T.V. monitors will be set back 3'-0" from the glass, they will not bc considered to be sigls
but simply window displays.
The 3'-6 ll4" x4'-1tf Gorsuch Ltd. window would be located immediately to the west of
the two existing Gorsuch display windows which are located immediately west of the
Gorsuch Ltd. entrance.
The Gorsuch Building is located in Commerciat Core I. The site coverage allowed in this
zone distict is 807o. The existing building's site coverage is 87Vo. Under this proposal, site
coverage would increase to 87.4Vo. Therefore. in orrder to allow the construction of these two
window additions totaling 28 so. ft.. the applicant is requestins an increase in site coverase
of O.4Vo.
The applicant witl also be required to obtain exterior alteration approval prior to the issuance
of any building permir. The applicant has elected to have each of the required approvals (site
coverage and exterior alteration) considercd at a separate PEC meeting.

Upon rsview of Criteria and Findings, Scction 18.62.060 of the Vail Municipal Code,
the comrnunity Development Deparrnent recommends denial of the rcquested
variance based on the following factors:
A. Consideration of Factors:
1. The relationship of the requested variance to other existing or
potential uses and structures in the vicinity.
To the north, south, east and west arp rcstaurant, r€tail, commercial and office
luses. To the west, across Bridge Street, is Pepi's Restaurant and Bar. To the
south across Gore Creek Drive is ttre Golden Bear jewelry and clothing store.
To ttre north is the Slifer, Smith and Fmmpton Real Estate Ofiice and Slifer
Collection Interior Design and Home Accessories businesses. To the east arc
thc Vail Rowhouses.
Staff believes the proposed site coverage variance request would not negatively
impact other potential or existing uscs and structlrres in the vicinity.
2. The degree to which relief from the strict and literal interpretation
and enforcement of a specified regulation is necessary to achieve
compatibility and uniformity of treatment among sites in the
vicinity or to attain the objectives of this title without grant of
special privilege.
The applicant's business is on the north side of Gore Creck Drive, in basement
retail space of the Gorsuch Building. The applicant believes the business'
basement location is a hardship (please see applicant's Request for Variance
which is attached to this memo). Statr believes it would be a grant of special
privilege to approve a site coverage variance for this lot as there are no unusual
or unique circumstances on this property which are not found on similarly
zoned properties elsewhere in the Village.
3. The effect ofthe requested variance on light and air, distribution of
population, transportation and traffic facilities, public facilities and
utilities, and public safety.
The requested variance will havc no impact on any of the above-mentioned
criteria.
B. The Plannine and Environmental Commission shall make the followine
findines beforc lrantins a variance:
1. That the granting of the variance will not constitute a grant of special
privilege inconsislcnt with the limitations on other properties classified
in the same disrict.
2. That the granting of the variance will not be detimental to the public
health, safety or welfare, or materially injurious to properties or
improvements in the vicinity.
3. That the variance is warranted for one or more of the following rcasons:
a. The strict literal interpretation or enforcement of the specified
regulation would result in practical difficulty or unnecessary
physical hardship inconsistent with the objectives of this title.
b. There are exceptions or extraordinary circumstances or
conditions applicable to the same site of the variance that do not
apply generally to other properties in the same zone.
c. The suict interpretation or cnforcement of the specified
regulation would deprive the applicant ofprivileges enjoyed by
the owners of other properties in the same district.
Iv. STAFF RECOMMENDATION
Staff rpcommends denial of the site coverage variance request. Staff does not believe this
property is encumbercd with a physical hardship or unique circumstances and that the project
does not moet the findings for a variance.

Related to Site Coverage
My wife and I have operated Super Star Studios for oneyear. We are proud to say it is a clean, healthy form of inter-active entertainment that is tailored for families and youths.
We request that the proposed 34 square foot additionto the Gorsuch Building be all-owed even though it does not meetthe criteria set forth in section f8.24.150 concerning sitecoverage. The variance reguested seems justified for the following
reasons:
There are other buildings within Commercial Core I that
have expanded over the 808 guidelines. Secondly, the uniguefeatures of the basement space do not allow for a storefrontof any kind. This has proven to be very detrimental to business.Previous tenants of this space have failed due to lack of visualexposure. Super Star Studios has attempted to exist for oneyear without some form of a storefront and is on the verge offail-ing as we}l. By adding 34 square feet of exterior display
window space, Super Star Studios will be able to promote itsbusiness as all the other storefronts do in Commercial CoreI. The actual design that is proposed is tasteful and will
improve the appearance of the Gorsuch Building. Finally, it "
seems the purpose of any town code related to resort businessis to assure that quality shops be allowed that round out theshopping and/or entertainment experience of its guests. Ourbusiness meets that criteria and should be given a fair chance.

Enclosed are the specifications for our building permit. After
meeting with Wayne Whitaker of Johns-Manrvil1e, I have revisedour roof specification. If John decides to add insulat.ion tothe roof , this is the specification we wiIl.-use:
JM Spec. No. 4GIG, 4 layers of Glasply nopped to the Fesco
Foam Insulation, Black Scoria applied with a 60 lb. per
sq. flood coat. The insulation wiLl be a !2" layer offoil faced urethane and a Ltd" layer of Feseo Foammechanically fastened with Deck Fast Plates and screwsor an approved equal. There will also be fire treated2x4's at 8'-0" 0.C. in the field to help secure theinsulation.
If John decides not to add insulation to the roof, we willuse this specification:

Construction completed the valley cricket and spreadthe remaining rock at the Gorsuch/Clock Tower Bld.
As I recall we were going to wait and see how the closeproximity of the chimney to Ehe ventilation unitaffected the Gorsuch space. I have checked with Dave
Gosuch several times aird tre has told me that they never
encountered any orders coming from the vent system sinceit has been operational . Because the chirurey has notaffeeted the vent system I would hope the we- are done

x 4'-1" Super Star Studio window would be located immediately to the oast of the existing
Gorsuch entraxce, and at the top of the stairs leading down to the basement retail space
occupied by Super Star Studios (see attached rendering). The promotional material to be
displayed would be in the form of two T.V. monitors which would be set back 3'-0" from the
face of the glass and therefore are not covered by the Town of Vail Sign Code. Because the
T.V. monitors will be set back 3'-0" from the glass, they will not be considered to be signs
but simply window displays.
The 3'-6 Ll4" x 4'-tn Gorsuch Ltd. window would be located immediately to the west of
the two existing Gorsuch display windows which are located immediately west of the
Gorsuch Ltd. entrance.
The Gorsuch Building is located in Commercial Core I. The site coverage allowed in this
zone district is 807o. The existing building's site coverage is 8770, Under this proposal, site
coverage would increase to 87.4Vo. Therefore. in order to allow the constmction of these two
window additions totaling 28 sq. ft.. the aoplicant is requesting an increase in site coverase
of O.4Vo.
The applicant will also be required to obtain exterior alteration approval prior to the issuance
of any building permit. The applicant has elected to have each of the required approvals (site
coverage and exterior alteration) considered at a sepamte PEC meeting.

M. CRITERIA AND FINDINGS
Upon review of Criteria and Findings, Section 18.62.060 of the Vail Municipal Code,
the Community Development Department rccommends denial of the requested
variance based on the following factors:
A. Consideration of Factors:
1. The relationship of the requested variance to other existing or
potential uses and structures in the vicinity.
To the north, south, east and west are restaurant, retail, commercial and office
luses. To the west, across Bridge Street, is Pepi's Restaurant and Bar. To the
south across Gore Creek Drive is the Golden Bear jewelry and clothing store.
To the north is the Slifer, Smith and Frampton Real Estate Office and Slifer
Collection Interior Design and Home Accessories businesses. To the east are
the Vail Rowhouses.
Staff believes the proposed site coverage variance request would not negatively
impact other potential or existing uses and structures in the vicinity.
2, The degree to which relief from the strict and literal interpretation
and enforcement of a specified regulation is necessary to achieve
compatibility and uniformity of treatment among sites in the
vicinity or to attain the objectives of this title without grant of
special privilege.
The applicant's business is on the north side of Gore Creek Drive, in basement
retail space of the Gorsuch Building. The applicant believes the business'
basement location is a hardship (please see applicant's Request for Variance
which is attached to this memo). Staff believcs it would be a grant of special
privilege to approve a site coverage variance for this lot as there are no unusual
or unique circumstances on this property which are not found on similarly
zoned properties elsewhere in the Village.
3. The effect of the requested variance on light and air' distribution of
population, transportation and traffic facilities' public facilities and
utilities, and public safety.
The requested variance will have no impact on any of the above-mentioned
criteria"
The Planning and Environmental Commission shall make the following
findings before granting a variance:
1. That the granting of the variance will not constitute a grant of special
privilegc inconsistent with the limitations on other properties classified
in the same disrict.
That the granting of the variance will not be detimental to the public
health, safety or welfare, or materially injurious to properties or
improvements in the vicinity.
That the variance is warranted for one or more of the following reasons:
a. The strict literal interpretation or enforcement of the specified
regulation would result in practical difficulty or unnecessary
physical hardship inconsistent with the objectives of this title.
b. There are exceptions or exraordinary circumstances or
conditions applicable to the same site of the variance that do not
apply generally to oilrer properties in the same zone.
c. The strict interpretation or enforcement of the specified
regulation would deprive the applicant of privileges enjoyed by
the owners of other properties in the same district.

My wife and I have operated Super Star Studios for oneyear. We are proud to say it is a clean, healthy form of inter-active entertainrnent that is tailored for families and youths.
We request that the proposed 34 square foot additionto the Gorsuch Building be allowed even though it does not meetthe criteria set forth in section 18.24.150 concerning sitecoverage. The variance requested seems justified for the following

There are other buildings within Commercial Core I thathave expanded over the 808 guidelines. SecondLy, the uniquefeatures of the basernent space do not allow for a storefrontof any kind. This l'ras proven to be very detrimental to business.Previous tenants of this space have failed due to lack of visualexposure. Super Star Studios has attempted to exist for oneyear witlrout some form of a storefront and is on the verge offailing as well. By adding 34 square feet of exterior clisplay
